REPORT WRITING - Reports must be ascomprehensive as possible so that a person withoutprevious knowledge of the incident can completelyunderstand it. All report narratives must be written in thefirst person and should be typed. When writing reportnarratives, the employee must type in lowercase letters,capitalizing only when necessary. The report must betyped using single line-spacing only, however one spacemay be left between paragraphs.

Exception: When it is not possible to type, print inuppercase letters, using black ballpoint pen or No. 2pencil.

* Use simple sentences;• Leave a one-line separation between paragraphs;* Report all relevant facts concisely in chronological

order;* Support any opinions with evidence;* Double check all numbers, incl. INC Nos., DR Nos.,and page Nos. on each page of the report as required;and,

* Obtain all required signatures.

REPORT NARRATIVES. The narrative portionfor all types of investigations must bedocumented within each of the report headingcategories as appropriate and in the order aslisted below. Ail headings must be typed orwritten in uppercase block letters andunderlined. If no pertinent information exists fora particular heading, document the reason (i.e.,"None visible"). All reporting narratives must bewritten in the first person.

Exceptions: Certain headings may be omittedif not applicable to the type of investigation beingdocumented. If the report qualifies as a Short-Form investigation, no headings or narrative arerequired with the exception of a detailed list ofproperty stolen, lost, recovered, or damagedusing the columns provided.

Note: The information included under eachheading is not all-inclusive. Any information,which would further clarify or detail thecircumstances surrounding the case, may beadded. Except for the purpose of clarity,information already contained in other areas ofthe report does not need to be duplicated or re-stated.

When documenting the statement of an officer'sinvestigative actions (see Investigative Action Statements), it is not necessary to re-writeeverything contained within the statement. Anyinformation elemental to the crime and/or arrestmust be briefly paraphrased with a reference indicating the statement in which the detailed information can be found.

Example - Officer Smith observed the handgun in the suspect's waistband. (Seestatement of Ofcr Smith, page 3.)

Officers are reminded that, at the time of arrest. arresting officers must have specific knowledge gf all elements of the crime for which thesuspect has been arrested. Officers should beable to articulate that knowledge, including howand when it was obtained, and must document itwithin the report narrative.

A. Additional Person(s) Involved.[Heading may be omitted if not applicable.]Ensure all other persons other than thevictim and suspect involved in the incidentare documented, including but not limited towitnesses and parents (if a juvenile isinvolved).

B. Source of Activity.[This heading must be included.]Ensure all pertinent information is includedand accurate, including, but not limited to,the officer's unit assignment, name(s) andserial number(s), the type of call (i.e., radiocall, citizen flag-down, officer observation,desk report), and the complete ten-digitincident number.

C. Investigation.[This heading must be included.]All elements of the crime or incident must bethoroughly described. Include all observations,clearly articulating the actions, demeanor, and/orbehavior and statements of all involvedparticipants. Circumstances regarding search andseizure must be clearly articulated. Theinvestigation section must be used to build the factpattern and document the investigating officer'sspecific training and experience in support of anydeterminations made and actions taken by theofficer(s). Ensure the elements of probable causedescribed in this section are consistent with theelements described within the "Statement ofProbable Cause" section of the Probable CauseDetermination (PCD), if applicable.

D. E. Injury/Medical Treatment.[This heading must be included.]Document any pre-existing injuries, injuriessustained during the incident, and any injuriessustained resulting from an arrest or use of force.Document any lack of injuries if reporting a "CrimeAgainst Person" and/or use of force. Document thelocation of treatment and treatment provided.Include the name of the doctor and the medicalrecord number. If medical information releaseforms are signed, document the information underthis heading and attach a copy to the report. If thearrestee refuses to sign a medical informationrelease form, document the refusal and the namesof any medical personnel who witnessed therefusal.

Due to confidentiality issues, when someone isgiven medical treatment for a specific medicalillness (AIDS, high blood pressure, tuberculosis,etc.), not related to the arrest/crime, the illnessmust not be documented in the report unless it isan element of the crime (i.e., 647f P.C., 120291H&S).

