Call to Order/Roll Call Mayor David Hair called the City Council Meeting to order for September 27, 2018 at 7 p.m. The roll call indicated Mayor Hair and Councilmembers Cindy Cummings, Mark Williams and Daniel Grange were in attendance with Councilmembers Clay Wilker and Michael Callahan excused. Also Treasurer Tara Hobbs and Recorder Corey Twedt were present. Opening Remarks/Pledge of Allegiance Councilmember Cummings welcomed everyone to the Council Meeting and led all present in the pledge of allegiance. Approval of agenda and time allocations The agenda for the City Council Meeting of September 27, 2018 was reviewed. Councilmember Williams moved to approve the agenda for September 27, 2018. Councilmember Grange seconded. Councilmembers Cummings, Grange and Williams voted yes with Councilmembers Wilker and Callahan excused. (A copy of the agenda is included as Attachment “A”.) Approval of minutes of the previous meeting The Council reviewed the minutes of the City Council Meeting for August 23, 2018. Councilmember Cummings moved to approve the minutes for August 23, 2018. Councilmember Williams seconded. Councilmembers Cummings, Grange and Williams voted yes with Councilmembers Wilker and Callahan excused. Public Comment Period Mayor David Hair opened the floor for any public comments. No one signed up for the public comment portion of the meeting.

Consideration of a Resolution Appointing Kermit Price to Continue Serving as the City Representative on the Cache Mosquito Abatement District (CMAD) Board Mayor Hair said that Kermit’s term on the CMAD Board was expiring at the end of the year. He recommended to the Council that Kermit continue to represent the City in this capacity. Recorder Twedt confirmed that Kermit is willing to do so. Councilmember Grange and Mayor Hair both said that they felt Kermit was doing a great job in this position. Councilmember Williams moved to approve Resolution 2018-19; A Resolution appointing Kermit Price to continue serving as the Millville Representative on the Cache Mosquito Abatement District Board. Councilmember Cummings seconded. Councilmembers Cummings, Grange and Williams voted yes with Councilmembers Wilker and Callahan excused. (The approved resolution is included with the minutes as Attachment “B”.) Report on P & Z Meetings held September 6, 2018 and September 20, 2018 Development Coordinator Harry Meadows reviewed with the Council the Planning Commission’s draft minutes for the meetings held September 6, 2018 and September 20, 2018. (Copies of the draft minutes are included as Attachments “C” and “D”.) Consideration of a Resolution of Agreement Between Millville City and Josh Barnett Regarding Zoning of a Potential Future Annexation Mayor Hair explained that Josh had initially planned to purchase parcel 02-117-0019 and annex into Providence where he would develop a 65-unit multi-family complex. The neighbors on the Millville side were concerned about this. Additionally, Providence had planned to add some commercial property on the west side of that development. Some of the landowners that were planning to be part of that annexation decided not to annex because of the density that it would bring to the area. Josh Barnett is now coming to Millville to understand the possibility of annexing into Millville and building approximately 15 single-family homes on that parcel. He is trying to understand how the Council would feel about this and if he could develop 1/3-acre lots (Residential R1 Zone). The resolution being considered would give Josh some assurance that if he goes through the cost and time to annex into Millville, he would be able to rezone to R1 and he would not have to run the sewer line from its current location to his new subdivision. Councilmember Williams said that he didn’t like the idea of an agreement. He said that a future Council may not agree with what this Council decides. Councilmember Cummings asked Josh what his plans were for this subdivision. Josh said that he wanted to do one road down the middle (going east and west) with 15 single-family homes and a road stub to the north that would eventually connect to the Guymon property.

