PROCLAMATIONWHEREAS, the crime of domestic violence violates the basic human rights of safetyand dignity, and 146 women were killed due to domestic violence in Texas including 183 children lost a parent;and

WHEREAS, the problems of domestic violence and teen dating violence are not confined to any group of people, but cut across all economic, racial, gender and societal barriers; and

WHEREAS, the impact of domestic violence and teen dating violence directly affectsindividuals and communities when society ignores or tolerates violence in relationships;and

WHEREAS, women and men need to work together to bring safety and equality; and

WHEREAS, the Hays County Sheriff’s Office, San Marcos Police Department, Kyle Police Department and Buda Police Department and Hays County District Attorney’s Office are partnering with the Hays-Caldwell Women’s Center to promote Domestic and Teen Dating Violence Awareness in our local communities and in our area High Schools and;

WHEREAS, last year HCWC provided face-to-face services to over 1,024 local victimsof domestic violence and provided 7,057 days of shelter; and

WHEREAS, last year HCWC provided these direct services to 60 victims from The City of Buda, and

NOW, THEREFORE, I, ______________, by virtue of the authority vested in me as _________________ of Buda, Texas do hereby proclaim the month of October 2017 asNational Domestic Violence Awareness Month

And call upon the people of Buda to work together with HCWC and local partners to bring an end to domestic violence and teen dating violence.

Subject: Ratification of the acceptance of the Certification of Unopposed Candidatesfor the November 2019 General Election (City Clerk Alicia Ramirez)

1. Executive SummaryThe City Council approved the Election Order on August 6, 2019. The deadline to file for candidacywas August 19th and the deadline for a write-in candidacy was August 23rd. A candidate filed forthe At-Large Position 1 office. Therefore, the candidate is unopposed. Two candidates filed forSingle Member District C; therefore, an election will be held for this office.

2. Background/HistoryTo cancel an election for the At-Large Position 1, the City Council must first receive and accept theCertification of Unopposed Candidates form (or the authority may create its own form) from theauthority responsible for preparing the ballot. The cancellation order/ordinance must be adopted inan open meeting. The candidates are not required to be present. Certificates of election should beprepared for each unopposed candidate; however, the certificates of election should not be issueduntil after Election Day, as follows. Section 2.053 provides that the certificate of election shall beissued “in the same manner and at the same time” as for a candidate elected at an election.Therefore, the candidates, who have been declared “elected” at the meeting ordering thecancellation, must wait until after the official election day (even though no election is held) and noearlier than the prescribed canvassing period (even though no canvass is held) to be sworn in andassume their duties. Candidates may complete the Statement of Elected Officer prior to Election Day.The Statement should be kept locally; it does not need to be sent to the Secretary of State’s Office.Copies of this order/ordinance must be posted on Election Day at each polling place that would havebeen used had the election not been cancelled.

3. Staff's review and analysisThe next steps will be scheduled as follows:

1) October 7, 2019 - Issue the Statement of Elected Officer to the unopposed candidate

2) November 19, 2019 - Canvass period is November 8th through November 18th. The canvassprocess will be required for SMD C position only.

3) December 3, 2019 - Per the Charter Section 4.06 Taking of Office, each newly elected person to the6

The amendment to Sec. 2001.502 relates to prize fee for licensedauthorized organizations and requires a municipality currently receiving a share of the bingo prizefee declare its intent to continuing receiving said fee by November 1, 2019. If the City fails to declareits intent to impose and receive the fee by November 1, 2019; the City will cease collection of the feeafter January 1, 2020.

2. Background/HistoryThe Texas Lottery Commission (TLC), Charitable Bingo Operations Division, collects prize fees fromcharitable bingo activity.

1. Executive SummaryThis Interlocal Cooperation Agreement between San Marcos, Hays County, City of Kyle and City ofBuda in the regional partnership to manage and operate the San Marcos Regional Animal Shelter(“Shelter”) located at 750 River Road, San Marcos, Texas.