Note: Injuries include those that are visible and"complained of," even though not visible. If noinjuries or complaints of injuries, write "None," or"No Injuries Complained Of."

F. Photos, Recordings, Videos, DICV, BWV, andDigital Imaging[This heading must be included.]Document any photos, recordings, videos, DICV,BVVV, and digital imaging taken of the scene,search warrant locations, and injuries (visible,complained of, or lack of). Document the type(Polaroid, digital, 35mm) and number of photos,recordings, videos, DICV, BWV, and digital imagingtaken, or the number of 35mm rolls of film used, theSID request number, and the name of theemployee who took the photos, recordings, videos,DICV, BVVV, and digital imaging. If no photos,recordings, videos, DICV, BWV, and digital imagingwere taken, indicate the reason.

G. Booking.[Heading may be omitted if not applicable.]Document the location where the arrestee wasbooked, the related booking charge (title andappropriate Code section), as well as the name andserial number of the watch commander whoapproved the booking. Include all pertinentinformation from events that occurred at the stationduring the booking process before the jaileraccepted the arrestee. If the arrestee wasdebriefed, document who conducted the debriefingand where the information was documented, if notwithin the body of the narrative.

H. Evidence.[This heading must be included.]Fully describe the chain of custody of any evidencerecovered, the location where the evidence wasbooked, and how it was marked. Each item shouldbe numbered and correspond with items listed inthe related Property Report, Form 10.01.00.Generally, the associated Property Report shouldonly be a listing of the above evidence which is tobe booked. Ensure a Receipt for Property Takeninto Custody, Form 10.10.00, is completed andprovided to the appropriate party, and theappropriate check box is marked on the face sheetof the report.

STATEMENTS.

A. Investigative Action Statements. When completinga statement of the officer's investigative actions, the officer must complete only the shaded areas and the statement section of the InvestigativeAction/Statement Form, Form 03.11.20. Theofficer's statement must be a detailed description ofthe officer's actions and observations including the source of the call, the officer's individualobservations, and the officer's individual actions. Ifadditional space is needed, a Continuation Sheet,Form 15.09.00, must be used.

B. Statements of Involved Persons. There is norequirement that the Investigative Action/StatementForm, Form 03.11.20, be utilized in everyinvestigation for documenting the statements ofinvolved persons, except murder investigations, orwhen the signature of the person interviewed isbeing sought.

Should the suspect make spontaneous statements,the statements must be included under theappropriate heading within the narrative portion ofthe report.

If the suspect has been advised of his/her MirandaRights, per LAPD Form 15.03.00, Field Officer'sNotebook, the Miranda Admonition and anyresponse to the Admonition must be documented inany resulting report (Manual Section 4/202.10).

If only minimal information is sought, the MirandaAdmonition (verbatim) and resulting statements maybe documented in the narrative. If, however, a moredetailed statement is sought, the InvestigativeAction/Statement Form should be utilized todocument the statements obtained. Onlystatements not included on the InvestigativeAction/Statement Form need to be documentedwithin the narrative portion of the report.

Note: When a suspect is arrested and a statementis obtained, the page number where the statement isrecorded must be noted on the arrest face sheet inthe space provided.

If the signature of the individual providing thestatement is sought, the statement should be writtenin the first person. If no signature is sought, thestatement should be written in the third person. Inall cases, the interviewing officer must beresponsible for documenting the statement(s) of theindividual being interviewed.

The original completed Investigative Action/Statement Form must be included as a page of theoriginal report.

Exception: Debriefing of suspects for intelligencepurposes (not related to the investigation) must be

documented on a separate Investigative Action/Statement Form. The debriefing statement must beforwarded to the Area Detectives and must not beincluded as a page of the original report.

Note: The Investigative Action/Statement Form isnot always appropriate and its use should bedetermined on a case-by-case basis by theinvestigating officer and/or supervisor.

Refer to Department Manual Section 5/03.11.20 forfurther information regarding the use of statements.

REPORTS REQUIRED. A crime report must becompleted when it is brought to police attention that,within the City of LA, a felony has been or is believed tohave been committed, or a misdemeanor has beencommitted. This includes when an officer acting as adecoy is the victim of a crime or a vehicle or otherproperty is used as "bait".