Councilmember Grange said that there was a lot of unknowns with this agreement. Recorder Twedt explained that the agreement would not give any special treatment. It is only stipulating that if annexed, the land could be R1. Mayor Hair said that all of the ordinances would still need to be followed regarding annexation and subdivision development. Councilmember Cummings said that she didn’t see a downside in making the agreement. She said that she would prefer the development be in Millville since people living on this parcel will be using Millville roads. She said she would prefer the impact fees come to Millville and not Providence. Additionally, if done in Millville, they would have some control over what is done there. Steve Guymon was at the meeting. He is the landowner with property to the north of the parcel being discussed. Steve was planning to annex with Josh into Providence until he heard the plans for the multi-family development, which caused him to withdraw from the annexation. He discussed the Providence City plan for this area being multi-family medium density and that this development was intended to have 66 housing units. Steve Guymon said that he is not in favor of this plan and he feels that all the people that live around this area would much prefer single-family homes. There was some discussion on if annexation could occur with the private lane that was currently in the County that borders the north side of the Zollinger property. Steve Guymon said that the lane would likely have to be annexed into Millville City as well. Councilmember Cummings moved to approve Resolution 2018-20, A Resolution accepting an Agreement with Josh Barnett. Councilmember Williams seconded. Councilmember Cummings said that single-family homes in Millville was much better than multi-family complexes in Providence. Either way, there will be impact to our City. We would prefer see single-family homes and get the impact fees from the development. Councilmembers Williams and Grange said that they were not against the annexation or of a rezone to residential, but that they do not want to approve an agreement. The sewer requirements were then discussed. The current ordinance states that any new subdivisions west of 100 West would need to connect to the sewer system that was installed for Ridgeline High School. Since the current sewer lines are so far from this proposed subdivision, Mayor Hair recommended that sewer connection not be required, but that dry sewer should be installed so that the roads would not have to be ripped up when sewer is installed in the future. Councilmember Cummings voted yes, Councilmembers Grange and Williams voted no with Councilmembers Wilker and Callahan excused. The resolution was not adopted. (The resolution that was discussed and not approved is included with the minutes as Attachment “E”.)

Consideration of Jeffrey Strate Request to Revert Parcel 03-035-0043 from a Single Parcel back to Three Separate Parcels Development Coordinator Meadows said that Mr. Strate had submitted a conceptual to subdivide this parcel into four lots. As part of the conceptual, requirements were set for him to add sidewalks along both streets as well as widen the 200 South Road that abuts his property. Coordinator Meadows said that there was an initial parcel in 1954 where the home currently sits. In 1958, two additional parcels were subdivided off. In 1978, they were combined into a single parcel. According to County Recorder Michael Gleed, the parcel could revert back to how it was subdivided prior to 1978 if the Millville City Council gave approval. Development Coordinator Meadows explained that if the parcel were reverted back to how it was in 1958, the lower parcel would only have 80 feet of frontage instead of the required 108 feet. Councilmember Grange said that going from one parcel to multiple parcels would be a new subdivision that would have to comply with current frontage requirements and current code. Jeffrey Strate said that P&Z wants sidewalks on both roads which he feels is not conducive to the irrigation system from that old home. Additionally, they want him to widen the portion of the 200 South Road that borders his property. This might require that electrical poles get moved. Jeffrey said he would like to request adjustments to the requirements from P&Z. Mayor Hair said he would like to go look at the property to better understand what is being discussed. Councilmember Grange explained that 200 South is designated as a collector road. That is why it would need to be widened. There were some questions as to whether a minor subdivision would require the widening of the road. Councilmember Grange said that he was concerned with the Council making too many concessions. The current code requires any subdivision come up to current code requirements. Councilmember Cummings said that she would like more information and would like to go look at the property. Mayor Hair agreed. Councilmember Grange said that there had been some discussion of moving the collector road from 200 South to 300 South, but nothing was done yet and it may never change. He said that he felt that any division is a new division and is required to go through the subdivision process and follow the ordinance. Recorder Twedt mentioned that MacKay Moore had requested something very similar with his subdivision recently where lots had been combined previously and he just wanted to re-subdivide. He had to go through the process of a new subdivision. He wasn’t able to just revert to how it was previously.

