The ACP Scheme envisages merely placement in the higher pay-scale of financial benefits (through financial upgradation) only tothe Government Servant concerned on personal basis and shalltherefore, neither amount to functional / regular promotion norwould require creation of new posts for the purpose.

The Financial upgradation granted under the ACP Scheme shall becounted against regular promotion.

The residency period (regular service) for grant of benefits underACP Scheme shall be counted from the grade in which an employeewas appointed as Direct Recruit.

The Financial upgradation granted is personal to incumbents forthe stated purposes of the ACP Scheme and is restricted forfinancial and certain other benefits (House Building Advance /allotment of Govt. Accommodation / advances etc) only withoutconferring any privileges related to higher status (e.g) invitation toceremonial functions, deputation to higher posts etc.

The financial upgradation under the ACP granted to the aboveofficers is personal to them and has no relevance to seniority andthere shall be no additional financial upgradation for the seniorson the ground that their junior employee in the grade has gothigher pay scale under the ACP Scheme.

The pay of the above officers shall be fixed under the provisions ofFR 22(1) (a) (i) subject to minimum financial benefit of Rs.100/- asper Dept. of Personnel 86 Training's order No. 1/6/97-Pay.I dated05.07.1999. The financial benefit allowed under ACP Scheme isfinal and no pay fixation benefits shall accrue at the time of regularpromotion. i.e. posting against functional post in the higher grade.

vii) Grant of higher pay scale under the ACP Scheme shall beconditional to the fact that an employee, while accepting the saidbenefit, shall be deemed to have given his unqualified acceptancefor regular promotion on occurrence of vacancy subsequently. Incase if any officer refuses to accept the higher post on regularpromotion subsequently, he shall be subject to normal debarmentfor regular promotion as prescribed in the general instructions inthis regard. The above order is based upon the assumption that there is novigilance / non-vigilance case pending against the officer. Further,that he / she is not under suspension and not covered by any ofthe three conditions mentioned in DOPT, New Delhi's O.M. No.22011 / 04 / 9 1-Estt (A) dated 14.09.1992. The concernedCommissionerate / Division office may kindly ensure that thiscodition is satisfied before grant of ACP. In respect of officers,where this condition is not satisfied, the order is deemed to nothave been issued. Such cases should be brought to the notice ofthis office immediately.

Before granting ACP benefit, the period of suspension of officers ifany, may please be excluded.

The concerned Commissionerate will check and ensure correctnessof the due date of upgradation from SERVICE RECORDS of the officersbefore grant of actual financial benefits. Any discrepancy may bebrought to the notice of this office.

The appointment of the officer at Sr. No.01 to 08 are against 10% quotareserved on the basis of qualifying departmental examination and officer atSr. No.09 to 21 are against 5% quota reserved on the basis of seniority-cum-fitness.

The appointment is without prejudice to the claim of their seniors who may befound fit for appointment later on and confers on them no right for continuedretention as Lower Division Clerk.

The officers who have not passed the typing test will be required to pass thetyping test within the period of two years from the date of their appointmentand those do not qualify would be reverted to Group"D" post. They will,however, not draw increment until they qualify in typewriting test within theperiod of six months.

The promoted officers who join now will be deemed to be on probation for aperiod of two years i.e. 20/09/2002 to 19.09.2004 and their probationcompletion will be declared as per rules in this regard.

Their pay may be fixed in the cadre of LDC (Pre-restructured) on notionalbasis w.e.f. 20.09.2002 as per F.R 22(I)(a)(1) & FR 27 after obtaining theiroption within the prescribed period. However they are not entitled for drawalof arrears of pay from the date of notional promotion.

The seniority of the above officers will be fixed according to the existingorders.

The Controlling Officer of the officers covered by this order will ensure that noofficer in the promotion list is allowed to join if the officer is under suspensionor facing any charge-sheet or prosecution or undergoing punishment as onSeptember,2002 to till date and report this fact to this office immediately.

prior to implementation of 6th Pay Commission.