Exception: a crime report is not required when:* No victim is indicated; or,* Arson is suspected and the Fire Department assumes

responsibility for the immediate investigation.

Note: The Combined Report Section on the ArrestReport, Form 05.02.00, may be used in lieu of aseparate IR as per instructions on the Arrest ReportField Notebook Divider.

COURTESY REPORTS. Courtesy reports must only betaken when the following conditions exist:* The Person Reporting is an LA City resident; and,* Exigent circumstances exist (e.g., there is an active

mutual aid task force in operation; travel distance tothe concerned jurisdiction is extreme); and,

* The concerned jurisdiction does not complete atelephonic report; and,

* Prior approval is obtained from a supervisor or adetective.

Note: Courtesy reports must not be taken telephonically.

TELEPHONIC REPORTING. The following crimes maybe reported telephonically when no unusualcircumstances exist which require a field investigation:* Stolen vehicle when the Person Reporting (PR) is the

Registered Owner or lessee, and the reporting officerhas verified registration, ownership, and ID of PRthrough DMV files.

Note: Stolen vehicle reports must not be takentelephonically for rented vehicles.

* B/TFV or Plain Theft, when property is less than$3,000 and PR is the owner.

* Grand Theft-Pickpocket, when suspect is not at thescene, there is no possibility of locating the suspect bya limited follow-up investigation by field personnel,AND the property is less than $3,000.

* Battery, when not likely to recur and no immediate MTrequired.

* Lewd/Annoying Phone Call, when PR is in noimmediate danger.

* Any misdemeanor reportable on an IR when theoffense is not directly related to a labor dispute andhas no racial, ethnic, or religious connections.

* Stolen Bicycle, when bike report is the only reportrequired.

Note: A PR who requests a receipt must be advisedthat a Victim's Report Memo may be obtained at thestation where the report was taken.

REPORT UNITS. Report Units must be requested whenpractical for report calls at contract hospitals, and forADW or 211 report calls after determination that a reportonly is required and a Report Unit is available. Theassigned Radio Unit must cause any required initialbroadcast to be made.

Radio Units must not request a Report Unit if thesuspect is apprehended, or the 211 victim is a bank, or itis impractical for the victim to remain at the scene.

SUBMITTING REPORTS FOR APPROVAL. Robbery,kidnap, and rape reports must be delivered without delayto the approving supervisor. An officer completing avehicle report must immediately obtain a DR and mustsubmit the report for approval at EOW or at the nextroutine trip to the station. Other reports will be submittedto a supervisor for approval as soon as practicable.

Note: Officers shall obtain a Division of Records (DR)number within two hours of determining that aMissing/Found Persons Investigation Report will becompleted for any missing person (e.g., juvenile oradult).

CONDUCTING THE INVESTIGATION. After initialdeployment procedures, officers should work as partnersduring initial investigations and compare notes to besure that all the facts have been gathered.* Notify the investigating unit without delay if there is aneed for an immediate major crime investigation.Start a Crime Scene Log if appropriate;

* Protect the scene (e.g., Banner tape) - locate itemsthat could ID suspects or show how the crime wascommitted;

* Locate and identify witnesses, request them to remainfor questioning, and question them separately;

* Establish the elements of the crime and other detailsrelating to who, what, when, where, why, and how;and,

* Complete the necessary reports.

If an investigative or specialized unit takes over atthe scene, the unit thus relieved must then:* Give the investigating unit all pertinent evidence & info;* Prepare an Investigative Action/Statement Form andprovide it to the primary unit, if required;

* Assist where necessary or requested;

* Assist preparing appropriate reports for continuity ofevidence or to assure complete and accuratereporting;

* Make DFAR entries relating to disposition of call and IDof investigating unit relieving them; and,

* Return to their prior assignment when no furtherassistance is required.

Note: If the area has not been canvassed andconcerned investigating officers or specialized unitsrespond to the scene and take responsibility forconducting the preliminary investigation then they will beresponsible for canvassing the area.