Councilmember Grange motioned that this be tabled to be discussed at a future meeting. Councilmember Williams seconded. Councilmembers Cummings, Grange and Williams voted yes with Councilmembers Wilker and Callahan excused. Councilmember Grange clarified that property would not have to be dedicated for the street as long as it was a minor subdivision. (The information discussed is included with the minutes as Attachment “F”.) Discussion on Celco Request for City Border Line Adjustment Mayor Hair said that Celco owners are in the process of applying for a City property line adjustment that would move their property from Millville City to Providence City. He said that he and Recorder Twedt attended the Providence City Council Meeting where this was discussed. One concern is the 550 East Road that connects Millville to Providence. Most of the portion of the road that is not completed is on Celco property and will need to be completed by them. Mayor Hair said that he had met with Ezra Eames and they had decided that Ezra would finish installation of the water line as quick as possible. Then with Ezra’s portion of the road and Josh’s portion of the road, the City would complete from approximately 25 North going south. When Ezra develops Phase 4 of Mond-Aire, he will put the cost of his portion of the 550 East Road in escrow with the City so that he can work on his development while everything else plays out with the Celco property. Councilmember Cummings expressed concern with the Providence plan for multi-family housing in this area (Providence Life-Cycle Zone). All of this traffic will drop down directly into Millville and won’t really affect Providence. She said that she is not in favor of the property line adjustment because of the negative impact it will have on Millville City. Mayor Hair said that they plan to develop the upper portion of the Celco property first. (The information is included with the minutes as Attachment “G”.) Open and Public Meeting Training Recorder Twedt reviewed training material with the Council relating to State requirements regarding the Open and Public Meetings Act. (The training material reviewed is included with the minutes as Attachment “H”.) Consideration of an Ordinance Modifying Millville City Code Chapter 2.48 that would Permit Councilmember Electronic Meeting Participation Recorder Twedt reviewed the proposed code change that would permit Councilmember participation electronically for City Council Meetings. He explained that there had been a couple of close calls recently where a Councilmember had to race back so that a quorum was present and a meeting could be started. With this change, a Councilmember could call in to a meeting and participate electronically if needed. Most other cities have made similar modifications in recent years and Recorder Twedt reviewed their codes when writing the proposed ordinance.

Councilmember Williams moved to adopt Ordinance 2018-12, Allowing Councilmember Electronic Meeting Participation. Councilmember Cummings seconded. Councilmembers Cummings, Grange and Williams voted yes with Councilmembers Wilker and Callahan excused. (The information is included with the minutes as Attachment “I”.) Consideration for Change to City Council Bill Approval Process Recorder Twedt reviewed the memo explaining the proposal to change the tradition of spending City Council time reviewing bills. (The memo is included with the minutes as Attachment “J”.) Councilmember Grange said he liked the proposed change as it would free things up so that bills could be paid when they need to be paid. Recorder Twedt mentioned that there were still three signatures required on all checks and that the Council would continue to receive a list of all checks that have been paid out so that they can keep an eye on them as well. Councilmember Cummings said that she felt requiring City Council approval was micro-managing and not necessary. Councilmember Williams motioned to improve the bill paying process as proposed. Councilmember Cummings seconded. Councilmembers Cummings, Grange and Williams voted yes with Councilmembers Wilker and Callahan excused. Councilmember Cummings moved to pay the bills. Councilmember Williams seconded. Councilmembers Cummings, Grange and Williams voted yes with Councilmembers Wilker and Callahan excused. Discussion on Future Infrastructure Projects Mayor Hair said that he received the news this week that Aquifer Storage and Recovery will not be approved for the Glenridge Well. The application from the Division of Water Quality has been denied. He said that a new water source is now a much higher priority than sewer since the Glenridge Well will likely not be a viable culinary water source for very much longer. He will be meeting with engineers and is trying to move things along. As far as the most viable options, Mayor Hair said that spring water on the south side of Millville Canyon was his top priority, but that the spring is a couple of miles up the canyon. He said that mixing at Glenridge is an option, but is likely not a long-term solution. Another well is a possibility, but would be expensive and comes with long-term pumping costs. Councilmember Williams said that he thought the City was planning on doing an analysis of the different options to determine the best thing to do. Mayor Hair said that this was correct. Currently, we are working on reducing the list of options so that the analysis is affordable for the City. He said that the priorities in his opinion right now are the canyon spring, a new well and then pressurized secondary irrigation. Councilmember Cummings expressed her frustration with the Division of Water Quality on how long it took to come to this decision on ASR and how much time and money was spent.

