This Memorandum of Agreement, made and entered into by and between:

The SANTA ROSA MANPOWER TRAINING CENTER, a Tech-voch institution duly organized and existing under the laws of the Philippines, with office address at LM Subdivision Community Compound, Brgy. Market Area, City of Santa Rosa, Laguna, Philippines, represented herein by the City Mayor, Hon. ARLENE B. ARCILLAS, hereinafter referred to as the SCHOOL~ ____ ________ _ ___ .. _____ _ _____ ___ ___ ___ _____________ -

LAGUNA AUTO PARTS MANUFACTURING CORPORATION (LAMCOR), a corporation duly organized and existing under and by virtue of the laws of the Philippines, with principal address at 102 South Science Avenue, Laguna Technopark, Bo. Don Jose, City of Santa Rosa, Laguna represented herein by its Vice President - Administration, Mr. VALENTINO G. AGNO hereinafter referred to as the COMP ANY.

WITNESSETH that:

WHEREAS, the SCHOOL endeavors to establish with the COMP ANY an In- plant training of its students for their practicum exposure in the industry as part of their curriculum for the completion of their technical education program;

WHEREAS, the COMP ANY agrees to assist the SCHOOL in the implementation of the In-Plant Training Program as part of its effort to upgrade the skill and work knowledge of

future employees.

WHEREAS, the City Mayor of Santa Rosa, by virtue of Sangguniang Panlungsod Resolution Number ___ series is given authority to enter into this Memorandum of Agreement with the Laguna Auto Parts Manufacturing Corporation (LAMCOR);

NOW, THEREFORE, for and in consideration of the foregoing premises and of the mutual covenants herein set forth, the parties hereby agree and stipulates the following terms

and conditions:

A. The SCHOOL shall:

1. Select, identify, recorrunend and endorse student-trainees who will undergo the In-Plant Training which will be for a period of five (5) months.

2. Conduct pre-departure orientation/seminar to students (and preferably to their parents/guardians) who intend to undergo the In-Plant Training Program in the

COMPANY.

3. Provide the basic orientation on work values, behavior and discipline to properly prepare the student-trainees for their In Plant Training.

4. Assign/designate an In-Plant Training/Program Coordinator who will be responsible for:

4.1 monitoring the training progress of student-trainees;

5. Voluntarily withdraw any student-trainee who is found to have violated or in defiance of the rules and regulations of the company, and to impose the appropriate sanctions;

6. B. The COMP ANY shall:

l_ Accommodate for the In-Plant Training Program the students-trainees from the SCHOOL, who have satisfactorily passed the screening procedure conducted by the COMPANY and upon completion/submission of the student-trainee requirements and the required medical examinations.

2. Provide monetary and non-monetary benefits to the student-trainees as follows:

2.2 Additional cash allowance of P19.13/day which represents the 75% of the CTPA (Conditional Temporary Productivity Allowance) and SEA (Socio-Economic Allowance);

2.3 Meal Subsidy of P15.00 per worked day;

2.4 Free Uniform (5 T-shirts for 5 months train ing, free working shoes);

2.5 Free use of shuttle service from Balibago to Lamcor and Vice-Versa according to shuttle schedule; .

2.6 Free Group Personal Accident Insurance coverage (max limit of Pl0,000 medical reimbursement and P25,000 death assistance);

2.7 Payment of allowance with premium for training rendered beyond the usual

working time and day.

3. Issue Certificate of Completion to students-trainees who have completed their In-Plant

Training.

4. As it may be deemed necessary, provide the SCHOOL with relevant information of students-trainees performance evaluation/rating, disciplinary actions and other student­

trainees records.

C. This Memorandum of Agreement shall likewise include the following terms and conditions:

1. It is expressly understood that there will be no employer-employee relationship between the COMPANY and the student-trainees of the SCHOOL. They shall be deployed to the COMP ANY as part of their school curriculum on In-Plant Training;

2. The student-trainees, Program Coordinator and the SCHOOL, shall abide with the existing rules and regulations of the COMP ANY, and other rules which maybe introduced upon prior notice.

3. Both the SCHOOL and the COMPANY shall endeavor to improve the In-Plant Training Program, through consultation and regular dialogue.

4. Both the SCHOOL and the COMP ANY have the right to discontinue this In-Plant Training Program on reasonable grounds upon written notice to the other party concerned.

5. This Agreement maybe amended, modified or altered by mutual consent of both parties.

D. EFFECTMTY:

This Agreement shall take effect upon the date of signing thereof by both parties and shall continue to be in full force and effect until terminated. This agreement maybe terminated by either parties by serving a written notice to the other party at least 30 days prior to its termination.
