The Envelope should be addressed to : The Asst.General Manager(Mechanical.) National Aluminium Company Ltd., Opp: Ore Handling Complex, VISAKHAPATNAM (AP) , PIN – 530 035.

The General terms and conditions are given in Annexure-I . It may be noted that price bids will be considered for evaluation, of those bidders who will qualify in Techno-commercial bid only.

(1). i) You are requested to go through the General terms and conditions of tender and special

conditions of contract with scope of work given in Annexure-II, before submission of tender.

ii) The Techno-commercial bid (Annexure-III) should contain the EMD in the form of Bank draft/Banker’s cheque drawn in favour of National Aluminium Co.Ltd., or BG from any Nationalised Bank payable at Visakhapatnam or pay order favouring National Aluminium Company Ltd. , along with the complete information as sought in Techno-Commercial Bid.

iii) The tenderer shall comply with the following Qualifying criteria and the required documents shall be submitted without fail as otherwise your offer is liable for rejection (as per Annexure-VII.)

iv) Experience of having successfully completed following similar works during last Seven years ending last day of month previous to the one in which applications are invited and past performance in similar contracts. a) A single work order amounting to Rs.48,64,670/- (OR) b) Two Work Orders amounting to Rs.30,40,410/- each (OR) c) Three Work Orders amounting to Rs.24,32,335/- each

Similar work means “Operation & maintenance of Guest House / Hotels”.

v) The bidder shall have executed similar works in last 7 years in PSU/Govt.Organisation/reputed leading Private Company.

vi) The tenderer shall submit attested copies of registration certificates w.r.t. Service Tax.

vii) Details of present commitment of the tenderer . viii) Statement of Deviations / exceptions to Tender terms & conditions as per Annexure. ix) Latest Banker’s certificate regarding financial soundness of the tenderer. x) The Tenderer shall comply with all the applicable Statutory rules/ guidelines for the subject

work. xi) Your confirmation that you have not been banned or de-listed by any Government or quasi

Government agencies or Public Sector Undertakings. If you have been banned or de-listed by any Government or quasi Government agencies or PSUs, then this fact must be clearly stated. If this declaration is not furnished, your Bid shall be treated as non-responsive and liable for rejection.

- 3 - xii) A letter indicating the following legal information in respect of the firm/ proprietor shall be

furnished. (a) Arbitration cases pending with NALCO. (b) Disputed work not completed with respect to NALCO. (c) Pending civil cases against the firm or the proprietor of the firm etc. (d) Pending criminal cases against the firm . (e) Punishments awarded under civil or criminal cases. Contractors / Transporters having criminal cases pending against them / convicted in criminal cases will be debarred from participating in the tender.

xiii) If the tender opening date falls on holiday / unforeseen eventualities, the same shall be

opened on the next working day or at the earliest convenience.

xiv) The contract shall be awarded to the L1 Bidder alone.

(2). Rates should be quoted strictly as per Schedule of Rates / Price Bid in Annex.-IV & Annex.-V. After evaluation of Techno commercial bids, the qualified bidders shall be intimated by letter / fax / telephone regarding the date of opening of price bids.

(3) While offering the rate, statutory labour components such as payment of minimum wages, PF,

ESI, Bonus, leave salary, public holiday, terminal benefits and applicable taxes may be taken into account. The contractor has to insure proper uniform to the personnel to be engaged at NALCO TH.

Your offer(as per enclosed check-list) should reach us on or before the date and time as mentioned above either by hand or by registered post. The Tender received late / incomplete/ without the requisite EMD/ Tender cost etc. are liable to be rejected. NALCO accepts no responsibility for any loss/ delay/ non-receipt of offers sent by post. Offers with INCOMPLETE PRICE BIDS WILL BE LIABLE FOR REJECTION. NALCO reserves the right to accept or reject any of all the tenders in part of full and to change the Tender Schedule without assigning any reason thereof. ANNEXURE - I TERMS & CONDITIONS OF CONTRACT

1. TENDER DOCUMENT :-

The tender document consists of General Conditions of the Contract (G.C.C.) of NALCO, Scope of work, Special Conditions of the contract and bill of quantity & Schedule of rates . The bidder may refer to the G.C.C. in the Office hours of all working days at NALCO’s Port Facilities Office if he so desires.

2. EARNEST MONEY DEPOSIT:-

The Contractor shall deposit the Earnest Money as stipulated in the Letter/ Notice Inviting Tender in the form of D.D. / Banker’s cheque in favour of NATIONAL ALUMINIUM COMPANY LTD., payable at VISAKHAPATNAM or in the form of BG from any Nationalized Bank as approved by NALCO. The EMD shall not carry any interest and will be refunded to the unsuccessful bidders, after finalisation of the contract. The EMD of successful bidder shall be adjusted towards Initial Security deposit after awarding of the contract if the contractor is willing to do so. The EMD shall be forfeited , if : a) The Bidder withdraws the Bid after Bid opening during the period of bid validity. b) The Bidder does not accept the correction of the Bid prices, pursuant to

clause 11. c) The successful bidder fails within the specified time limit to

i) Sign the Agreement or ii) Furnish / deposit the required performance security amount/ Initial Security

deposit (ISD).

