National PREA Resource Center Certified Auditor Newsletter April 2016 This auditor newsletter contains important information regarding requirements for maintaining PREA auditor certification from the US Department of Justice (DOJ). Please read it in its entirety. Understanding the New FAQ Regarding Placement of Transgender Inmates and Residents The DOJ PREA Working Group recently released an FAQ regarding appropriate housing and programming placement decisions for transgender inmates and residents. The FAQ, which was added to the PREA Resource Center (PRC) website, includes clarification on the requirements in standard 115.42 and information that is critical for auditors to understand as they assess an agency and facility’s compliance with this standard. The information in the FAQ was a central piece of auditor training and should not be new to auditors. However, it provides information that is likely to have a large impact on practice in the field, and auditors should be prepared to cite the standard requirements and the relevant FAQ when conducting audits. The FAQ clarifies that “Any written policy that assigns transgender or intersex inmates or actual practice to gender-specific facilities, housing units, or programs based solely on their external genital anatomy violates the standard.” (Emphasis added). Policies and practices must require an individualized assessment and must give “serious consideration” to transgender or intersex inmates’ own views with respect to safety in order to be PREA compliant. As the FAQ states, “The assessment, therefore, must consider the transgender or intersex inmate’s gender identity—that is, if the inmate self-identifies as either male or female.” It is the auditor’s responsibility to examine both an agency or facility’s policy and the actual assessments to determine whether the agency is, , conducting individualized, in practice case-by-case assessments for each transgender and intersex inmate. This will require a thorough review of the entire process, including reviews of specific inmate records. The auditor’s role in this issue is to the safety of inmates at the highest risk of victimization in critical confinement facilities. The PRC will be releasing a pre-recorded webinar to all certified auditors to clarify the mandatory parameters of this requirement and the expectations for auditing compliance. Reminders:

Check Your Spam FolderThe PRC has received reports from auditors about messages sent via the auditor contact page on thePRC website being filtered as spam. Some protections are set up on the website to prevent junk mailfrom reaching your inbox. These are important preventative features, but they sometimes filter messagesthat are not spam. We advise auditors to regularly check spam folders for any messages that may havebeen unnecessarily blocked. Of course,   open any messages or click any links sent fromdo notsuspicious users.

Duty to ReportThe PMO has received a number of reports regarding auditor conduct that may be negligent, fraudulent,or reflective of conflicts of interest. Because many of these reports are not specific and do not includeactionable information, the PMO has instituted an affirmative duty for all auditors to report any knowledgeof or information regarding another auditor’s criminal conduct, malfeasance, negligence, fraud, orconflicts of interest. The PRC has added a dedicated form to the website for the field to access andprovide input on auditors to the PMO. This form is designed to encourage the submission of specificinformation that the PMO and the PRC can use to guide ongoing audit quality improvement efforts and toimprove the credibility of the audit function. Auditors should use this form to fulfill their duty to report.None of the fields in the form are required; however, auditors are encouraged to include as much detailas possible to allow the PMO and PRC to follow up on the information provided.

Auditor Portal and Course ContentOnly courses and continuing education content that are mandatory for all auditors will be considered partof the continuing education requirements. There will be no more than 10 hours of mandatory continuingeducation content each year, though there may be less. However, several resources on the AuditorContinuing Education and Resource Portal are helpful reminders of good audit practice and the PREAstandard requirements. We encourage you to browse the courses and resources available on the portalto ensure you are taking advantage of the existing knowledge base.

 Auditor HelplinePRC audit staff members are available Monday through Friday to monitor and respond to inquiries via theauditor helpline. Auditors who are preparing for an audit or working on an audit report can email questionsto  . The PRC will attempt to answer these as quickly as possible,[email protected] within a week. Auditors who have questions during the   portion of an audit can email onsite
