CALL TO ORDER & ESTABLISHMENT OF QUORUM Ms. Valentino called the meeting to order at 8:40 a.m. in the Auditorium of the Indiana Government Center South Building, 302 West Washington Street, Indianapolis, Indiana 46204 and declared a quorum, in accordance with IC § 25-23-1-5(b). ADOPTION OF THE MINUTES FROM THE SEPTEMBER 20, 2007 MEETING OF THE BOARD A motion was made and seconded to adopt the minutes from the September 20, 2007 meeting of the Board. VALENTINO/BURGHDUFF Motion carried 8-0-0 IV. INDIANA STATE NURSES ASSISTANCE PROGRAM (ISNAP) REPORT Charles Lindquist, ISNAP Program Director, presented the monthly report to the Board. Mr. Lindquist informed the Board that ISNAP has, as of September 2007, 465 active clients, 31 new intakes, 51 intakes in process and 20 RMA’s returned. Mr. Lindquist stated that ISNAP’s fall conference, Chronic Pain and Addiction, on September 21, 207 was successful and provided a detailed report to the Board. Mr. Lindquist stated that ISNAP staff met on September 15, 2007 to review applicants that have applied for the Needs Assistance Fund. They reviewed eight applications and eight of them qualified for assistance and vouchers were mailed to them. Mr. Lindquist addressed the audience at the request of the Board.

I. CALL TO ORDER & ESTABLISHMENT OF QUORUM

Ms. Valentino called the meeting to order at 8:40 a.m. in the Auditorium of the Indiana Government Center South Building, 302 West Washington Street, Indianapolis, Indiana 46204 and declared a quorum, in accordance with IC § 25-23-1-5(b).

II. ADOPTION OF THE AGENDA

III. ADOPTION OF THE MINUTES FROM THE SEPTEMBER 20, 2007 MEETING OF THE BOARD

A motion was made and seconded to adopt the minutes from the September 20, 2007 meeting of the Board.

IV. INDIANA STATE NURSES ASSISTANCE PROGRAM (ISNAP) REPORT Charles Lindquist, ISNAP Program Director, presented the monthly report to the Board. Mr. Lindquist informed the Board that ISNAP has, as of September 2007, 465 active clients, 31 new intakes, 51 intakes in process and 20 RMA’s returned. Mr. Lindquist stated that ISNAP’s fall conference, Chronic Pain and Addiction, on September 21, 207 was successful and provided a detailed report to the Board. Mr. Lindquist stated that ISNAP staff met on September 15, 2007 to review applicants that have applied for the Needs Assistance Fund. They reviewed eight applications and eight of them qualified for assistance and vouchers were mailed to them. Mr. Lindquist addressed the audience at the request of the Board.

V. DISCUSSION 1. Board of Director Position on the Indiana Nursing Workforce Development Coalition The Board requested staff to contact them and request additional information regarding the position and ask them to appear at the next Board meeting.

VI. EDUCATION 1. Everest College – Report of Survey Visit

The Board reviewed the survey visit conducted by Laurie Peters, MSN, RN and Susan Dye, MSN, RN on August 3, 2007.

Board Action: A motion was made and seconded to approve the recommendations made by Laurie Peters and Susan Dye. Everest College will remain on Conditional Accreditation.

VII. PERSONAL APPEARANCES

A. Appearance by Applicants for Licensure A motion was made and seconded to affirm the recommendations of Carolyn Slagle and Marcia Laux for the Board regarding the personal appearances by Applicants for Licensure, as follows:

BURGHDUFF/VALENTINO Motion carried 6-0-2 Ms. Slagle and Ms. Laux abstained.

1. Marilyn Keating Ms. Keating appeared before the Board regarding the positive response on her application for licensure by endorsement. Ms. Keating reported that she had three alcohol related traffic violations: Ms. Keating was convicted of a DUI in 1995, a DWAI in 2002, and a DWAI in 2006. Ms. Slagle and Ms. Laux recommended that Ms. Keating’s license be issued on indefinite probation on the condition that Ms. Keating be evaluated by ISNAP and enter and comply with an RMA if eligible for ISNAP participation. 2. Christina Wease Ms. Wease did not appear before the Board regarding the positive response on her application for licensure by endorsement. Ms. Wease will be rescheduled before the November Board meeting. 3. Precious Davis Ms. Davis appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Davis reported that she has been hospitalized for substance abuse treatment on four occasions in 1988, 1990, 1997, and 2000. Ms. Davis stated that she has been sober since April of 2000. Ms. Slagle and Ms. Laux recommended that Ms. Davis be approved for licensure by examination. 4. Jason Keller Mr. Keller appeared before the Board regarding the positive response on his application for licensure by examination. Mr. Keller reported that he voluntarily checked himself into an alcohol dependency treatment program in 2006. Ms. Slagle and Ms. Laux recommended that Mr. Keller’s license be issued on indefinite

