*DefinitionsGDOE is recognized as the State Education Agency (SEA) by the US Dept. of Education (USED).

School Districts are recognized as the Local Education Agencies (LEAs) by USED.

Total Formula Count is the Census count of the total number of children listed under the poverty, neglected, delinquent, foster, and TANF (Temporary Assistance for Needy Families) categories.

Set-asides are funds GDOE deducts from its Title I A allocation for School Improvement, Administration, and Academic Achievement.

Funds for each set-aside remain with GDOE. Funds for School Improvement and Academic

Achievement are spent on LEAs by GDOE.

There are two types of Charter schools:

A charter school created by the state school board is considered a Charter LEA.

A charter school created by a local school board is considered a school that is part of LEA.

Hold Harmless (HH) Provision

This provision, when it applies, protects LEAs from getting a decrease in their current year allocation based on the previous year’s allocation from GDOE.

There are 3 HH percentage levels: 85% 90% & 95% which are based on poverty levels within LEA.

In GA, LEA can receive an allocation that is more than its HH amount but not less.

The HH provision applies to the Basic, Concentration, Targeted and Education Finance Incentive Grant (EFIG) final allocations.

There are time limits with HH provisions.

Hold Harmless Percentages

The less poverty the LEA has, the lower its HH percentage will be.

95% HH- the poverty level of LEA is at or above 30%; held harmless for 95% of its funding.

90% HH- the poverty level of LEA is at or above 15%,but less than 30%; held harmless for 90% of its funding.

85% HH- the poverty level of LEA is below 15%; held harmless for 85% of its funding.

* Allocation Calculations All LEAs regardless of size are treated equally.

Basic: the LEA must have a minimum of 10 formula children and the total number of formula children must be at least 2% of LEA’s 5-17 population.

For example, if the total number of children aged 15-17 in LEA is 1,000 then the LEA would need to have a minimum of 20 formula children to receive these funds.

Concentration: the LEA must qualify for Basic and have a minimum of 6,500 formula children or the total number of formula children must be at least 15% of LEA’s 5-17 population.

For example, LEA has fewer than 6,500 formula children. The total number of children aged 15-17 in the LEA is 1,000. If the LEA has at least 150 formula children it would qualify for Concentration funds (1,000 x 15%= 150). If it has fewer than 150 formula children, it would not qualify to receive these funds.

Targeted & Education Finance Incentive Grant (EFIG): the LEA must have a minimum of 10 formula children and the total number of formula children must be at least 5% of LEA’s 5-17 population.

For example, if the total number of children aged 15-17 in LEA is 1,000 then the LEA would need to have a minimum of 50 formula children to receive these funds.

Neglected and Delinquent (N&D) Count

In October LEAs are required to count children that are neglected (e.g. foster children) or delinquent (e.g. housed in a juvenile detention center) and report the numbers to GDOE.

GDOE compiles these numbers into a report sent to USED.

GDOE uses this count to calculate the neglected and delinquent allocation.

Funds for Title I, Part D, Neglected and Subpart 1, Delinquent funds

Subpart 1- USED issues a separate grant for delinquent children. The Dept. of Juvenile Justice (DJJ), Dept. of Corrections and the Department of Behavioral Health and Developmental Disabilities (DBHDD) receive these funds directly because they are the only state agencies in Georgia that directly serve delinquent children.

Allocations for neglected children are reserved from the final Title I A allocation calculated for each LEA under Basic, Concentrations, Targeted and EFIG funds. They are not additional funds.

LEAs are required to use these funds to provide services to children classified as neglected. These funds stay with the LEA.

* Approval

Allocations to LEAs must be presented to the State Board of Education (SBOE) for approval.

Preliminary allocations are posted to the GDOE website as UNOFFICIAL.

Once approved by SBOE the allocations are reposted to the GDOE website as OFFICIAL.

Any change in the allocation to LEA must be presented to SBOE for approval before the change is official.

* Allocation Process for II A GDOE as the SEA sets aside 1% of its total IIA grant

award allocation for administration as authorized by legislation.

After setting aside the administration funds at the state level. 2.5% of the remaining grant is awarded as a subgrant to the Board of Regents in GA and 2.5% is set aside for program activities at the state level.

After all the set-asides have been calculated, the remaining grant funds are made available to eligible LEAs.

LEA base allocation originates with its FY02 allocations for Class Size Reduction and Eisenhower Math & Science to keep LEAs at a hold harmless level as authorized by NCLB.

After the base allocations are calculated, 80% of the remaining grant is given to LEAs based on their poverty count data. 20% of the remaining grant is given to LEAs based on their 5-17 children count data. Poverty and 5-17 data are provided by USED.

A per pupil allocation is calculated using the number of poverty children and total 5-17 population for GA.

Each LEA allocation is done by calculating the per pupil allocation by the number of poverty children and 5-17 population for each LEA.

GDOE as the SEA sets aside 5% of its total Title III A grant award for state level activities as authorized by legislation.

After setting aside the funds for state level activities, the remaining 95% of the allocation is awarded to LEAs.

90% of the remaining 95% in grant funds is allocated to LEAs based on the number of LEP students served by the LEA. LEP student counts are submitted to GDOE by LEAs annually.

10% of the remaining 95% in grant funds is allocated to LEAs who have experienced a significant increase in the number of immigrant children as compared to the average from the preceding two fiscal years.

For FY07 the significant increase was measured by taking the lowest-average percent increase of LEAs still serving 40 or more students which allowed all LEAs serving at least 40 immigrant students to receive these funds (LEAs serving 40 or more students are held to Title III A requirements).

LEA must have enough LEP students to generate a grant allocation of at least $10,000. Since LEP student counts fluctuate each year, the amount of LEP students needed to meet this threshold also changes. For example, in FY07, LEA needed a minimum of 63 students to meet the $10,000 threshold. In FY06, a minimum of 48 students was needed.

In FY07, GDOE created an LEP Consortium consisting of LEAs serving LEP students, but not enough to receive a grant award. The LEP students of these LEAs were grouped together, so an allocation could be generated.

*TITLE VI B 2- Rural and

Low Income Schools

Title VI, Part B, Subpart 2 allocations are done based on a report sent by USED indicating which GA LEAs are eligible to receive Rural and Low Income School (RLIS) funds.

GDOE as the SEA sets aside 5% of the Title VI B 2 grant for state level activities as authorized by legislation.

After setting aside the funds for state level activities, grant awards for eligible LEAs are based on a per pupil allocation derived from average daily attendance figures provided by USED.

Take LEA previous year Title I A allocation from GDOE (not USED) and multiply by LEA hold harmless level.

This will give you approximately how much LEA will

receive for the upcoming fiscal year. This only works for Title I A since it is the only grant with hold harmless provisions.

For example, if LEA previous year allocation from GDOE was $1,000,000 and hold harmless is 90%, LEA will receive approximately $900,000 for upcoming school year.

NOTE: If Georgia’s SEA allocation from USED decreases, all LEA allocations would also decrease.
