A N ORDINANCE R E G U L A T I N G T H E JURISDICTION OF MAGISTRATES' COURTS.

W H E R E A S lite jurisdiction of the Magistrates' Courts which is prescribed in the Ottoman Magistrates' Law of 1913׳ lias been amended from time to time by Rules of Court and it is desirable further to define such jurisdiction and to make other amendments in the Magistrates' Law,

B E IT E N A C T E D by the High Commissioner of Palestine, with the advice of the Advisory Council thereof:

Jurisdiction. 1• Magistrates' Courts shall exercise jurisdiction in the cases following:

(a) Offences for which the maximum penalty does not exceed imprisonment for one year or a tine of £E. 100, and offences under the Articles of the Ottoman Penal Code specified in the first part of the Schedule to this Ordinance, provided that a Magistrate maj not for any such offence pass a sentence exceeding one year's im­prisonment or a tine of £E. 100 or both these penalties in cases in which the Law so permits. The Magistrate shall not fry offences under the Press Law, nor under the Articles of the Ottoman Penal Code specified in the second part of the Schedule hereto.

(b) Actions for the recovery of possession of immovable property of any value.

(c) Actions for the partition of immovable property and for Mubaya.

(d) Other civil actions in "which the value of the subject matter, or the amount of the damage claimed does not exceed £E. 100.

(e) Counterclaims to the same value or amount as in ori­ginal actions, provided" that where the counterclaim arises from the same subject matter or circumstances as the original action the Magistrate may try such counterclaim whatever may be the amount claimed in it.

No criminal or civil action or counterclaim which involves a decision as to the ownership of immovable property may be heard by a Magistrate.

Venue. 2. The President of a District Court may change the place of trial in a Civil or Criminal action from the Court of one Ma­gistrate to the Court of another in the same district when it may appear to him expedient so to do, and may order a Magistrate's Court to sit at any place within the district .either generally or for the purpose of a particular action.

3. In criminal cases the accused person shall have the Appeal, right, to appeal .from the decision •of a Magistrate's Court to the District Court if the penalty indicted is a fine exceeding £E. 10 or imprisonment exceeding 15־ days.

The Public Prosecutor shall have the right to appeal from any judgment of a Magistrate's Court in a criminal case.

In actions falling under sub-section •(b) or(c)of Article i an appeal shall lie as of right to the Land Court whatever may be the value of the subject matter.

In other civil actions any parly shall, have a right of appeal to the District Court where the amount or value of the subject matter claimed by him or for which judgment is given against him is not less than £E. 20.

Leave to appeal may be granted by the President of the District Court in any case in which an appeal does not. lie as of right.

4. The decision of the District or Laud Court in any appeal Appeal from from a Magistrate's Court shall be final; but the President of the District Court may, if he considers it proper so to do, grant leave to Court etc. appeal to the Supreme Court on a point of law.

5. Application for leave to appeal against a judgment under Applications Articles 3 or 4 hereof shall be made in writing within 10׳ days of for leave, the delivery of the judgment if in presence or of notification to the applicant if delivered in his absence and shall contain a state­ment of the grounds upon which leave to appeal is'requested, and shall be accompanied by deposit in Court ol the sum o f £ E . l which shall be forfeited if leave to appeal is refused.

(i) If leave to appeal is granted, the deposit shall be applied in payment of the fees of appeal, and any balance not required for tins purpose shall be repaid to the applicant.

(ii) If leave to appeal be granted the ordinary procedure on appeal shall be followed, but no further ground of appeal shall be submitted. Within 10־ days from the date upon which noti­fication of leave to appeal is made to him the applicant shall comply with the provisions of the law relating to appeals as to payment of fees, furnishing security, and.otherwise,.. If the judg­ment was one of imprisonment,"tlie 'President' may. order the release of the appellant on bail.

6. Notwithstanding anything, in the Ottoman Penal Code, r

the Court otherwise orders, shall commence to run from the date at which the condemned person is first confined in virtue of the judgment. ) . •.

Any period durihg which the condemned person is released on bail pending an appeal shall be deducted.