RIGHT TO ACCEPT / REJECT THE TENDER NALCO reserves the right to reject any or all the tender without assigning any reason thereof.

3. SECURITY DEPOSIT (S.D.) :

Total Security Deposit is 10% of the total contract value. The contractor has to deposit 2½% of the total contract value as Initial Security Deposit (ISD) within 10 days of receipt of LOI/WO. The rest amount shall be deducted @ 10% from the gross amount of R.A. Bills till the total security deposit is collected. The contractor may also deposit 10% of the contract value at a time. The S.D. may be deposited in the form of DD/Banker’s cheque or BG . The EMD can be adjusted with S.D. or shall be refunded as per the wish of the contractor. The S.D. shall be refunded with the final bill after completion of the contract on certification of the Officer I/C.

4. CONTRACT PRICE :-

The rates quoted shall be inclusive of all taxes and duties except Service Tax. The bidder shall quote Basic rate only . The rate shall be firm during the contract period. The contractor should take all such accounts in to consideration while quoting the rates. The quoted rates should be strictly as per the Bill of Quantity (BOQ) enclosed. However, the quantities mentioned in the BOQ are approximate and may vary for which the contractor shall have no right to claim for any compensation whatsoever on account of this. The Service Tax shall be reimbursed as per existing rules/ guidelines. Any statutory rise in taxes/ duties during the contract period shall be reimbursed on production of proof .

5. FORFEITURE OF S.D. :-

The S.D. shall be liable to be forfeited if the contractor fails to execute the job as per schedule and/ or not attending the job after award of the contract and/or in the event of termination of the contract for any such breach. This will be as per clause No.20 of G.C.C. of NALCO.

6. RISK AND COST :-

If the contractor fails to execute the job as per the scope of work & special conditions , the officer I/C shall arrange the same from other sources at the risk & cost of the contractor.

7. VALIDITY OF OFFER :-

The rates offered by the bidder shall be valid for a period of four months from the date of opening of tender.

8. PAYMENT TERMS :-

a. R.A. bills thus entitled or proportionate to the part thereof duly approved by Officer I/C shall be payable subject to deductions towards , income tax or any other statutory dues as per rules.

b. Payment shall be made through E-payment only . The contractor is required to fill up the enclosed Bank Mandate form in duplicate and submit to NALCO before commencement of job. No compensation is payable for any delay in releasing payments.

9. PENALTY :-

In the event of failure of the contractor to perform as per the contract, penalty is leviable as specified in the Special Conditions of the contract or as specified in clause 24 of G.C.C. Decision of Engineer-in-Charge in this regard is final and binding.

10. EXECUTION OF AGREEMENT :-

The contractor has to execute an agreement in a Rs. 50/- non-judicial stamp paper as per the G.C.C. of NALCO in the prescribed format.

- 3 - 11. TERMINATION OF THE CONTRACT : (Clause No. 25 of GCC)

If the contractor does not commence the work in the manner described in the contract documents or if the officer in charge notices / finds, the occurrence of any one or the following events / contingencies namely :

i) Failure to carry out the works in conformity with the contract .

ii) Failure to carry out the works in accordance with the time schedule.

iii) Failure to carry out and execute the works to the satisfaction of NALCO.

iv) If the contractor abandons the work . The contractor shall be held responsible for all the consequential additional cost or losses incurred / suffered by NALCO besides termination of the contract.

12. STATUTORY PROVISIONS :-

The Contractor shall abide by various statutory provisions to the satisfaction of Central/State Govt. authorities. The contractor has to comply with provisions made in various status such as contract labour (regulation & abolition) Act, Employees Provident Fund, the Payment of Wages Act, Industrial dispute Act, Factory Act, E.S.I. Scheme, payment of royalty, mines act, workers compensation act and all other acts as mentioned in the G.C.C. Nothing extra will be payable on these accounts. In case of failure of the contractor to comply with any statutory provisions, NALCO as principal employer shall have the right to withhold the bills and Security Deposit of the contractor and or take such action as it may be deemed fit.

13. WORKS ON SUNDAYS AND HOLIDAYS :

The contractor shall carry out the work on Sundays and other Holidays and also during night hours if exigency arises in the interest of timely completion of the work, without claiming any extra charges from NALCO.

14. SAFETY PRECAUTIONS :-

The Contractor shall have to take all safety precautions for his workmen during any hour of the day and will be responsible for any First Aid / Emergency treatment of his employees. Contractor shall abide by all the time and the safety regulations of NALCO Safety appliances like Safety helmet, Shoes etc., shall be provided by the Contractor to all workmen working under him.

- 4 - 15. OFFICER I/C :-

The Officer I/C for this contract shall be Sr.Manager(H&A) or his representative. The contractor shall report to the Officer I/C for all related jobs.

