Merced Community College District Board of Trustees Workshop held August 23, 2013 1. Public Session Call to Order The Board President (Dennis Jordan) called the meeting to order at 2:10 p.m. The meeting was held in the Margaret M. Randolph Board Room on the Merced College Campus in Merced. They briefly reviewed their agenda and packet that was provided. Each participant introduced themselves and shared their expectations for today. 3. It was suggested for Trustees to attend a couple of Academic Senate and College Council meetings to see how their processes work but cautioned against participating in the meetings. The Board is in need of developing their new goals.

4. Board Education: Policies and Law/Regulations on Participatory Governance

Mr. Arterberry provided handout which outlined the law and regulations for faculty, staff, and students in regards to participatory governance. More information and discussion on this item occurred during the previous item.

3. Closed Session a. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION

Significant exposure to litigation pursuant to subdivision (b) of Section 54956.9: (1 case)

Board President Jordan reported out of closed session the Board voted unanimously to have legal counsel negotiate the terms of a settlement agreement. Trustees shared their reflections and key points learned from yesterday’s session which included:

• Being together in one room and getting to know each other • Tensions were high in the beginning but by the end all groups seemed to

be on the same page and the door is opened for better communication & understanding

• It is okay to make mistakes, but learn from those for the future and don’t take it personally

• Trust was an overarching theme and it is needed among all • It is important to get to know people to increase trust • Started to get to know the various groups and the people who represent

them • Connect with the community as Trustees vs. attending meetings on

campus • Need to focus on the “big bowl” and work on bigger, overall issues • Important to review and update the Board goals which set the direction for

the District

4. Board/CEO Relations Mr. Arterberry asked for responses and discussion to the following questions:

a. How do you view your role as a Trustee and what are the expectations of those who elected you? Responses to this question showed the Trustees have a “bigger picture” focus in their roles.

b. How would you define the effective Board/CEO relationship? Trust, communication, delegation, education, and support were the elements identified.

c. How can the Board best support the Superintendent/President to be successful? Channels of communication clear, collegial dialogue, keep him abreast of what Trustees hear, trust in his decisions, and clear expectations and evaluation of goals were the themes identified for this question.

d. How can the Superintendent/President best support the Board to be successful? The common responses to this question were for him to keep the Trustees informed, provide them education opportunities, open channels of communication, time to review information before making decisions, and trust.

A short break was taken for lunch. The Board’s mission, characteristics of an effective leader, and elements of an effective Board and CEO were discussed and reviewed. Policy, practices, and protocols which relate to the Board and their role were delineated. Accreditation Standard IV was reviewed.

The Board President (Dennis Jordan) called the meeting to order at 5:00 p.m. The meeting was held in the Margaret M. Randolph Board Room on the Merced College Campus in Merced.

2. Hearing of the Public An opportunity was provided for members of the public to address the Board on matters of general district business. Luis Flores asked the Board to consider honoring Hispanic Heritage Month in the month of September and stated this year is the 25th anniversary of the nation honoring Hispanic heritage. The Board will consider this item for the October agenda.

Taylor, Joanne Schultz, Kevin Kistler, Everett Lovelace, Leonel Villarreal (CSEA), Cherie Davis (Management Team), Joe Allison, Mike Cuchna, Anne Newins, Russ O’Donnell, Doug Kain, Mai Meidinger, Karyn Dower, Robin Shepard, Stacey Hicks (Recording Secretary) Board President Jordan reported that in closed session the Board voted unanimously to reject the claim referenced as item 3d. The Board also voted unanimously to authorize payment of the remainder of the claim referenced as item 3e in the amount totaling $4830. Trustee Lashbrook led the Pledge of Allegiance.

5. Discussion of the Final Budget for 2013-14 Dr. Schultz provided information and background on the 2013-14 final proposed budget. This included the process timeline followed since the tentative budget was provided, how we ended 2012-13, information gathered from state budget workshop, review of revenue assumptions and projections, expenditure assumptions and projections, reserve/fund balance assumptions and projections, salary comparisons over the last six years by group, other funds, and the sound fiscal management report card. She stated there is a great deal of uncertainty in the budgeting process as only about 35% of what came from the State is part of the budget act for 2013-14. The net income in 2012-13 was not as low as was estimated but was also not as high as we hoped. The books were closed with a 1% possible loss. Revenue assumptions include: all state budget assumptions based on P2 computational revenue; assume the District is going to meet the estimated enrollment restoration; deficit factor is estimated at 1%; and, estimating the new revenue to be at $1.88 million, which is $20,000 below the tentative budget. The final budget revenue projection is $51,656,471. Joe Allison reviewed the final budget expenditure assumptions which include: the full-time faculty obligation for fall 2013 is met; seven vacant faculty positions will be filled; adjustments for step/column and longevity increases; employee benefit rate adjustments; general fund support is eliminated for DSP&S, matriculation and Cal Works and is reduced for EOP&S based on the additions to the state budget; vacation payouts; and, planned expenditures have been added. The final budget expenditures projection is $53,115,772. This will leave an ending balance of $4,201,763 by bringing the ending fund balance forward from 2012-13. Joe stated the final budget reserve assumptions provides the Board reserve of 6% is met within the estimated ending balance of 7.9%; restoral items that were removed from the prior year budgets are not included in the expenditure budget although a reserve amount is being set aside to partially restore these items; carryover of encumbrances and materials; and a small amount is set aside for budget augmentations.

