4.1 Leigh Ogston, Senior Negotiator/Senior Consultation Advisor, BC Region, Federal Department of Indigenous and Northern Affairs Canada (INAC) Leigh Ogston, Senior Negotiator/Senior Consultation Advisor, BC Region, INAC, provided members with a presentation on the Government of Canada’s approach to negotiations with indigenous peoples. In response to questions and comments, members were informed about: • federal funding programs being available for First Nations and local

government capacity building • efforts to coordinate local, provincial and federal approaches to First Nations

consultation and to develop best practices • a lack of federal capacity to oversee and monitor how federal guidelines are

being used to inform First Nations consultation by federal agencies • the evaluation of First Nation consultation efforts on federal projects being by

court decision Members commented on the need for improved communications from the federal government to local governments about best practices and approaches to consultation and reconciliation efforts at the local level. Members also commented about challenges facing local governments in providing capacity funding for local governments and First Nations, and in obtaining federal support and direction on the review of infrastructure projects. Presentation material titled “Whole of Government Approach to the Duty to Consult” is retained with the May 4, 2017 Aboriginal Relations Committee agenda.

5.1 Metro Vancouver’s Information Sharing and Engagement with First Nations on Construction Projects Amrit Dhatt, Public Involvement Communications and Education Coordinator, Water Services, and Andrea Winkler, Public Involvement Program Manager, Liquid Waste Services, provided members with a presentation on information sharing and engagement with First Nations on construction projects highlighting the duty to consult and desire to engage, consultative areas and statement of intent in Metro Vancouver, interests that have emerged on various projects, potential First Nations interests, the Crown regulatory process, and the non-regulatory process. In response to questions, members were informed about involvement by local First Nations in the North Shore Treatment Plant Project.

Presentation material titled “Information Sharing and Engagement with First Nations on Construction Projects” is retained with the May 4, 2017 Aboriginal Relations Committee agenda.

5.2 Quarterly Report on Reconciliation Activities Report dated April 18, 2017 from Marino Piombini, Supervisor, Aboriginal Relations, Legal and Legislative Services, providing a quarterly report on reconciliation activities. It was MOVED and SECONDED That the MVRD Board receive for information the report, dated April 18, 2017, titled “Quarterly Report on Reconciliation Activities.”

5.3 2017 Community to Community Forum Marino Piombini, Supervisor, Aboriginal Relations, Legal and Legislative Services, informed members that staff will report back to the Committee in future on discussions with a local First Nation on a potential 2017 Community to Community Forum event.

5.4 Manager’s Report Report dated April 18, 2017 from Ralph G. Hildebrand, General Manager, Legal and Legislative Services/Corporate Solicitor, updating the Aboriginal Relations Committee on the Committee’s 2017 Work Plan, appointment of observers to the Metro Vancouver Aboriginal Relations Committee, Celeste Haldane being selected as the new Treaty Commissioner by the Province and First Nations Summit, Watershed Access Request and Approval Procedures Policy, Katzie First Nation approval of its Community Land Code, Tsleil-Waututh Nation election results, provincial staffing changes, province-wide Community to Community Forum, and media articles of interest.

5.1 To: Aboriginal Relations Committee From: Marino Piombini, Supervisor, Aboriginal Relations, Legal and Legislative Services Date: June 28, 2017 Meeting Date: July 6, 2017 Subject: 2017 Community to Community Forum RECOMMENDATION That the Aboriginal Relations Committee receive for information the 2017 Community to Community Forum proposal in the report, dated June 28, 2017, titled “2017 Community to Community Forum.” PURPOSE To provide the Aboriginal Relations Committee with the 2017 Community to Community Forum proposal for information. BACKGROUND One of the priorities for the Aboriginal Relations Committee as set out in the Terms of Reference is engagement in initiatives and activities that strengthen relationships between Metro Vancouver municipalities and First Nations within the Metro Vancouver region. The Aboriginal Relations Division, operating under the purview of the Aboriginal Relations Committee, is committed to relationship building with area First Nations. Community to Community Forums are intended to foster positive relationships between communities. The Committee endeavours to co-host one Community to Community Forum each year with a different First Nation or multiple First Nations. In 2014, a Forum was held with Katzie First Nation and in 2015, a Forum was co-hosted with Tsleil-Waututh Nation. Last year, a Community to Community Forum was held with Squamish Nation at the Chief Joe Mathias Centre. 2017 Community to Community Forum This report has been prepared to inform the Committee of the 2017 Community to Community Forum and to ensure that the forum aligns with the Committee’s objectives of strengthening relationships with area First Nations. In April 2017, Tsawwassen First Nation responded to Metro Vancouver’s proposal for a Community to Community Forum in 2017. Tsawwassen First Nation expressed an interest in having an Aboriginal Relations Committee to Tsawwassen Executive Council workshop-like approach to the Forum. The Tsawwassen First Nation-Metro Vancouver Aboriginal Relations Committee Community to Community Forum is set to take place on:

