Call to Order Beth Ann Ball, Section Chair, called the meeting to order at 9:26 a.m. The Section began the meeting by reading the vision statement. The Occupational Therapy Section is committed to proactively:

Assistant Attorney General’s Report LaTawnda Moore, AAG informed the Section that she will prepare the practice pointers overview at the Section Retreat. Enforcement Report Mary Beth Lavey reported that the Enforcement Division opened one case and closed six cases since the September 14, 2017, meeting. There are currently five cases open. There is one active consent agreement and two adjudication orders being monitored. Mary Beth Lavey recommended that the Section accept consent agreement OT FY17-041 in lieu of going to hearing. Action: Beth Ann Ball moved that the Section accept consent agreement OT FY17-041 in lieu of going to hearing. Anissa Siefert seconded the motion. Mary Beth Lavey abstained from voting. The motion carried. Mary Beth Lavey recommended that the Section accept consent agreement OT FY17-042 in lieu of going to hearing. The motion carried. Correspondence The Section reviewed the correspondence and provided feedback to the Correspondence Liaison. Old Business Review Rule Comments The Review the rules comments. The majority of the comments received were in support of the changes. New Business Draft Rule Language for CE Volunteering Beth Ann Ball recommends that Section define indigent people as uninsured and underinsured. The Section discussed how an individual would show proof of volunteering in this capacity. The Section will continue to work on draft language for this rule. The AAG will assist the Section in the process. Anonymous Complaints The Section receives approximately three anonymous complaints yearly. The Board does not currently accept anonymous complaints because there is no one to validate the complaint and there is no witness to testify. Open Forum The staff will schedule new Board member orientation soon. The Section will change the meeting start time to 9:30 am. The Section assigned Liaison roles for the new Board Members. Joanne Estes will be the Licensure Liaison and Melissa Van Allen will be the Correspondence Liaison. Ohio Occupational Therapy Association (OOTA) Report There was no formal report for the Section. Items for Next Meeting Rule Review Internal Pelvic Floor in OT Practice Next Meeting Date The next regular meeting date of the Occupational Therapy Section is scheduled for Thursday, January 18, 2018.

4755-9-01 Continuing education.

(A) Pursuant to division (C) of section 4755.06 of the Revised Code, no person shall qualify for licensure renewal as an occupational therapist or occupational therapy assistant unless the licensee has shown to the satisfaction of the occupational therapy section that the licensee has completed twenty contact hours of continuing education activities within the two year renewal cycle.

(B) Acceptable continuing education activities may include:

Serving as a volunteer for indigent and uninsured persons, as defined in division (7) of section 2305.234 of the Revised Code without compensation.

(C) Be credited as one hour of CE for each sixty minutes spent providing services as a volunteer, not to exceed 4 hours of the total biennial CE requirement.

(i) It contributes directly to professional competency; (ii) It relates directly to the clinical practice, management, or education of occupational therapy practitioners;

Proof of service may be verified by completion of a Verification of Participation form which is to be signed by the recipient or his/her Medical Power of Attorney or OT of record

Here is the language that the RN’s have on their website. A: Effective April 6, 2017, HB 290 (131st GA) authorizes the RN to serve as a volunteer for indigent and uninsured persons, without compensation, for up to 8 hours and use this as qualifying CE. The Board is adopting rules to clarify the process that should be effective February 1, 2018. Until that time, please review Section 4745.04, ORC, at: http://codes.ohio.gov/orc/4745.04v1.

(b) Have the individual giving consent sign the form in the conscious presence of a competent witness;

(c) Have the witness also sign the form and attest that the individual giving consent appeared to do all of the following:

(i) Concur with the treating physician in believing that all approved treatment options would be unlikely to prolong the patient's life;

(ii) Understand the risks involved with using the investigational drug, product, or device; (iii) Willingly desire to use the investigational drug, product, or device to treat the terminal

condition.(3) An eligible patient, or the patient's parent, guardian, or other person legally responsible

for the patient, may revoke consent to treatment with an investigational drug, product, or device at any time and in any manner that communicates the revocation.