ID OF SUSPECTS IN FIELD. If field ID of a suspect isnecessary to determine if the suspect is the perpetrator,the victim or witness should be transported to thesuspect. A suspect may be transported to a victim orwitness for ID when:* Exigent circumstances exist that make it unreasonable

for the victim or witness to be transported to thesuspect; or,

* Probable cause exists to arrest the suspect for theoffense; or,

* The officer obtains the free & voluntary consent ofsuspect.

An officer who intends to conduct a field show-up mustinform the victim or witness that:* The person is in temporary custody as a possiblesuspect only;The fact the person is in police custody does notindicate his/her guilt or innocence; and,

* The purpose of the show-up is to either eliminate oridentify the person as the perpetrator.

The above admonition must be included in the arrestreport under the "Investigation" heading.

OUTSIDE AGENCIES RESPONSIBILITY. LAUSD, PortWarden, and the Los Angeles County Sheriff'sDepartment (LASD) normally conduct the initialinvestigation of crimes occurring on their property,except complex felonies, crimes of violence involvinguse of a weapon, or property loss in excess of $1,000($10,000 if Port Warden). INTERVIEWS.Student under 18 on school grounds - requestdetective. If none available and immediate investigationis necessary, explain the reason to the principal or viceprincipal and request permission to question the studentat school or to take student from school for the purposeof questioning or arrest.

Female under 18 on sex matter - should be conductedby female police officer when practicable.

INCIDENT NUMBERS. Enter the incident number in theupper right-hand corner of the IR. If multiple incidentnumbers have been created for the same call, enter theprimary incident number to which all reports can be tied.

DR NUMBERS. When a report of any type has beenassigned a DR and other reports of related incidents aremade, they must bear the DR of the original report.

Exceptions: Each worthless document, each stolenvehicle, each license plate booked, and each missingperson require separate DR numbers. Each burglaryrequires a separate DR (See Burglary Paragraph forexceptions). Each Vice or Narcotics Investigationrequires a separate Vice or Narcotics DR; only a relatedVice or Narcotics follow-up must bear that DR. Only arelated Missing Person FU, Arrest, or Property Reportmust bear the Missing Person DR.

DUE DILIGENCE. Prior to booking, the arresting officer shall verifywhether the arrestee has an arrest warrant. (Exception: Jail personnel areresponsible for those booked at a field jail or those transported & bookedplain drunk.)

SHORT ARREST REPORT, Form 05.02.01. Used for 647f PC arrestswhen prosecution is not requested. and enroute bookings. (Refer toreport booklet cover for further info.)

RELEASE FROM CUSTODY (RFC), Form 05.02.08/NOTICE TOAPPEAR, Form 95.02.02. Used as Notice to Appear in Court ter adultarrestees (misdemeanor or infractions) released OR in lieu of booking orafter; and used in conjunction with the RFC Continuation, Form 05.02.08,to document the circumstances of the arrest and release, and to reportbooking of related evidence. (Refer to RFC/Notice booklet cover andinstructions printed on RFC Continuation form for further info.)

ARREST REPORT, Form 05.02.00. Used to report circumstances of allarrests or detentions of persons by the Department except:

• Court Order detentions.• Supplement charge by parole/probation officer.• Bond surrenders.• Those reported on a Short Arrest Report, Mass Arrest Report, RFC,

or Personal Service Citation.• Felony Warrants (unless required by 4/725.48).• Search Warrants (unless required by 4/725.48).• Misdemeanor Warrants (unless required by 4/725.48).• CHP responsibility.

The Arrest Report is also used as:

• A contact only report on juveniles.• A first page of a petition request.• A combined crime report.• A combined evidence report.• Marsy's Rights Card. When a victim of any type of crime has been

provided a Marsy's Rights Card, the reporting officer, supervisor, ordetective shall check this face sheet box or document it in the"Additional" heading of the Arrest Report.

COMPLETION INSTRUCTIONS — GENERAL.

A. The Arrest Report shall show sufficient facts to establish a primafacie case for the offense charged and include all facts pertaining toany additional offenses committed by the arrestee.

