ln compliance with the order dated 24.02.2016 passed by the Hon'ble Civil Judge Senior Division, Jind in civil suit No. 328 of 2015 titled as Renu Sharma versus State of Haryana and others, the Governor of Haryana is pleased to appoint the following person as Headmistress in Government High School under the provisions of the Haryana State Education (School and Inspection Cadre) (Group B) Service Rules, 1998, in the pay scale of Rs. 7500-250-10000-EB-250-12000 plus usual allowances as admissible under the State Government Rules from time to time:-

The candidate is directed to join her place of posting mentioned against her name' within

15 days from the date of receipt of this order on the following terms and conditions :-

1. She is hereby appointed as Headmistress w.e.f. 25.01.2008 i.e. the date from which the

candidate junior to her was appointed as such. The benefit of ante-dated appointment will

be admissible to her only for the purpose of seniority and continuity in service and actual

financial benefits will be admissible to her from the date she joins duty as High School

Headmistress.

2. This appointment is offered to her subject to the final outcome of the following cases

i. SLP which is being filed in the Hon'ble Apex Court against the order dated

05.07.2018 passed in RSA No. 4651 of 2017 by the Hon'ble High Court.

ii. LPA No. 1773 of 2013 titled as Dinesh Kumar and others Vs. State of Haryana

which has been filed by the petitioner on the same issue and this LPA is sub-judice

in Hon'ble Punjab and Haryana High Court.

3. She is appointed purely on temporary and provisional basis.

4. This appointments is against temporary post and her seniority and record of substantive

post shall be considered on the basis of her seniority and record of service as and when

such posts is available.

5. She shall have to take an oath of allegiance to the Constitution of India.

6. She shall produce a certificate before joining the duties to the effect that she has one living

husband in case she is married. The candidate who has more than one living wife/husband,

shall not be eligible for appointment to the post offered unless the Government after being

satisfied that there is special grounds for doing so, exempt her from this condition.

7. She will not be allowed to apply for any post outside the department for a period of atleast

five years.

8. She shall be on probation for a period oftwo years. The period of probation can be extended

for a further period not exceeding one year, if considered necessary.

9. In other matters, not specifically mentioned in this communication, she will be governed

by the Civil Services Rules as applicable to Haryana Government Employees and such

orders/instructions as may be issued by the Government from time to time.

10. In case of reserved category candidate, the appointment is provisional and is subject to the

Scheduled Castes/ Scheduled tribes and Backward Class Certificate being verified through

the proper channels. If the verification reveals that the claim of belonging to SC/ST and

BC, as the case may be, is false then his services will be terminated forthwith without

assigning any further reason and without prejudice to such further action as may be taken

under provisions of the Indian Penal Code for production of false certificate.

11. It is made clear that character and antecedents have not been got verified before issue of

the appointment letter to the appointee and in case subsequently any adverse fact comes to

the notice of the State Government/ Department regarding her character and antecedents,

her services shall be terminated without any notice.

12. She is hereby directed to show her original certificates of academic qualification,

experience and other relevant certificates to the concerned District Education Officer of

her place of posting. The District Education Officer would verify the genuineness of her

original certificates and accordingly, give a certificate to this effect. The District Education

Officer will also ensure that the candidates submits her medical fitness certificate first duly

issued by the Medical Board only then she should join as Headmistress in the respective

school of posting. The District Education Officer will also give character and antecedent's

verification forms to her and after getting them filled in by her, the same be sent to the

Directorate through a special messenger within a week's time. This is the personal

responsibility of the concerned District Education Officer.

13. If she is already in Government job as Class-II officer, need not submit a fresh Medical

fitness report whereas others are directed to appear before the Medical Boards as may be

constituted by the Director General Health Services, Haryana, Panchkula and medical

fitness report is to be submitted in the office of the concerned District Education Officer

before joining the place of posting as Headmistress in respective Government High School.

14. She will be governed by the Haryana State Education (School and Inspection Cadre)

(Group-B) Service rules, 1998 as amended from time to time.

15. If at any time during the course of her temporary appointment, she desires to resign, she

shall be required to give one month's clear notice or forfeit, in lieu thereof, her salary

including allowances etc. for one month or for the period by which the notice falls short of

one month. Such a notice will be given to her by the Government also in the case if it is

proposed to terminate her services in lieu thereof. The Government will be liable to pay

her salary, including allowances for one month or for the period by which the notice falls

short of one month.

16. No TA/DA will be admissible to her for joining as Headmaster.

17. If she gets an appointment as Headmistress on the basis of her furnishing false or fraudulent

information/ facts which is detected later on, her services would be liable for termination

without any notice.

If she is willing to accept this offer of appointment as Headmistress, HES-II (School Cadre)

on the above tertns and conditions, she should submit her joining report as per aforesaid directions.

5. The mutual transfer would be effective only when both the employees seeking mutual transfer submit a consent document to their respective Principals.

6. The condition that official has not been joined previous transfer place of posting is not implemented on Cancellation Order.