probation on the condition that Mr. Keller be evaluated by ISNAP and enter and comply with an RMA if eligible for ISNAP participation. 5. Megan Houser Ms. Houser appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Houser reported that she has been convicted of an OWI and is currently on criminal probation. Ms. Slagle and Ms. Laux recommended that Ms. Houser’s license be issued on indefinite probation, for at least the length of her criminal probation, on the condition that Ms. Hauser be evaluated by ISNAP and enter and comply with an RMA if eligible for ISNAP participation. 6. Ryan Evens Mr. Evens appeared before the Board regarding the positive response on his application for licensure by examination. Mr. Evens reported that he received a conviction on drug possession charges in 2004, resulting in a sentence of six months of house arrest. Mr. Evens stated that he is no longer involved with the group of people he feels were a negative influence and that he does not use illegal drugs. Ms. Slagle and Ms. Laux recommended that Mr. Evens be approved for licensure by examination. 7. Brooke Brandenstein Ms. Brandenstein appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Brandenstein informed the Board of the conviction for minor consumption of alcohol in 2004 and OWI in 2007. Ms. Slagle and Ms. Laux recommended that Ms. Brandenstein’s license be issued on indefinite probation, for at least the length of her criminal probation, on the condition that Ms. Brandenstein be evaluated by ISNAP and enter and comply with an RMA if eligible for ISNAP participation. 8. Debra Tillman

Ms. Tillman did not appear before the Board regarding the positive response on her application for licensure by endorsement. Ms. Tillman will be rescheduled before the November Board meeting.

9. Sara Ingram

Ms. Ingram appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Ingram’s LPN license is currently on probation and she is currently participating in ISNAP. Ms. Slagle and Ms. Laux recommended that Ms. Ingram’s license be issued on indefinite probation, on the condition that she comply with the terms of her current RMA with ISNAP.

10. Toni Hart

Ms. Hart appeared before the Board regarding the positive response on her application for licensure by endorsement. Ms. Hart reported having a criminal conviction for embezzlement in 2007 and is currently serving three years of probation. Ms. Hart stated that she has met with the Illinois Board of Nursing and that no action against her license will be taken in that state. Ms. Slagle and Ms. Laux recommended that Ms. Hart’s temporary license be issued and that Ms. Hart be required to submit proof that Illinois is aware of her criminal conviction and have not taken action against her license. 11. Kimberly Cripe

Ms. Cripe did not appear before the Board regarding the positive response on her application for licensure by endorsement. Ms. Slagle and Ms. Laux recommended the Board deny her application for licensure by endorsement.

12. Ellen Tice

Ms. Tice appeared before the Board regarding the positive response on her application for licensure by endorsement. Ms. Tice reported having had a disorderly conduct conviction and an unrelated termination in 2006 for medication errors. She stated that she was required to write a letter to the Maine Board of Nursing. Ms. Slagle and Ms. Laux recommended that Ms. Tice’s temporary license be issued and that Ms. Tice be required to submit documentation of the Maine Board of Nursing’s actions as a result of reporting the termination circumstances. 13. Susan Home

Ms. Home did not appear before the Board regarding the positive response on her application for licensure by endorsement. Ms. Home will be rescheduled for the November Board meeting.

14. Gardnetta Gibbs

Ms. Gibbs appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Gibbs reported a 1999 conviction for marijuana possession and a 2003 conviction for public intoxication. Ms. Slagle and Ms. Laux recommended that Ms. Gibbs be approved for licensure by examination. 15. Monica Little

Ms. Little appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Little reported a 2005 arrest for drug possession. Ms. Slagle and Ms. Laux recommended that Ms. Little be approved for licensure by examination. 16. Julie Vanes

Ms. Vanes appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Vanes reported a 2007 conviction for DUI. Ms. Slagle and Ms. Laux recommended that Ms. Vanes’ license be issued on indefinite probation, for at least the length of her criminal probation, on the condition that Ms. Vanes be evaluated by ISNAP and enter and comply with an RMA if eligible for ISNAP participation. 17. Barbara Davis

Ms. Davis appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Davis reported having been convicted of DUI in 2001 and 2002. She states that she has been sober since 2002. Ms. Slagle and Ms. Laux recommended that Ms. Davis be approved for licensure by examination. 18. Stephanie LaFontaine

Ms. LaFontaine appeared before the Board regarding the positive response on her application for licensure by examination. Ms. LaFontaine reported two convictions on minor consumption charges in 2001 and 2002. She states that she no longer drinks alcohol. Ms. Slagle and Ms. Laux recommended that Ms. LaFontaine be approved for licensure by examination. 19. Kimberly Wolfe