(D)(1) Except for actions constituting willful or wanton misconduct, a treating physician who recommends or treats an eligible patient with an investigational drug, product, or device in compliance with this section is not liable for or subject to any of the following for an action or omission related to treatment with the investigational drug, product, or device: damages in any civil action, prosecution in any criminal proceeding, or professional disciplinary action.

(2) This section does not create a new cause of action or substantive legal right against a treating physician or hospital related to a physician's not recommending the use of an investigational drug, product, or device.

(E) An official, employee, or agent of this state shall not, solely because an investigational drug, product, or device has not been approved for general use by the United States food and drug administration, prevent or attempt to prevent access by an eligible patient or eligible patient's treating physician to an investigational drug, product, or device that is being provided or is to be provided in accordance with this section or section 4729.89 of the Revised Code.

(F) If an eligible patient dies while being treated with an investigational drug, product, or device and there are any o utstanding costs related to treating the patient, the patient's estate, devisees, and heirs shall not be held liable by any person or government entity for those costs.

(G) Nothing in this section requires a health care insurer, the medicaid program or any other government health care program, or any other entity that offers health care benefits to provide coverage for the costs incurred from the use of any investigational drug, product, or device.

(H) Nothing in this section condones, authorizes, or approves of assisted suicide, as defined in section 3795.01 of the Revised Code, or any action that is considered mercy killing or euthanasia.

(I) As soon as practicable after the effective date of this section, the state medical board shall create a template of the form to be used by a treating physician to secure a patient's informed consent under division (C)(2) of this section and make the template available to physicians and hospitals.

Sec. 4745.04. (A) As used in this section: (1) "Indigent and uninsured person" and "volunteer" have the same meanings as in section

2305.234 of the Revised Code. (2) "Licensing agency that licenses health care professionals" means all of the following: (a) The state dental board established under Chapter 4715. of the Revised Code; (b) The board of nursing established under Chapter 4723. of the Revised Code;

(c) The state board of optometry established under Chapter 4725. of the Revised Code; (d) The Ohio optical dispensers board established under Chapter 4725. of the Revised Code; (e) The state board of pharmacy established under Chapter 4729. of the Revised Code; (f) The state medical board established under Chapter 4731. of the Revised Code; (g) The state board of psychology established under Chapter 4732. of the Revised Code; (h) The state chiropractic board established under Chapter 4734. of the Revised Code; (i) The hearing aid dealers and fitters licensing board established under Chapter 4747. of the

Revised Code; (j) The board of speech-language pathology and audiology established under Chapter 4753.

of the Revised Code; (k) The Ohio occupational therapy, physical therapy, and athletic trainers board established

under Chapter 4755. of the Revised Code; (l) The counselor, social worker, and marriage and family therapist board established under

Chapter 4757. of the Revised ode; (m) The chemical dependency professionals board established under Chapter 4758. of the

Revised Code; (n) The Ohio board of dietetics established under Chapter 4759. of the Revised Code;(o) The Ohio respiratory care board established under Chapter 4761. of the Revised Code;(p) The state board of emergency medical services e stablished under Chapter 4765. of the

Revised Code; (q) The state board of orthotics, prosthetics, and pedorthics established under Chapter 4779.

of the Revised Code; (r) Any other licensing agency that considers its licensees to be health care professionals. (B) Notwithstanding any provision of the Revised Code to the contrary, a licensing agency

that licenses health care professionals shall apply toward the satisfaction of a portion of a licensee's continuing education requirement the provision of health care services if all of the following apply:

(1) The licensing agency that licenses health care professionals requires a licensee to complete continuing education as a condition of having a license renewed by the agency.