13 LOCATION TO COMPLETE REPORT

• All misdemeanors, narcotic and felony vice arrest reports — inthe Area where arrestee is booked (Except: fel. Narc. in Pae orWLA, & misdemeanor 148/415 w/ofcr victim — in Area ofarrest.)

• All felonies except narcotics and vice — in area of bookingapproval. (Except forgeries in OVB — at VNYS Area.)

Exception: County Jail system bookings for misdemeanors, &felonies are investigated by the local Area detectives.

C. RESPONSIBILITY TO DELIVER REPORT. Officers shall deliverArrest Reports as follows.

• When not completed in the Area of responsible investigativeunit — to that unit, when practical; or cause CPS or NECSnotification.

• When narcotics involved outside Area of assignment — to theirField Enforcement Section, Bureau Narcotic's Unit.

• All officers in Area Record Unit — to their Collision InvestigationFollow-up Unit (CIFU).

COMPLETION INSTRUCTIONS — SPECIFIC.

A. EVID/CRIME RPT. CHECKBOXES. appropriate box(es) if theArrest Report also serves as a Combined Arrest/Evidence 8/orCrime Report (refer to paragraphs F & G).

B. DR NUMBER — when applicable (Combine Evidence, CombinedCrime, or related DR). Enter this DR No. in both spaces (top rightand vertically top left).

Approving supervisors must ensure that the arresting officer hasprinted out the criminal history, or "rap sheet," and placed the LANo., if available, on the Arrest Report.

D. ADMONITION OF RIGHTS. Advise all juveniles upon taking intocustody and ascertain if they understand their rights. Do not seek.waiver until the juvenile is to be interrogated. Field officers arerequired to "Mirandize" and interrogate adult felony arrestees,except if crime involved is homicide, crime vs. person victimhospitalized, responsibility of specialized unit, a conflict case (suchas battery on police officer), or a crime which requires extensivefollow-up or expertise. If not admonished, enter "NOT ADVISED."

E. INVOLVED PERSONS.

Repeat complete victim information (name, etc.), if CombinedCrime Report. Always enter sex, descent, and DOB of victimand witnesses. If misdemeanor, analyzed evidence other thannarcotics is involved, enter as a witness: 'Police ChemistAnalysis of ' (enter appropriate item; e.g.,clothing).If witness will be unavailable for some period within fourmonths of the report date, enter the reason and dates in thewitness's stetement.

• If misdemeanor witness resides outside LA County, enter allfacts to which they can testify in the report.

• If LAFD ambulance personnel are witnesses, enter their fullnames, unit, & what they can testify to In the report.

• Enter 'X' in last column to indicate day phone contact.

F. COMBINED CRIME REPORT. This section may be used in lieu ofa Investigative Report (IR) when all suspects identified as theperpetrators are in custody, all property is recovered, only one crimeis involved, and the W/C or investigating officer advising the bookingapproves. (If multiple victims of crime vs. person, use IR, becauseeach victim counts as separate crime.)

When used as crime report, the reporting officer shall:

• Check the "Crime Report" box and enter victim's name underthis box vertically;

• Enter the DR number in BOTH spaces;• Enter complete victim information under "Involved Persons,"

including a repeat of V-1's name. If multiple victims andspaces are insufficient, continue at beginning of narrative; and.include the elements of the crime in the appropriate paragraphof the arrest narrative.

Note: If multiple arrestees. check the 'Crime Report' box andcomplete the 'Combined Crime Report' section on ONE face sheetonly. Use the face sheet of the arrestee most likely to be filed on,when appropriate.

G. COMBINED EVIDENCE REPORT. (Exceptions to using thisprocedure at all are listed on the reverse side of the Property Report.)When this procedure may be used, there aro two ways in whichcombined arrest/evidence is reported:

1. Directly on the face of the Arrest Report with no PropertyReport (limited to one arrestee, no gun, and two items ofevidence). In this instance:• Check the 'Evidence Report' checkbox:• Enter the DR number in BOTH spaces;• Complete the 'Combined Evidence Report' section;• Enter evidence details in arrest narrative: and• Forward copy of arrest face sheet with the evidence

(2 copies to narcotics, or if blood or urine is bookedwithin OVB.)