2. Background/HistoryIn 2011, the City of Buda began contracting animal sheltering services through the City of SanMarcos. The City of Kyle and Hays County began utilizing San Marcos sheltering services as well. SanMarcos Animal Shelter has evolved into a regional animal shelter with all the aforementionedparties participating. This interlocal agreement establishes San Marcos as the regional shelter withall other parties supporting operation and costs associated with carrying out their objectives.

On December 12, 2018, San Marcos City Council approved a resolution directing staff to develop animplementation plan to reach a 90% or higher live outcome rate at the San Marcos Regional AnimalShelter. Shortly thereafter, the City of Buda passed an resolution in support of the implementationplan to achieve a goal of sustained 90% or higher live outcome rate for dogs and cats processedthrough the San Marcos Shelter. The Pawsitive Outcomes Implementation Plan Committee wasformed and spent several months meeting, evaluating potential solutions, and developing the plan tobe presented to the San Marcos City Council in June. During a May 17, 2019 meeting of the shelter’sregional partners (San Marcos, Kyle, Buda, and Hays County), a request was made to form a Budgetand Policy Committee (Committee)so that each entity’s elected officials could discuss the policy andbudget implications of the proposed implementation plan. The membership composition of saidCommittee would be comprised of the City Manager and one Councilmember from each respectivecity.

1. Executive SummaryThe Fiscal Year 2019 Operating Budget was originally adopted by City Council on September 18,2018. A change is required to the 2019 operating budget to reflect the cost to relocate a portion ofthe 20" diameter effluent force main for the Proposition 5 - City Park project.

2. Background/HistoryAt the September 17th City Council meeting, staff presented to City Council an agenda itemauthorizing the City Manager to spend up to $75,000 for the relocation of a portion of the EffluentForce Main for the City Park project. This project included the relocation of approximately 200linear feet of 20-inch pipe and the installation of a valve. The estimated cost for the materials torelocate the line was less than $75,000, and Council directed staff to prepare a budget amendmentto appropriate funds for the project.

3. Staff's review and analysisThis is the final budget amendment of the 2019 fiscal year. Staff has reviewed this budgetamendment requests and presented the request for a budget amendment to City Council at theSeptember 17th Council meeting when staff discussed the need for the force main for the ongoingCity Park project. Staff has determined that this amendment is necessary in order to fund the costfor the purchase of materials to relocate the 20" diameter effluent force main. Funds are availablein the Wastewater Fund.

4. Financial ImpactThis budget amendment increases expenditures in the Wastewater Fund by $75,000. See theattached Exhibit A.

5. Summary/ConclusionThis budget amendment will allow for the proper funding needed in the Wastewater Fund'sequipment account for the necessary materials needed for the relocation of the 20" diameter effluentforce main. ORDINANCE NO. 2019-____

AN ORDINANCE OF THE CITY OF BUDA, TEXAS, APPROVING AND ADOPTING AN AMENDMENT TO THE BUDGET FOR OPERATING THE MUNICIPAL GOVERNMENT OF THE CITY OF BUDA FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2018 AND ENDING ON SEPTEMBER 30, 2019; AND ESTABLISHING A SAVINGS CLAUSE AND AN EFFECTIVE DATE.

WHEREAS, by Ordinance No. 2018-27, passed and approved on September 18, 2018, the City Council of the City of Buda approved and adopted the City of Buda, Texas budget for the fiscal year beginning October 1, 2018, and ending on September 30, 2019; amended on February 19, 2019 by Ordinance No. 2019-03, June 18, 2019 by Ordinance No. 2019-10; September 3, 2019 by Ordinance No. 2019-16 and,

WHEREAS, the City Council desires to amend the operating budget of the municipal government of the City of Buda for the fiscal year October 1, 2018 to September 30, 2019; and,

WHEREAS, said budget amendment has been submitted to the City Council by the City Manager, in accordance with Financial Procedures in Article VI, Section 6.04 of the City Charter,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BUDA, TEXAS:

Section 1. That the City Council of the City of Buda does hereby ratify, approve and adopt the amendments to the budget considered for fiscal year of October 1, 2018 to September 30, 2019 as identified in Exhibit “A”, which is attached hereto and incorporated herein by reference.

