NATIONAL SOCCER LEAGUE Special CM The Chairman stated that clubs would now go to the Competitions with full knowledge of the relegation-promotion formula. 3RD DIVISION; The Chairman stated that there was nothing to discuss in the 3rd division except to in- form the meeting that the Executive Committee had resolved that four (4) teams from the two (2) Regional Play-offs be promoted to the OK League at the end of 1991 as against the two (2) teams in previous years, this was a recommendation subject to this meeting's ratification. The basis was two (2) from Transvaal and two (2) from Natal. The house duly accepted the recommendation. The Public Relations Officer stated that clubs will observe from the number of teams making up the OK League that it was not only two teams that have been promoted. The Chairman informed delegates that as to the actual playing of matches in the 3rd di- vision, there would be streams set up Regionally on a geographical basis so as not to travel long distances. The regions would be Natal, Transvaal and OFS combined. With regard to referees, it was resolved that RASA must appoint them within the area in which they live to cut down on Referees' Travel expenses. ASSOCIATED LEAGUES: The Chairman stated that these Leagues will be dissolved this year and will fall in with the 3rd division and play under the same auspices as the 3rd division. line FRIENDLY MATCHES: Mr Mahlangu of Witbank Aces stated that since the embargo of friendly matches was im- posed pending the recommendations of the Commission of Enquiry on the Orkney dis- aster, clubs were unable to test their strength in order to prepare for the new season. The Chairman replied that the Commission has almost completed its responsibility and during next week they would report to the Management Committee in as far as the poli- cy with regard to friendly matches is concerned to avoid any recurrence of such a disas- ter in the future. The Chairman further stressed that this matter was not negotiable. SASA TO NSL PROMOTION: Mr Lekgetho asked what the quota was for promotion from SASA to NSL as there was a heavy inflow due to the unavailability of grounds in the townships. As regards the stadium and facilities there was a Committee that had been appointed but unfortunately members had not yet replied as to whether or not they are prepared to serve on that Committee and as soon as the Committee was in place they would be asked to get in touch with Mr Lekgetho. Mr Peter Evans asked whether the EPL teams would be integrated with the other teams or whether the FPL teams would form a stream of their own? The Chairman replied that those teams would be integrated in the streams in their local- ity.

3RD DIVISION;

The Chairman stated that there was nothing to discuss in the 3rd division except to in­form the meeting that the Executive Committee had resolved that four (4) teams from the two (2) Regional Play-offs be promoted to the O K League at the end of 1991 as against the two (2) teams in previous years, this was a recommendation subject to this meeting's ratification. The Chairman informed delegates that as to the actual playing of matches in the 3rd di­vision, there would be streams set up Regionally on a geographical basis so as not to travel long distances. The regions would be Natal, Transvaal and OFS combined.

With regard to referees, it was resolved that RASA must appoint them within the area in which they live to cut down on Referees' Travel expenses.

The Chairman replied that the Commission has almost completed its responsibility and during next week they would report to the Management Committee in as far as the poli­cy with regard to friendly matches is concerned to avoid any recurrence of such a disas­ter in the future.

The Chairman further stressed that this matter was not negotiable.

The Chairman further informed members that the play-offs would determine the teams to be promoted and further meetings with the 3rd division team at their various areas would be held.

OTHER MATTERS:Mr Vincent of Oppenheimer Fast XI requested that members of the Committee should at­tend some of the matches in the 3rd division because on one occasion they played a match on Tuesday which ended on Wednesday.

The Chairman informed the members that the point is noted as serious because some Referees tend to look down upon the teams in the lower leagues.

The second question was about registration of amateur players and those who were with the FPL or former NSL?

The Chairman informed the meeting that it had been resolved at the last joint meeting of the FPL and NSL Executives, that the determination of players registrations would be which club last registered the player at the end of 1990 and that would be the club recognised to be last registered with. The meeting duly accepted this proposal as most convenient and reasonable, and in response to the 2nd question, he was referred to and advised on what was contained in the constitution.

SCALE OF FEES;The Chairman asked the recorder to give the members the Scale of Fees applicable for 1991.

