Everymotorcarrier,itsofficers,drivers,agents,repre-sentatives, and employees directly concerned with in-spection or maintenance of commercial motor vehicles mustcomplyandbeconversantwiththeserules.

General Requirements

Everycarriershallsystematicallyinspect,repair,and maintain all commercial motor vehicles under its control.

Record Keeping Requirements

Motor carriers must maintain the following informa-tion for every vehicle that they have controlled for 30 daysormore:

n Identifying information, including company num- ber,make,serialnumber,year,andtiresizen Ascheduleofinspectionstobeperformed,includ- ing type and due daten Inspection, repair, and maintenance recordsn Recordsoftestsconductedonbuseswithpushout windows, emergency doors, and marking lights

Theserecordsmustberetainedforoneyearatthelocation where the vehicle is garaged, and maintained for six months after the vehicle leaves the carrier’s control(viasale,trade-in,orscrap).

Roadside Inspection Reports

Any driver who receives a roadside inspection report must deliver it to the motor carrier.

Certification of Roadside Inspection Reports

Anofficialofthemotorcarrieristoexaminetheroad-side inspection report and ensure that any violations or defects noted on the report are corrected. Within 15daysaftertheinspection,thecarriermustsignthecompleted roadside inspection report to certify that all violationshavebeencorrected,andthenreturnittotheindicatedaddress.Acopymustberetainedfor12months from the date of inspection.

Post-Trip Inspection ReportProperty carrier drivers must complete a driver vehi-cleinspection(Post-Trip)foreachvehicledrivenattheend of each driving day when they have either found orbeenmadeawareofavehicleand/ordeficiency.This report must cover at least the following parts and accessories:

n Servicebrakes(includingtrailerbrakeconnec-tions)n Parking(hand)braken Steeringmechanismn Lightingdevicesandreflectorsn Tiresn Hornn Windshield wipersn Rearview mirrorsn Couplingdevicesn Wheels and rimsn Emergencyequipment

The report must list any condition that the driver either found or had reported to him/her that would affectsafetyofoperationorcauseabreakdown.Ifnodefectordeficiencyisreportedorfound,thereportshould state this. The driver must sign the report in all cases.

Equipment, Inspection and Use Pre-Trip Inspection Report

Beforedispatchingthevehicleagain,acarriershallensurethatacertificationhasbeenmadeastoanydefectordeficiencythattheyhavebeencorrected,orstatethosedeficienciesthatdonotrequireimmediatecorrection.Carriersmustkeeptheoriginalpost-tripinspectionreportandthecertificationofrepairsforatleast three months from the date of preparation.

Beforestartingout,thedrivermustbesatisfiedthatthe motor vehicle is in safe operating condition. If the lastvehicleinspectionreportnotesanydeficiencies,the driver must review and sign to acknowledge that necessaryrepairshavebeencompleted.Thereportdoesnothavetobecarriedonthevehicle.

EXCEPTIONS:ThePost-TripInspectionReportshallnot apply to a private motor carrier of passengers (nonbusiness),adriveaway-towawayoperation,oranymotor carrier operating only one commercial motor vehicle.

Periodic Inspection

Everycommercialvehicle,includingeachsegmentofacombinationvehicle,requiresaperiodicinspectionandmustbeperformedatleastonceevery12months.At a minimum, inspections must include all items enumerated in the Minimum Periodic Inspection Standards,AppendixGtoSubchapterB.Carriersmay perform required annual inspections themselves. The motor carrier must retain the original or a copy of the periodic inspection report for 14 months from the report date.

Equivalent to Periodic Inspection

The motor carrier may meet periodic inspection re-quirementsthrough:

n Self-inspectionbyqualifiedemployeeorn Thirdpartyinspectionbyqualifiedindividual

Documentation of Inspection

Documentation(report,sticker,ordecal)ofthemostrecentperiodicinspectionmustbekeptonthevehicle.

Inspector Qualification

Motor carriers must ensure that persons performing annualinspectionsarequalified.Inspectorsmust:

n UnderstandtheinspectionstandardsofPart393 and Appendix G n Beabletoidentifydefectivecomponentsn Haveknowledgeandproficiencyinmethods,pro- cedures, and tools

Inspector Training or Experience

Inspectorsmayhavegainedexperienceortrainingby:

n Completingastateorfederaltrainingprogram, orearningastateorCanadianprovincequalifying certificateincommercialmotorvehiclesafety inspectionsn Acombinationofothertrainingorexperience totaling at least a year

Evidence of Qualifications

Motor carriers must retain evidence of an inspector’s qualificationsuntiloneyearaftertheinspectorceasesto perform inspections for the carrier.

Brake Inspector Qualification

Themotorcarrierisresponsibleforensuringthatall inspections, maintenance, repairs, and service to brakesofcommercialmotorvehiclescomplywiththese regulations. The carrier must ensure that the em-ployeesresponsibleforbrakeinspection,maintenance,service,orrepairsmeetminimumbrakeinspectorqualifications.