Ms. Wolfe appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Wolfe reported having been convicted of DUI in 2002 and Public Intoxication in 2004. She states that she has attended an outpatient treatment program and has been sober since 2004. Ms. Slagle and Ms. Laux recommended that Ms. Wolfe be approved for licensure by examination. 20. Annique Smith

Ms. Smith appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Smith reported having been charged with theft and having a conviction for illegal consumption. She stated that circumstances surrounding those events involved an abusive relationship, and that she has worked with adolescents from similar situations for the past 10 years. Ms. Slagle and Ms. Laux recommended that Ms. Smith be approved for licensure by examination. 21. Jennifer Stevens

Ms. Stevens appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Stevens reported having been treated for alcohol abuse in 2003. She stated that she does not currently attend any support program but relies on friends and family for support in remaining sober. Ms. Slagle and Ms. Laux recommended that Ms. Stevens be approved for licensure by examination. 22. Jessica Truman

Ms. Truman appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Truman reported having been convicted of DUI in 2003 and 2005. She stated that she has successfully completed criminal probation from her 2005 DUI conviction. Ms. Slagle and Ms. Laux recommended that Ms. Vanes’ license be issued on indefinite probation, on the condition that Ms. Truman be evaluated by ISNAP and enter and comply with an RMA if eligible for ISNAP participation.

23. Tanya Hubbard

Ms. Hubbard appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Hubbard reported having been investigated for neglect on allegations that her dependent was left in an unlicensed daycare. She stated that there are no criminal charges pending. Ms. Slagle and Ms. Laux recommended that Ms. Hubbard be approved for licensure by examination. 24. Jennifer Farias

Ms. Farias appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Farias reported having been convicted for public intoxication in 1999 and a DUI in 2002. Ms. Slagle and Ms. Laux recommended that Ms. Farias be approved for licensure by examination. 25. Bethany Carr

Ms. Carr appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Carr reported having had criminal charges of domestic battery against her from a 1999 incident and having been convicted of DUI in 2006. She stated that she has participated in AA, performed 120 hours of community service, and has completed criminal probation. Ms. Slagle and Ms. Laux recommended that Ms. Carr be approved for licensure by examination without probation on the condition that she be evaluated by ISNAP, and if eligible, sign an RMA. B. Appearance by Applicants by Renewal – Before the Full Board

Ms. Slagle and Ms. Laux were out of the meeting. 1. Rebecca Schultz Ms. Schultz appeared before the Board regarding the positive response on her renewal application. Ms. Schultz reported having been disciplined and terminated from employment for failing to follow her employer’s policy and for refusing to take a particular patient. She stated that she exercised reasonable judgment in regards to patient care in failing to follow employer policy and that she refused to take a patient because she was pregnant and concerned about health risks. Board Action: A motion was made and seconded to renew Ms. Shultz’s license.

2. Rosanna Wheeler Ms. Wheeler did not appear before the Board regarding the positive response on her application for licensure by renewal. Ms. Wheeler will be rescheduled at the November Board meeting. 3. Robert Ingram Mr. Ingram appeared before the Board regarding the positive response on his renewal application. Mr. Ingram reports a 2006 arrest for OWI. He stated that he has been sober since January of 2007 and will remain on criminal probation until March of 2008. Board Action: A motion was made and seconded to renew Ms. Shultz’s license.

4. Helen Gartner Ms. Gartner appeared before the Board regarding the positive response on her renewal application. Ms. Gartner reports having been disciplined at work for an alcohol related incident, during which she tested positive for being under the influence of alcohol during work. She stated that she is currently maintaining an RMA with ISNAP. Board Action: A motion was made and seconded to renew Ms. Gartner’s license on indefinite probation for

at least the length of her RMA with ISNAP.

5. Dennis Skinner Mr. Skinner appeared before the Board with counsel, LaTonya Wright, regarding the positive response on his renewal application. Mr. Skinner reported that his Ohio nursing license is currently suspended, and that he has voluntarily surrendered his license to be placed on inactive status. He stated that he is currently maintaining an RMA with ISNAP.

Board Action: A motion was made and seconded to renew Mr. Skinner’s license on indefinite probation for at least the length of his RMA with ISNAP. Further, the Board requested Mr. Skinner’s renewal be referred to the Attorney General’s Office.

6. Sharon Jean Kluzinski Ms. Kluzinski appeared before the Board regarding the positive response on her renewal application. Ms. Kluzinski reported having been terminated from employment for sleeping on the job in August of 2007. She states that she is currently maintaining an RMA with ISNAP. Board Action: A motion was made and seconded to renew Ms. Kluzinski’s license on indefinite probation

for at least the length of her RMA with ISNAP. VALENTINO/BURGHDUFF Motion carried 6-0-0

7. Pamela Partridge Ms. Partridge appeared before the Board regarding the positive response on her renewal application. Ms. Partridge reported that she submitted a letter to the Governor’s office indicating that she is facing criminal charges for check deception, however, she did not indicate this on her renewal application.