The recorder duly gave the members the fees as adopted by the Management Committee.

There being no further business, the meeting was terminated.

The Chairman declared the meeting opened.

OPENING REMARKS:The Chairman informed the delegates that the League's Legal Adviser Adv. N. Cassim had been invited to come and give delegates the spirit of the amendment which had been proposed by the Executive Committee.

Advocate Cassim informed the delegates that in principle he wanted to motivate and at­tempt to demonstrate to them that the framers of the amendment and proposed adopters, namely the Executive Committee have not abandoned the prime objective in any dispute is the pursuit of truth, that has not been abandoned or abolished in the proposed amend­ment.

He then demonstrated by comparing the present situation against the future if the amend­ment is adopted, the need for the amendment is a speedy resolution of any dispute that lies before the League.

The present system envisages that any dispute before the League is firstly determined by the Disciplinary Committee and if the grievant party is not happy with the result, then there is an Appeal Board and it stops there whether you like or don't like the decision, but there is a law called the review procedure which means that any in tribunal there is an inherent review power of the court which means that if you are not happy with the proceedings resulting in the outcome of the decision, you can take those proceedings on review, you go to the Supreme Court and you do not say to the Supreme Court we want you to find that we the losing party are right and the winning party is wrong, that is not what the Supreme Court can do, all what the Supreme Court can do is to examine the procedure and find whether there was what is known in legal terms as a reviewable ir-

regularity and if the court finds that there was a reviewable irregularity, all that the court can do is to set aside the decision and send it back to the body that took the decision.

He gave an example and stated that when a person is accused of an offensive behaviour, he must be presented with it and he must be given an opportunity to be heard and that is called basic principles of natural justice and fair play and that is what happens in a re­view case.

Advocate Cassim further stated that the reason for this amendment is that a speedy reso­lution can be achieved as against a court review which would under normal circum­stances take three months and this creates havoc for the League.

The judge cannot substitute his decision for the decision of the Disciplinary Committee and the Appeal Board, all he can do is setting aside and sending it back for review.

All what the League was creating now, was a system where the Arbitrator will not only exercise review powers, he will ultimately decide what is right and wrong, so in fact the criticism that the clubs are limiting their rights with respect is wrong, because in the amendments the club are given greater rights, the greater right is that if somebody is un­happy with the Appeal Board, then he can go to the Independent man who will be set up by the League, but then the club must accept his decision as final and binding.

He further stated that the development of alternative dispute resolution, is a very very strong rising phenomena mainly in the western world and understands that the FIFA statutes have this clause.

The Chairman thanked Advocate Cassim for the dissection of the amendment and would now ask the Chief Executive Officer to give the principle of the amendment.

The Chief Executive Officer stated that the clubs had heard a presentation putting across the Lawyer's perspective and would now endeavour to put across the Soccer Adminis­trator's perspective.

The clubs must never lose the opportunity to improve their constitution wherever it oc­curs and must see that positively at all times.

A constitution is a dynamic document for as long as there is an Association of people or people constituting an Association such as the League for so long does the potential exist for dispute and disagreement, therefore, for so long as the potential for improving a Con­stitution exist, the Constitution of America is referred to very often as a classic case of a document that old and yet still in the making.

The main objective therefore of assembling in this manner in this house today is to seize the opportunity to improve our constitution, to rearrange or regulate our relations and rights to one another afresh, remembering that as we go about our business of organising and administering soccer, we do so with a bond and duty firmly imbedded at the back of our minds and that obligation is to ourselves members of this organisations, our sponsors, people who invest in our activities for us to realise our aims, we have a bond and duty to spiritual owners of your clubs, your supporters.

Therefore, as we carry out our activities we must remember we have one resource among others that is not available unendingly and that is time in whatever we do we must do in a reasonable time frame, we must do in order to come to a solution as quick­ly as possible.

The Chief Executive Officer had been called upon at the last media conference the con­tention being that the League was to embark on an exercise that will have the effect of tempering adversely with the rights of individuals and the rights of clubs, to take away those rights, to diminish the role of justice in the scheme of things in the League, gave him the opportunity to recall the genesis of that issue as has been debated by the press.