7. Where a charge is preferred against a Government Proceedings official in respect of any act relative to his functions the Magi- against officials, strate before whom complaint is made shall, before taking any proceedings with reference thereto other than issuing a Warrant of arrest and search in urgent cases, lefer the complaint to the Attorney General and shall not proceed .further in the matter except upon his instructions.

Complaints 8. Notwithstanding anything in Art. 58 of the Ottoman by private Magistrates' Law or in any other• provision of the said law the persons. Police may in any cast1 in which they are satisfied that no public

interest will be served by prosecuting a complaint refuse to pro­secute but the complainant may upon such refusal lay the !'com­plaint before the ]Magistrate who shall hear and give judgment upon it accordingly.

Rules. 9. The Chief Justice may from time to time make Mules of Court regulating the practice and procedure to be adopted in the Magistrate's Court and in any appeals from the decision of such Courts.

Partial repeal of Ottoman Magistrates' Law.

The provisions of the Ottoman Magistrates' Law and .10׳of any amendments thereto concerning the jurisdiction of Magis­trates' Court so far as they are inconsistent with the provisions of this Ordinance, are hereby repealed.

Commencement. 11׳. This Ordinance shall come into force on and •from the day to be appointed in that behalf by the High Commissioner and notified by Order published in the Gazette.

Short Title. 12. This Ordinance may be cited as the Magistrates' Courts Jurisdiction Ordinance 1924.

A N ORDINANCE TO PROVIDE FOR T H E P U N I S H M E N T OF CONTEMPT OF COURT.

HE IT E N A C T E D by the High Commissioner of Palestine, with the advice of the Advisory Council thereof:-

If any person wilfully obstructs by any act or threat an officer of any Court in the performance of bis duty; or within or close to the room or place where the Court is sitting wilfully misbehaves in a violent, threatening, or disgraceful manner, to the intimidation of suitors or other's resorting thereto; or

while the Court is sitting makes a noise by way of expressing approval or disapproval of any proceeding or judgment or in any other manner; or

wilfully insults any member of the Court, or any assessor, or any officer of the Court, during his sitting or attendance in Court, or in his going to or returning from Court;

the person• so acting• shall be liable to be immediately apprehended by order of the Court, and to be detained until the rising of the Court, and on enquiry and consideration then and there, and'without further trial, to be punished with a fine of not more than £E. 5 or with imprisonment for not more than one month in the discretion of the Court.

A Minute shah be made and kept of every such case of punishment, recording• the facts of the offence, and the extent of the punishment, and if the* punishment is inflicted by a. District Court or by a Magistrate, a copy of the Minute shall be forthwith sent to the Chief Justice.

Nothing in this Article shall effect the liability of a person committing an offence against the Court ar any of'its officers to be prosecuted under Article 112 or 116 of the Ottoman Penal Code, provided always that a person punished for an offence under this Article shall not be liable to a further prosecution in respect of the same matter; and any such prosecution, if begun, shall be stayed by the District Court in such manner and on such terms as the District Court thinks just.

2. justice or to !)ring into contempt the Court before which such m t o Contempt• proceedings are pending, the Supreme Court may, upon the application^!' any party to such proceedings or of its own motion or on the motion of the Attorney General,' summon such person to appear to show cause why he should not be punished for his contempt by fine or imprisonment, and in default of appearance may proceed against such person by way of attachment, in manner provided in case of disobedience to an order or injunction.

3. A witness who refuses to be examined according to law or to answer such questions as may be lawfully put to him without showing any just ground for such refusal may be com­mitted to prison by the Court summarily for a period not exceeding one month, unless he shall in the meantime and before the close of the proceedings consent to be examined and to answer.

Refusal of a witness to answer questions.

4. The Supreme Court, the District Court and the Land Refusal to obey Court shall have power to enforce by fine or imprisonment p r d e r s 0 1 t h e

obedience to any Order issued by them directing any act to be 0 U 1 ' done, or prohibiting the doing of any act.

No order of fine or imprisonment shall be made unless and until the person in disobedience lias been summoned to appear and has appeared, or has in default of appearance been brought before the Court by a writ of attachment to show cause why such an order should not be made.

