Call to Order Beth Ann Ball, Section Chair, called the meeting to order at 9:43 a.m. The Section began the meeting by reading the vision statement. The Occupational Therapy Section is committed to proactively:

Approval of Minutes Action: Beth Ann Ball moved that the minutes from the July 11, 2017, meeting be approved as submitted. Anissa Siefert seconded the motion. The motion carried. Special Orders Election of Section Chair Action: Mary Beth Lavey nominated Bet Ann Ball to be Section Chair for the period beginning September 14, 2017 and ending immediately following the September 2018 Section meeting. The Nominations were closed. The members present voted to elect Beth Ann Ball as Section Chair. Election of Section Secretary Action: Mary Beth Lavey nominated Anissa Siefert to be Section Secretary for the period beginning September 14, 2017 and ending immediately following the September 2018 Section meeting. Action: Mary Beth Lavey moved that the Section file no change rules for 4755-1-02, 4755-1-03, 4755-3-03, 4755-3-04, 4755-3-06, 4755-3-07, 4755-3-09, 4755-3-10, 4755-3-11, 4755-3-14, and 4755-3-15. Anissa Siefert seconded the motion. The motion carried. Administrative Reports Licensure Report Action: Beth Ann Ball moved that the Occupational Therapy Section ratify, as submitted, the occupational therapist and occupational therapy assistant licenses issued by examination, endorsement, reinstatement, and restoration by the Ohio Occupational Therapy, Physical Therapy, and Athletic Trainers Board from July 11, 2017, 2017, through September 14, 2017, taking into account those licenses subject to discipline, surrender, or non-renewal. Assistant Attorney General’s Report Melissa L. Wilburn, AAG, had no formal report. Enforcement Report Beth Ann Ball reported that the Enforcement Division opened three cases and closed four cases since the July 11, 2017, meeting. There are currently nine cases open. There is one consent agreement and two adjudication orders being monitored. Enforcement Actions: Action: Beth Ann Ball moved that the Section issue a notice of opportunity for a hearing for case number OT FY17-041 for failure to document in an accurate and timely manner. Anissa Siefert seconded the motion. The motion carried. Action: Beth Ann Ball moved that the Section rescind the notice of opportunity for a hearing for case number OT FY17-042 for failure to maintain billing records for multiple patients. Mary Beth Lavey seconded the motion. The motion carried. Correspondence The Section reviewed the correspondence and provided feedback to the Correspondence Liaison. Old Business CE for Volunteering The Section will work with the Assistant Attorney General on draft rule language for continuing education for volunteering. The Section discussed expanding the ability to earn continuing education to other populations. New Business None Open Forum The Section was informed that Ms. Wilburn was reassigned and this will be her last meeting with the Ohio OTPTAT Board. The Section thanked Melissa Wilburn, AAG for her service. Ohio Occupational Therapy Association (OOTA) Report There was no formal report. Strategic Plan The Section reviewed the strategic plan. The Section removed the licensure compact portability from the 2017 schedule. The Section added the Ohio Occupational Therapy Jurisprudence Examination Review to the 2018 schedule. Assistant Attorney General Brief Legal Review Melissa Wilburn, AAG gave the Section guidance on responses to questions regarding the Medicaid School Program. Action: Anissa Siefert moved that the Board go into executive session pursuant to section 121.22(G)(3) of the Ohio Revised Code to discuss legal advice, pending and imminent court action. There was no action taken. Medicaid School Program The Section discussed the amended language for MSP rules. The Section’s formal response to MSP is as follows: “This question represents a billing issue, which is not within the Board’s jurisdiction. Please seek professional advice from an accountant or lawyer to your satisfaction on this issue.” The Section will add this to the standard responses. Discussion on Proposed Laws and Rules The Section reviewed the Five Year Rules. The Section identified rules for no changes. The Section will review the recommended changes at the September 2017 Section meeting. The Section discussed language passed in HB 290 regarding offering continuing education for volunteering. Melissa Wilburn, AAG provided sample rule language for this new requirement. The Section will continue to work on draft language for occupational therapy practitioners. Standard Responses The Section reviewed the standard responses and made the updates where needed. Open Forum The Section reviewed the AOTA SNF document and determined that it is a billing issue and does not need to address by the Board. The Section’s Correspondence Liaisons will be Mary Beth Lavey and Anissa Siefert. OT1 November 2017 Yocheved Kleinerman, OT [email protected] Dear Ms. Kleinerman: This letter is in response to your correspondence regarding whether occupational therapists can perform pelvic floor therapy and if CEU's related to this can be applied to licensure renewal. Pelvic floor therapy would appear to be a specialty practice area for occupational therapists and training emphasizing these skills would be necessary for safe/effective practice. Continuing education credits in this area would seem most appropriate to maintain skills and remain up-to-date with this type of intervention. According to Ohio rules and laws, occupational therapy is defined below, along with information regarding obtaining CEU's on various topics. 