(2) The licensee provides the health care services to an indigent and uninsured person. (3) The licensee provides the health care services as a volunteer. (4) The licensee satisfies the requirements of section 2305.234 of the Revised Code to qualify

for the immunity from liability granted under that section. (5) The health care services provided are within the scope of authority of the licensee

renewing the license. (C) A licensing agency that licenses health care professionals shall permit a licensee to satisfy

up to one-third of the licensee's continuing education requirement by providing health care services as a volunteer. A licensing agency that licenses health care professionals shall permit a licensee to e arn continuing education credits at the rate of one credit hour for each sixty minutes spent providing health care services as a volunteer.

(D) A licensing agency that licenses health care professionals shall adopt rules as necessary to implement this section. The rules shall be adopted in accordance with Chapter 119. of the Revised Code.

(E) Continuing education credit received under this section for providing health care services is not compensation or any other form of remuneration for purposes of section 2305.234 of the Revised Code and does not make the provider of those services ineligible for the immunity from liability granted under that section.

Sec. 5155.01. (A) As used in this section, "appointing authority" has the same meaning as in section 124.01 of the Revised Code.

(B) The board of county commissioners shall make all contracts for new buildings and for additions to existing buildings necessary for the county home, and . The board shall prescribe rules for the management and good government of the home.

The (C)(1) If the superintendent or administrator of the county home is a public employee, the superintendent or administrator is the county home's appointing authority and may employ an administrative assistant and additional necessary personnel, at rates of wages to be fixed by the board of county commissioners, as may not be found available on the part of the residents of the facility. The

(2) If the superintendent or administrator is not a public employee, the board is the appointing authority for any public employees of the county home. The superintendent or administrator may make recommendations to the board regarding the employment or removal of any public employee of the county home. The board is not the appointing authority for a county home employee who is not a public employee.

(D) The superintendent or administrator and administrative assistant shall be removed if either of them requires or permits residents or employees to render services for the private interests of the superintendent or administrator, the administrative assistant, any member of the board of county commissioners, any private interest, or any member of the board of county hospital trustees if that board has entered into an agreement or otherwise has operational control as provided in section 5155.011 of the Revised Code.

Sec. 5155.012. A board of county commissioners may enter into a contract with a public or private entity to aid it the board in the execution of its powers and duties for the management and good government of the county home.

Pursuant to such a contract, the board may authorize a public or private entity to select a superintendent or administrator for the county home. A superintendent or administrator may not be selected pursuant to a contract without the advice and consent of the board. An individual selected as a superintendent or administrator pursuant to a contract is not a public employee due to being selected to serve in that position or performing the duties of that position.

Sec. 5155.03. (A) The board of county commissioners or operator shall appoint do either of the following:

(1) Appoint a superintendent, who may be authorized to use the title "administrator," who or administrator of the county home;

(2) In accordance with section 5155.012 of the Revised Code, enter into a contract with a public or private entity that agrees to select a superintendent or administrator with the advice and consent of the board.

(B) The superintendent or administrator may reside on the premises of the county home or another building contiguous to the county home, and who shall receive the compensation the board

(C) Requirements: (2) Any license holder shall be given credit, as defined in rule 4732-3-01 of the Administrative Code, for participation in any CE program or course that is not specifically disapproved by the board as provided for under paragraph (C) (5) of this rule and that is designated as acceptable by a relevant accrediting authority as specified in division (B)(1) of section 4732.141 of the Revised Code as meeting the following criteria:

(c) In accordance with division (B) of section 4745.04 of the Revised Code, up to one-third of the biennial CE requirements may be completed by providing volunteer services to indigent and uninsured persons. To qualify under this rule, volunteer services shall:

(i) Be provided at a free clinic or other non-profit organization that offers health care services based on eligibility screenings identifying the client as an "indigent and uninsured person" as that term is defined in division (A)(7) of section 2305.234 of the Revised Code;

(ii) Be documented in writing in the form of a certificate or a written statement on letterhead from an administrative official at the organization where services were rendered, specifying at a minimum the license holder's name, license number, date(s) of qualifying volunteer services, and number of hours of services.