2. With a Property Report. In this instance.

• Check the 'Evidence Report' checkbox on the ArrestReport;

• Enter the DR number in BOTH spaces on the ArrestReport;

• Enter the notation 'SEE PAGE ' in large letters inthe 'Combined Evidence Report' section.

Note: If multiple arrestees, complete the above three steps onall face sheets, and enter the name of the arrestee to whomthe evidence is booked directly under the 'Evidence Report'checkbox on all arrest face sheets.C. OTHER IDENTIFYING NUMBERS. These numbers are to be

entered on the Booking Form when available at the time of booking.

• Number the Property Report as a page of the ArrestReport; e.g., Page 3 of 3. (Make this the last pageunless there is a Juvenile Arrest Supplemental Report.Form 05.02.06. In that case, make that the last page.);and,Forward a copy of the Property Report, stapled on thetop of the arrest face sheet, with the evidence (2 copiesif narcotics or firearm, or blood or urine is booked withinOVB.).

H. APPROVAL/REPORTING OFFICERS. Reporting Officers: Printfirst, middle initial, and last names in space provided. Whenpractical, one officer shail complete all phases if a misdemeanorarrest. The names, serial numbers, and assignment of officersassisting but not needed for testimony shall appear under the'Additional' heading. On a private person's arrest, the arrestingperson's name shall be entered followed by (CZN). The captionReporting Officer(s) shall be crossed out,

If evidence is booked by an officer as part of a private person'sarrest, and that evidence is listed on the arrest face sheet CombinedEvidence Report section, the name, serial number, division anddetail of the officer shall be entered on the second line of ReportingOfficer(s).

I. NARRATIVE. On a Continuation Sheet, Form 15.09.00. See FieldNotebook Divider General Reporting Instructions. Form 18.30.00, formore detailed information.

• Investigation. Describe every relevant event the arrestingofficers saw or did between the time the activity started andthe time of arrest. If probable cause is net included underSource of Activity, it shall be included here.

• Arrest. Describe everything pertinent that occurred from thetime the arrest was made to the booking process. Theseactivities could be at the scene, at another location, or at thestation.Note: Refer to adults as 'Suspect' until arrested, then as'Arrestee.' Juveniles are always 'Subjects' (In crime reports,both adults and juveniles are 'Suspects.' whether or not theyhave been apprehended).

• Injury/Medlcal Treatment. Enter general description of theinjuries that occurred during the crime or as a result of thearrest. In this specific injury paragraph, enter the technicaldetails of the diagnosis and medical treatment.

• Photos, Recordings, Videos, DICV, BWV and DigitalImaging. Document any photos, recordings, videos, DICV,BWV and digital imaging taken of the scene, search warrantlocations, and injuries (visible, complained of, or lack of).Document the type (Polaroid, digital, 35mm) and number ofphotos, recordings, videos, DICV, BWV and digital imagingtaken, or the number of 35mm rolls of film used, the SIDcontrol number, and the name of the employee who took thephotos, recordings, videos, DICV, BWV and digital imaging. Ifno photos, recordings, videos, DICV, BWV arid digital Imagingwere taken, indicate the reason.Booking. Describe everything pertinent that occurred at thestation before the jailer accepted the arresteeNote: The arrestee is the personal responsibility of thearresting officer until the booking is complete and the jailer hasaccepted the prisoner. Also include under this heading the

supervisor approving the booking (rank, name, serial number,and assignment), location booked and charge.

• Evidence. Fully describe the chain of custody of anyevidence recovered, the location where the evidence wasbooked, and how it was marked. Each item should benumbered and correspond with items listed in the relatedProperty Report, Form 10.01.00.

• Canvassing. Document the efforts to canvass the area forwitnesses when applicable.

• Court Information. List the names of all officers involved inthe investigation, the specific portions of the investigation eachofficer can testify to, any specialized expertise, the officer'sdivision of assignment, and the officer's vacation period.