The SpursAVanderers/Darkies case was not necessarily the one that motivated this trend of thinking in the circles of the Executive Committee, there is a case which left the Ex­ecutive in no doubt by the end of last year that this mechanism had to be introduced and that was the Pretoria CalliesAA/itbank Shepherds case. If the SpursAVanderers/Darkies case has contributed, it has contributed only to reinforce the conviction and we are not attempting to passing a vote of no confidence in the Courts of the land, all we are say­ing is that organisations such as ourselves do have their own unique ways and mecha­nisms of resolving their problems and we don't need to be burdening the courts who are already so overladen with work and there lies the crux of the matter.

The courts are not always likely to give the attention on your problem the urgency you may desire.

As the Spurs/Wanderers case unfolded, there came a cry from the media quarters and it was the League that was hung, that this cannot be allowed to continue, this is not the way that members of an organisation such as this one should go about resolving their dis­putes.

Those self-serving newspapers last week did a complete turn about and now crying to high heaven that this cannot be right, if this were to be channelled successfully it cannot be fair for the clubs of the League.

Now delegates are to remember that newspapers have a different agenda and as the say­ing goes "wear different hats for different functions" and their main preoccupation is to sell newspapers and to increase circulation unless there is an element of sensation, news­papers will not sell as the owners would want them to sell.

Soccer stands on the brink of CAE and FIFA membership and both constitutions of these organisations contain this clause.

He stated that it was unfair on the part of Sunday Times to use Jomo Sono's image and name to convey to the League that one of the members is in disagreement with the League, it is not Jomo talking there and this was told to the newspaper and they did not dispute it, it is the Sunday Times talking, they are fermenting an element of sensation in order to bring about an increased circulation.

But all what the League seeks to say in the amendment is that let us agree that we will provide for expeditious resolving of our disputes and disagreements, in the course of it, it is judicious that the Arbitrator will be the ultimate level of appeal, let us agree to contract out the right to go to the Supreme Court and remember this is a very vital and crucial point that is totally overlooked, that going to the Supreme Court is a privilege of the few, a privilege of the monied and excludes the majority.

The Chairman stated that now was the time to ask questions but his common sense told him that questions would be raised as the proposed amendments are read and he called Mr Hacker to read the proposed amendments.

Mr Hacker read the amendments as detailed hereunder:

An appeal against any finding, penalty, decision or sentence of any sub-committee or disciplinary body constituted in terms of this Constitution or any Rules and Regulations formulated in respect of any competitions concerning the NSL, shall lie to the Appeal Board and thereafter lie only on an Arbitrator, in accordance with what is provided below.

ARBITRATION:1. (a) All members of the NSL, without limiting the generality thereof, shall include

clubs, officials and players, shall be obliged to submit their disputes of whatsoev­er nature in the event of any party not being satisfied with the decision of the Ap­peal Board, to the arbitration within seventy two (72) hours of such decision.

(b) The Arbitrator's decision shall be final and binding on the parties and no appeal shall be entertained.

(c) The parties before the Arbitrator, including the NSL, shall be entitled to legal rep­resentation.

(d) The Arbitrator shall be, if the question in issue is:(i) primarily an accounting matter, an independent auditor of not less than ten

years standing;(ii) primarily a legal matter (including the interpretation of the Constitution and/or

Rules and Regulations of the League), a practising Senior Counsel;(iii) Any other matter, an independent person.

The Chief Executive Officer of the NSL shall submit a list of THREE PERSONS NAMES to the parties in dispute and if within three days thereafter they do not mutually agree upon their election of an Arbitrator from such list and ad­vise the League, the appointment of the Arbitrator shall be determined by the Chairman of the local Bar Council.

(e) The Arbitration shall be held:(i) At a venue to be determined by the Chief Executive Officer;(ii) informally and in a summary manner i.e. on the basis that it will not be nec­

essary to observe the strict rules of evidence or the usual formalities or pro­cedures;

(iii) immediately with a view to its being completed within twenty one (21) busi­ness days after it is demanded;

(iv) in all other respect under the provisions of "The Arbitration Act 1965"(f) The Arbitrator shall have the power to open up and review and revise any opin­

ion, decision, requisition or notice and to determine all matters in dispute which shall be submitted to him and shall determine the procedure to be adopted upon every or any such reference. Dispute, determination or award shall be in the sole and absolute discretion of the Arbitrator, who may determine the dispute in all re­spects.The Arbitrator's decision in all respects shall be final and binding on all parties concerned.