16 ARBITRATION :- All the disputes or differences which shall at any time arise between the party and NALCO, the same shall be dealt as per clause No.87 of G.C.C. of NALCO.

17. P.F & E.S.I ACCOUNT CODE :-

The contractor should possess his own PF & ESI codes and should cover all his workers engaged by him under PF & ESI Act.

19. GATE PASSES FOR EMPLOYEES :

The contractor shall apply for photo entry passes for his employees in a prescribed proforma available with the owner. The employee pass has to be produced at the entry gate of the plant premises on demand. Without the employee pass, no body shall be allowed to enter into the plant premises. No extra payment shall be made in these accounts. The contractor workers are to produce the entry pass on demand while at work.

20. GATE PASS FOR MATERIALS :

To bring the materials / equipments / tools etc., inside the plant for execution of the work, the contractor has to produce the same at the gate security personnels and made sure that the materials are recorded in their register. If the contractor wants to take out any material out of the plant premises, he has to apply with the purpose / reason to the Eng./ Officer I/C.

21. LABOUR ESCALATION : a) The prices / rates mentioned in the schedule of rates shall remain firm throughout

the contract period and shall not be subject to escalation except in case of statutory increase and payment thereon shall be made on submission of documentary evidence.

b) In case of variation in labour wages, the reimbursement shall be made as per the following escalation formula.

VL = 0.85 x W x Y ( L1 - L0 ) 100 L0 Where, VL = Variation in labour cost to be paid. W = Value of work done on which escalation is payable. Y = Actual labour component in percentage = 76.45% L1 = Minimum daily wage of unskilled worker (revised) L0 = Minimum daily wage of unskilled worker (pre-revised)

- 5 - 22. OTHER CONDITIONS :-

a The rates offered in the tender should be clearly written both in words and in figures in English and should be free from any deletions, cuttings and over writings. All corrections and over writings if any should be counter signed by the tenderer. In case of overwriting or illegibility the interpretation of NALCO shall be final and binding on the contractor.

b. In case the contractor is required to execute any work which are not included in the schedule of rates, such rates of extra items shall be derived as per provisions in the G.C.C.

c. NALCO’s General Conditions of Contract as amended from time to time & special conditions of contract shall form a part of this contract. NALCO’s G.C.C. may be seen by the bidder in office hours in the office of the undersigned.

d All statutory levies / recoveries are to the account of the contractor except Service Tax. e. The Basic rate excluding Service Tax quoted shall be firm during the contractual period.

f. NALCO reserves the right to cancel the tender without assigning any reason.

g. Tender should consists of the following documents.

i. All tender documents should be signed by the Tenderer on every page. ii. EMD as mentioned. iii.Covering letter addressed to AGM(MECH), NALCO, VIZAG. iv. A statement showing the important / similar works executed

in the last three years. h. The offers once received, no revision in price whatsoever shall be allowed.

i. The accepted rates by NALCO for the purpose of execution of work by contractor shall be valid for the entire contract period or as mentioned in the Special terms and conditions.

j.. NALCO reserves the right to terminate or cancel the contract as per the clause 25 of G.C.C.

k. All the documents i.e., Income Tax, Sales Tax, Service Tax Regn. work experience

certificates shall be submitted along with the tender as otherwise the offer submitted shall be liable for rejection.

l. You are requested to strictly comply with the environmental/safety requirements during execution of work.

The offer shall be sent in a sealed envelop superscribing the name of the work, date of opening

of the tender and “quotation do not open” and addressed to the Asst.General Manager(Mech), NALCO, Port Area, Visakhapatnam so as to reach us on or before the schedule date & time as mentioned above.

NATIONAL ALUMNIUM COMPANY LIMITED (A Government of India Enterprise)

Port Facilities: Visakhapatnam. NAME OF THE WORK : MANAGEMENT (OPERATION &

MAINTENANCE) OF TRANSIT HOUSE AT, ASPALLA HILLS, NALCO, VIZAG

SPECIAL CONDITIONS OF CONTRACT

1.00 DEFINITION OF TERMS

The Company shall mean National Aluminium Company Limited (A Government of India Enterprise) having its registered Office at NALCO Bhavan, P/1, Nayapalli, Bhubaneswar.

The Contractor means 'the successful bidder' who has agreed to provide the stipulated service herein to the Company and includes the contractor's legal representative, his successors and permitted assignees.

The "Office-in-Charge" means the person designated by the Company and shall include those who expressly authorized by the Company to act for and on its behalf.

2.00 SUBMISSION OF BIDDER 2.01. Interested parties are requested to read the terms and conditions of this

Contract very carefully before quoting their rates. There will be no compromise in the stipulated conditions. All pages of these documents are to be duly stamped, signed and submitted as a token of acceptance of all terms and conditions along with the commercial bid.