6. Public Hearing on the Final Budget for 2013-14 An opportunity was provided for members of the public to address the Board on the Final Budget for 2013-14. There was some discussion and questions related to the budget.

7. Hearing of the Public An opportunity was provided for members of the public to address the Board on matters of general district business. Mike Cuchna and Anne Newins provided an update on the Field of Honor project which will occur for one week, November 3 through 11, on the front lawn of the Merced campus. Forms for flags can be dropped off with Robin Shepard or online. Professor Jaime Farao expressed concerns on behalf of the agriculture advisory committee and some animal science students regarding the Board’s initial decision regarding the Brooks Ranch contract. Deano Migliazzo addressed the Board regarding his dairy’s relationship with Merced College. Agriculture students addressed the Board with their concerns regarding the Board’s actions in relation to the agriculture program.

8. Additions and/or Changes to the Agenda None.

9. Presentations a. Risk Pays Award

Russ O’Donnell from ASCIP presented Merced College with an award recognizing that we are a top performer in the pool of their insured Districts. He thanked Denise Butler, Dr. Schultz, and Dr. Taylor for their roles in ensuring the District practices safety. He also presented a check for $4,000.

b. Board Education – Common Assessment Project

Dean Doug Kain introduced Professor Mai Meidinger. Professor Meidinger is the region leader for the Common Assessment Project. Professor Meidinger provided an overview of the project. The aim of the project is to develop a single assessment tool which would be utilized throughout the California Community College system so if students transfer between colleges they will not have to re-take an assessment test for class placement in their new college within the system. The common assessment

would be for the subjects of math, reading, writing, and ESL students. It is being developed by faculty and is based on curriculum. It is anticipated approval will happen in spring 2014 and begin to use the new tool in fall 2014. Once the Chancellor’s Office approves the tool the C6 Consortium will help with the initial purchasing of the new test.

11. To the Board for Discussions and/or Action a. Proposed 2013-14 Final Budget

MSC (McCabe/Hicks) to approve the 2013-14 Final Budget as presented. The student trustee advisory vote was aye.

b. Confirmation of Authorized Bank Accounts Dr. Schultz said this is part of the Chancellor’s Office budget and accounting manual. Every year the bank accounts of the District must be reviewed and approved by the Board.

MSC (Arzamendi/Gutierrez) to confirm the continuing need for the bank accounts presented. The student trustee advisory vote was aye.

c. October 2013 Board Meeting Date Dr. Taylor explained that he and four Trustees will be traveling to Seattle, WA, on October 1, 2013, for an ACCT conference which is the date currently set for the October meeting.

MSC (Upton/Hicks) to hold the October Board meeting on Tuesday, October 8, 2013. The student trustee advisory vote was aye.

d. Request to Serve Wine/Beer at President’s Circle Dinner Dr. Taylor explained there is an annual dinner of the President’s Circle, which is held on campus, where beer and wine is traditionally served.

MSC (Arzamendi/Hicks) to approve serving wine/beer at the President’s Circle Dinner on September 25, 2013. The student trustee advisory vote was no.

e. Request to Provide Wine for Artists’ Reception for the Play “Evangeline” Robin Shepard provided information and background on the play “Evangeline” which will be performed at Merced College on October 10. There will be an artists’ reception on October 9 at 6:00 p.m. in the art gallery. MSC (Lashbrook/Upton) to approving serving wine for the artists’ reception for the play “Evangeline” on October 9, 2013. The student trustee advisory vote was no.

12. To the Board for Information a. Quarterly Financial Status Report, 2012-13 Fiscal Year; Quarter Ended June

30, 2013 Dr. Schultz provided an overview of the 311Q for the fourth quarter of 2012-13. She also gave some comparisons in areas over the last 5 years.

b. College for Kids 2013/Community Services Dean Karyn Dower provided a report on the 2013 College for Kids and Community Services. She informed the Board that community services won the President’s Blue & Gold award this year at convocation. In 2013, a total of 223 sessions were provided through College for Kids.

