MFB TERMINATION CASE COMES TO A CLOSE

FWC DECISION PENDING  The mammoth case of the MFB's attempt to terminate the Operational and ACFO's Agreements came to a close in the Fair Work Commission today with the UFU and MFB Counsel presenting final legal submissions.    Commissioner Wilson has reserved his decision.  It is not known when a decision will be handed down.  The Branch Committee of Management thank all those that participated in the hearing and have supported the UFU in defending the matter.    

The UFU case was a wealth of evidence to demonstrate in law and in practice that the 2010 MFB UFU Operational Staff Agreement and the 2010 MFB UFU ACFO Agreements should not be terminated.  The unity of the Union was evident with powerful evidence from 74 witnesses from all ranks and 60­100 firefighters attending every day of the 15­days of hearing and the two days of the legal submissions.   No stone was left unturned in preparing the case by the legal team of Herman Borenstein QC, Barrister Malcolm Harding and Ryan Carlisle Thomas Partner Philip Gardner and Solicitor Nick White. In addition Solicitor Tonia Sakkas and Barrister Anna Forsyth willing came to assist when more hands on deck were needed.  The Branch Committee of Management would also like to acknowledge the dedication of the UFU staff for the hard work and long hours.   The staff went the extra mile in many ways including assisting with the preparation of witness statements, provision of detailed responses to MFB claims and any other matter as requested.  The solidarity of UFU members was overwhelming.  The strength shown by the members of our union throughout this period under such a sustained attack will never be forgotten.  The UFU is in a great position to tackle the challenges we still face.    This chapter may be over but it is time to redirect our energies into forging a stronger and better future for generations to come by ousting the Napthine Government.