2.02. All inclusive rates for fixed and variable operating charges should be quoted as per the schedule (Annexure-III) annexed to this tender documents. Similarly all inclusive rates for food and beverage items should be quoted as per the schedule (Annexure-IV) annexed to this tender document and the rates of food items shall be fixed after running and maintenance of guest house contract is finalized. The schedules should be duly signed by the tenderer

2.03. The schedule of rates quoted by the contractor shall remain firm till the completion of contract and shall not be subject to escalation. Schedule of rates shall be deemed to include all taxes & duties and overall costs expenses and liabilities of every description and all risks of every kind to be taken in the executing and completion of the work.

2.04. NALCO reserves the right to accept or reject either in full or in part of any quotation and withdraw the letter of enquiry without assigning any reason thereof. (01)

3.00. LOCATION & DETAILS OF ROOMS.

NALCO’s Transit house is located at Daspalla Layout, Visakhapatnam. The Transit House is having 26 rooms and 07 bedded dormitory and the total capacity is 59 as under:-

1first floor: 5 rooms, 7 bedded dormitory, common dining hall & kitchen

2nd Floor : 4VIP Rooms, VIP kitchen dining hall. 3rd floor 2 VIP suits, 5 normal rooms 4th floor 10 normal rooms 5th floor multipurpose hall, one store room & pantry.

Besides, the Transit House has drawing halls, a reception room-cum-office in the first floor. The total capacity of transit house is 59.

4.00. PERIOD OF CONTRACT. The contract will be for a period of two years, to be reckoned from the date of execution of the job.

5.00 SCOPE OF WORK. 5.01. Preparing and serving meals to the guests according to their needs. Foods will include bed tea, breakfast, lunch, afternoon tea and dinner.

5.02. T providing food at dining hall or in the room as per as per the convenience of the guests/ occupants or as per the decision of the Management from time to time.

5.03. Serving soft drinks or fresh juices to the guests as and when they need excluding alcohol.

5.04. Manning the office of the guest house round the clock and attend to the guests and all telephone calls in courteous and helpful manners. Keeping a check on entry of unauthorized persons with the help of your staff & Security guards. [

5.05. Proper upkeep of the rooms, making beds, cleaning and Sweeping of rooms and the entire transit house premises.

5.06. Preparing and serving food and beverage for officials parties as per the MENU fixed by the Officer-in-Charge, on case to case basis depending upon the requirement.

5.06. To engage such experienced and professional cooks who are able to prepare (i) Indian style of food and (ii) Western/Continental style of food for the Occupants/guests staying in the transit house along with experience personnel.

The Scope of work shall, however not be limited to these functions only. All other functions reasonably required to be performed for proper Operations and maintenance of the Guest House shall be deemed to have been included in the contract.

The Scope of work/services and supply of materials may alter in quantity or quality as per exigencies of work. The contractor shall accordingly provide services as may be required by the Officer-in-charge on a notice of 7 days.

6.00. QUALIFICATIONS REQUIRMENTS OF MANPOWER TO BE DEPLOYEED

The contract shall deploy appropriate manpower including leave reserve for all categories of manpower for execution of the contract and for providing the required services for the efficient running of the transit house. The contractor shall indicate the category wise manpower in his quotation. (i) The deployment of least manpower, on any working day, cannot be less than, what is indicated below:-

a) Caretaker cum supervisor 01 (For General Supervision) (High skilled category) b) Cook (skilled category) 02 (Overall responsibility of kitchen) c) Cook helper cum attendant 05 (2 each for A & B shift & 1 for (Semiskilled category) general shift) f) Sweeper/helper (unskilled) 06 (4 sweeper & 2 helper for kitchen)

The job of Cooks and cook helper should be interchangeable at the time of required i.e. both the categories should be in a position to manage the job in the absence of any one of the categories in the kitchen. The compulsory qualification requirements of the above personnel to be deployed is brought out at Annexure-vi

The Contractor shall provide all staff with proper uniform.

7.00 FACILITIES / INFRACSTRUCTURE TO BE PROVIBEDE BY NALCO TO THE CONTRCTOR.

7.01. The furniture like cots, bed side tables, tables, chairs, dining tables and dining Chairs, dressing tables, sofa sets etc. in the rooms, lobby & dining hall shall be provided by the Company.

7.02. The utensils (vessels) including crockery and cutlery will be supplied by the Company. 7.03. The curtains, bed covers, bed sheets, woolen blankets, mattresses, pillows, Towels and other linen will be provided to the contractor by the Company. 7.04. The air conditioners, refrigerators, geysers (water heaters), televisions, water Cooler, telephone etc in the rooms will be provided by the Company. (03)

7.05. The gas connections and cooking oven(s) shall be provided by the Company. However, gas, refilling (cost of gas cylinders) is to be done/ borne by the contractor at his own cost.

7.06. The telephone (2 Nos. i.e. one with STD facilities and another without STD facilities with two parallel connections) shall be provided by the Company subject to recovery of personal out station calls made by the contractor and guests/occupants.

7.07. Electricity and water (including existing water pumps) will be provided at the Company cost, but contractor should take utmost care for its minimum use.