4755.04 Definitions. As used in sections 4755.04 to 4755.13 and section 4755.99 of the Revised Code: (A) “Occupational therapy” means the therapeutic use of everyday life activities or occupations with individuals or groups for the purpose of participation in roles and situations in the home, school, workplace, community, and other settings. The practice of occupational therapy includes all of the following: (1) Methods or strategies selected to direct the process of interventions, including, but not limited to, establishment, remediation, or restoration of a skill or ability that has not yet developed or is impaired and compensation, modification, or adaptation of activity or environment to enhance performance; (2) Evaluation of factors affecting activities of daily living, instrumental activities of daily living, education, work, play, leisure, and social participation, including, but not limited to, sensory motor abilities, vision, perception, cognition, psychosocial, and communication and interaction skills; (3) Interventions and procedures to promote or enhance safety and performance in activities of daily living, education, work, play, leisure, and social participation, including, but not limited to, application of physical agent modalities, use of a range of specific therapeutic procedures to enhance performance skills, rehabilitation of driving skills to facilitate community mobility, and management of feeding, eating, and swallowing to enable eating and feeding performance; (4) Consultative services, case management, and education of patients, clients, or other individuals to promote self-management, home management, and community and work reintegration; (5) Designing, fabricating, applying, recommending, and instructing in the use of selected orthotic or prosthetic devices and other equipment which assists the individual to adapt to the individual’s potential or actual impairment; (6) Administration of topical drugs that have been prescribed by a licensed health professional authorized to prescribe drugs, as defined in section 4729.01 of the Revised Code. (B) Acceptable continuing education activities may include: (1) Attending professional workshops, seminars, and/or conferences. There is no limit of contact hours in this category. (a) Credit is obtained by attending presentations that have either been sponsored or approved by the occupational therapy section, the American occupational therapy association (AOTA), the Ohio occupational therapy association, offered by an AOTA approved provider, or which meets the following criteria: (i) It contributes directly to professional competency; (ii) It relates directly to the clinical practice, management, or education of occupational therapy practitioners; and (iii) It is conducted by individuals who have demonstrated expertise in the subject matter of the program. (b) Prior approval from the section is not required if paragraphs (B)(1)(a)(i) to (B)(1)(a)(iii) of this rule have been met. The Ohio Occupational Therapy Laws and Rules do not speak specifically to HIPAA requirements. As health care professionals, OT practitioners must abide by HIPAA in regards to protecting a client's privacy with respect to care provided and the medical record. Telephone conversation should be exchanged only if the receiver can be identified as someone who has permission to be involved in the case by using something like a code word as an identifier. Emails should be encrypted to prevent access to protected information via the internet. Information exchange via fax is unpredictable and could result in information exposure as a wrong number could be utilized or someone not authorized to pick up the information may be on the receiving end. The Ohio Occupational Therapy Laws and Rules do not specifically speak to an occupational therapist's ability to perform cupping as part of intervention. Education and skills training in cupping would be necessary for safe and effective use of cupping as an intervention as is with all other modalities used to aid in achieving treatment outcomes. Competence in the modality is of upmost importance, along with the occupational therapist being able to specify an understanding of the rationale behind using such a treatment modality. It is permissible for children to receive OT services in the school system and as an outpatient simultaneously. Children qualify based on test scores to receive therapy services in the school setting according to qualifications set by the State of Ohio. Children would need to be evaluated by the occupational therapist they are receiving services from outside the school setting on an outpatient basis and results of these evaluations would guide plan of care development for outpatient OT treatment. The OT Section cannot speak to billing/scholarships in the above situation as we do not have jurisdiction to provide guidance in this area. Occupational Therapy
Hello, I have a question regarding whether the services we provide at a community-based non-profit called fall within the scope of practice of PT and OT as acknowledged by the Ohio OT, PT, and AT Board. Our organization runs developmental play groups for children, facilitated by therapists. These groups are designed and implemented by therapists with a focus on developmental skills like fine motor coordination, balance, motor planning, social skills, sensory processing, and more. We do not provide evaluations or individualized therapy treatment, but we do modify the group activities to target needs of the children in the group and to accommodate for limitations. We would like to know whether this type of service is recognized by the licensure board for PTs and OTs as a non-traditional or alternative practice setting that still falls within the scope of our practice as therapists. We would like to request written documentation from the board indicating that our services are recognized as falling within our scope of practice that we could keep on hand in order to ensure that our professional liability insurance would cover us. Draft Language for Volunteer CE
4755-9-01 Continuing education.
(A) Pursuant to division (C) of section 4755.06 of the Revised Code, no person shall qualify for licensure renewal as an occupational therapist or occupational therapy assistant unless the licensee has shown to the satisfaction of the occupational therapy section that the licensee has completed twenty contact hours of continuing education activities within the two year renewal cycle.
(B) Acceptable continuing education activities may include:
Serving as a volunteer for indigent and uninsured persons, as defined in division (7) of section 2305.234 of the Revised Code without compensation.
(C) Be credited as one hour of CE for each sixty minutes spent providing services as a volunteer, not to exceed 4 hours of the total biennial CE requirement.
(i) It contributes directly to professional competency; (ii) It relates directly to the clinical practice, management, or education of occupational therapy practitioners;
Proof of service may be verified by completion of a Verification of Participation form which is to be signed by the recipient or his/her Medical Power of Attorney or OT of record
Here is the language that the RN’s have on their website. A: Effective April 6, 2017, HB 290 (131st GA) authorizes the RN to serve as a volunteer for indigent and uninsured persons, without compensation, for up to 8 hours and use this as qualifying CE.
