Issue 10 - October 2013 From Our President Monthly Newsletter Durango Area Assn. of REALTORS I am truly looking forward to my term as president along with the awesome leadership team we recently installed. My suggestion as a focus this term will be to promote the value of Realtor’s to our community, and the value of DAAR, to you. Buyers and sellers need us in good times, when the best properties are scarce and pricey as well as in challenging times, when FSBOS are harder than ever to market and days on market are long. We need to connect with the consumer in ways no impersonal website can. I will suggest new ideas; specifically encouraging the established Realtors to mentor the new, those of you having been in the business for 10 to 20 plus years know Durango history & can write excellent contracts yet may be lacking in the new technological and marketing skills that the younger generation is more in tune with. We would also like know what you might offer your association based on your past career or experiences, we always seem to be in need of a financial background. My hope is that you will consider getting involved with your association; networking with each other is an opportunity to bring current information back to your own busi- ness, which adds value. (Durango, CO) -- Amanda Erickson, Executive Offi cer of the Durango Area Association of REALTORS® is being honored by the National Association of REALTORS® with the Strategies in Nonprofi t Management Certifi cate from The University of Chicago Graham

School of General Studies, which recognizes exceptional efforts made by the REALTOR® association executives.

Amanda is one of 70 elite REALTOR® association executives who have achieved this mark of excellence. Local and state association executives who have earned the Certifi cate represent more than 1,001,000 REALTORS® in 48 states in 1,380 REALTOR® associations.

“This is truly an honor and I am very proud to be receiving this Certifi cate. It is a high point in my career as an association executive,” Erickson said.

Prior to becoming a graduate of the University of Chicago Certifi cate program, participants in the program must attend six customized classes in association and non-profi t management and pass the pre-and post-work as-signments for each class. Participants must demonstrate knowledge of areas critical to REALTOR® association management, including strategic planning, performance management, leadership, budgeting and fi nance, advo-cacy and lobbying, board governance and developing effective programs. Erickson will receive a diploma from the University of Chicago.

NAR members recently received word that the U.S. Department of Housing & Urban Development would be implementing a new policy on Oct. 1, 2013, that would prevent dual agency agree-ments in FHA pre-foreclosure transactions.

The National Association of REALTORS® immediately began talks with HUD officials on the proposed change. On Wednesday afternoon HUD officials reported to NAR that they would reis-sue the July Mortgagee Letter (#2013-23) and remove all dual agency language (Part Three of the PFS Participation Requirements). The result is that the dual agency policy will not be implemented on Oct. 1, allowing NAR to continue the dialogue with agency officials on a for-mal solution to the dual agency issue.

HUD had proposed the policy change in response to fraud and abuse detected by the HUD Inspector General in the pre-foreclosure sales process.

NAR, working with state and local association presidents, sent a letter to HUD highlighting the concerns about the policy and the disruptive effect its implementation would have on commu-nities across the nation.

DISCLOSURE… WHAT SHOULD WE DISCLOSE? What defects should be disclosed? The best answer to this question comes from the Code of Ethics and Arbitration Manual published by the National Association of REALTORS. It states; “any material fact that could affect a reasonable purchaser’s decision to purchase, or the price that a purchaser might pay, should be disclosed” “ The question that Ethics panels should consider in determining whether a REALTOR has concealed a pertinent fact is whether disclosure of the fact in question could have had an effect on a reasonable purchaser’s decision.”

There are two reasons why we disclose. First, doesn’t a purchaser have the right to know the condition of what they are buy-ing? If you were buying a car and the seller knew of hidden defects, would you want to know about them before you agreed on a price? Second, by disclosing you protect two very important people; the seller and yourself. If there is a defect in the house that is important enough to cause a buyer not to buy the house and you do not disclose it, would it make sense that once the buyer does find out about that defect that it is important enough for the buyer to sue you and the seller.

Here is the interesting thing about this situation. What if the buyer has moved out of state? Who is the only person (who has errors and omission insurance) still in Colorado for the buyer to sue? Now instead of potentially paying ½ of the damages you get to pay them all. Probably the worst thing in this situation for you is the time, effort and energy you will be required to expend to help defend the errors and omission insurer. You will have to spend time with the defense attorneys, maybe go-ing to court, and loosing time from your real estate practice. It’s just not worth it.