7.08. Kitchen and Storage facilities will be provided by the company. 7.09. The maintenance of air conditioners, Geysers, Water pumps, TV sets will be taken care by Company. 7.10. The list of materials issued to the contractor at the beginning of contract

period will be duly acknowledged /accepted by the contractor or his authorized representative. Inventory of such materials will be maintained by the contractor for periodical (quarterly) verification by the officer-in-charge. On completion or termination of the contract all materials which are under his custody shall be handed over to the Officer-in-charge by giving proper accounting. In case of shortage of materials, the contractor shall have to bear the cost of material as fixed by NALCO and the cost of material is to be taken as 125% of original cost. However, standard life/allowance for breakage/damage for different items will be permitted as per the norms fixed by NALCO, which shall be binding on the party.

8.00. RESPONSIBILITY OF THE CONTRACTOR 8.01. Hospitality:

The Contractor will ensure that a guest arriving for check-in received with courteously, and taken to the room, allotted by the Officer-in-charge with help offered to carry his/her luggage to allotted room. In case of guest arriving without prior booking, the contractor will make him wait in the office/ reception room or in the lounge with due courtesy and seek instruction from the officer-in-charge over phone. Except under exceptional circumstances where the status of the guest is known and the concerned officials are not accessible, the contractor can allot any room on his own.

The bearer/room boy taking the guest to a room will check the state of linens, the working conditions of AC, light, TV, Geyser and fan availability of glasses and drinking water in the jug, in presence of the guest. The bearer will explain whatever is considered essential for comfortable stay of the guest and take orders if required before leaving the room. (04)

The Contractor shall supply washed and ironed bed sheets, towels toilet paper, mosquito repellant, soap, liquid soap etc, as and when occupants comes and on alternate day if he continue stay for more than two days at a stretch, then he should be provided with all above items.

The visitors coming to meet a guest putting up in the guest house shall be required to contact reception and only after the reception gets approval of the guest, the concerned visitor can be allowed to visit the guest in his room. The Receptionist or the Manager posted in the Guest House by the contractor shall be required to extend to the guest service like getting taxies, getting medical assistance, getting a telephone number connected, conveying message received in absence. The Officer-in-charge must be kept informed about cases of medical assistance unless otherwise instructed the guests will pay for their taxi and medical assistance.

The bearers, sweepers and others engaged by the contractor shall be honest with high integrity. Personnel belongings of the guests must be safe and protected. Any personnel items left behind by any guest after checking out is to be kept in safe custody and the officer-in-charge is to be informed about it.

It must be ensured by the contractor that courteous and polite behavior is extended to the guests at all times by his staff both over phone and in person. If any member of the staff is found to have misbehaved or whose manner is not up to the satisfaction, his services in the guest house shall be dispensed with immediately.

8.02 CATERING The Contractor shall ensure 24 hours catering services for the guests. If a guest has booked his lunch or dinner in advance before checking in, or after checking in and has indicated late or early timings for such services, the same must be made available to him in warm condition irrespective of normal lunch or dinner timings of the guest house.

Where there is no advance booking of lunch or dinner and a guest has checked in late for these purposes, the contractor shall provide standard snacks and beverages (non-alcoholic) if required by the guest.

Breakfast, lunch, dinner services shall be provided in the dining hall during specified hours.

With prior notice, the contractor shall be required to cater to official parties by making necessary arrangements for the purpose, within or outside the guest house premises on prior notice. The cost of such services shall be as per pre-determined rates unless otherwise decided by the company.

The contractor under no circumstances shall provide catering services to any individual or group within the guest house premises including its adjacent area without prior approval of the officer in charge.

No alcoholic drinks shall be allowed to be stocked / serviced in the transit house premises.

The contractor shall use only good quality raw material for preparation of food items, like refined oil of approved brand, tea, coffee, rice and all other ingredients as approved by NALCO.

The contractor shall provide hygienic and good quality food items and render smooth and efficient service.

The rate of food items to be charged to the guests shall be mutually as per the agreed rates. The cost of food items shall be directly collected from the guests by the contractor.

8.03 CONSERVANCY & MAINTENANCE Perfect cleaning of curtains, linens, towels, bed sheets, pillow covers, bed covers, towels, hand towels, blankets, curtains, door mats etc. shall be done by the contractor at his own cost/arrangements.

The Contractor shall be required to keep the Guest House in neat and clean conditions through supply and use of consumables such as, detergent powder, antiseptic liquids, air freshener, toilet paper, toilet brush, odonil, brooms etc. The rooms and dormitory area should be sprayed with insecticides like Finit, Hexit, and Baygon etc. on daily basis to prevent mosquitoes etc. The rooms and dormitory area shall also be sprayed with room fresheners before occupation by the guests for freshness.

Sweeping, dusting and cleaning of rooms, kitchen corridors, walls, ceiling, terraces and all open and covered areas, in and around the Guest House shall be carried out by the contractor regularly.

Maintaining the building premises including lawn and garden in good conditions all the time. Regular dusting/ cleaning of all furniture, fixtures, fittings, including all wood, glass, laminated and aluminium surfaces provided in the guest house . (06)

shall be done by the contractor using appropriate materials. Carpet shall be mechanically cleaned by the contractor.