2. The Chairman declared the meeting opened.

OPENING REMARKS:

The Chairman welcomed the delegates to the meeting. He stated that in the History of any organisation whether big or small or any organisation in total control of a situation you have a crisis, in a different way in that they think that an organisation is now weak and therefore, should re-assess itself and others view a crisis as a panic situation but those people who have their senses, who realises that a crisis in any organisation whether big or small, powerful or weak is healthy and is healthy for one reason only that if an organisation is shaken into a situation of complacency it immediately has the op­portunity of being forced on itself to carry out the process of reassessment and what we have in the proud history of the League in 1991 is a series of events that have culminat­ed into today's meeting which in his view was an exercise of reassessment.

How are we conducting ourselves, how we propose to conduct ourselves and where have we gone wrong and if we have gone wrong, lets put our heads together, lets not all get excited, lets not start calling each other names, lets not blame any one, two or three individuals, but lets put our heads together as members of this organisation and resolve our problems and ensure that when we leave the meeting today the League will grow stronger than it has ever been.

He stated that he made these remarks because of their relevancy, as the League has un­derwent a series of traumas in the last 60 days and were well known to the members and was requesting the members present for their unwavering support, commitment and promise that even if a member has to die for the League that members are prepared to do so.

1. CREDENTIALS

Mr Leboa stated that in terms of Article 12.13 of the League's Constitution, clubs repre­senting the Divisions are:

3. JOMO MIDAS COSMOS SUPREME COURT APPLICATION TO LIQUIDATE THE NSL

The Chairman informed the members that this was the subject matter which had caused this meeting to be convened originally.

The matter had now been settled and the Chairman gave the meeting a brief resume that the application was lodged in the Supreme Court in Johannesburg for the liquidation or alternatively the suspension of two senior officials and further alternatively, the Executive was entrusted with the task of opposing the application.

The Chairman stated that he was not going into the merits of the application and would also not deal with the contentions which were listed in the application because he felt it was now not necessary for this meeting. After the Acting Chairman filed affidavits on be­half of the League there were certain decisions that were taken and at the end of it all the application was withdrawn by the applicant, the League agreed to pay half of the appli­cants costs and the other half be paid by the other two parties.

That is the result of the Supreme Court application.

The Chairman stated that he would not want to throw this matter open for discussion as it would not serve any purpose, it was history and the upshot of this application not im­portant for the rest of the meeting.

The Executive Committee at a meeting after advice from Senior Counsel, Mr Cilliers de­cided that in view of some of the allegations made in the press, the Executive Committee was happy to step down, that clubs decide who must be in the Executive Committee and the Acting Chairman had made this undertaking in the affidavits filed with the Court and that is why there is an immediate problem of overcoming the present Constitution which does not make provision for holding elections in extraordinary circumstances and the cir­cumstances found today are extraordinary.

The proposals to the amendment of the Constitution attached to the circular convening this meeting are proposals coming directly from the Senior Council.

The proposals are in two fold:

They deal with the situation where the meeting has to amend the existing Constitution, because the existing constitution makes no provision for an election today of the Execu­tive Committee and to complicate the matter a little bit more, there is a situation where this League was officially launched in 1991 and therefore, there is an agreement which has been entered into with the former Eederation which allowed for five (5) former mem­bers of the FPL to occupy five seats in the Executive Committee, one of which would be the Vice-Chairman.

The advice of the Senior Counsel was that the agreement could not be interfered with, therefore, whatever amendment was made to the Constitution had to embody the agree­ment for two reasons:

- it was an agreement to unify;

- it was embodied in the Constitution.

The other problem was that there is a clause in the Constitution which says there shall be no elections in 1991 season.

The proposals that will be made will sufficiently take care of the situation.

