This Regulation may be cited as the "Veterinary Drug

and Animal Feed Administration and Control

Authority Establishment Council of Ministers

Regulation No. 272/2012".

Definitions

In this Regulation unless the context otherwise requires:

1/ "Proclamation" means the Veterinary Drug and

Animal Feed Administration and Control

Proclamation No. 728/2011;

2/ "veterinary drug", "feed" and "feed additives" shall

have the meanings assigned to them under Article 2

of the Proclamation;

3/ "Ministry" or "Minister'' mc:ans the Ministry or · Minister of Agriculture, res~~tively;

4/ "Region" means any regio111 referred to under

Article 47{1) of the Constitution of the Federal

Democratic Republic of Ethiopia and includes the

Addis Ababa and Dire Dawa c:ity administrations;

5/ "P.erson" means any natural or· juridical person;

6/ any expression in the mascuiline gender includes

the fembine.

3. Establishment

1/ The Veterinary Drug and Feed Administration and

Control Authority (hereinafter the "Authority") is

hereby established as an autonomous federal

government organ having its 01wn legal personality.

2/ The Authority shall be accountable to the Ministry.

4. Head Office

The head office of the Authority shlall be in Addis

• Ababa and it may have branch offi,ces elsewhere, as

necessary.

S. Oblectlve

The objective of the Authority shall be to ensure

improvement of animal productivity and availability of

wholesome animal products to the consumers.

6. Powers and Duties of the Author!n:

1/ The Authority shall have the powers and duties to:

a) exercise the powers and dluties granted to it by

Article 20 and other releV'ant provisions of the

Procla~ion;

b) collect service fee m' accordance with the rate

determined by the government;

c) own property, enter into ,contracts, sue and be

sued in its own name;

d) perform such other related activities as may be

necessary for the attainment of its objective.

2/ The Authority mil¥, where it finds it necessary,

delegate part of its pow,ers and duties to

appropriate regional organs. \

7. Organization of the Authority

The Authority shall have:

1 / an Advisory. Board;

2/ a Director General and, as may be, necessary, Deputy Director Generals to be appointed by the

government; and

3/ the necessary staff.

9. Duties and Responsibilities of the .Advisory Board

The Advisory Board shall hav,e the duties and

responsibilities to provide advice on:

1 / the fonnulation and impleme111tation of policies,

strategies and guidelines for ,ensuring the safety

and efficacy of veterinary drugs and quality

standards .of feed;

2/ proper disposal system for expi:red and substandard

veterinary drugs, feed and feed :additives;

3/" the implementation of international agreements

concerning veterinary drugs andl feed.

10. Meetings of the Advisory Board

1 / The Advisory Board shall meet: as frequently as its

functions require.

2/ There shall be a quorum wher•e more than half of

the members of the Advisory Board are present at

any meeting.

3/ Decisions of the Advisory Board shall be passed by

majority vote; in case of a tie, the Chairperson shall

have a casting vote.

4/ Without prejudice to the provis:ions of this Article,

the .~ dvisory Board may_\ dopt its own rules of

proc~ure.

11. · Powers and Duties of the Director General

1/ The Director. General ·shall be the chief executive . .

officer of the Authority and slhall, subject to the

general directions of the Miinistry, direct and

administer the activities of the Authority.

2/ Without limiting the generality ,of sub-article ( 1) of

this Article, the Director Genera.I shall:

a) exercise the powers -a1nd duties of the

Authority stated under Article 6 of this

Regulation;

b) employ and administer employees of the

Authority in accordance with the federal civil

service laws;

c) prepare and submit to the: Ministry the work

program and budget of the Authority, and

implemeht same upon approval;

d) effect payments in accordance with the

approved budget and wo,rk program of the

Authority;

e) represent the Authority i1n its dealings ~ith

third parties;

f) prepare and submit to the Ministry the

performance and financiial reports of the

Authority.

3/ The Director General may de:legate part of his

powers and duties to other officers and staff of the

Authority to the extent necessary for the efficient

performance of the activities of 1the Authority.

Budget

The budget of the Authority shall be allocated by the

government.

13. Books of Accounts -

1/ The Authority shall keep complete and accurate

books of accounts.

2/ The books of accounts of the Authority shall be

audited annually by the--Auditor General or by an

auditor assigned by the Auditoir General.

14. Effective Date

This Regulation shall come into force on the date of I

publication in the Federal Negarit Gazette.