The Contractor shall ensure that utensils, crockery, cutlery and cooking equipments provided to him are always maintained in clean and hygienic condition using hot water as well as appropriate soaps and detergents. (5.)

The Contractor shall keep kitchen/dinning, places and its surrounding areas in the best of hygienic conditions. The contractor shall take adequate and appropriate measures to keep the guest house premises free from flies, cockroaches, rodents and white ants. It will be responsibility of the contractor to keep ACs and Geysers switched off when not in use and if the occupant has forgotten to do so. It will also be the responsibility of the contractor to ensure that the door and windows of a room are closed when AC is on. If any guest has forgotten to do so, it should be pointed out politely.

The employee of the contractor shall not use any vacant room for gossiping, resting or watching TV. They shall also not use the dining hall or reception area for such purposes. Any deviation shall be viewed adversely.

The Contractor shall keep proper record of all fittings, fixtures, furniture and equipments taken out of the guest house for maint. /repair purposes. It will be the responsibility of the contractor to keep the concerned officials informed about the malfunctioning or defect in any equipments/item, provided in the guest house. The contractor shall be penalized for not reporting promptly defects in any item provided by the Company.

Small plumbing jobs like leakage in taps, clearing of choked pipe lines and cleaning of over head tank and underground tank (periodically) shall be done by the contractor. For bigger civil jobs the contractor will co-ordinate with NALCAO officer in charge for getting the jobs done in time.

Small electrical jobs like replacing tubes/bulbs, calling fuse call office for replacement of blown fuse etc. shall be done by the contractor. For other major electrical jobs the contractor will co-ordinate with the NALCO Officer-in-charge for getting the jobs done in time.

8.04 GARBAGE DISPOSAL The contractor shall ensure that all wastes/ rejects, leftover, and garbage generated in the kitchen and other area of the guest house are always put into covered dustbins and then packed in large suitable disposable bags every day. These bags properly tied up must be taken out of the guest house on (07)

regular basis and put into garbage bins available outside the guest house.

It will be responsibility of the contractor to ensure that in the course of a party all disposable or used cups, plates and leftover are put into dust bins/garbage bins either by guiding the guests to do so or by getting the same done by his staff.

8.05 UNIFORMS It shall be responsibility of the contractor to provide his workers of all categories with UNIFORMS as to specified and ensure that the uniforms are regularly used in clean conditions. In case of failure on the part of the contractor to supply the specified uniforms, the company shall supply the same to the contractor's workmen at the contractor's risk and cost. In case of failure of any workmen to wear the prescribed uniform while on duty, penalty shall be imposed on the contractor. Apart from regular use of uniforms, the contractor shall ensure that his employees maintain good personal hygienic and do not smoke, chew pan/ tobacco or take alcohol.

8.06 TELEPHONES The guest can make local calls free of charge. In case of STD call made the cost of the same needs to be recovered from the guests, unless otherwise instructed. The contractor will account for STD calls bills. It will be the responsibility of the contractor to discourage use of phones by unsolicited visitors.

8.07 ACCOMMODATION The contractor shall make his own arrangements for accommodation of his employees. None of his employees shall be allowed to use any part of the guest house for living/accommodation purpose.

8.08 COMPLAINTS In case of complaints for standards and quality of food and room arrangement and services, the officer-in-charge or his authorized representative shall have the liberty to inspect and suitable action as deemed fit will be taken to improve the condition.

The Contractor shall maintain a suggestion-cum complaint book at the reception and present the same to the Guests or any concerned official of deliberated negligence on the part of the contractor, suitable actions shall be taken against the contractor.

8.09 DOCUMENTATION The Contractor shall be required to keep and use various registers and forms prescribed for the purpose such as advance booking of rooms, occupancy (08)

Register, assets register, monthly information sheets, billing forms, money receipts etc.

The Contractor shall be responsible for collection of his dues against the food bills from the guests. These bills shall however be presented to the guests in prescribed formats and as per the stipulated tariffs.

The contractor shall collect the room rent from the guests as per applicable rates. Amount charged should be recorded in the appropriate columns of the prescribed occupancy register and money receipt provided by the company, shall be issued to the guest. All collections against room rent must be deposited in the company after due certification of the Officer-in-charge once in every fortnight i.e. on 1st day and 16th day of every month. Any failure to do so will be viewed seriously and penalty shall be imposed.

In case of persons declared as company guests for accommodation purpose only, the contractor shall collect his food bill dues from the guests and submit information on the period of stay in prescribed format.

In case of persons declared as company guests for both boarding and lodging purposes, the contractor shall submit his claims on food expenses to the Company after getting signature of guest on the face of the bills. Such bills should be submitted in prescribed format in a consolidated manner once in a month for certification by the Officer-in-charge and payment.

The contractor shall be required to keep all registers and documents updated on regular basis and present them to the Officer-in-charge whenever required.