Qualifications for Brake Inspectors

Thebrakeinspectormust:

n Understandandbeabletoperformthebrakeser- vice and inspectionn Knowthemethods,procedures,toolsandequip- ment needed andn Bequalifiedtoperformbrakeserviceorinspection bytrainingand/orexperience

Qualifying Brake Training or Experi-ence

Qualifyingbraketrainingorexperienceincludessuc-cessfulcompletionof:

n Astate,Canadianprovince,federalagency,or union training programn A state-approved training programn TrainingthatledtoattainmentofastateorCanadi- anprovincequalifyingcertificatetoperformas- signedbrakeserviceorinspectiontasks,including passageofCDLairbraketestinthecaseofabrake inspection orn Oneyearofbrake-relatedtraining,experience,or combinationofboth

Maintaining Evidence of Brake Inspec-tor Qualifications

Motorcarriersmustmaintainevidenceofbrakein-spectorqualificationattheprincipalplaceofbusinessorthelocationwheretheinspectorworks.Evidencemustberetainedfortheperiodduringwhichthebrakeinspector is employed in that capacity and for one year thereafter.

The same items are requiredtobeinspectedbyeachdocument.FHWA'sandCVSA'soutofservicecriteriaareintendedtobeusedinrandomroadsideinspections to identify critical vehicle inspection items and provide criteria for placing a vehicle(s)outofservice.Avehicle(s)isplacedoutofserviceonlywhenbyreasonofitsmechanical condition or loading it is determined tobesoimminentlyhazardousastolikelycauseanaccidentorbreakdown,orwhensuchcondition(s)wouldlikelycontributetolossofcontrolofthevehicle(s)bythedriver.Acertainamountofflexibilityisgiventotheinspectingofficial whether to place the vehicle out of serviceattheinspectionsiteorifitwouldbeless hazardous to allow the vehicle to proceed to a repair facility for repair. In contrast, the Appendix G inspection procedurerequiresthatallitemsrequiredtobeinspectedareinproperadjustment,arenotdefective and function properly prior to the vehiclebeingplacedinservice.Differences Between the Out Of Service Criteria & FHWA's Annual Inspection 1. Brake System. TheAppendixGcriteriarejectsvehicleswithanydefectivebrakes,anyairleaks,etc.Theoutofservicecriteriaallows20%defectivebrakeson non steering axles and a certain latitude on airleaksbeforeplacingavehicleoutofservice.2. Coupling Devices. AppendixGrejectsvehicleswithanyfifthwheel mounting fastener missing or ineffective. Theoutofservicecriteriaallowsupto20%missing or ineffective fasteners on frame mountingsandpivotbracketmountingsand25%onsliderlatchingfasteners.Theoutofservice criteria also allows some latitude on cracked welds. 3.ExhaustSystem.AppendixGfollowsSection393.83 verbatim.TheCVSAoutofservicecriteriaallowsvehicles to exhaust forward of the dimensions giveninSection393.83 as long as the exhaust does not leak or exhaust under the chassis. 4. Fuel System. SameforAppendixGandtheoutofservicecriteria. 5. Lighting Devices. Appendix G requires all lighting devices requiredbysection393 tobeoperativeatalltimes. The out of service criteria only requires one stop light and functioning turn signals on therearmostvehicleofacombinationvehicletobeoperativeatalltimes.Inaddtiononeoperative head lamp and tail lamp are required during the hours of darkness. 6. Safe Loading. SameforbothAppendixGandtheoutofservice criteria. 7. Steering Mechanism. SteeringlashrequirementsofAppendixGfollows the new requirements of §393.209 .8. Suspension. Appendix G follows the new requirements of §393.207 whichdoesnotallowanybrokenleavesinaleafspringassembly.Theoutofservicecriteriaallowsupto25%brokenormissingleavesbeforebeingplacedoutofservice. 9. Frame. The out of service criteria allows a certain latitudeinframecracksbeforeplacingavehicleout of service. Appendix G follows the new requirements of §393.201 which does not allow any frame cracks. 10. Tires. Appendix G follows the requirements of §393.75 which requires a tire tread depth of 432 inch on power unit steering axles and 232 inch on all other axles. The out of service criteria only requires 232 inch tire tread depth on power unit steering axles and 132 inch on all other axles. 11. Wheel and Rims. The out of service criteria allows a certain amount latitude for wheel and rim cracks and missing or defective fasteners. Appendix G meets the requirements of the new §393.205 which does not allow defective wheels and rims noneffectivenutsandbolts.12. Windshield Glazing. The out of service criteria places in a restricted service condition any vehicle that has a crack or discoloration in the windshield area lying within the sweep of the wiper on the drivers side and does not address the remaining area of the windshield. Appendix G addresses requirements for the whole windshield as specified in §393.60 13. Windshield Wipers. AppendixGrequireswindshieldwiperstobeoperative at all times. The out of service criteria only requires that the windshield wiper on the driver'ssidetobeinspectedduringinclementweather.