4. COMMISSION OF ENQUIRY

The Chairman stated that there had been a fair amount of criticism in some instances rightly and others wrongly of the manner in which the whole matter had been dealt with, the strongest criticism being that the Executive Committee appointed an internal com­mission consisting of members of the Executive Committee to investigate matters con­cerning other members of the Executive Committee and quite rightly the perception out there is that this is a cover-up and this is just members of the Executive Committee trying to put it mildly in order to pull a job on the organisation.

The Chairman stated that he wished to explain this situation in order to clarify the per­ception which has been floating around. Initially, when this whole problem arose, the Ex­ecutive Committee in its wisdom felt that it should consult with first division clubs which it did. At that first division clubs meeting the recommendation of the first division clubs was all three persons who were not named in that meeting should immediately be sus­pended and an Independent Commission of Enquiry consisting of somebody outside the organisation, a retired judge or Senior Counsel should head a One Man Commission to investigate the entire matter.

The Executive Committee took that recommendation and consulted Senior Counsel whose advice was the following;

- If you appoint an Outside Commission you shall be faced with an immediate frustra- tive delay, which meant that anyone of the three persons was to testify before a Re­fined Judge or Senior Counsel or Outside Person.

That person would state that he is not prepared to divulge information he has, he may be incriminated in a criminal trial, tbe matter is sub-judice and therefore, until his criminal matter is sorted out, he is not prepared to say anything, that would have caused that Commission to delay proceedings there and then.

His advice was as follows:

- There is also the problem of the Attorney General, who will exercise his privilege as he is entitled to stop you from holding a public Commission because it would inter­fere with his investigations and that there is nothing precluding from having an in­ternal Commission, and on that basis advised to go ahead with the Commission, and this was given to clubs of the first division and they accepted.

The Commission had encountered problems in that most of the organisations' documents had been taken by the Attorney General because of the criminal investigations and a meeting had been held with the Attorney General, but he stated that he was still prepar­ing and once he was ready to serve indictments or charges against the parties concerned would then give the League all the information which it needed which was in his pos­session and whilst he was preparing indictments was not prepared to part with informa­tion.

This situation had to be accepted.

At a meeting of the first division clubs last week it was felt that the Chairman of the Com­mission had now become Acting Chairman of the League and that created a conflict and was felt that the Acting Chairman of the League stand down and recuse himself from the Commission and this was accepted. The other view was that because of all allegations of an internal cover-up, the Executive Committee should seriously consider expanding the Commission to include two club representatives, one member from Disciplinary Com­mittee and one member from SAFA subject to ratification by this meeting.

One Disciplinary Committee Member: Mr D Norman One SAFA Member: Mr S Morewa

The SAFA nominee was subject to approval by SAFA Executive Committee which has since approved.

The Chairman stated that the ratification of the meeting is required for the expansion of the Commission to include the above persons.

The convenor of this Commission in following protocol would be Mr S Morewa (SAFA)

Mr Lekgetho asked the Chairman to give a report of what caused the Court Action in de­tails because he would not want to believe what he had been reading from the press. The Chairman gave a detail outlined as to what transpired from the Court Application and ultimately the Out of Court Settlement.

Mr Letuka suggested in view of the elections to be held later, he requested that the Act­ing Chairman should be included in the Commission as the Convenor.

Mr Motaung replied that the Convenor be Mr S Morewa and the Acting Chairman be left from the Commission.Mr Selane asked for the terms of reference for this Commission. The Chairman replied that unfortunately the minutes of the Executive Committee were not available and broad­ly the Commission was obliged to investigate and report on the entire sponsorship monies due to the Eeague.

Mr C Kgosana asked as to whether there were no able bodied persons in the second di­vision to represent them.

Mr Motaung replied that he wished to concur with the previous speaker and suggested that Mr J Lekgetho (second division) be included.

This was duly accepted by the house, and the other members were also ratified as prop­erly included in the Commission.

The other members of the Commission from the Executive Committee are:

5. AMENDMENTS TO PROVISIONS OF THE NSL CONSTITUTION IN TERMS OF THE PROPOSALS

The Chairman asked Mr Hack to deal with this item. Mr Hack asked the house for the comparison of the Constitution as against the proposals.