11. Reports a. From Academic Senate

Dee Sigismond gave the Board the hiring prioritization calendar for 2013-14 for reference. Senate is working on an update to Board Policy 4021. Trustee McCabe asked if there is equal representation for vocational and academic areas on the hiring prioritization committee. There was some discussion and questions. Dee stated there is fairly equal representation.

b. From Faculty Association Keith Law said he is excited about Merced College being off warning and faculty are happy that dark cloud is lifted. He stated reports on negotiations are positive. Faculty obligation number is of concern as is our meeting the 50% law.

c. From Classified Senate No one present to report.

d. From CSEA Leonel Villarreal had nothing to report.

e. From Management Team Cherie Davis reported the sub-committee of the management team on a restructure of the management will be presenting the information gathered this Thursday to the entire management group. Management Council met with Matthew Lee. Managers participated in the governance workshop and continue to be part of the shared governance process on campus.

f. From Board Members

Trustee Hicks expressed his appreciation for the College for Kids presentation as well as the program itself. His granddaughter has participated for many years and always enjoys it. He thanked Joanne for providing an understandable budget presentation.

Trustee Upton and her family appreciate College for Kids program. She liked the document put together for convocation on the strategic plan and is excited about the work the strategic planning committee will be doing. Trustee Arzamendi attended a MCSBA meeting last week which was informative and will attend a dinner later this month. He appreciated the reports given tonight. He was proud to see how much help was available to new students from staff as he helped his adopted daughter begin at Merced College. He thanked everyone for staying through tonight’s meeting. Trustee McCabe expressed his concern regarding the view of the agriculture students tonight as the issue was about the contract itself, not the horses being on campus. He feels the agriculture department needs to take better care of their area on campus. Trustee Lashbrook is excited about the work of the Foundation and is enjoying her time on the Foundation committee. She reported the reorganization task force has voted to include one voting student member. She is looking forward to the recommendations from the task force. Student Trustee Johnson introduced two members of ASMC who attended tonight’s meeting. There were two other students who attended the meeting as well but had to leave early. ASMC is excited to have a voting member on the reorganization task force. She thanked Trustee Lashbrook for their lunch meeting last week and she looks forward to doing the same with the other Trustees and administration. Trustee Gutierrez enjoyed the workshops held in August. He thanked the agriculture professor and students for coming tonight to express their views. He encouraged everyone to support the Field of Honor project and to attend “Evangeline”. He was excited to attend the first home game for our volleyball team and looks forward to the tournament this Friday. He thanked the presenters for their information tonight.

Trustee Jordan expressed his appreciation for the College for Kids program. He enjoyed the workshops and was happy to see the participation of staff and faculty. He was impressed with convocation this year. He proposed the idea of having a staff talent night which would showcase the wonderful staff and faculty and their talents outside the classroom and job here at Merced College for our community. He especially appreciated the presentation on the Common Assessment Project and is happy to see we are moving in that direction for the betterment of our students.

g. Superintendent’s Report

Dr. Taylor said there is work being done on a Board Policy on governance, agenda structure, a fact sheet for the Board, and next steps which all came from the workshops held in August. The Chancellor was here last week for a luncheon. Our police officers have asked to be released from CSEA representation and administration is working on this. He thanked the students and staff who helped the Higher One card issue at the beginning of the semester. He acknowledged the A&R staff for their excellent work as well as the staff who pitched in during an equipment failure in the Student Union building last week. He brought attention to the list of Board education opportunities he provided to the Board.

14. Future Discussion Items from Board Members Trustee Gutierrez reminded everyone to have the resolution to honor Hispanic Heritage month placed on the October agenda.

Citizens’ Bond Oversight Committee

Background Information

Pursuant to Education Code Section 15278, the District established the Citizens’ Bond Oversight Committee at a Board of Trustees Meeting held on February 4, 2003, in order to satisfy the accountability requirements of Proposition 39. The Board of Trustees adopted the Citizens’ Oversight Committee Bylaws, setting forth the duties and rights of the Committee, at a meeting held on June 17, 2003.

The purpose of the committee is to “inform the public concerning the expenditure of bond revenues.” The committee is charged with reviewing the expenditure of revenue to ensure the bond revenues are expended in compliance with the purposes of the bond and the requirements of Proposition 39. The following students have been nominated by Merced College ASMC Advisor, Raul Alcala, and will each serve a two-year term.

Administrative Services Staff are actively seeking a member to serve as a representative for a Taxpayer Organization.