8.10 SAFETY CODE The Contractor shall maintain first- aid facilities for his employees. The Contractor has to ensure all precautionary measures and exercise utmost care in handling the gas cylinder/ inflammable liquids etc. as required under the law and/or as advised by the fire authorities of the Company.

The contractor shall take requisite precautions and use his best endeavors to prevent any riotous or unlawful behavior by or amongst his workmen and others employed by him for the preservations of peace and protections of the Guest House property.

8.11 NOTICE AND ADDRESS The contractor shall provide their local address in advance. All correspondences/notices/instructions given by/to the contractor shall be in the local address only.

8.12. A list of staff/employees to be deployed by the contractor with address & photograph to be submitted by the contractor for police record

8.13. The Contractor shall be responsible for the proper behavior of the staff, Workmen and others, shall exercise proper degree of control over them, and in particular without prejudice to the said generality, the contractor shall be bound to prohibit/prevent any employees from trespassing or acting in any way detrimental or prejudicial to the interest of the community or the properties or occupiers of land or properties in the neighborhood. In the event of such trespassing, the contractor shall be responsible for all consequent claims or actions for damages or injury or any other grounds whatsoever. The decision of the Officer-in-charge upon any matter arising under this clause shall be final.

8.14. The contractor shall have to execute the contract by himself and can not engage any subcontractor for the same. 8.15. The contractor shall be responsible for ensuring that the works are executed

fulfilling various norms spelt out in the contract by providing and using the quality of materials and manpower throughout the job completion.

Any failure by the Company at any time or from time to time to enforce or require strict keeping and performance of any of the terms and conditions of agreement, or to exercise a right hereunder, shall not constitute a waiver of such terms and conditions or rights and shall not effect or impair the same of the right of the company at any time to avail itself of the same.

8.16 The Contractor may visit the site and acquaint himself fully with the physical Conditions of the Transit House. No claim other than those stipulated herein shall be entertained by NALCO in the plea of ignorance or difficulties or hardship involved in providing these services.

Except the agreed rates, no other charges whatsoever will be paid.

Note:- The conditions stated as contractor's responsibility in this document are illustrative in nature. To improve the maintenance and services, the contractor, during the operation of the contract, will be free to make suggestions out of his experience in the line. Similarly the company can implement new ideas for better management of the guest house in consultation with the contractor without any extra financial implication. It is important that all the employees of the contractor should have clear understanding of the services the contractor is required to render. [[

9.00 SUBMISSION OF BILLS The Contractor shall submit the catering bills in respect of Company Guests in duplicate, in the prescribed proforma within 7th days of the following months to the Officer in charge for payment. (10)

The Contractor shall submit the monthly bill towards fixed charges and bed maintenance charges in the prescribed format for payment as per the scheduled rate to the Officer-in-charge and the payment shall be released within 10 days of submission of the bill.

The Contractor shall ensure deposit of room rent collected from the Occupants/ Guests fortnightly in the prescribed format, otherwise penalty @ Rs.50/- per day will be charged. All payments due to the contractor shall be made by crossed account payee cheque and the contractor shall present his bills duly pre-receipted on proper revenue stamp. Receipt for payment made on account of work when executed by a firm, must be signed by a person holding due power of attorney in this respect on behalf of the contractor, except when the contractors are described in their tender as a limited company in which case the receipts must be signed in the name of the Company by one of its Principal Officers or by some other persons having authority to give effectual receipt for the Company.

10.00 COMPENSATION/PENALTY

Penalty for failure to render service or violation of the contract would be as under:-

9. Non supply of manpower Rs. 50/- per day per man for non manning The contractor shall maintain a complaint register and suggestion book which shall be made available to the employees on demand and shall allow for inspection of the same at any time by the authorized representative of NALCO. It the complaint is found genuine, then NALCO shall have the liberty to fine up to Rs.1000/- per accident or to take any other appropriate action as deemed fit by the management.

11.00 OTHER TAX LIABILITY Income tax, sales tax or any other tax like service tax charges etc. on works contract, as applicable from time to time shall be deducted at source from the monthly running bills of contractor.

12.00 In case any complaints of non-fulfillment of any obligation under the contract, the management reserves the right to withhold payment, due to the contractor and out of such amounts or amount of security held, if any, or the amounts likely to fall due to the contractor (but without obligation to do so) to make such payments as it may consider necessary for smooth and unhindered working.

The contractor shall at his own expenses carry and maintain such insurance with reputable Insurance Company/ Companies as may be required under the law or regulation.

13.00 TERMINATION OF THE CONTRACT During the operation of the contract, NALCO reserve the right to terminate the contract by giving 30 days notice in writing. No compensation in this regard shall be paid to the party.

During the operation of the contract, if the contractor fails to execute the job or in case breach of the contractual obligation, NALCO reserve the right to make alternative arrangements and carry out the job at the risk and cost of the contractor for the remaining period. In such cases, the security deposit of the contractor shall stand forfeited and be absolutely at the disposal of NALCO.

In case it is noticed that the contractor has furnished any false information, NALCO reserves the right to terminate the contract or impose penalty as deemed fit and the same is binding on the party.