Mayor Hair said that he would continue to work on understanding and proving out the various water source options to filter down the list and have engineers work up a cost and feasibility analysis on one or two things. He will provide an update at the next City Council Meeting. City Reports Councilmember Grange congratulated Public Works Director Chad Kendrick for his new position and role within the City. Mayor Hair said that he would like Chad to plan to report to the Council once per month unless things came up that needed to be addressed more frequently. Director Kendrick thanked the Mayor and Council for the opportunity to serve in this position. He said that the City has been kept in good shape in the past and that he will do his best to continue this into the future. ROADS: Director Kendrick reported that the sidewalk project was progressing quite well and that he was not aware of any resident complaints or concerns with the construction work that has been taking place. PARKS: Director Kendrick said that within the next couple of weeks, they will be shutting down the splash pad for the winter. They have replaced the broken slide at the South Park and a replacement for the slide at the North Park has been ordered. The North Park slide is still under warranty and will be arriving soon. WATER: Director Kendrick said that the wells would be turned off soon and the City will be back on spring water. Councilmember Reports (A copy of the Councilmember Assignments List is included with the minutes as Attachment “K”.) Councilmember Cummings said that the ULCT Conference was very good this year and that she felt that the ULCT was catering more now to the smaller cities and towns instead of just focusing on the large ones. Recorder Twedt said that he agreed. The conference had been very beneficial for him as well.

Councilmember Williams reminded the Council of the upcoming Cache Summit Conference and said that he felt it would benefit the City if any Councilmembers were available to attend. Development Coordinator Meadows said that there had been issues with feces and urine on the floors in the North Park restrooms. He installed a camera and could see that the construction crews have been using the restroom even though they had been asked not to. Coordinator Meadows has met with the contractors to make them aware of the issue. He said that he would like to begin locking the restrooms at night. Councilmember Cummings suggested they look into electronic timers so that someone wouldn’t have to go there twice per day to deal with the locks. Development Coordinator Meadows said that he would look into it. Coordinator Meadows said that he received a text indicating that he should measure the set-backs of the new homes in the Park Meadows Subdivision to see if Millville Code was being followed. Out of the five new homes, two are in violation of City Code. One is 11 feet and another is 8 feet within the City setback requirements (built too close to the road). These homes are both over 50% completed. They were both measured incorrectly by the builders and inspected incorrectly by the County building inspectors. Adam and Erica Farmer as well as Tyson Coleman came to the meeting at different times to discuss the issues with where their homes are located. Both of them had measured the property line from the curb and not considered the City right-of-way. Mayor Hair expressed his concern that this had not been caught by the County building inspector. Of all the inspections, he felt that this was the most important. Councilmember Cummings said that it was too late to make a correction. They aren’t going to make someone tear down their home at this stage. She suggested that the County building inspector be invited to the next meeting to discuss the problem and find a solution going forward. There was some discussion in finding a new building inspector or possibly contracting with an inspector from another city. Councilmember Cummings said that in the very least, the inspection fees should be refunded for those that were done incorrectly. Councilmember Cummings also asked that some additional information be added to the P&Z checklist documents to ensure that builders are aware that their property line does not start at the curb. Development Coordinator Meadows said that he would look into this although it has not been an issue before and the builders should have known better. RESOLUTION 2018-20

APPROVING THE HUNSAKER REZONE OF PARCEL 03-035-0073 FROM AGRICULTURAL (A) TO RESIDENTIAL (R1)