Recommendation/Requested Action

Item: Appropriations Limit for Fiscal Year 2013-14 Presented By: Joanne Schultz For: Information Action X Background Information Under Article XIII-B of the Constitution and Chapter 1205, Statutes of 1980, all community college districts are required to compute an annual appropriations limit. That appropriations limit is adjusted annually for changes in price index, population, and other factors (if applicable). Government Code Section 7908 (c) requires each community college district to report to the Chancellor of the California Community Colleges at least annually its appropriations limit, appropriations subject to limit, the amount of State aid and subventions, local property taxes, interest earned from the proceeds of taxes, and amounts excluded from the appropriations subject to limit. The “GANN” Appropriations Limit for the Merced Community College District is calculated to be $56,623,151. The appropriation subject to the limit contained in the Final Budget is $45,259,665. Recommendation/Requested Action It is recommended that the Board of Trustees pass the attached resolution adopting the appropriations limit for the 2013-14 fiscal year. APPROPRIATIONS LIMIT FOR FISCAL YEAR 2013-14

WHEREAS, on November 6, 1979, the people of California passed Proposition 4, a constitutional amendment Article XIII-B requiring an appropriations limit for state and local government units; and WHEREAS, Senate Bill 1352, Chapter 1205 of 1980, implements Proposition 4, and requires the Board of Trustees to establish by resolution an appropriations limit each fiscal year beginning with 1981-82; and WHEREAS, the Board of Trustees has directed that the appropriations limit for fiscal year 2013-14 be developed in accordance with the provisions of Government Code Sections 7900-7913 implementing Article XIII-B of the California Constitution; and WHEREAS, the documentation used in determining the appropriations limit for fiscal year 2013-14 has been made available to the public in the Office of Business Services for fifteen days prior to the adoption of this resolution. NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees does hereby establish the fiscal year 2013-14 appropriations limit as $56,623,151. Background Information The District Warehouse is currently storing 14 handguns which have an estimated value of less than $5,000. We are requesting the handguns currently in use by the Criminal Justice Program be declared as surplus, in order to facilitate the negotiated replacement trade. Maintenance of the current handguns would require extensive repair costs in order to ensure the safety of the students and instructors. It is no longer economically feasible to continue using these handguns for classroom use. The purchase of new handguns for this program would total $5,397.84. However, the actual cost to the District for the purchase of these handguns is $1,869.84 which includes a trade-in discount of $3,528 for the surplus handguns listed below. If we are unable to use this method for replacement, funds will not be available to purchase new ones.

Item: Department Restructure for Grounds and Transportation Presented By: Joanne Schultz, VP of Administrative Services For: Information Action X Background Information As allowed in Title 5, Article 2, 53021(c) 1,2,3 a restructure to both the Transportation and Grounds Departments is requested in order to keep critical operations functioning effectively. The Transportation Department is down one and one-half positions out of a two and one-half staff operation. The proposal is to permantly reassign Ramon Avila, Sr. to the position of Lead Transportaion Mechanic and recruit his vacated position, leaving the 19 hour Mechanic I vacant. This is critical for keeping the fleet in working order to service student travel. Further needs will be assessed. The Grounds Department is down two positions out of a nine and a half-staff operation. The proposal is to permanantly reassign Saul Gonzalez, a 19 hour Grounds Keeper I into one of the two vacant Grounds Keeper I full-time positions. That would leave one and one-half positions vacant. This provides savings and a workable arrangement for the grounds teams. This would be effective on October 14th and would be included on the November Personnel Schedule. Recommendation/Requested Action The President/Superintendent recommends the permanent reassignment of Ramon Avila Sr. to Lead Transportation Mechanic and Saul Gonzalez to full-time Grounds Keeper I effective October 14th.

Merced Community College District Resolution 14-17 Declaring September 15 to October 15 as Hispanic Heritage Month at

Merced Community College District WHEREAS, The Merced Community College District Governing Board honors the heritage of Hispanics and Hispanic-Americans and Latin-Americans and acknowledges their many contributions to our Nation; and WHEREAS, the Hispanic student population of Merced Community College District has grown considerably, from 36.27 percent in 2007-08 to 51.35 percent in 2012-13; and WHEREAS, Merced Community College District is a federally-recognized Hispanic-Serving Institution (HSI); and, WHEREAS, one of the Core Values in the Merced Community College District’s Strategic Plan includes “Diversity- We embrace diversity as a strength of our community and celebrate it our institution;” and WHEREAS, President Lyndon Johnson established National Hispanic Heritage Month in 1968; and WHEREAS, in the year 1988, the observance was expanded and made into public law by President Ronald Reagan; and WHEREAS, this time period holds great significance, including the anniversary of independence of several Latin American countries (Belize, Chile, Costa Rica, El Salvador, Guatemala, Honduras, Mexico, and Nicaragua); and WHEREAS, this time period celebrates the contributions of visionary leaders, such as César Chavez, Dolores Huerta, and Sonia Sotomayor, to the national landscape; THEREFORE BE IT RESOLVED, that the Merced Community College District proclaims the period between September 15 to October 15 as Hispanic Heritage Month. AT THE October 8, 2013 MEETING OF THE BOARD Item: Urban Planning Grant Application Presented by: Joanne Schultz, Vice President Administrative Services For Information X For Action Background Information The Merced Community College District is eligible to apply for funds for the Urban Greening Planning Grant Program under the “Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006” (Proposition 84). This proposed project furthers the Governor’s State Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1. The proposed Merced College Urban Greening project, if funded, will support planning activities associated with conservation and beautification of the Merced College main campus located at 3600 M Street, in the heart of the city of Merced, California. These activities include developing site analysis and plans, plant lists, water conservation measures, convening stakeholder and community meetings, and developing a funding and implementation plan. Recommended Action The Superintendent/President recommends approval of the attached resolution to enable the District to apply for an Urban Greening Planning grant on or before October 11, 2013. RESOLUTION 14-18 MERCED COMMUNITY COLLEGE DISTRICT BOARD OF TRUSTEES

APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE URBAN GREENING PLANNING GRANT PROGRAM UNDER THE SAFE DRINKING WATER, WATER

QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84)

WHEREAS, the Legislature and Governor of the State of California have provided funds for the program shown above; and WHEREAS, the Strategic Growth Council has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the Strategic Growth Council require a resolution certifying the approval of application(s) by the Applicants governing board before submission of said application(s) to the State; and WHEREAS, the Applicant, if selected, will enter into an agreement with the State of California to carry out development of the Urban Greening Plan. NOW, THEREFORE, BE IT RESOLVED that the Merced Community College District Board of Trustees:

1. Approves the filing of an application for the Merced College Urban Greening Plan; and,

2. Certifies that Applicant understands the assurances and certification in the application; and,

3. Certifies that applicant will have sufficient funds to develop the plan; or will

secure the resources to do so; and,

4. Certifies that applicant will work towards the Governor’s State Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1; and,

5. Appoints the Merced Community College District Vice President of

Administration, Joanne Schultz, Ed.D., or her designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for development of the aforementioned plan.

Item: Administrative Services Division Restructure and Staffing Plan Presented By: Joanne Schultz, VP of Administrative Services For: Information X Action ____ Background Information As allowed in Title 5, Article 2, 53021(c) 1,2,3 The Administrative Services Team is proposing to take advantage of the nine vacancies in the Division and realign the departments to consolidate work, add support where needed, increase the level of expertise, provide an environment of safety, support program review objectives, increase productivity through more fully utilizing technology, advance the Technology Plan, build infrastructure to advance the survey results and ultimately reduce the budget. The proposed plan takes nine positions including three SERP positions at a total savings of $530K and proposes filling some positions, creating some new ones and leaving some vacant for a net salary savings of $211K not including benefits. Purpose: This plan is designed to utilize Title 5, Article 2, 53021 © 1,2,3 and take advantage of retirements and unfilled positions in order to consolidate work, add support where needed, increase the level of expertise, provide an environment of safety, support program review objectives, increase productivity through more fully utilizing technology and ultimately reduce the budget.

There is approximately $530K of savings with all of the vacancies. Some positions will need to be replaced and some additional positions added. Once all personnel are moved or hired there will still be a savings of $211K in 2013-14.

What is not included: This plan is not an all-encompassing plan. There were many suggestions from staff and managers that were very good ideas. It was not possible to include all of these ideas at this point. There may be vacancies created by the movement of staff or internal hiring which are not necessarily identified and will need to be considered when known. The outcome of the Bookstore has not been considered in this restructure. The discussion on student drivers is not complete so the impact on the fleet is unknown. Water reduction plans are in discussion as is a new facilities master plan and a botanical garden. The college and our mission are changing and this is a first step to position the Administrative Services Division to support some of those changes.

Next Steps: If the plan is approved by the Board of Trustees, then the effects of the plan along with the new and revised job descriptions will be negotiated with the CSEA. The movement of transfers can begin and once the job descriptions are approved, the CSEA positions can be advertised as is appropriate. After all of the transfers are complete, we will take a look at any vacated positions for rehire.

Campus Police:

1. This area has several hourly employees. We intend to add 4 new positions out of the hourly budget: bring the 2 - 19 hour citation officers on full-Time and hire 4 – 19 hour positions. This will allow expanded coverage and a secure workforce limiting the number of temporary employees needed by the department. (page 11 of 17 and 17 of 17 in the 12-13 Police Department program review)

2. Currently the Environmental Technician is budgeted here. After the Risk and Environmental Safety Manager is hired and the person has a chance to see what support is needed, we will

discuss this position at that time. The vacant position will move to the Risk management department.

Fiscal

3. There is an Accounting Technician position that is vacant. This position will remain vacant. An additional position is proposed to bring a higher level of expertise to the department in the form of a Classified Accountant. This higher level will allow the department to more fully utilized the Colleague system and assist the management team implementations and well as function at a higher level of expertise and at an increased level of productivity. (page 25 of the Business Services program review) A portion of this position will be funded from the indirect cost rate which is currently under development. The desire is to fill this position with a qualified internal candidate from within the college as defined in Title 5, Section 2, 53021 (b)(3).

