The company is making a big issue of strikes, therefore, we wantto set the record straight. This union does not want to strike, havenot planned to strike and do not anticipate a strike. We furtherassure you, no officer of this union will call you out on strike. Thisunion settles over ninety-eight percent (98%) of our agreementswithout any labor problems. We believe we can accomplish thesame here at this company.

In an all out attempt to confuse the people, the company isresorting to fear and scare tactics. Remember, the democraticprocedure of this union protects you against nasty andunwarranted strikes. A two thirds majority of the bargaining unit, voting in secret ballot is necessary to approve any strike. Now,consider this.... before there could be a strike, the company andunion committee must negotiate to an impasse.......

This union's position is that we will continue to negotiate(avoiding impasse and avoiding strikes). Some of you may bethinking if there is no impasse and no strike....how do we get ourunion contract? The answer is very simple, we will keep thecompany at the bargaining table with your committee until anagreement is reached.

By taking the above approach, we can avoid a strike. Thecompany cannot replace employees. No employee loses their joband all employees continue to receive their pay checks. The recordshows that the S.M.W.I.A. has been successful over ninety-eightpercent (98%) of the time. We are very confident we can do thesame here.

Respectfully yours,

Union Committee

““WE ARE FAMILY”WE ARE FAMILY”IS WHAT THE COMPANY WANTS

YOU TO BELIEVE!

WHAT DOES THIS REALLY MEAN?

You hear the phrase “we are family” a lot lately. A family meansa group with ancestry, household or group of related things.Actually, I doubt if you were ever referred to as “family” untilyou started talking to our union.

Would a family sell or close your family business?

Would a family use intimidation to stop you from talking toUnion Representatives?

Would a family use threats to stop you from forming a union?

Would a family promise rewards if you stop talking to UnionRepresentatives?

Think about it. Before you started talking to UnionRepresentatives, this was not a “happy family”. The companyis trying to interfere with your right to form or assist in forminga union. They want you to stop signing authorization cards orask for them back. They might tell you we will impose on yourprivacy, by bothering you at your home.

We believe your family needs to know about the value of aunion contract and ask questions about union benefits. Thiselection is very important to your future and we feel your familyshould be involved in this decision.

“LOOK, I HAVE

ANOTHER CHARGE FROM THE NLRB.

YOU SAID I COULD THREATEN AND

COERCE MY EMPLOYEES.

WHAT DO I DO NOW?”

“I’M CONSULTING WITH THREE OTHER ATTORNEYS ABOUT YOUR CASE AS WE SPEAK. YOU TRIED THE FAMILY THING, NOW YOU HAVE TO SCARE THEM A LITTLE MORE!”

Page 18: NOW THAT YOU WANT A UNION THE COMPANY FOUND THE THAT OPENS THE DOOR THIS WAS THE COMPANY’S OPEN DOOR POLICY.

Typically, companies do not believe employees are entitled to better

wages and conditions. It is not their policy to share profits with

employees. They usually resort to scare tactics such as threatening to

close, relocating, downsizing, outsourcing work, layoffs, etc. These tactics are used to scare employees from forming a Union and having a

voice.

IF OUR EMPLOYEES VOTE FOR A UNION

Page 19: NOW THAT YOU WANT A UNION THE COMPANY FOUND THE THAT OPENS THE DOOR THIS WAS THE COMPANY’S OPEN DOOR POLICY.

UUnionionnTHE BOSS WANTS TO TAKE THE “YOU”

OUT OF THE UNION. THEY WANT YOU TO THINK OF THE UNION AS AN OUTSIDE FORCE. THEY WANT YOU TO CHOOSE BETWEEN THE UNION OR THEM. THEY WANT YOU TO THINK ONLY OF THEIR

INTEREST AND NOT YOUR OWN INTEREST.

YOU HAVE INTEREST TOO, EQUALITY IN THE WORKPLACE. YOU SHOULD HAVE

THE RIGHT TO MAKE YOUR OWN DECISION.

STOP BEING PART OF A ”DO - IT - YOURSELF” OR MERIT SYSTEM. “YOU” AND YOUR FELLOW WORKERS HAVE A CHOICE FOR A BETTER FUTURE, WHEN

YOU FORM A UNION.

CONTRACTLET’S PUT IT

IN

Writing

OUR SOCIETY IS BASED ON LEGAL CONTRACTS. WHEN YOU BUY A HOUSE, CAR, INSURANCE,

ANYTIME YOU FINANCE, YOU SIGN A CONTRACT.

YOU ARE SELLING THE BEST YEARS OF YOUR LIFE HOUR BY HOUR - DAY BY DAY, ON THE INSTALLMENT

PLAN WITHOUT A CONTRACT!!

IT IS TIME YOU HAD A CONTRACT THAT GUARANTEES GOOD WAGES, GOOD WORKING CONDITIONS AND

GOOD BENEFITS.

SHEET METAL WORKERS’ UNION SIGN CONTRACTS TOO AND FOR THE BEST OF REASONS,

TO PROTECT WORKERS RIGHTS

WHEN THE BOSS IS THE JUDGE,JURY AND PROSECUTOR!

DIFFERENCES OF OPINION ARE A FACT OF LIFE IN THE WORKPLACE. DECISIONS ABOUT PAY,

HOURS, PROMOTIONS, DISCIPLINE, SCHEDULING AND MORE CAN PROVOKE CONFLICTS......ESPECIALLY IF THERE IS

FAVORITISM OR UNEQUAL TREATMENT.