THE ABOVE HEADINGS ARE ALWAYS USED. THE BELOW SPECIFICHEADINGS ARE ONLY USED WHEN APPLICABLE. SEE FIELDNOTEBOOK DIVIDER 18.30.00 FOR SPECIFIC INSTRUCTIONS.

• Additional. Details which need explanation but do not fitsmoothly under the other headings: e.g., disposition ofarrestee's personal properly, opinions of arresting officers thatmight be of importance to follow-up investigators, particularlyin vice, narcotics, arid bunco cases, reason arid names usedfor inquiry if no rap sheet attached; etc.

• Collision Summary. If a Traffic Collision Report (CHP 555)has been completed, the information documented within thissection shall be written exactly as it appears in the "CollisionSummary" section of the Traffic Collision Report.Property Stolen/Lost/Recovered. Document any propertystolen, lost, recovered or damaged as a result of the incidentthat you are reporting.

J. MULTIPLE ARREST REPORT. One narrative may be used toreport the arrests of multiple persons (except 547bPC) made at thesame approximate time and location when the circumstances arethe same. A separate face sheet shall be made for each arresteeand a copy of the narrative attached to each face sheet.In each left margin, print 'MULTI '. (Enter no. of arrestees.)

K. PRIVATE PERSON'S ARREST. When a private person's arrest is,or appears to be, illegal, the arresting person shall be advised andreferred to City Attorney's (CA's) Office. When the private personinsists upon arresting the individual, the officer shall not take theperson into custody, complete an FI, notify a supervisor of thecircumstances, and with approval of a supervisor, release thearrested person. The officer shall then complete a Employee'sReport, Form 15.07 00, detailing the circumstances of the arrest andrelease.

A private person desiring to make a lawful arrest for a misdemeanornot committed in the officer's presence, shall be advised that he/shemay make a physical arrest or make a crime report and proceedthrough the CA's Office. If he/she requests the officer to receive thearrestee, the officer shall do so (142PC). All persons involved shallbe advised that the officers are not making an arrest merelyreceiving the arrested person. Officers shell verify the ID of thearrested person and determine the arrestee's eligibility for RFC. Ifeligible for RFC, follow those procedures. If ineligible for RFC, theofficer shall:

• Request the private party to accompany officers to station;• Assist private party with Arrest Report. Officers' names are to

appear only in narrative as 'Transporting' or 'Receiving,' or onthe Arrest face sheet as the officer booking the evidence if it islisted on the Arrest face sheet [the 2"' line of ReportingOfficer(s) is used for this purpose);

• Cause the private person to write 'I have arrested this person'at the bottom of the arrest narrative, followed by the privateperson's signature (full name), address and phone number;

• If arrestee has signed a statement of guilt of theft, forward acopy of it and all other arrest related written documents in thepossession of the arresting person, with the Arrest Report tothe CA's Office. Forward original copies when possible;

• Book arrestee to the private person. Cross out ReportingOfficer(s), enter the private person's name, and enter CZN asthe Detail; and

• Complete other necessary reports.

Note: The arresting private person need not accompany officers tothe station when:

• The arrest is for petty theft or misdemeanor forgery;• The crime occurred at a regularly established place of

business;• All the elements of the offense are present and there appears

to be probable cause for the arrest; and,• Telephonic approval of the WIC has been obtained.

L. WARRANT ARRESTS. Misdemeanor warrant arrests shall bereported on an Arrest or RFC only if required in Department ManualSection 4/725.48. The teletype abstract shall be included.

Note: The arresting officer is responsible for completing theRelease Information section of the Investigator's Final Report, Form05.10.00, if felony warrants is for violation of California State paroleunder authority of 3056 PC or 3151 WIC; Violation of probationbench warrant held by LASD; or Failure to Appear bench warrantheld by LASD. Upon completion, the 05.10.00 shall be delivered tothe record clerk, Area of Booking.

FELONY WARRANT ARRESTS INVOLVING ADULTS. For felonywarrant arrests, including parole/probation warrants, officers shallsubmit the following to the watch commander (WC) or his/herdesignee:

• Arrest Report "Face Sheet," Form 05.02.00:Note: The "Approval/Reporting Officer" section must still becompleted. including the "Supervisor Approving Report" box.