WHEREAS, a petition to rezone property for parcel 03-035-0073 in the City Millville has been received from Dan Hunsaker; and WHEREAS, the City Council reviewed the rezone and gave previous approval with adoption of Resolution 2018-5; and WHEREAS, the Planning Commission has reviewed the rezone request at the Planning Commission Meetings held September 20, 2018 and October 4, 2018; and WHEREAS, the Planning Commission held a Public Hearing on October 4, 2018 to receive public input on the request; and WHEREAS, the Planning Commission recommended to the City Council the approval to change the zoning as requested for said parcel;

THEREFORE, BE IT RESOLVED that Millville City approves the rezone of Parcel 03-035-0073 from Agricultural (A) to Residential (R1). Approved and passed by the Millville City Council this 11th day of October 2018. MILLVILLE PLANNING COMMISSION MEETING

City Hall - 510 East 300 South - Millville, Utah

Oct 4, 2018

1. Roll Call: Chairman Garrett Greenhalgh, Commissioners Larry Lewis, and Rachel Thompson.

Others Present: Development Coordinator Harry Meadows, Treasurer Tara Hobbs, Jeff Hurd, Steve Coppleters,

John Rhodes, Dan Hunsaker, Mayor David Hair, Susan Seely, Scott Seely, and Recorder Corey

Twedt. Secretary Adria Davis recorded the minutes.

2. Opening Remarks/Pledge of Allegiance

Chairman Greenhalgh opened the meeting at 8:01 p.m.

He led those present in the Pledge of Allegiance.

3. Review and Approval of agenda

The agenda for the Planning Commission meeting of Oct 4, 2018 was reviewed. A motion was

made by Commissioner Lewis to approve the agenda as outlined. Commissioner Thompson

seconded. Commissioners Thompson, Greenhalgh and Lewis voted in Favor with Commissioner

Dickey excused and Commissioners Farmer and Anderson (Alt.) absent.

4. Review and Approval of the Minutes of the Planning Commission Meeting

The minutes for the meeting of Sept 20, 2018 were reviewed. A motion was made by

Commissioner Lewis to approve the minutes as outlined. Commissioner Thompson seconded.

Commissioners Thompson, Greenhalgh and Lewis voted in Favor with Commissioner Dickey

excused and Commissioners Farmer and Anderson (Alt.) absent.

5.A. Zoning Clearance – Susan Seely, residence addition at 209 N Main.

This is an addition including a bathroom upstairs and an upgrade to their roof.

Commissioner Bonnie Farmer arrived at the meeting at this time.

This home has setbacks smaller than are currently allowed, however when the home was built in

1935 the setback requirements were different and Main Street has been widened since that time.

There is no change to the home’s footprint so it is still a conforming lot.

Commissioner Thompson made a motion to approve the clearance. Commissioner Lewis

seconded. Commissioners Thompson, Greenhalgh, Farmer, and Lewis voted in Favor with

Commissioner Dickey excused and Commissioner Anderson (Alt.) absent.

5.B. Public Hearing regarding a Rezone request from Dan Hunsaker, to rezone parcel 03-

035-0073 from (A) Agricultural to (R1) Residential.

Commissioner Farmer made a motion to open the public hearing at 8:07 p.m. Commissioner Lewis

seconded. All voted in Favor.

All persons listed above were present at the public hearing with Councilmember Daniel Grange

arriving in the middle of the hearing.

John Rhodes (property owner to the south of this parcel) – stated that he was told by Mr. Hunsaker

that he would never be able to build due to watershed issues. Mr. Rhodes wanted to know if that had

changed. He wouldn’t have bought if that was the case.

A map was pulled up showing the wetlands and floodplains in this area. No areas showing water

issues could be identified on the property in question other than the Garr springs canal on the south

border of the parcel.

Secretary Davis read a letter that had been submitted by Linda Hendrickson in favor of the rezone.

(See attached)

Development Coordinator Meadows clarified that the Garr Springs canal will be piped for further

development in this area.

