Mayor Bose commented on the Capital Funding recently approved for the School Board,pointing out that $54.9 million has been approved out of a $18 million Capital Budget. MayorBose expressed concern with the amount of funding approved and advised that the School BoardChairman is currently trying to arrange a meeting with the Minister of Education, Chairman ofthe School Board, and the Mayor.

3. Public Information Meeting - Fraser Valley Gas Exploration

Alderman McKinnon noted that there will be a Public Hearing on June 19th at 7:30 p.m. at theCloverdale Community Centre on gas exploration in the Fraser Valley.

4. Environmentally Sensitive Areas Open House

Mayor Bose noted that there will be an open Open House and a Public Meeting onEnvironmentally Sensitive Areas in Surrey on June 19th, with the Open House between 6:00 and7:00 p.m. and the Public Meeting at 7:00 p.m.

5. Semiahmoo Fish & Game Club

Alderman Higginbotham advised that she recently attended the Annual Barbecue of theSemiahmoo Fish & Game Club.

6. Annual General Meeting - Surrey Rehabilitation Centre

Theircombination and conditions are currently being inspected by this Department and if all by-lawrequirements are met, their license will be issued.

Item No. R299 Secondary Suites/Illegal Suites By-law Enforcement (2104-012)

The Deputy Municipal Manager submitted a report from the Chief Inspector indicating thatalthough Council is in the process of reviewing its position with respect to secondary suites, weare still receiving a number of complaints regarding what is currently an illegal suite. Thesecomplaints are documented and if they are as a result of a nuisance item such as parking, noiseor garbage, the nuisance item is attended to under the appropriate By-law. As for the illegal useof the suite contrary to the Zoning By-law, the Crown has advised us that they are not preparedto accept charges under the Zoning By-law for illegal suites until Council has completed theirdeliberation on this issue and made the necessary policy and By-law amendments.

As an operational policy this department is recording all complaints on illegal suites and dealingwith the nuisance items associated with these complaints but we are not proceeding with By-lawcharges for illegal occupancy at this point in time.

The Deputy Municipal Manager submitted a report from the Municipal Clerk concerningCouncil approval on April 3, 1989, to enter into an agreement with the "NOW" newspaper forthe provision of statutory advertising for Municipal purposes.

The Municipal Clerk was recommending that the agreement with the NOW newspaper forprovision of statutory advertising for Municipal purposes be continued for the remainder of 1990on the same terms and conditions as approved in 1989 including a maximum page cost of$596.25, and that the agreement be reviewed in 1991.

AND WHEREAS there is significant confusion with the taxpayers as to what tax rates theMunicipal Council are responsible for

AND WHEREAS the Municipal Council is held accountable by the taxpayers for the total on thetax notice rather than just the tax rate they are responsible for

THEREFORE, BE IT RESOLVED that the Minister of Municipal Affairs, Recreation andCulture amend Section 431 of the Municipal Act to allow Councils the option of sending out aseparate (school tax) billing, if the Municipality chooses to do so.

AND WHEREAS THE Ministry of Municipal Affairs has initiated a program to stimulate the construction ofaffordable rental housing;

(c) OIL SPILLS - FRASER & VANCOUVER PORTS

WHEREAS the risk of major oil spills resulting from bulk shipments of petroleum products through the Port ofVancouver and the Fraser Post is unacceptable;

AND WHEREAS there are limited resources in the Greater Vancouver Area to deal with oil spills;

NOW THEREFORE BE IT RESOLVED that the Union of British Columbia Municipalities requests theFederal and Provincial governments to jointly decide on a new shipping point for such products, one whichdoes not jeopardize the Gulf of Georgia and the Straits of Juan de Fuca with ecological damage.

(d) SANITARY SEWER DAMAGE CLAIMS

WHEREAS Section 755.3 of the Municipal Act provides that a municipality is not liable for damages arisingout of a breakdown or malfunction of a sewer system

AND WHEREAS a sewer system is operated for the benefit of all the residents of a municipality

AND WHEREAS significant property damage and a health hazard may arise when a sanitary sewer systembreaks or malfunctions

AND WHEREAS in most instances property owners do not carry insurance to compensate them for thedamages caused by a sanitary sewer break or malfunction

AND WHEREAS the Municipality can create a fund to compensate property owners for said damage claims

THEREFORE, be it resolved that the Minister of Municipal Affairs, Recreation and Culture amend Section755.3 of the Municipal Act to make the property owner responsible only for blockages in the sewer line thatruns between their house and the property line and further, that the Municipality be responsible for breakagesor malfunctions in the sewer line from the inspection chamber to the main line and in the main line.

AND WHEREAS the retention of existing trees provide the following positive benefits:

urban trees are 15 times more effective than rural trees at offsetting CO2

shade trees and urban forests improve our urban quality of life

trees enhance the economic value of urban property

trees aid in reducing carbon dioxide, mitigate the heat island effect and reduce energy consumption, thushelping to reverse global warming trends

treed areas contribute to social well-being and promote a sense of community

AND WHEREAS many property owners and developers clear cut properties prior to development

THEREFORE, BE IT RESOLVED that the Minister of Municipal Affairs, Recreation and Culture amend theMunicipal Act to allow the Municipality to control or regulate tree preservation on private property.

1. Automatic Teller Machines

At the May 14, 1990, Regular Council meeting Alderman Robinson submitted the followingNotice of Motion:

WHEREAS more and more Automated Teller Machines are being located throughout Surrey;

AND WHEREAS these machines are used extensively around the clock;

AND WHEREAS many are in relatively isolated areas and there has been a marked increase in crimerelated to ATMs;

AND WHEREAS Surrey has not considered safety, lighting, visibility or urban safety as they relateto ATMs in our Zoning By-laws;

NOW, THEREFORE, the Municipal Council of TheCorporation of the District of Surrey resolves:

That a set of guidelines be developed and the relative amendments be brought forward that wouldaddress the lighting, urban safety, visibility and overall safety as they relate to ATMs in the District ofSurrey.
