The Menomonee Falls Village Board Aug. 5approved a contract that will allow new gates to beinstalled at the Lepper Dam as part of an overall reha-bilitation of the structure.
The dam is located just north of Main Street andcreates the Mill Pond. The board awarded a contract toNuGen Johnson LLC for $192,195 to install the gates,which is below the village estimate of $211,000. Thework will be paid for through funds from the village cap-ital budget.
At the start of discussion, Trustee Jim Jeskewitz saidthe new gates will be stainless steel instead of regularsteel.
"We hope that they will be able to fix all the leaks,"Jeskewitz sa id.
He added that once the gates are installed, the vil-lage has the option of installing timbers that wouldallow the village to work on the gates without drainingthe pond. The gates and rehabilitation are the firstphase of a project that will involve dredging sentimentbehind the dam in t he second phase.
Village Manager Mark Fitzgerald added that thedam rehabilitation will include sealing, caulking andwork with the stone and concrete wall of the game.
Trustee Sharon Ellis asked about recent work thatwas done on the dam. Public Works Director ArlynJohnson said previous work included inspection andsome repairs to the gates. He said the repairs on theseals failed and the new leaks will be addressed by pur-chasing new gates. Fitzgerald said the work that was

The next steps in the court hearinginvolving the village of Menomonee Fallsand Lodging Investors of Menomonee Fallsunfolded days after a Waukesha CountyCourt Judge ruled in favor of the village ina lawsuit over debt obligations.
Lodging Investor of Menomonee Fallsis the ownership group of the Radisson
Hotel in Menomonee Falls. In April 2010,the village of Menomonee Falls provided a$17.6 million loan to Lodging Investors toconstruct and manage the hotel.
Several members of the ownership haddeclared bankruptcy and the ownershipgroup had been reduced to JamesHeyden, Constance OMara Heyden andL.A.C. Concepts.
On July 24, Waukesha County CircuitCourt Judge James Kieffer ruled in favor ofa summary judgement request from the vil-lage of Menomonee Falls stating thatLodging Investors was in default of its obli-gations. After the ruling, James Heydensaid he would be forced to file for bank-ruptcy.
Since that ruling, Lynne Mueller, anattorney for James Heyden, submitted a let-ter to the court stating that Heyden hasfiled for bankruptcy.
On Aug. 2, Randall D. Crocker, an

New motion made by village in lawith hotel ownership group

The Menomonee Falls Plan Commissionxpressed support for a Planned Residentialevelopment (PRD) zoning that will allow for127-single family lot subdivision to be
eveloped on property on Town Line Roadnd south of the Union Pacific Railroad track.
The development will also include 12uplex lots which will be located adjacent toe railroad track. The lots range from 9,600uare feet to 20,000 square feet. The
evelopment will be created on 84.95evelopable acres. The estimated value of
the project is $57,825, according to infor-mation provided to village staff by the devel-oper.
The current proposal includes one accesspoint and an emergency exits. Director ofCommunity Development Matt Carranexplained that Waukesha County wants thenorth access point to be an emergencyentrance and exit only. Commission memberTim Newman said he preferred that the northaccess point be allowed for everyday use.
Carran added the village will have toapprove a change to its comprehensive plan,which lists the property as being used forcommercial development.
The Menomonee Falls Planommission supported a request Aug. 6at will allow for the redevelopment ofoperties along Appleton Avenue north ofe Fire Station.

parking lots will be reconfigured into a sin-gle public parking spot.
The plan required a three-lot certifiedsurvey map and a change to the currentPlanned Infill Overlay District. No onespoke on a public hearing on the changesto the zoning district.
The commission supported the zoningchange and the certified survey map. Thecommission then supported a conditionaluse permit for the Pink Lemonade salon thatwill allow the business to move into theN88 W16653 Appleton Ave. building.

According to information from villagestaff, a monopole tower at N83 W13330Leon Road was constructed in 1988 and aconditional use permit was approved forVoicestream to place their wireless facilitieson the tower. Voicestream became T-Mobilethe next year.

Operating while intoxicated A male subject was arrested for oper-
ating while intoxicated-third offense at 1:45p.m. July 28 after police were dispatched tothe report of an erratic driver near GoodHope Road and Appleton Avenue. The sub-ject admitted to taking several Ambien pillsprior to driving.
A 26-year-old Menomonee Falls manwas arrested for operating while intoxicated-first offense at 10:29 p.m. July 26 after hewas stopped at Main Street and FountainBoulevard for erratic driving. The
subjectwho physically resisted officers asthey attempted to handcuff him, was alsocited for a variety of other offenses, includ-ing unsafe lane deviation and driving with-out insurance.

Several underage subjects were citedfor resisting/obstructing and underage con-sumption of alcohol at 12:13 a.m. July 27 atFalls Fest in Village Park. Police made con-tact with the group after an anonymous citi-zen reported that the subjects were intoxi-cated and about to drive with an 11-year-oldchild in the vehicle. As a result of the investi-gation, the subjects were arrested for thepreviously noted offenses, and arrange-ments were made for the child to receive a
ride home from a sober adult.Warrant A 28-year-old Milwaukee man was
taken into custody on a body-only warrantat 2:05 a.m. July 27 following a traffic stopat Lisbon and Marcy Road.