14.00 RIGHT TO GET THE WORK DONE FROM OTHER SOURCES Nothing herein contained shall restrict the Company from accepting similar (12)

Services from other sources at its discretion.

15.00 STATUTORY LAWS & PAYMENT OF CLAIMS & DAMAGES The Contractor must comply with all prevailing statutory laws and regulations/acts etc. as applicable in the state of Andhra Pradesh.

15.01 Should the owner have to pay any money in respect of such claims or demands as aforesaid the amount so paid and the cost incurred by the Owner shall be charged to and paid by the Contractor and the contractor shall not be at liberty to dispute or question the right of the owner to make such payments notwithstanding the same may have been made without his consent or authority or in law or otherwise to the contrary.

15.02 In every case in which by virtue of the provisions of section 12, subsection (i) of workmen’s compensation Act, 1923 or other applicable provision of workmen’s Compensation Act or any other Act, the owner is obliged to pay compensation to a workman employed by the contractor in execution of the works, the owner will recover from the contractor the amount of the compensation so paid, and without prejudice to the rights of owner under section 12, sub section (2) of the said act. Owner shall be a liberty to recover such amount or any part thereof by deducting it from the security deposit or from any sum due to the contractor whether under this contract or otherwise. The owner shall not be bound to contest any claim made under section 2 sub-section (i) of the said Act except of the written request of the contractor and upon his giving to the owner full security for all costs for which the owner might become liable in consequence of contesting such claim.

16.00 EMPLOYMENT LIABILITY The Contractor shall be responsible for engagement of required number of workmen with required skills for operation and maintenance of Guest House. As per the scope of the contract the contractor have deployed the requirement of the category manpower such as supervisor, cooks, cooks helper cum bearer, sweeper etc. The contractor shall be responsible for payment of wages for execution of contract to each worker employed by him and the contractor is to fix the wage period not exceeding one month in line with statutory provisions for which wages are to be paid. The Officer-in-charge shall nominate representative at the time of disbursement of wages and shall certify the disbursement in the Register of wages or Register of wages cu muster roll.

Contractor shall obtain a labour licence from the concerned authorities under the contract labour (Regulations and Abolition) Act, 1970 and furnish a copy of the same to Officer-in-charge within 30 days of award of contract. (13)

The Contractor shall comply with the provisions of Employees Provident fund Act and Employees State Insurance Act. The contractor shall deposit Employees and Employer's contribution with; the appropriate Authority every month regularly in respect of the manpower deployed by him in his

own PF/ESI number and furnishes the proof of such deposits so made. Besides PF/ESI contributions, Retrenchment compensation, annual leave, Holiday wages etc. shall be paid to the workman engaged by the contractors as per statutory provisions.

The Contractor shall also comply with the provisions of the payment of Wages Act, 1963, Minimum Wages Act, 1948, Employer Liability Act, 1938, Workmen's Provident fund Act, 1952 and Contract Labour Regulation and Abolition Act, 1937, Employment of children Act, 1938 or any other law relating thereto and rules made there under from time to time.

17.00 ADDITION AND DELETION OF SCOPE The scope of the work/services may alter in quantum as per exigencies of work. The contractor shall accordingly provide service as may be required by the Officer-in-charge on giving notice of 15 days without any extra financial implication.

18.00 ARBITRATION All the disputes or differences which shall at any time arise between the party and NALCO; the same shall be dealt as per clause No. 87 of G.C.C of NALCO.

19.00 JURISDICTION For all dispute arising out of this contract, the jurisdiction shall lie under the Jurisdiction of Visakhapatnam Court only.

Annexure - VI Annexure of clause no 6.00 on required category of manpower

The contract shall deploy appropriate manpower including leave reserve for all categories of manpower for execution of the contract and for providing the required services for the efficient running of the transit house. The contractor shall indicate the category wise manpower in his quotation. (i) The deployment of least manpower, on any working day, cannot be less than, what is indicated below:-

a) Manager/Supervisor under highly skilled category 01 No. for general supervision. The person must have the following qualification & in line experience. i.) He must be a graduate ii.) He must have 3 years in line working experience

in 15 rooms hotel or guest house.

b) Cook under skilled category 02. Nos who must have passed 8th class & having 3 years cooking experience in hotel or guest house having not less than 15 rooms C).Cook helper & bearer under 05.No.

Semiskilled category with 9 the pass & having two years in line experience

PRE-QUALIFICATION CRETERIA

a). Financial criteria :- Average annual financial turnover during the last three years, ending March of the previous year, should be at least Rs.18, 24,255/- of the estimated cost.

b) Experience criteria :- Experience of having successfully completed similar

works during last seven years ending last day of month previous to the one which applications are invited should be either of the following :-

i) Three similar completed works costing not less than the amount equal to Rs.24,32,335/-

or ii) Two similar completed works costing not less than the amount equal to Rs.

30,40,410/- or

iii) One similar completed works costing not less than the amount equal to Rs.48,64,670/-

c). Similar works means “Operation & maintenance of Guest House/Hotels”.
