I have attached the ordinances extending the impact fee suspensions. Rather than just extending the suspension by one year, I provided that the fees are suspended until the board adopts an ordinance reimposing the fees. Since the fees have been held in abeyance this long, the board will probably want the chance to reevaluate the proposed fees and the annual increases before they resume collection anyway. ORDINANCE NO. 2011-_

AN ORDINANCE AMENDING COLUMBIA COUNTY ORDINANCE NO. 2007-41, AS AMENDED, THE COLUMBIA COUNTY EDUCATIONAL SYSTEM IMPACT FEE ORDINANCE; PROVIDING FOR THE CONTINUED SUSPENSION OF COLLECTION OF THE COUNTY'S EDUCATIONAL SYSTEM IMPACT FEES; PROVIDING FOR PERIODIC REPORTS TO THE BOARD ON THE STATUS OF THE ECONOMY AND LOCAL BUILDING INDUSTRY DURING THE SUSPENSION PERIOD; PROVIDING FOR NOTICE OF IMPACT FEE RATES UPON EXPIRATION OF THE SUSPENSION PERIOD; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, on October 18, 2007 the Board of County Commissioners enacted

Ordinance No. 2007-41, the Columbia County Educational System Impact Fee

Ordinance (Ordinance No. 2007-41 as amended herein shall be collectively referred to

as the "Ordinance") imposing impact fees for Educational Facilities within the County;

WHEREAS, the impact fees imposed pursuant to the Ordinance took effect on

February 1, 2008;

WHEREAS, the downturn in the national, state and local economy has resulted

in increased foreclosures, business closings and a decline in new construction projects

within the County;

WHEREAS, a decline in construction projects within the County impacts all local

industries that are dependent upon growth, such as construction, manufacturing and

real estate;

WHEREAS, on April 2, 2009, the Board created the 2009 Economic Recovery

and Incentive Program to provide for suspension of the County's Educational Facilities

Impact Fees for a period not to exceed one year, subject to extension, in order to allow

time for the national, state and local economy to recover and to stimulate local

development, preserve jobs in the construction industry and expand the County and

School Board's tax bases;

WHEREAS, the 2009 Economic Recovery Incentive Program expired on

December 31, 2009 and was extended an additional year pursuant to an ordinance

amendment in 201 O;

WHEREAS, the Board now desires to provide for an additional extension of the

suspension of collection of the County's Educational Facilities Impact Fees.

NOW, THEREFORE, BE IT ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF COLUMBIA COUNTY, FLORIDA, that:

Section 1: Section 1.02K of the Ordinance is hereby amended in its entirety to

read as follows:

K. The 2008-2009 economic downturn has resulted in increased foreclosures, business closings and a decline in new construction projects within the County. A decline in construction projects within the County impacts all local industries that are dependent upon growth, such as construction, manufacturing and real estate. A decrease in the number of Building Permits issued by the County also adversely impacts the County and School Board's budgets. Growth of the County and School Board's tax bases is dependent upon new construction, redevelopment and increasing property values. In this economic climate the collection of Educational System Impact Fees, as established pursuant to this Ordinance, may place the County in a non-competitive position with other local governments that have chosen not to require growth to pay its fair share of needed improvements to the Educational System and thus hinder efforts by the County and the community to encourage economic development opportunities within the County, to preserve and create permanent employment expansion opportunities for the County's citizens, and expand the County and School Board's tax bases. Therefore the Board wishes to establish the Economic Recovery and Incentive Program providing for suspension of the County's Educational Facilities Impact Fees for a period net to e>Eseed t\¥0 years, subjest to e>Etension, in order to allow time for the national, state and local economy to recover and to stimulate local development, preserve jobs in the construction industry and expand the County and School Board's tax bases.

Section 3: Section 2.02 of the Ordinance is hereby amended in its entirety to

SECTION 2.02. ECONOMIC RECOVERY AND INCENTIVE PROGRAM.

A. The Board hereby establishes the Economic Recovery and Incentive Program to provide for suspension of collection of the County's Educational System Impact Fees, in order to allow time for the national, state and local economy to recover and to stimulate local development,

preserve jobs in the construction industry and expand the County's tax base.

B. During the suspension period, the County shall not collect the Educational Facilities Impact Fees imposed pursuant to Section 2.01 herein.

C. The provisions of this Ordinance relating to expenditure of existing Educational System Impact Fee funds and annual reporting requirements shall remain in effect during the suspension period.

D. Any Educational System Impact Fees collected by the County between January 1, 2009 and April 1, 2009 shall be refunded to the record Owner of the applicable Residential Construction on the date of issuance of the refund.

E. By June 1 of each year during the suspension period, the County Manager and the Superintendent shall provide a report to the Board and the School Board relating to the status of construction activity within the County since the effective date of this program. Such report shall include the number and type of permits issued, the amount of Educational System Impact Fee revenues lost as a result of the suspension, a summary of pending development projects, an overview of the national, state and local economy and impacts on the County and School Board's budgets and an update on the capital improvement plans.