Section 2: Severability. If any clause or provision of this Ordinance shall be deemed to be unenforceable for any reason, such unenforceable clause or provision shall be severed from the remaining portion of the Ordinance, which shall continue to have full force and effect.

Section 3: Repeal. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed.

Section 4: Passage. Pursuant to Section 3.12 of the City Charter, if the Council determines that the first reading of this ordinance is sufficient for adequate consideration by an affirmative vote of five or more members of the City Council during the first reading and the Ordinance was passed by the affirmative vote of four or more members of the City council; therefore, this Ordinance is adopted and enacted without further readings. In the event a second reading is necessary, this Ordinance is adopted and enacted upon the affirmative vote of four or more members of the City Council upon second reading.

Section 5: Effective Date. Pursuant to Section 3.12 of the City Charter, this ordinance is effective upon adoption, except that every ordinance imposing any penalty, fine, or forfeiture shall become effective only after having been published once in its entirety, or a caption that summarizes the purpose of the ordinance and the penalty for violating the ordinance in a newspaper designated as the

1. Executive SummaryThe Fiscal Year 2020 General Budget was originally adopted by City Council on September 17, 2019. Since the adoption of the budget, staff has identified a section in the Fee Schedule that requiresupdating to reflect the most current fees for the Facilities, Parks and Recreation section of the FeeSchedule. These fees are directly related to Parks-related pavilion and facility rentals.

2. Background/HistoryThe City's Fee Schedule was adopted by City Council on September 17, 2019, along with the adoptionof the City's annual operating and capital budget. The City's fee schedule includes a list of all cityfees and charges imposed for various services, activities, events, materials, and supplies providedby the City. Included in the Fee Schedule, in Article A7.00, are fees related to Facilities, Parks andRecreation. During the preparation of the Fee Schedule for the Fiscal Year 2020 budget adoption,some of the fees in this category were inadvertently reduced. The fees that were reduced hadpreviously been adopted by City Council and were reflected in the Fiscal Year 2019 budget. Thesefees were also in place throughout the 2019 Fiscal Year.

The fees requiring an update with this amendment are included in Article A7.00 section (a) SmallPavilions, section (c1) Stagecoach Park Pavilion, and section (c2) Stagecoach Park Amphitheater. The attached Exhibit "A" is the Fee Schedule adopted by City Council on September 18, 2018 for theFiscal Year 2019 budget. The fees for these three sections, that were approved for Fiscal Year 2019,are highlighted in Exhibit "A". These are the fees that require an update on the attached Exhibit "B"Fee Schedule, approved by City Council on September 17 for Fiscal Year 2020. The Exhibit "B" FeeSchedule identifies the correct fees for this Fee Schedule amendment.

3. Staff's review and analysisCity staff has reviewed the Fee Schedule and has identified various fees in the Facilities, Parks andRecreation section of the recently adopted Fee Schedule that are being requested to be amended toreflect current fees for the rental of small park pavilions, Stagecoach Park pavilion, and theStagecoach Park Amphitheater. These fees have previously been approved by the Parks Commission,and the City Council approved the updated fees when the Fiscal Year 2019 budget was adopted lastyear on September 18, 2018. The amendment to the Fee Schedule also amends the Permit Feessection under Facilities, Parks and Recreation by removing two $10 fees that were previously

Financial ImpactThe request to update the Fiscal Year 2020 Fee Schedule to reflect fees in Exhibit "B" is made in orderto assess the current, and correct, fees for the rental of park pavilions and the Stagecoach Parkamphitheater. These fees have been previously approved by City Council. These fees were also usedto calculate park-related revenues that are included in the adopted 2020 budget.