• Day: July 20, 2017 • Time: 8:30am-12:30pm (with registration and breakfast at 8:30am, meeting at 8:45am, lunch

at 11:45am) • Location: Tsawwassen First Nation Recreation Centre (1929 Tsawwassen Drive, Tsawwassen,

• 8:30am-8:45am Registration • 8:45am -9:45am Welcome, Breakfast and Opening Remarks • 9:45am -10:30am Presentations and Discussion (Metro Vancouver and Tsawwassen) • 10:30am-11:45am Guided Bus Tour of Tsawwassen Lands and Development • 11:45am-12:30pm Buffet Lunch and Networking

The budget for this Forum allows for up to 50 participants to attend, including:

• 5 Tsawwassen First Nation Executive Council Members (Chief and Executive Councillors) • 6 Tsawwassen First Nation staff • 10 Tsawwassen First Nation community members • 16 Metro Vancouver Aboriginal Relations Committee participants (i.e. 13 Committee

members and 3 observers from neighbouring regional districts) • 2 additional Metro Vancouver Board members (i.e. Chair and Vice-Chair) • 10 Metro Vancouver staff (from Legal & Legislative Services, CAO’s Office, Water Services,

Liquid Waste Services, Planning, Human Resources, Solid Waste, and other departments) • 1 contractor (i.e. audio visual)

ALTERNATIVES 1. That the Aboriginal Relations Committee receive for information the 2017 Community to

Community Forum proposal in the report, dated June 28, 2017, titled “2017 Community to Community Forum.”

2. That the Aboriginal Relations Committee receive the report, dated June 28, 2017, titled “2017 Community to Community Forum”, amend the proposal as necessary, and endorse it as amended.

3. That the Aboriginal Relations Committee provide alternative direction to staff. FINANCIAL IMPLICATIONS The Aboriginal Relations budget endorsed by the Committee included provisions for a Community to Community event. This event falls within that budget. Alternative 1 takes into consideration that the Community to Community Forum would be beneficial for strengthening the political relationship between Tsawwassen First Nation and Metro Vancouver, and that the expenses for undertaking such a forum are considered to be a good investment. As with Alternative 1, Alternative 2 assumes that the Community to Community Forum would be beneficial in strengthening the relationship with Tsawwassen First Nation, but that the Committee wishes to augment the proposal. Alternative 3 would imply that the Aboriginal Relations Committee is silent on the merits of such an event and/or that the Committee is not in favour of such an event at this time. OTHER IMPLICATIONS The focus of this Community to Community Forum is different from some of the previous events held with Katzie (2014), Tsleil-Waututh (2015) and Squamish (2016). The 2017 Community to Community

Forum is proposed to be a Tsawwassen First Nation Executive Council and committee members meeting with Metro Vancouver’s Aboriginal Relations Committee. SUMMARY / CONCLUSION This report presents the proposed 2017 Community to Community Forum with Tsawwassen First Nation. A Community to Community Forum provides an opportunity for bringing together First Nations and local governments to foster positive relationships between communities. Given that one of the priorities for the Aboriginal Relations Committee is engagement in initiatives and activities that strengthen relationships between Metro Vancouver and First Nations within the region, the proposed Community to Community Forum is intended to meet the Committee’s objectives. Alternative 1 is, therefore, recommended by staff.