Mr Hack stated that the Executive Committee had resolved to add that:

- Clause 6.1.1. (v) and 6.1.3. (dd)

Public Affairs Officer be removed from the election roll, that position would be ap­pointed by the Executive Committee on the basis of an employed person as opposed with the powers to vote.

- 1.1. Clause 6.1.2.1.

The deletion of: "It is specifically recorded that the shall be no elections for the 1991 season"

- 1.2. Clause 6.1.2.2A

If circumstances require, the Executive Committee may also be elected at an extraor-

dinary General Meeting of the League, convened, inter alia, for such purpose, in which event, the provision of clause 6.1.2.2. shall not apply. Nominations shall be made orally by the Chairman of the proposing club and by the Chairman of the sec­onding club.

Voting shall be by show of hands and the provisions of 12.2. to 12.10 and 12.13 and 12.14 shall apply.

In the event that the Constitution is amended as set out above, all existing members of the Executive Committee shall stand down and an Extraordinary General Election of the Executive Committee shall take place, provided that the provisions of the agree­ment concluded between the League and the clubs of the former Federation are com­plied with.

The Chairman asked as to whether the above amendments with the exception of Clause 6.1.4.2.4. are being accepted by the Elouse to be included in the Constitution and the house affirmed.

The Chairman asked as to whether was there anyone in the house in disagreement with the proposals, and there was none.

Mr Selane asked as to whether if the agreement of the League and the former Federation clubs has to stand, does it mean that when the elections are held now the Federation clubs would not take part in view of the agreement being honoured.

The Chairman replied that legally they are entitled to vote but normally they are not, be­cause the moment they have their five in they cannot vote.

Mr Selane asked that the Chairman make a ruling on that.

The Chairman stated that he cannot give a ruling on that as it was a constitutional ruling and thus he cannot make a ruling. Mr I Khoza stated that there was a bit of discrepancy here in that the former Federation Clubs voted for the five people in the Executive Com­mittee and the former NSL clubs did not vote for those members and would be unfair for the League to allow the Federation clubs to vote for the Executive Committee whilst the five members are being retained.

The Chairman stated that this was a moral argument which was right as this meeting is constituted in terms of the Constitution and the people that are to be barred now have participated in all deliberations and legally they cannot be barred. Whilst there is a moral argument the Chairman could appeal to former Federation clubs to exercise their moral obligations not to vote in the issue where former NSL clubs are voting, but cannot bar anyone from voting, because it would be wrong and illegal.

The Chairman appealed to the house to exercise their patience and morality as he can­not stop anyone here from voting who is entitled to vote.

Mr Chachalia stated that it was proper and correct that if an agreement was reached be­tween the two parties and because of the problems that the League have, that agreement be honoured as a matter of morality and once the agreement is honoured then the posi­tion of voting is a matter that you cannot rule on, the same reciprocity is expected from the former Federation clubs, if they do not indicate very clearly that they will not vote then they must all also stand down as the Constitution was all to stand down.

The Chairman stated that this clarifies the position.

Mr Gumede stated that it would be unfair to the former Federation if the five members could stand down as they are unknown to former NSL clubs and the former Federation clubs would be out-voted and this was a reality.

The Chairman then addressed himself to the former Federation clubs that as former Chairman of the former Federation, for their assurance in the light of the spirit of the

agreement and the acceptance of the spirit of the agreement this morning they would not vote in the elections of the other positions in the Executive. He asked as to whether there was any ex Federation club that disagrees with this motion.

There was no ex Federation club that disagreed with the motion and the Chairman closed this discussion.

The Chairman then stated that the entire Executive Committee in terms of the Court Set­tlement is now dissolved.

Mr J Mahlangu moved that the five members of the former Federation are in included in the Executive Committee and was seconded by Mr J Khumalo.

Mr Olifant of SAFA was nominated the Returning Officer.

Mr Olifant stated that the elections would be held for the following:

- Chairman- First Vice Chairman- Treasurer- Five Executive Members

Mr Cumede moved that the members of the Executive Committee be returned en bloc and only elect the Chairman and the Vice Chairman be elected and was duly seconded by Mr I Khoza.