F. By September 1 of each year during the suspension period, the County Manager and the Superintendent shall provide an additional report to the Board and the School Board, updating the data provided in the June report, providing recommendations for whether the suspension period should be extended and delineating the process for reimplementing the Educational Facilities Impact Fees at the end of the suspension period, including possible review of the impact fee studies pursuant to Section 3.05 of the Ordinance, possible revisions to the annual fee increases established in Section 2.01 and providing for the 90 day notice period required by Section 3.09 herein.

G. Collection of the Educational System Impact Fees shall resume upon the Board's adoption of an amendment to this Ordinance reimposing Educational System Impact Feeson Jan1:-Jary 1, 2011, and upon expiration of protJided that the notice period required by Section 3.09 has expired ey s1:-Jch date. In the e,,ent the notice period has not expired on Jan1:-Jary 1, 2011, colleotion of the fees shall res1:-Jme 1:-Jpon expiration of the QO day notice period.

Section 4. Severability. If any clause, section or provision of this Ordinance

or the Educational System Impact Fee imposed pursuant to this Ordinance shall be

declared unconstitutional or invalid for any reason or cause, the remaining portion of

said Ordinance shall be in full force and effect and be valid as if such invalid portion

thereof had not been incorporated herein.

Section 5. Effective Date. A certified copy of this Ordinance shall be filed in

the Department of State by the Clerk of the Board within ten (10) days after enactment

by the Board and the Ordinance shall take effect as provided by law.

All Emergency Medical System Impact Construction occurring within the County that submits a complete application for a Building Permit on or after January 1, 2009 and centinuing threugh and including December 31, 2010 shall not be required to pay the Emergency Medical System Impact Fees imposed by this Section pursuant to Section 8.02. The collection of Emergency Medical System Impact Fees shall resume upon expiration of the suspension period as provided in Section 8.02.F. herein.

The Board hereby establishes the Economic Recovery and Incentive Program to provide for suspension of collection of the County's Emergency Medical Services, Fire Protection, Correctional Facilities and Roads Impact Fees for a ~eriod not to exceed tv.,o years, commencing on January 1, 2009, in order to allow time for the national, state and local

economy to recover and to stimulate local development, preserve jobs in the construction industry and expand the County's tax base.

B. During the suspension period, the County shall not collect the Emergency Medical Services Impact Fees imposed pursuant to Section 2.04 herein, the Fire Protection Impact Fees imposed pursuant to Section 3.04 herein, the Correctional Facilities Impact Fees imposed pursuant to Section 4.04 herein or the Roads Impact Fees imposed pursuant to Section 5.04 herein.

C. The provisions of this Ordinance relating to expenditure of existing Impact Fee funds and annual reporting requirements shall remain in effect during the suspension period.

D. Any Impact Fees collected by the County between January 1, 2009 and April 1, 2009 shall be refunded to the record Owner of the applicable Capital Facilities Impact Construction on the date of issuance of the refund.

E. By June 1 of each year during the suspension period, the County Manager shall provide a report to the Board relating to the status of construction activity within the County since the effective date of this program. Such report shall include the number and type of permits issued, the amount of Impact Fee revenues lost as a result of the suspension, a summary of pending development projects, an overview of the national, state and local economy and impacts on the County's budget and an update on the capital improvement plans.

F. By September 1 of each year during the suspension period, the County Manager shall provide an additional report to the Board, updating the data provided in the June report, providing recommendations for whether the suspension period should be extended and delineating the process for reimplementing the Emergency Medical Services, Fire Protection, Correctional Facilities and Roads Impact Fees at the end of the suspension period, including possible review of the impact fee studies pursuant to Section 8.10 of the Ordinance and providing for the 90 day notice period required by Section 8.13 herein.

G. Collection of the Emergency Medical Services, Fire Protection, Correctional Facilities and Roads Impact Fees shall resume upon the Board's adoption of an amendment to this Ordinance reimposing Impact Fees on January 1, 2011, and upon expiration of provided that the notice period required by Section 8.13 has expired by sush date. In the e•.1ent the notise period has not sxf:)ired on January 1, 2010 ~. sollestion of the fees shall resume upon expiration of the 90 day notise period.

Section 11. Severability. If any clause, section or provision of this Ordinance

or any Impact Fee imposed pursuant to this Ordinance shall be declared

unconstitutional or invalid for any reason or cause, the remaining portion of said

Ordinance or remaining Impact Fees shall be in full force and effect and be valid as if

such invalid portion thereof had not been incorporated herein.

Section 12. Effective Date. A certified copy of this Ordinance shall be filed in

the Department of State by the Clerk of the Board within ten (10) days after enactment

by the Board and the Ordinance shall take effect as provided by law.