Grounds, Custodial, Maintenance and Transportation

4. There are 5 vacant positions in this department. 2 Grounds positions, 1 Lead Transportation Mechanic, 1 part-time Transportation Mechanic and a Maintenance and Operations Manager. Four of these positions will remain vacant including the management position.

5. In order to support the grounds department, the service areas have been reworked to include 4 teams of 2. This new format is being regularly monitored to ensure that the workload is evenly distributed. The one 19 hour Grounds keeper will reassigned to one of the two full-time positions to assist with the losses in this area and even out the teams.

6. The Lead Mechanic will be replaced by the current Mechanic II and the vacated Mechanic II position will be filled by an internal recruitment as defined in Title 5, Section 2, 53021 (b)(3). The reassigned employees have the expertise and qualifications to carry out the necessary functions in the Transportation area. We are currently assessing the size and needs of the fleet and as retirements occur in the future the number needed in this department will be reassessed.

7. The current Administrative Support Secretary will be made full-time and will not only continue to work in Transportation but will take on additional related activities that will be moved around as a result of the position assignment shift below. These will be among the effects that will be negotiated once the plan is approved.

NOTE: The duties that are going to be moved will consist of support for the facilities committee, Bond Oversight Committee web page, Equipment rentals, meeting coordination, meeting room set ups, facility rental billing. Additionally pull notices and key distribution will be moved as well. The movement will be among support staff in Security, Facilities, fiscal and the position 7 noted above to ensure that no one position is overloaded.

Facility Planning and Development

8. This position does work that is traditionally done at the management level: Space Inventory, IPP and FPP planning and submissions, master planning and facility usage. Increase this position up to an appropriate level manager. This position will also develop a plan for increasing facility rental opportunities and rework the facility rental fee structure to more closely align with our neighboring colleges. The work that is needed on the Prop 39 Energy Plan, along with the new construction that is due to be approved and the laundry list of new regulations that are in the works make this a necessary and important management position. The person that is currently in this position will move into this new position. This level of knowledge will be vital to the planning a development of the current capital activity as well as future endeavors.

9. The duties that are currently unit work, will be handed off to the support staff with an increase of ½ of an FTE to take on the additional work.

10. It is recommended that the management position above take on the direct oversight of the event staff and facility rental program and personnel so that new facility rental program will have adequate planning and oversight.

Print Services

11. The Print Services Manager has been providing design plus creative and effective marketing tools for the college for some time. He has worked to enhance the image of the college and is doing much more than simply providing print services. This position will have a title and job description change to Graphic Communications Manager and should be raised to a level that is commensurate with the new job description. In addition to his current assignment we are considering adding some creative solutions to increase non-apportionment revenue such as the MC Press, book publishing for faculty, a Copy Center open to students and staff, and professional printing service for not-for-profits.

Purchasing, Mail Room and Warehouse

12. The recently vacated Purchasing Director will be replaced at a management level rather than a director. The VP will oversee Print Services and the Bookstore as a result of this change. Contract tracking will still occur in purchasing but contract management and review will be handled by the Risk Manager. The former manager will be the replacement for this position. The former buyer will move back into the vacated buyer position. This will leave a vacancy in Student Fees. A decision will need to be made as to how to replace this position.

Risk and Environmental Safety

13. This is a new position for the District. This position will plan, organize, coordinate and direct the District’s Risk Management functions, including, safety, hazardous materials management (HAZMAT), ergonomics, ADA compliance and investigation, property, liability and workers’ compensation insurance program statistics and complaints, reviews and analyzes the District’s contracts and compliance with health and safety standards and regulations. It will also provide

for training and assess safety complaints as well as organize the safety committee and work toward making sure that all employees are aware of the nature of risk and how to mitigate it. Once this person is in place they will determine what sort of support is needed.

Information Technology Services

14. There is currently a Help Desk Lead position open. We are proposing to permanently reclass the Help Desk Assistant into the Lead position and leave the Help Desk Assistant vacant. However the District only uses about 30% of the current SAE or Strategic Academic Enterprises (Colleague). There is a need for someone to analyze workflow in departments that are currently utilizing dbase, access and excel to perform essential functions. The Systems Data Analyst would actually assist with the implementation of module functionality and provide the additional backend support. (pg 11 of Information Technology Services program review) Additionally, there is a need for an additional Network Technician. We also propose a reclass for the Personal Computer Technician into a Network Technician to assist with higher level operations and implementation of the virtual desk top system.