5.2 To: Aboriginal Relations Committee From: Marino Piombini, Supervisor, Aboriginal Relations, Legal and Legislative Services Date: June 22, 2017 Meeting Date: July 6, 2017 Subject: Quarterly Report on Reconciliation Activities and Opportunities RECOMMENDATION That the MVRD Board receive for information the report, dated June 22, 2017, titled “Quarterly Report on Reconciliation Activities and Opportunities.” PURPOSE To provide the MVRD Board of Directors with a quarterly report on regional and local reconciliation activities and opportunities. BACKGROUND In February 2017, the Aboriginal Relations Committee endorsed, as part of its 2017 Priorities and Work Plan, a quarterly update on regional and local reconciliation activities and opportunities. This report is presented as an information report on reconciliation activities. RECONCILIATION ACTIVITIES On October 30, 2015, the Metro Vancouver Board adopted a resolution endorsing the Truth and Reconciliation Commission’s Summary Report on Indian Residential Schools, as well as the following activities: • Liaise with the Truth and Reconciliation Commissions (and, by extension, Reconciliation Canada); • Raise awareness about Indian Residential Schools; • Provide cultural competency training; and • Strengthen relationships with First Nations. The various objectives above, established by the Board, are referenced in Attachment 1, and include: • Activities that have been undertaken by Metro Vancouver over the past few months; and • Upcoming opportunities for reconciliation over the next few months. ALTERNATIVES There are no alternatives to present as this is an information report. FINANCIAL IMPLICATIONS The various activities identified have been included in the Aboriginal Relations budget for 2017. There are no additional financial implications with respect to the items identified in this report.

Metro Vancouver staff presentation to the City of Surrey Mayor, Council and Senior Staff on “Building Relations with First Nations.”

Metro Vancouver Aboriginal Relations was asked by the City of Surrey to provide a 2-hour presentation to the Mayor, Council and senior staff with the City of Surrey. Over 20 participants attended this session, which focused on the history of aboriginal- and non-aboriginal relations, treaty negotiations, First Nations in the region and current land claims, as well as advice on working effectively with aboriginal peoples.

engagement plan based on your specific project or initiative

• Create community profiles to gain a preliminary understanding of the communities’ interests

• Learn to assess the level of engagement for each Aboriginal/Indigenous group

• Learn to identify appropriate people to start the engagement process with

• Review various methods to conduct consultation activities

• Prepare for dealing with common issues that may be barriers to achieving meaningful engagement, like capacity building

• Receive a copy of a workbook to guide them through the process

Metro Vancouver participated in this half-day session for the purpose of: • Providing information to help with negotiation

Strengthening Relationships with First Nations

UBCM/First Nations Summit “Community to Community Forum.” June 6, 2017 at Musqueam

This one-day session, held every five or six years, provided an opportunity for local government elected officials and staff and First Nations elected officials and staff to discuss issues of mutual interest. Metro Vancouver was represented at this session by both elected officials and staff.

Provide Cultural Competency Training

“Indigenous History and Cultural Awareness Session”, facilitated by the Raven Institute on June 14, 2017 at Metro Vancouver head office in Burnaby.

This three-hour session incorporated the elements of the session attended by Aboriginal Relations staff on January 16, 2017 at Musqueam. The session was for local government staff on the Municipal Technical Advisory Committee (MTAC) on Aboriginal Relations as well as some Metro Vancouver staff. The session focused on the history of indigenous people in Canada and how this history continues to influence the wellness of indigenous families, communities and nations. The session also promoted dialogue on how indigenous history connects to individuals, businesses, and the larger Canadian and international communities.

National Aboriginal Day events. June 21, 2017.

Metro Vancouver staff produced a listing of National Aboriginal Day events in the Metro Vancouver region and made it available to members of the Aboriginal Relations Committee, the Municipal Technical Advisory Committee on Aboriginal Relations, and Metro Vancouver staff. An Intranet article, explaining the significance of this day, which recognizes and celebrates the cultures and contributions of the First Nations, Inuit and Métis peoples of Canada, was also prepared for Metro Vancouver staff.

Tsawwassen First Nation-Metro Vancouver 2017 Community to Community Forum. July 20, 2017 at Tsawwassen.

As part of its annual Work Plan, the Aboriginal Relations Committee co-hosts a Community to Community Forum with a local First Nation. For 2017, the event will be held at the Tsawwassen First Nation Recreation Centre in Tsawwassen, BC involving Tsawwassen’s Executive Council and the Aboriginal Relations Committee, and staff and invited members from both the First Nation as well as regional district staff. A tour of Tsawwassen First Nation Lands and development will be included as part of the Forum.

Gathering of Canoes. July 14, 2017 (11am-5pm). Vanier Park in Vancouver.