• Investigator's Final Report, Form 05,10.00;Note: Officers must still comply with procedures for theCompletion of the Investigator's Final Report outlined inDepartment Manual Section 4/775.20.

• Copy of the Warrant Information Sheet (MS) or abstract forwarrants issued within California; and,

• Booking Approval, Form 12.31.00.

Note: Parole/probation holds are different fromParole/probation warrants. Parolees at Large (PALs) areconsidered parole warrant suspects. Parole and probationholds require an arrest narrative.

JUVENILE WARRANT ARRESTS. For warrant arrests involvingjuveniles, officers must submit the following:.

• Arrest Report "Face Sheet," Form 05.02.00;• Investigator's Final Report, Form 05.10.00;• Copy of the Warrant Information Sheet (WIS) or abstract for

warrants issued within California; and,• Juvenile Arrest Supplemental Report, Form 05.02.06.

Note: Officers must document the circumstances under whichthey came into contact with the juvenile on the Juvenile ArrestSupplemental Report.

• Disposition of Arrest and Court Action, Form 05.09.00.

1551.1 PC FUGITIVE ARRESTS. For 1551.1 PC Fugitive arrests,officers shall submit the following to the WC or his/her designee:

• Arrest Report "Face Sheer;• Disposition of Arrest and Court Action, Form 05.09.00;• Investigator's Final Report;• Probable Cause Determination (PCD), Form CRIM 084;• National Crime Information Center (NCIC) printout; and,• Booking Approval.

PAROLE HOLDS. For parole holds, officers shall submit thefollowing to the WC or his/her designee:

• Arrest Report "Face Sheer;• Investigator's Final Report;• Arrest narrative;• PCD Form;• Copy of parole hold authorization from the California

Department of Corrections and Rehabilitation; and,• Booking Approval.

PROBATION HOLDS. For probation holds, officers shall submit thefollowing to the WC or his/her designee:

• Arrest Report "Face Sheer;• Investigator's Final Report;• Arrest narrative;• PCD Form;• Copy of probation hold authorization from the Los Angeles

County Probation Department; and,• Booking Approval.

Note: The Consolidated Criminal History Reporting System(CCHRS) printout, Criminal Identification and Information (CII)printout, Department of Motor Vehicles (DMV) history, and CityAttorney's Disclosure Statement are not required for felony warrantarrests, 1551.1 PC fugitive arrests, parole holds or probation holds.

EXCEPTIONS. An arrest narrative shall be completed under thefollowing circumstances:

• Arrests involving a use of force;• Evidence recovered as a result of the arrest;• If arrestee receives injuries which could be attributed to the

officers;• Aggravated or unusual circumstances; and,• At the direction of the watch commander.

M. ARMED FORCES PERSONNEL. Print MILITARY on top leftmargin, and include in narrative the arrestee's rank, serial number,branch of service, unit and its location, dress (uniform or plainclothes), and duty status.

JUVENILE ARREST SUPPLEMENTAL REPORT, Form 05.02.06.Complete this form on all juvenile arrests. Include it as the last pageof the Arrest Report. Arresting officers shall notify the juvenile'sparents or guardian without delay

JUVENILE PETITION REQUEST FORMAT. To request a petition,follow the reporting instructions on the page 2 of the Juvenile ArrestSupplemental Report.

AFFIDAVIT OF MINOR (Business & Professions Code),Form 05.02.07. Complete an Affidavit of Minor for B & P Code Violations,Form 05.02.07, when a minor (under 21 for this purpose) B & P arrest isrelated to any ABC licensed premises, the minor waives Miranda Rights,AND the minor Indicates a willingness to provide information, Section 1through 28 should be completed by the minor, but may be completed bythe arresting officer if the minor is unable. Section 29 must be completedby the minor. The remainder of the Affidavit, indicating the apparent ageof the minor, shall be completed by the arresting officer. If the minor doesnot waive the Miranda Rights, or refuses to complete the Affidavit, indicatethis fact in the additional section of the Arrest Report or RFC. TheAffidavit is distributed as a page of the Arrest Report or RFC.