Grant of higher pay scale under the ACP Scheme shall be conditional to the

fact that an employee, while accepting the said benefit, shall be deemed to

have given his unqualified acceptance for regular promotion on occurrence of

vacancy subsequently. In case if any officer refuses to accept the higher post

on regular promotion subsequently, he shall be subject to normal debarment

for regular promotion as prescribed in the general instructions in this regard.

However, as and when he accepts regular promotion thereafter, he shall

become eligible for second upgradation under the ACP Scheme only after he

completes the required eligibility, service period under the ACP scheme in

the higher grade subject to the condition that the period for which he was

debarred for regular promotion shall not count for the purpose. If any officer

has earlier refused promotion to the grade to which he/ she is being granted

ACP, then ACP benefit will not be granted to him. Respective

Commissionerates may check this aspect before granting ACP benefit to the

officer.

viii] The above order is based upon the assumption that the officer is not under

suspension and there is no vigilance / non-vigilance case pending against the

officer neither officer is under going penalty. Further, he/ she is not under

suspension and not covered by any of the three conditions mentioned in

DOPT, New Delhi's O.M. No. 22011/04/ 91-Estt (A) dated 14.09.92. The

concerned Commissionerate may kindly ensure that this condition is satisfied

::5::Before granting ACP benefit, the period of suspension of officers if any, may

please be excluded.

In the case of officers listed above who are on deputation, in view of the

D.O.P.T's O.M. No.22034/5/2000-Estt(D) dated 20 th August, 2001 modifying

the clarification No. 29 in the D.O.P.T's O.M. dated 10.2.2000, they are

allowed to opt to draw pay in the higher scale of pay under ACP Scheme

without deputation allowance during the period of deputation, if it is more

beneficial than the normal entitlements under the existing general orders

regulating pay on appointment on deputation basis.

In case of officers in the above list who are presently on deputation/long

leave/on study leave or those who are working outside the cadre in any

post, the financial benefit is from the date mentioned against their names

should be given notionally and actual benefit on the basis of normal pay

fixation may be given on the repatriation.

Subject:- Esit: Transfers and postings in the grade of Inspector to CustomsCommissionerate, Kandla - reg.

The following Inspectors working in the combined cadre of Gujarat State arehereby transferred and posted to the Customs Commissionerate, Kandla withimmediate effect.

The above officers are posted to the Customs Commissionerate, Kandla for aperiod of 4 ye4rs. However, they should note that they arc liable to be reverted back atany time and posted to any Commissionerate in the combined Gujarat cadre dependingupon the vacancy situation and administrative exigencies without assigning anyreasons or prior notice.

The above office: s should note that they are liable to be posted anywhere in thejurisdiction of Customs Commissionerate, Kandla. The detailed posting within theKandla Cornmissioncrate will be decided by the Commissioner of Customs, Kandla.

The above officers should note that in the event of their refusal to accept the offerof posting to Customs Commissionerate, Kandla without sufficient cause, they shall notbe considered for posting to the Customs Commissionerate, Kandla for a period of next3 years. They will also not to be considered for deputation to other organization likeAirport, DRI, DGCEI, NCR, CNIB during next 03 years.

It is also clarified that the posting of the officers to the CustomsCommissionerate, Kandla is governed by the provisions of transfer/deputation policyissued by the Chief Commissioner of Customs, Ahmedabad vide F.No.11/3•

6. Further, the posting order in respect of Shri And G. Parmar, Inspector ofVadodara-11 Commissionerate, whose name is figuring in-the select panel is not issuedfor the reasons that he has withdrawn his willingness for posting to CustomsCommissionerate, Kandla. Accordingly, he will not be considered for posting toCustoms Commissionerate, Kandla for a period of three years and lie will also not he

years will be counted from c' .012010, or any other date extended by the CadreControlling Authority. In case, the officers are not relieved within one month of issue ofthis order, reasons may be communicated, failing which it will be construed that theofficer is not willing to be posted at CH Kandla on deputation and order will becancelled with the conditions as per para 7 of this order.