7. The official will be update their profile in MIS Portal when he/she join/relieve from his present working station and also supply the information to the Directorate.

1n compliance with the order dated 24.02.2016 passed by the Hon'ble Civil Judge Senior Division, Jind in civil suit No. 328 of 2015 titled as Renu Sharma versus State of Haryana and others, the Governor of Haryana is pleased to appoint the following person as Headmistress in Government High School under the provisions of the Haryana State Education (School and Inspection Cadre) (Group B) Service Rules, 1998, in the pay scale of Rs. 7500-250-10000-EB-250-12000 plus usual allowances as admissible under the State Government Rules from time to time:-

The candidate is directed to join her place of posting mentioned against her name' within

15 days from the date of receipt of this order on the following terms and conditions :-

1. She is hereby appointed as Headmistress w.e.f. 25.01.2008 i.e. the date from which the

candidate junior to her was appointed as such. The benefit of ante-dated appointment will

be admissible to her only for the purpose of seniority and continuity in service and actual

financial benefits will be admissible to her from the date she joins duty as High School

Headmistress.

2. This appointment is offered to her subject to the final outcome of the following cases

SLP which is being filed in the Hon'ble Apex Court against the order dated

05.07.2018 passed in RSA No. 4651 of 2017 by the Hon'ble High Court.

LPA No. 1773 of 2013 titled as Dinesh Kumar and others Vs. State of Haryana

which has been filed by the petitioner on the same issue and this LPA is sub-judice

in Hon'ble Punjab and Haryana High Court.

3. She is appointed purely on temporary and provisional basis.

4. This appointments is against temporary post and her seniority and record of substantive

post shall be considered on the basis of her seniority and record of service as and when

such posts is available.

5. She shall have to take an oath of allegiance to the Constitution of lndia.

6. She shall produce a certificate before joining the duties to the effect that she has one living

husband in case she is married. The candidate who has more than one living wife/husband,

shall not be eligible for appointment to the post offered unless the Government after being

satisfied that there is special grounds for doing so, exempt her from this condition.

7. She wi 11 not be allowed to apply for any post outside the department for a period of atleast

Live years.

8. She shall be on probation for a period oftwo years. The period of probation can be extended

for a further period not exceeding one year, if considered necessary.

9. In other matters, not specifically mentioned in this communication, she will be governed

by the Civil Services Rules as applicable to Haryana Government Employees and such

orders/instructions as may be issued by the Government from time to time.

10. In case of reserved category candidate, the appointment is provisional and is subject to the

Scheduled Castes/ Scheduled tribes and Backward Class Certificate being verified through

the proper channels. If the verification reveals that the claim of belonging to SC/ST and

BC, as the case may be, is false then his services will be terminated forthwith without

assigning any further reason and without prejudice to such further action as may be taken

under provisions of the Indian Penal Code for production of false certificate.

11. It is made clear that character and antecedents have not been got verified before issue of

the appointment letter to the appointee and in case subsequently any adverse fact comes to

the notice of the State Government/ Department regarding her character and antecedents,

her services shall be terminated without any notice.

12. She is hereby directed to show her original certificates of academic qualification,

experience and other relevant certificates to the concerned District Education Officer of

her place of posting. The District Education Officer would verify the genuineness of her

original certificates and accordingly, give a certificate to this effect. The District Education

Officer will also ensure that the candidates submits her medical fitness certificate first duly

issued by the Medical Board only then she should join as Headmistress in the respective

school of posting. The District Education Officer will also give character and antecedent's

verification forms to her and after getting them filled in by her, the same be sent to the

Directorate through a special messenger within a week's time. This is the personal

responsibility of the concerned District Education Officer.

13. If she is already in Government job as Class-II officer, need not submit a fresh Medical

fitness report whereas others are directed to appear before the Medical Boards as may be

constituted by the Director General Health Services, Haryana, Panchkula and medical

fitness report is to be submitted in the office of the concerned District Education Officer

before joining the place of posting as Headmistress in respective Government High School.

14. She will be governed by the Haryana State Education (School and Inspection Cadre)

(Group-B) Service rules, 1998 as amended from time to time.

15. If at any time during the course of her temporary appointment, she desires to resign, she

shall be required to give one month's clear notice or forfeit, in lieu thereof, her salary

including allowances etc. for one month or for the period by which the notice falls short of

one month. Such a notice will be given to her by the Government also in the case if it is

proposed to terminate her services in lieu thereof. The Government will be liable to pay

her salary, including allowances for one month or for the period by which the notice falls

short of one month.

16. No TA/DA will be admissible to her for joining as Headmaster.

17. If she gets an appointment as Headmistress on the basis of her furnishing false or fraudulent

information/ facts which is detected later on, her services would be liable for termination

without any notice.

If she is willing to accept this offer of appointment as Headmistress, HES-II (School Cadre)

on the above terms and conditions, she should submit her joining report as per aforesaid directions.