Dan Hunsaker –When he started development in this area back with Phase 1 he did a wetlands study

for both parcels he owned. He stated that the map we reviewed today shows accurately. FEMA has

updated their floodplain maps since his original study. He also stated that the Army Corps of

Engineers stipulated that the canal never be piped solid straight through.

No additional comments were made.

Chairman Greenhalgh made a motion to close the public hearing at 8:16 p.m. Commissioner Lewis

seconded. All voted in Favor.

5.C. Recommendation to CC regarding rezone

Councilmember Grange noted there is value in allowing this subdivision as it brings in a second access

road to the south fields if they are developed.

Mayor Hair discussed the Rhodes property that is in the county. If the county developed this area they

would have to bring a road through his land, including 2 of his fences. The 100 E road only goes

across Robison’s property. There is a utility easement that goes to 200 E through his land, but it is not

a road.

Mayor Hair also mentioned that Hunsaker has already dug test holes on the parcel he’s developing and

left them open for a long period of time. Some areas have been identified that they should not have

homes with basements in them due to the high water levels.

Chairman Greenhalgh discussed the concept of the turnaround that was already in place for the

existing development and which was on an additional parcel which Hunsaker owned as well. If the

new parcel was developed it would require a new turnaround at the end of the road but it must be on

his own property. This situation has come up before with the assisted living facility proposed on the

north end of town which was denied because they could not fit a turnaround on their own property and

it was not allowed on another’s parcel.

The distance from 350 South to the end of his property was in question, but that will need to be

worked through with the subdivision development.

Commissioner Lewis made a motion to recommend to the City Council to approve the rezone from

Agricultural (A) to Residential (R-1). Commissioner Thompson seconded. Commissioner Farmer,

Greenhalgh, Thompson and Lewis voted in Favor with Commissioner Dickey excused and

Commissioner Anderson (Alt.) absent.

5.D. Zoning Clearance – Jeff Hurd, residence at 283 E 500 N, CopperLeaf, Lot 7, including

Hillside Overlay.

Mr. Hurd clarified that the lot was #16. (lot 7 was a misprint) It was correct on the paperwork.

This is a hillside overlay lot. All documentation had been provided and reviewed by Engineer Murray.

The house faces east with retention walls on the north side. No walls will be greater than 4 feet tall.

Commissioner Thompson made a motion to approve the clearance. Commissioner Farmer seconded.

Commissioner Farmer, Greenhalgh, Thompson and Lewis voted in Favor with Commissioner Dickey

excused and Commissioner Anderson (Alt.) absent.

Commissioner Thompson made a motion to recommend to the City Council to approve the Hillside

Overlay. Commissioner Lewis seconded. Commissioner Farmer, Greenhalgh, Thompson and Lewis

voted in Favor with Commissioner Dickey excused and Commissioner Anderson (Alt.) absent.

5.E. Water share transfers

Recorder Twedt has drawn up a document with proposed changes based on prior discussions.

Water shares are beneficial to Millville if they are Garr Springs or Millville.

A lengthy discussion was held regarding irrigation water, culinary water, and pressurized secondary

water; including when people are charged, how much they are charged, how often they are charged,

and also the impact homes have on the city. Most of the discussion had been reviewed and debated in

prior meetings before.

It was determined to move ahead with the changes currently proposed.

Commissioner Lewis made a motion to set a public hearing for Thursday, Oct 18, 2018 at 8:05 p.m. to

receive public input on changes to Ordinance 16.04.070: Rules. The changes are regarding water

shares required at time of subdivision. Commissioner Thompson seconded. Commissioner Farmer,

Greenhalgh, Thompson and Lewis voted in Favor with Commissioner Dickey excused and

Commissioner Anderson (Alt.) absent.

6. City Council Report – review minutes from the Sept 27, 2018 meeting.

No comments were made.

7. Agenda Items for Next Meeting

Public Hearing for water shares.

8. Calendaring of future Planning Commission Meeting

The next regularly scheduled meeting will be held Thursday, Oct 18, 2018.