IN THE NON-UNION COMPANY THE EMPLOYER DECIDES EVERYTHING. THE COMPANY IS THE

LAW, JUDGE, JURY AND PROSECUTOR. THERE IS NOTHING YOU CAN DO ABOUT IT.

WITH A UNION CONTRACTYOUR RIGHTS ARE DEFINED!!!

THE COMPANY WANTS TO GO INTO

EXTRA INNINGSUSING UNDERHANDED TACTICS

Whenever workers start to organize themselves into a union, there is one thing they nearly always experience --- DELAY!

It doesn't take much thought to come up with the answersto the questions of "why” and "who" wants the delay. Everyone knowsthat the government NLRB election procedure takes time.

Now, let's see who wants to delay and why. Certainly it isn't yourunion. You have already signed cards that show the government youwant the election and you want it now!

The boss doesn't feel that way. Let's say that when your union isvoted in, you negotiate better wages and other benefits. Multiply thisincrease times the number of workers and you can see how much thecompany saves each week it delays the election.

Isn’t it strange, that the company spends the money you’reentitled to on an expensive Attorney, while they say you don’t need anoutside Union to represent you? Yet, the company brings in an outsideAttorney to tell them how to interfere with your rights and with yourmoney!!

And there's another reason. Companies think that delays helpto discourage you. It gives them time to whittle away at you andchange a few votes, so it will weaken your union's chances inthe election.

Just remember these facts. If the time seems to drag on, thecompany is trying to protect its pocketbook and weaken you. Yourbest defense is to be more determined than ever to win the electionand take the wages and benefits guaranteed in your contract!

YES THE OWNER HAS RIGHTS!!!!

FOR EXAMPLE THEY HAVE THE RIGHT TO JOIN ORGANIZATIONS LIKE THE CHAMBER OF COMMERCE, ASSOCIATED BUILDERS AND CONTRACTORS OR ANY ORGANIZATION.

YOU DIDN’T OBJECT WHEN THE COMPANY JOINED AN ORGANIZATION.

YOU DIDN’T SAY, “YOU’RE LETTING AN OUTSIDE GROUP COME BETWEEN US.”

ACTUALLY, JOINING ANY ORGANIZATION IS THE OWNERS BUSINESS AND NOT YOURS.

LIKEWISE, JOINING A UNION IS YOU AND YOUR FAMILIES BUSINESS, NOT THE OWNERS BUSINESS.

YOU DON’T TELL THE OWNER HOW TO RUN THEIR BUSINESS

THE OWNER SHOULD NOT TELL YOU AND YOUR FAMILY HOW TO RUN YOUR BUSINESS!!!

Page 24: NOW THAT YOU WANT A UNION THE COMPANY FOUND THE THAT OPENS THE DOOR THIS WAS THE COMPANY’S OPEN DOOR POLICY.

Page 25: NOW THAT YOU WANT A UNION THE COMPANY FOUND THE THAT OPENS THE DOOR THIS WAS THE COMPANY’S OPEN DOOR POLICY.

A UNION IS NOT FORMED TO FIGHT THE EMPLOYER. YOUR UNION IS ORGANIZED TO MAKE THINGS BETTER AND MORE FAIR FOR

EVERYONE.YOUR OWNER IS BUSY. IT TAKES TIME TO RUN A BUSINESS. THE COMPANY HAS TO BE EFFICIENT AND PROFITABLE. THERE ARE MANY DETAILS IN

RUNNING A BUSINESS. A COMPANY DOESN’T ALWAYS HAVE THE TIME TO ADDRESS PROBLEMS

WITH INDIVIDUAL EMPLOYEES.WITH A UNION, THERE IS A COLLECTIVE

BARGAINING AGREEMENT. IT COVERS WAGES, HOURS AND CONDITIONS OF EMPLOYMENT.

EVERYONE IS TREATED EQUALLY AND PROVIDES A METHOD OF SETTLING COMPLAINTS.

A UNION CONTRACT IS GOOD BUSINESS

Page 26: NOW THAT YOU WANT A UNION THE COMPANY FOUND THE THAT OPENS THE DOOR THIS WAS THE COMPANY’S OPEN DOOR POLICY.

It takes coordination strength, and a hammer big enough to get the job done.Your vote in the union election can determine how high you go up the ladder andif you "ring the bell" at the bargaining table.

You see, there's one language that every company understands when it sitsdown with a union to negotiate a contract. It's the language of strength and unity.

The greatest opportunity you will ever have to demonstrate such strength andunity comes when you vote in the NLRB election.

This election is conducted by the U.S. Government and the results are certifiedand made public. While no one will know how you vote, everyone will knowexactly how many voted for and how many against your union representation.

If 53% vote for the union and 47% against, then your union wins and thecompany must then bargain with you. The company will know that nearly half ofyou were against the union.

Compare that situation with one in which all of you vote for the union - a 100%victory. Consider the difference in the company's attitude toward your unity andstrength when you sit down to negotiate wages and conditions. When thecompany knows you are strong and united then you’ll be able to translate thatstrength into your contract.

So set your goal for a 100% vote for Sheet Metal Workers’ in this election. Justremember . . . the higher percentage you win the election by, the more strengthyou have in negotiations.