The nominations for Chairman and Vice Chairman were:

Messrs K Kunene - proposed by Mr K Motaung and seconded by Mr J Mahlangu L.M. Taunyane - proposed by J Sono and seconded by V Mahlangu.

Mr I Khoza proposed closure of nominations and was seconded by the house.

The said nominees were asked to recuse themselves after they had been asked as to ac­ceptance of nomination.

Mr Mahlangu proposed that the person receiving a lesser vote should be Vice Chairman and was seconded by the house.

Voting was announced by the Returning Officer as follows:

Mr Kunene - 162 votes Mr Taunyane - 74 votes Messrs K Kunene - Chairman L Taunyane - Vice Chairman

Mr Kunene took the rostrum and informed the clubs that as they had shown confidence in him he wished to inform the third division clubs that he would be making himself available to address meetings at their various regions as he realised that they were being neglected.

There being no further business the meeting was declared terminated.

CHAIRMANS ADDRESS NATIONAL SOCCER LEAGUE

SUNDAY APRIL, 26TH 1992 AT SOCCER CITY - FIRST NATIONAL BANK STADIUM

Seven years ago, the National Soccer League was born. The birth of this child is well documented and we need not go over it again.

Suffice it to say, teething problems aside, the child is growing and barring the unex­pected, will come of age in the not too distant a future.

Mr. Vice Chairman, members of the Executive Committee, honoured delegates and ob­servers, distinguished guests, ladies and gentlemen, it is indeed a great pleasure for me to welcome you all to this august gathering.

Seven years ago when this league was formed, its future was pregnant with many pos­sibilities. Given the circumstances of its formation, there was always the possibility of its demise. Thank God, it has not come to that.

The last 12 months have been the most traumatic in the history of this body. The problems the organisation went through are well known to most, if not all of you. These were both of an external and internal nature - largely the latter.

As you are well aware, I was elected to the chairmanship of the NSL last year in very unusual circumstances. I took over midstream, so to say, but even more problematic, at the time the NSL was in the midst of a crisis of monumental proportions.

There was a time when it appeared that the very existence of this organisation was on the line. Again, thank God, it did not come to that. We managed to weather the storm.

I know I have come in for criticism from some of you. Some of it was well meaning, but somewhat a little misplaced on some occasions. Belieye me, I accept criticism. Con­structive criticism builds us all. However, I wish to tell you here today how I saw things in the last eight months, and how I see the future.

One of the difficulties 1 experienced was that I took over the leadership of the NSL at a time when its administration was in shambles. Things were chaotic and sometimes seemed to me and to others, that we were on the verge of collapse, administratively and financial.

When I say this, I am not trying to reflect negatively on anyone who served on the NSL in any capacity whatsoever. I am not even trying to gloat over whatever small achieve­ments, if any 1 made in the last eight months.

The simple truth is that this was the state of affairs when I took over. The truth may often be bitter but if this organisation has to make any progress, as indeed it should, cer­tain unpalatables have to be said.

A chairman of an organisation such as the NSL is usually not required to attend to its day to day running. This aspect is usually left to the administration staff.

But, in the unique circumstances of the time, 1 found myself called upon to attend to numerous administrative matters that required urgent attention as the NSL lurched from one crisis to another.

As the media made one disclosure after another about the abuse of funds and power in this organisation, I found myself having to deal with the Press almost 24 hours a day, seven days a week! No joke about it.

In effect, I was often called upon to act as general manager because the previous in­cumbent was forced to vacate the position in the wake of allegations of wrong doing on his part.

I also found myself being forced to serve as Public Relations Officer of the organisa­tion. 1 need to state here that whereas I was aware of the problems of the NSL when I took over, I had not fully understood their enormity.

All this, together with the simple fact that I am a lawyer with a firm of partners and obligations to them (partners), made demands on my time that at times 1 found it difficult to meet.

My endeavours to attend to everyone's problems, I regret to say, were not always suc­cessful. I trust that my efforts to treat all the members equally were visible.