Re: Change Orders In Question For New Fort White Library

Akin Akinyem (Architect), Brooks Hayes (Project Manager), Ben Scott (County Purchasing Agent), Dale Williams (County Manager) and myself had a meeting about the new Fort White Library change order issues. After much discussion it was decided by Dale Williams, to pay change orders in question for the total amount of $9,340.77.

Below are listed the change orders in question:

1. Smoke Wall/ Bulkhead: This work was performed to correct an issue in the field noted by David Boozer, Division Chief - Fire. The area between the smoke partition at the trusses and the ceiling had to be framed and sheetrock installed so as to complete the smoke assembly below the ceiling.

2. Gable Correction: This work was performed to align the front gable with the columns at the drive through area and was approved via RFI #11. Detail C IS -1.0 and detail B/S - 2.0 gave different dimensions from the edge of building to the face of the gable and face of the column. This change corrected the discrepancy by furring out the gable to cover the masonry column in an aesthetically pleasing method.

3. Door Operator: This operator was installed at the request of Debbie Raulson to provide automatic access at the foyer entryway. The function circuitry was done by the County. This was done to supplement the one operator that was already included in the contract documents.

4. Drywall Level of Finish: This work was requested by Art Butler to provide a level of finish on the interior gypsum that was comparable to a Level 5 finish. The end result was a superior wall surface that neutralizes any effect of "down lighting" throughout the building.

With Change Order# 4, I do not have enough information nor do I know where to find it to make an opinion, nor do I know what was agreed to prior to the work being done.

In accordance with the Columbia County Charter Section 8.4, not later than Ju1y 1 of the year 2011 and of every eighth year thereafter, the Board of County Commissioners shall appoint a Charter Review Commission to review the Charter of the County. The Charter Review Commission shall be appointed in the same manner as a Charter Commission under the Florida Statutes; being composed of an odd number ofmembers, not less than 11 or more than 15.

The Board of County Commissioners in regular session held April 7, 2011 selected the composition of a 15 member Charter Review Commission with each Commissioner selecting three individuals. Therefore the following individual members are presented for appointed to the Charter Review Commission:

We need simple rules to build sophisticated collaborations in these open networks. Ed Morrison of the Purdue Center for Regional Development will introduce us to Open Source Economic Development and the discipline of Strategic Doing. We will explore how to build action-oriented collaborations quickly to accelerate innovation in our regions and state.

This is to correct the non-compliance finding by the Department of Community Affairs concerning Ordinance 2007-17, the adoption of changing 53.67 acres from Agriculture-3 to Highway Interchange land use classification. It was in non-compliance due to the wording of the ordinance which stated "will be changed" when a community water and sanitary sewer system becomes available to the site. It was found in non-compliance because it changes the property at a later time and not with the adoption of the ordinance. The agreement provides for the Department of Community Affairs to find the amendment in compliance provided that the following changes are made (Exhibit "B") and adopted by a new ordinance. The County was also able to negotiate the permitting of 20,000 square feet ofbuilding floor area through septic tanks prior to sewer facilities becoming available to the site.

Requesting to amend the Future Land Use Plan Map of the Comprehensive Plan by changing the land use classification of 539.49 acres from RESIDENTIAL LOW DENSITY (less than or equal to 2 dwelling units per acre) to CONSERVATION, this is part of the requirements from the Florida Communities Trust Grant. Property located around Alligator Lake but not the portion located within the city limits of Lake City.

The developer must provide competent evidence that the property is not in the stream to sink watershed or the Comprehensive Plan should be amended to allow for MUD land use classification in the stream to sink watersheds with development standards as providing for in the Land Development Regulations.

Land Development Regulations Amendments (adoption hearing):

LOR 11-01 - Board of County Commissioners

Amend the Land Development Regulations Section 5. 7 entitled Maintenance, to require that any road, street, utilities, public parking or other public area or drainage facility accepted for maintenance by the County be designed and built in accordance with the Board of County Commissioners requirements and amending Section 5.20 entitled Maintenance and Repair of Required Improvements, to require subdividers to maintain and repair the improvements they are required to construct until it has achieved no less than 50 percent build out with certificates ofoccupancy within the recorded subdivision; to increase the maintenance surety from 10 to 15 percent for required subdivision improvements; to provide the procedures for the Board of County Commissioners to accept the maintenance of subdivision improvements.

Planning and Zoning Board recommend denial. The Board's opinion is that the increase in property taxes generated by the change from acreage to subdivision lots should take care ofroad maintenance. This amendment would also discourage growth and development during these economic hard times.

LOR 11-02 - Board of County Commissioners

Amend the Land Development Regulations Section 4.2.3.2 entitled Width of Curb Break, to change the maximum width ofcurb breaks within residential areas from 24 feet to 40 feet, to change the minimum width ofcurb breaks within planned shopping centers, industrial developments multi-family developments with parking for 300 or more vehicles from 24 feet to 40 feet. and to revise the resolution number referenced in said section.