The 2013 Budget Act contains a block grant of $30,000,000 for Physical Plant and Instructional Support. Merced Community College District’s share is $234,347. Block grants are distributed on 3:1 match requirement for instructional support and 1:1 match for scheduled maintenance projects. Item: Space Inventory Report

For: Information X Action Background Information In an effort to keep the board informed of the capital planning process, we will be bringing the different components to the Board as they become due for either action and/ or information. These two items are reporting requirements and are brought to the Board for information. Space Inventory: The California Community College Space Inventory provides planning and management data about existing physical facilities. The uses and the applications of the space inventory are: Serves as an integral part of the annual Five-Year Construction Plan (EC Section 81821); assignment and control of college campus space; analysis of space utilization; projecting future facility needs; project planning for capital outlay construction; and development and maintenance of facility allocation and utilization standards and guidelines. All changes to the space inventory report are approved through the Facilities Master Planning Committee. This report was reviewed at the September 6, 2013 meeting. A summary of the Space Inventory Report is attached for the boards review. The Space Inventory is a California Education Code requirement and is due to the Chancellor’s Office October 18, 2013. Energy Usage Data: Pursuant to the Board of Governors Energy and Sustainability Policy, state energy efficiency incentives will be made available to qualifying districts to help offset costs in proposed state funded capital outlay projects. To qualify for these incentives, the District is required to report natural gas and electricity usage data on an annual basis. The report is attached for the boards review. The calculation is due to the Chancellor’s Office on October 18, 2013. Recommended/Requested Action This update is presented as information. BOARD POLICY 2330 QUORUM AND VOTING

Reference: Education Code Section 72000(d)(3), 81310 et seq., 81365, 81511, 81432; Government Code Section 53094; Code of Civil Procedure Section 1245.240

A quorum of the Board shall consist of a simple majority of members. The Board shall act by majority vote of all of the membership of the Board, except as noted below (E.C. 72000[d][3]). For Merced Community College District, at a minimum, a positive vote of four members is required to carry any measure, excepting the types of measures listed below. No action shall be taken by secret ballot. As per Education the Code Sections referenced above, the following actions require a two-thirds majority (five votes) of all members of the Board: • Resolution of intention to sell or lease real property (except where a unanimous

vote is required); • Resolution of intention to dedicate or convey an easement; • Resolution authorizing and directing the execution and delivery of a deed; • Action to declare the District exempt from the approval requirements of a

planning commission or other local land use body; • Appropriation of funds from an undistributed reserve; • Resolution to condemn real property. As per Education the Code Sections referenced above, the following actions require a unanimous vote of all members of the Board: • Resolution authorizing a sale or lease of District real property to the state, any

county, city, or to any other school or community college district; • Resolution authorizing lease of district property under a lease for the production

BOARD POLICY 2340 AGENDAS Reference:

Government Code Sections 5495, et seq., 6250 et seq.; Education Code Sections 72121, 72121.5

An agenda shall be posted adjacent to the place of meeting at least 72 hours prior to the meeting time for regular meetings. The agenda shall include a brief description of each item of business to be transacted or discussed at the meeting. If requested, the agenda shall be provided in appropriate alternative formats so as to be accessible to persons with a disability. No business may be acted on or discussed which is not on the agenda, except when one or more of the following apply:

• a majority decides there is an emergency situation as defined for emergency meetings;

• two-thirds of the members (or all members if less than two-thirds are

present) determine there is a need for immediate action and the need to take action came to the attention of the Board subsequent to the agenda being posted;

• an item appeared on the agenda of, and was continued from, a meeting

held not more than five days earlier. The order of business may be changed by consent of the Board. The Superintendent/President shall establish administrative procedures that provide for public access to agenda information and reasonable annual fees for the service. Agendas shall be developed by the Superintendent/President in consultation with the Board President. Members of the public may place matters directly related to the business of the District on an agenda for a board meeting by submitting a written summary of the item to the Superintendent/President. The written summary must be signed by the initiator. The Board reserves the right to consider and take action in closed session on items submitted by members of the public as permitted or required by law. Agenda items submitted by members of the public must be received by the office of the Superintendent/President at least ten calendar days prior to a regularly scheduled board meeting.

Agenda items initiated by members of the public shall be placed on the Board’s agenda following the items of business initiated by the Board and by staff. Any agenda item submitted by a member of the public and heard at a public meeting cannot be resubmitted before the expiration of a 90 day period following the initial submission.

PROPOSED BOARD POLICY 3250 INSTITUTIONAL PLANNING Reference: Accreditation Standard 3;

Title 5, Sections 51008, 51010, 51027, 53003, 54220, 55080, 55190, 55250, 55510, 56270 et seq.