This amendment to the Fee Schedule does not amend any revenue or expenditure amounts in theCity's recently adopted budget, but only fees include in the Fee Schedule.

Summary/ConclusionAn amendment to the Fiscal Year 2020 Fee Schedule for park and recreation fees related to pavilionand the Stagecoach Amphitheater rental will allow the Parks Department to assess the necessaryfees for rental of these facilities and to ensure that revenues included in the Fiscal Year 2020 budgetare collected based on updated fee amounts. The Permit Fees section also removes the $10 fee forElectrical Use Permits and Water Use Permits. These changes were previously approved by the ParksCommission.

ORDINANCE NO. 2019-___

AN ORDINANCE OF THE CITY OF BUDA, TEXAS, APPROVING AND ADOPTING AN AMENDMENT TO THE BUDGET FOR OPERATING THE MUNICIPAL GOVERNMENT OF THE CITY OF BUDA FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2019 AND ENDING ON SEPTEMBER 30, 2020; AMENDING APPENDIX A OF THE CODE OF ORDINANCES ENTITLED FEE SCHEDULE PREVIOUSLY ADOPTED ON SEPTEMBER 17, 2019; PROVIDING FOR PUBLICATION; PROVIDING FOR PENALTY; AND ESTABLISHING A SAVINGS CLAUSE AND AN EFFECTIVE DATE.

WHEREAS, by Ordinance No. 2019-18, passed and approved on September 17, 2019, the City Council of the City of Buda approved and adopted the City of Buda, Texas budget for the fiscal year beginning October 1, 2019, and ending on September 30, 2020; and,

WHEREAS, the City Council desires to amend the Exhibit “B” Fee Schedule, updating fees associated with Facilities, Parks and Recreation (a) Small Pavilions, (c1) Stagecoach Park Pavilion, (c2) Stagecoach Park Amphitheater, and (h) Permit Fees, of the municipal government of the City of Buda for the remaining fiscal year October 1, 2019 to September 30, 2020; and,

WHEREAS, said budget amendment has been submitted to the City Council by the City Manager, in accordance with Financial Procedures in Article VI, Section 6.04 of the City Charter,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BUDA, TEXAS:

Section 1. That the City Council of the City of Buda does hereby ratify, approve, and adopt the amendment to the budget considered for fiscal year of October 1, 2019 to September 30, 2020 as identified in Exhibit “B” (updated park fees), which are attached hereto and incorporated herein by reference.

Section 2: Severability. If any clause or provision of this Ordinance shall be deemed to be unenforceable for any reason, such unenforceable clause or provision shall be severed from the remaining portion of the Ordinance, which shall continue to have full force and effect.

Section 3: Repeal. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed.

Section 4: Passage. Pursuant to Section 3.12 of the City Charter, if the Council determines that the first reading of this ordinance is sufficient for adequate consideration by an affirmative vote of five or more members of the City Council during the first reading and the Ordinance was passed by the affirmative vote of four or more members of the City council; therefore, this Ordinance is adopted and enacted without further readings. In the event a second reading is necessary, this Ordinance is adopted and enacted upon the affirmative vote of four or more members of the City Council upon second reading.

Section 5: Effective Date. Pursuant to Section 3.12 of the City Charter, this ordinance is effective upon adoption, except that every ordinance imposing any penalty, fine, or forfeiture shall become effective only after having been published once in its entirety, or a caption that summarizes the purpose of the ordinance and the penalty for violating the ordinance in a newspaper designated as the

official newspaper of the City. An ordinance required by the Charter to be published shall take effect when the publication requirement is satisfied.

PASSED, APPROVED and ADOPTED on the first and final reading on the 7th day of October, 2019 at a regular meeting of the City Council of the City of Buda, Texas.