In case such person as aforesaid cannot be found within Writ of the jurisdiction of any Court in Palestine, the Court may make Sequestration, such order of fine or imprisonment as may seem just or may order that a writ of sequestration be issued against his property. The said writ shall bind his immovable property from the date of the order• in the same manner, and to the same extent in every respect, as an order' for sequestration in a civil action.

The writ of sequestration shall be directed to two or more persons to be appointed by the Court for' that purpose, who shall

be commanded and empowered to enter upon all the immovable property of the person against whom the writ shall issue, and to collect, take, and gel into their hands not only the rents and profits of his said 'immovable property, but also al ibis goods, chattels, and movable property, and detain and keep the same under sequestration in their hands until lie shall appear before the Court and clear his contempt, or the Court shall make other order to the contrary.

And the Court may order payment out of the proceeds of such sequestration of all charges attending the execution thereof, including such reasonable remuneration to the persons appointed to carry out the same as the Court shall think fit to allow.

In all proceedings against any person for disobedience, the Court, before which such proceedings are taken, shall make such order as to the costs thereby occasioned as to the Court shall seem just.

Appeals. 5 . An appeal shall lie iron) a conviction and sentence for any offence under Articles 1, 2, or 3 of this Ordinance as in the case of other criminal judgments. An appeal from a judgment given under Article 4 shall he to the High Court.

Repeal. 6. Articles 404-408 of the Ottoman Code of Criminal Procedure are hereby repealed.

Citation. 7. This Ordinance may be cited as the Contempt of Court Ordinance, 1924.

A N ORDINANCE TO A M E N D T H E P E N A L T I E S UNDER T H E L A W RELATING TO A N I M A L T A X .

BE IT E N A C T E D by the High Commissioner of Palestine with the advice of the Advisory Council thereof: -

Penalty for Concealment or Removal of Ani­mals prior to Enumeration for Tax Assessment.

1. Any person who, without written permission from a District or a Revenue official, prior to the enumeration of the animals of any area for the purposes of the assessment of the animal tax, removes from that area or conceals the whole or part of his animals, and any person who is accessory to such removal or concealment shall be liable, in addition to the penalties prescribed by the Ottoman Regulation of 20th Djemad 1, 1305, to a fine not exceeding £ F or imprisonment not exceeding 15׳ .one month.

In the case of animals belonging to a tribe or subtribe, the Sheikh of the tribe or subtribe shall be liable to the said penalty.

Citation. 2. This Ordinance may be cited as the Animal Tax Amendment Ordinance 1924׳,

NOTICE. ' EXAMINATION FOR SURVEYORS'

LICENCES. An examination of candidates for Surveyors'

Licences will be held at Ibe Survey Office, ,)alia, during the last week in March, 1924׳.

,Applications for examination should be made in writing to the Director of Surveys at least 3 weeks prior to the examination, and candidates are required to pay the lee prescribed in clause 2 of the Surveyors' Ordinance of June 21<;1׳, before sitting for the examination.

A syllabus of subjects covered by the examina­tion cau be obtained on application to Director of Surveys, Jaffa.

Candidates must provide their own instru­ments and labour for the practical examination.

NOTICE. The Plans and Rules for the development of

the New Quarters of Givat Eliahu and Amos (near the Talpioth Quarter, Jerusalem), which Were approved by the Jerusalem Town-Plainning Commission at its Thirty Sixth Meeting on January 11th, 1924, are deposited at the Office of the Secretary of the Commission, (The (!over-norate, Room No. 8, 1st Floor) in accordance with Section 13׳ (a) of the Town - Planning Ordinance, 1921, and are open to inspection daily, except Saturdays, between the hours of 9 A . M . and noon.

Any objection to the Plans o r Rules should be made in writing at once to the Secretary of the Jerusalem Town - Planning Commission, before the approval o f the Central Towa-Planning Commission is obtained.

NOTICE. Notice is hereby given that licences to prac­

tise as described hereunder have been notified as lost and that they should at once be returned to the Director of Health in the event of their com­ing into the possession of any persons other than the persons to whom they were respectively issued.