The Superintendent/President shall ensure that the District has and implements a broad-based comprehensive, systematic and integrated system of planning that involves appropriate segments of the College community and is supported by institutional effectiveness research. The planning system shall include plans required by law and those required by the College’s adopted planning structure. The Superintendent/President shall submit those plans for which Board approval is required by law or Title 5 to the Board. The Superintendent/President shall inform the Board about the status of planning and the various plans. The Superintendent/President shall ensure the Board has an opportunity to assist in developing the general institutional mission and goals for the comprehensive plans. PROPOSED ADMINISTRATIVE PROCEDURE 3250 - Institutional Planning Reference: Accreditation Standard 3, Title 5, Sections 51008, 51010, 51027, 53003, 54220, 55080, 55190, 55250, 55510, 56270 et seq. The College’s planning system is designed to be broad-based in terms of input by faculty, staff, students and community members. It is also comprehensive in that it addresses all areas of college mission, goals and operations, and it is systematic and integrated in that it operates on a regular cycle. In addition to the regular cycle for overall planning, the system includes periodic master planning for specific areas of need. The planning system is supported and informed by institutional effectiveness research, and it is improved as needed due to a regular process of system evaluation. Chief among the aims of the planning process is continuous attention to student learning outcomes for the District’s target population, and institutional changes to improve on those outcomes. Program review and other effectiveness measures are built into the system as core information driving adjustments. Purposes The fundamental purpose of ongoing, integrated planning and program review is to maintain and if possible improve the effectiveness of every college program and service and of the institution as a whole, based on the results of regular, systematic assessment. The ultimate beneficiaries of integrated planning and program review are our students and the community we serve. A secondary purpose of the process is to focus available resources—such as staff, budget, technology, and facilities—on the achievement of goals and objectives intended to maintain or improve effectiveness. Achieving some objectives requires resources over and above what is available, which means that a resource request is necessary. But achieving other goals requires no extra resources—only the reallocation of existing ones. Scope The planning and program review process applies to every part of the College. Structure The Educational Master Planning Committee (EMPC) coordinates the planning process. The Assessment Review Committee (ARC) is responsible for coordinating the program review process. The specific responsibilities of these committees and the other master planning committees are detailed in the Integrated Planning, Program Review and Shared Governance Handbook (“Handbook”). EMPC is the committee that maintains and updates the Handbook. EMPC also evaluates the planning process annually, in consultation with College Council and informed by the findings of ARC.

Cycle The planning system operates on a multi-year cycle in which goals are formulated for a given year based on program review information from the prior year, and progress on goals is then reported on at the end of the year, and influences subsequent goal formation in turn. The steps to the process are outlined in the current version of the Handbook (Section 1). Through the Resource Allocation Process, institutional planning shapes the College’s annual budget. The Handbook provides details about this process, as well as about the program review process (Section 2) and how program review information comes into planning and allocation decisions. Master Plans The College must maintain a long-term, multi-year educational master plan containing long-term strategic directions and the basis for them. The educational master plan needs to be based on broad and comprehensive data concerning the College’s service area and target population(s)—information that will assist the College in determining how best to fulfill its mission. As the College engages in a review and revision or updating of its educational master plan, the mission statement (BP 1200) should be reviewed and updated at the same time, with changes to be based on changes in the District’s service area, target population, or state-wide mission mandates. The educational master plan may be anywhere between five and twenty years in time scope, depending on available data and projections. EMPC is responsible for overseeing the development of the educational master plan. Once it is complete, the draft educational master plan shall be communicated to all College constituencies including students, and reviewed and approved by College Council, the Superintendent/President and the Board, after an appropriate opportunity for constituent input and response. Other, more specific “master plans” may be required. These and any other legally required planning documents should be informed by, and based on, the educational master plan. The College should develop and maintain, appropriate master plans in addition to legally required master plans. These should include a strategic plan, a technology master plan, and a staffing plan. Review and approval, and resource implications: Once any master plan is complete, the draft plan shall be forwarded to EMPC, which shall ensure that the plan is consonant with other master plans and strategic directions of the College as determined by the current educational master plan; then to College Council, which shall ensure adequate constituent review and communication concerning the implications of adopting the plan; and then to the Superintendent/President and the Board for review and approval. ADMINISTRATIVE PROCEDURE 4231 – Grade Changes Reference: Education Code Section 76224; Title 5, Section 55760 ADMINISTRATIVE PROCEDURE 4231 – Grade Changes Reference: Education Code Section 76224; Title 5, Section 55760 The instructor of the course shall determine the grade to be awarded to each student. The determination of the student's grade by the instructor is final in the absence of mistake, fraud, bad faith, or incompetence. The removal of an incorrect grade from a student’s record shall only be done upon authorization by the instructor of the course, with the following two exceptions: 1) If the instructor is no longer employed by the District and compelling evidence is available that there was a simple error in the grade submitted, the Vice President of Student Personnel OR Vice President of Instruction may change the grade, 2) If mistake, fraud, bad faith, or incompetence are present, the final determination concerning removal or change of grade will be made by the Board of Trustees based on the recommendation of the Superintendent/President. Students who believe that a grade is incorrect should obtain a “General Petition” grade change form from the Admissions and Records Office. All requests for a grade change, for both evaluative (A,B,C,D,F,FW) and non-evaluative grades (W), must be made in writing within two years of the last day of the semester in which the grade in question was earned.