The Gathering of Canoes involves a traditional landing of the “Pulling Together Canoe Journey.” During a 10-day journey along traditional highways from the Sunshine Coast to the City of Vancouver, up to 30 canoes—with First Nations, Public Service Agencies and youth paddlers—will request permission to land on the traditional territories of the Musqueam, Squamish and

A Walk for Reconciliation in downtown Vancouver, September 24, 2017

Tens of thousands of people are expected to participate in the second-ever Reconciliation walk. In 2013, over 70,000 people of all Nations, ages, abilities, communities, and faiths walked together. Led by Chief Dr. Robert Joseph, O.B.C., the walk was originally conceived as a healing tool among Indigenous peoples and non-Indigenous peoples, in light of the legacy of Indian residential schools. The walk is along a 3-4 km route, where participants will experience first-hand the healing and transformational power of ‘Namwayut — We Are All One, which is to guide the journey of moving forward together. Solicitor Date: June 28, 2017 Meeting Date: July 6, 2017 Subject: Manager’s Report RECOMMENDATION That the Aboriginal Relations Committee receive for information the report, dated June 28, 2017, titled “Manager’s Report.” Aboriginal Relations Committee 2017 Workplan Attachment 1 of this report sets out the Committee’s Workplan for 2017. The status of work program elements are indicated as pending, in progress, or complete. The listing is updated as needed to include new issues that arise, items requested by the Committee, and changes in the schedule. Province of BC-Musqueam Collaborative Management Agreement re: Fraser River Transition Area On March 30, 2017, the Province of BC (Ministry of Forests, Lands and Natural Resource Operations) and Musqueam Indian Band signed a Collaborative Management Agreement with respect to the Fraser River Transition Area. The agreement includes possible stewardship initiatives such as: research, recommendations; monitoring; and rehabilitation measures. A stewardship forum is also anticipated to be established to support input and participation with stakeholders and coordinate stewardship initiatives with other First Nations. The agreement allows for funding opportunities for Musqueam through the Province, through other agencies, non-government organizations, other orders of government, and through revenue-sharing agreements with proponents. A copy of the agreement is attached as Attachment 2. Province-Wide Community to Community Forum held at Musqueam on June 6, 2017 On June 6, 2017, the Union of BC Municipalities and First Nations Summit co-hosted the 6th Province-wide Community to Community Forum, over the past 20 years, at the Musqueam Community Centre in Vancouver. The dialogue focused on joint ventures, reconciliation, building relations and exploring ways to work together and engage in different types of collaboration. The Forum featured 25 presenters, including the National Chief of the Assembly of First Nations, Perry Bellegarde, who delivered the keynote address to attendees who were primarily from local governments and First Nation organizations. Assembly of First Nations – Government of Canada MOU on Joint Priorities On June 12, 2017, the Assembly of First Nations (AFN) and the Government of Canada signed a Memorandum of Understanding (MOU) on joint priorities. The MOU commits the parties to a regular and ongoing Cabinet-level process for First Nations’ leadership and members of the federal Cabinet to ensure progress on priorities identified by First Nations, which include:

3.4. Technical Working Group. The Technical Working Group will consist of an equal number of representatives from Musqueam and the Provincial Agency. A decision of the Technical Working Group requires the agreement of the majority of representatives including at least one representative of each Party.

3.5. Responsibilities of Technical Working Group. The responsibilities of the Technical Working Group include:

a. implementation of this Agreement, including addressing and resolving anyimplementation issues;

b. evaluation of this Agreement and the proposal of any recommendedamendments to this Agreement, as required;

c. management of the Dispute Resolution and Issues Resolution processes;

d. stakeholder and public engagement regarding the work under this Agreement,as required;

e. maintenance of the annual implementation work plan under 9.1 that reflectscurrent initiatives, under direction from the Management Working Group;

f. providing regular reports to the Management Working Group regardingprogress on and recommendations arising from work plan items;

g. addressing issues arising from day-to-day operations and implementation ofthe Engagement Framework;

h. implementation of the joint stewardship initiatives set out in Part 4, under thedirection of the Management Working Group;

i. development and maintenance of an annual stewardship work plan, under thedirection of the Management Working Group;

j. development and maintenance of terms of reference, under the direction of theManagement Working Group;

k. meeting on a monthly basis, or on an as-needed basis as otherwise agreed;

I. establishing Task Teams, as required; and

m. any other responsibilities agreed upon in writing by the Parties.

PART 4 - STEWARDSHIP

4.1. Collaboration on Stewardship. The Parties will Collaborate to support the responsible management of the Fraser River Transition Area, through joint stewardship initiatives that respect and consider Musqueam Aboriginal Rights.

4.2. Joint Stewardship Initiatives. The Technical Working Group will implement joint stewardship initiatives in accordance with the annual stewardship work plan to address environmental issues in the Fraser River Transition Area, which initiatives may include: a. review and update of best management practices in the Fraser River

Transition Area for specific program areas;