Board Action: A motion was made and seconded to renew Pamela Partridge’s license. Further, the Board requested Ms. Partridge’s renewal be referred to the Attorney General’s Office.

8. Larry Rogge Mr. Rogge appeared before the Board regarding the positive response on his renewal application. Mr. Rogge reported having been convicted of DUI in 2006 and having previously been terminated from employment. He stated that he is on criminal probation through the end of 2008.

Board Action: A motion was made and seconded to renew Mr. Rogge’s license on indefinite probation, for at least the length of her criminal probation, on the condition that Mr. Rogge be evaluated by ISNAP and enter and comply with an RMA if eligible for ISNAP participation.

9. Triquita Ray Ms. Ray appeared before the Board regarding the positive response on her renewal application. Ms. Ray reported having been convicted of DUI in March of 2007. She stated that she is not on criminal probation, but that she has paid fines and attended court-ordered alcohol education. Board Action: A motion was made and seconded to renew Ms. Ray’s license.

Mr. Kirtley appeared before the Board regarding the positive response on his renewal application. Mr. Kirtley received a DUI charge in July of 2004 and in April of 2006.

Board Action: A motion was made and seconded to renew Mr. Kirtley’s license on indefinite probation on the condition that Mr. Kirtley be evaluated by ISNAP and enter and comply with an RMA if eligible for ISNAP participation.

11. Valerie Brown Ms. Brown appeared before the Board regarding the positive response on her renewal application.

Board Action: A motion was made and seconded to forward Ms. Brown’s situation for review by the Attorney General’s office, and to renew Mr. Kirtley’s license on indefinite probation on the condition that Ms. Brown provide quarterly reports to the Board.

12. Jeanne Sims Ms. Sims appeared before the Board regarding the positive response on her renewal application. Ms. Sims reported that she is currently involved in a tort claim from an offender at her place of employment. The offender claimed Ms. Sims did not inform him that he had Hepatitis C. Board Action: A motion was made and seconded to renew Ms. Sims’ license.

13. Emily Swan Ms. Swan appeared before the Board regarding the positive response on her renewal application. Ms. Swan entered a plea agreement on July 10, 2006 for operating a vehicle while intoxicated endangering a person, class A misdemeanor. Board Action: A motion was made and seconded to renew Ms. Swan’s license.

14. Mary Ann Knaus Ms. Knaus appeared before the Board regarding the positive response on her renewal application. Ms. Knaus inadvertently initialed two rows of data on a flow sheet into future times of her shift Board Action: A motion was made and seconded to renew Ms. Knaus’ license.

15. Selena Brewer Ms. Brewer appeared before the Board regarding the positive response on her renewal application. Ms. Brewer was charged with a DUI in January of 2006. Board Action: A motion was made and seconded to renew Ms. Brewer’s license.

Ms. King-Jones appeared before the Board regarding the positive response on her renewal application. Ms. King-Jones was terminated from Howard Regional Health Systems for her husband’s presence in the nursing station. Ms. King-Jones was terminated from St. Joseph’s Hospital of Kokomo for medication errors. Board Action: A motion was made and seconded to renew Ms. Sims’ license.

17. Michael Vogel Mr. Vogel appeared before the Board regarding the positive response on his renewal application. Mr. Vogel was terminated from The Nurse Agency due to various complaints, such as; regarding the care he provided to ICU patients.

Board Action: A motion was made and seconded to renew Mr. Vogel’s license.

18. Teresa Hazlett Ms. Hazlett appeared before the Board regarding the positive response on her renewal application. On October 15, 2006 Ms. Hazlett was arrested for possession of a controlled substance Board Action: A motion was made and seconded to renew Ms. Hazlett’s license.

19. Holly Oehler Ms. Oehler appeared before the Board regarding the positive response on her renewal application. In August of 2005, Ms. Oehler was charged with driving a vehicle while intoxicated.

Board Action: A motion was made and seconded to renew Mr. Oehler’s license on indefinite probation on the condition that Ms. Oehler be evaluated by ISNAP and enter and comply with an RMA if eligible for ISNAP participation.

20. Denise Mann Ms. Mann did not appear before the Board regarding the positive response on her application for licensure by renewal. Ms. Mann will be rescheduled at the November Board meeting. 21. John Michael Hyde Mr. Hyde appeared before the Board regarding the positive response on his renewal application. On July 15, 2007 he tested positive for opiates on a urine drug screen at his place of employment.