(iii) Not be credited for license holders in a paid position at the organization at which the services are rendered;

(iv) Be psychological or school psychological services provided in compliance with the professional conduct requirements specified in rule 4732-17-01 of Administrative Code;

(v) Be credited as one hour of CE for each sixty minutes spent providing services as a volunteer, not to exceed seven hours of the total biennial CE requirement; and

(vi) Not count toward the requirements of division (A)(1) of section 4732.141 of the Revised Code to complete four hours of CE in professional conduct, ethics, and/or the role of culture, ethnic identity, or both in the provision of psychological assessment, consultation, or psychological interventions, or a combination thereof.

4755-1-01 Notice of meetings. (A) Any person may obtain the time and place of all regularly scheduled meetings or the time, place, and purpose of any special meeting by:

(C) The board will maintain a list of representatives of the news media who requested in writing notice of special or emergency meetings. In the event of an emergency meeting, the representatives of the news media who requested notification shall be notified immediately of the time, place, and purpose of the meeting. 4755-1-02 Method of public notice in adopting, amending or rescinding rules. (A) Prior to the adoption of any rule subject to the requirements of Chapter 119. of the Revised Code by the occupational therapy section of the Ohio occupational therapy, physical therapy, and athletic trainers board, public notice of the section's intention to consider adoption, amendment or rescission shall be given at least thirty days prior to the date set for the public hearing. Notice shall be given in the register of Ohio. The occupational therapy section may also issue any notice or publication to ensure that constructive notice is given to all persons who are subject to or affected by the proposed rule. The notice shall include:

(1) A statement of the occupational therapy section's intentions to consider adoption, amendment or rescission of a rule;

(2) A synopsis of the proposed rule, amendment, or rescission, or a general statement of the subject matter to which the proposed rule, amendment or rescission relates; and,

(3) A statement of reason or purpose of adoption, amendment or rescission of rules; and,

(4) The date, time and place set for the public hearing on the proposed action.

(B) Any person may receive notice by supplying the occupational therapy section with stamped, pre-addressed envelopes.

4755-1-03 On-site investigations/inspections. On-site inspections/investigations:

(A) Board investigators may conduct routine inspections at the work site of licensees to determine compliance with the laws and rules governing the practice of occupational therapy. Investigators will carry proper identification to be shown upon request.

(B) Routine inspections include, but are not limited to, checking the display of wall certificates, verifying proper delegation of tasks performed by unlicensed personnel supervised by occupational therapy staff, occupational therapy documentation, and/or medical records relating to an occupational therapy service.

(C) Investigations of complaints shall include search for specific evidence regarding the case. In accordance with division (A) of section 4755.02 of the Revised Code, the section may issue subpoenas to obtain copies of patient records and personnel files of licensees.

(D) All investigations/inspections shall be conducted pursuant to the laws and rules of the state of Ohio.

Hi. I work in a hospital setting. My employer has recently had us start using the "6 clicks" form. They are making this mandatory for us to complete. I have 2 questions regarding this. They are not allowing us to use the ADL version and want us to use the mobility screen form. Are OT's allowed to use the Mobility 6 clicks? Also, do we need to have a hard copy of the screen form completed in the patient's chart OR is simply documenting the RAW score in the electronic evaluation form sufficient? Occupational therapists are not required to have a referral and/or prescription to evaluate, treat and/or discharge clients in the State of Ohio. However, hospital or facility policies, accrediting bodies, and/or reimbursement agencies may be more restrictive than the Ohio Occupational and Physical Therapy Practice Acts. They may have other requirements and guidelines, including requiring a physician’s order to discontinue services, which need to be met for accreditation and/or reimbursement of occupational therapy services. In any situation, licensees should follow the more restrictive policies. The discharge summary would document final discharge date and disposition, as well as the reason for discharge.
