UNIVERSITY OF ILLINOIS

June 12.1926

The quarterly meeting of the Board of Trustees of the University of Illinois was held at the University, in Urbana, at 9 o’clock a. m. on Saturday, June 12, 1926.

The following members were present: President Trees, Mr. Armstrong, Mr. Barr, Mrs. Busey, Mrs. Evans, Mrs. Grigsby, Mrs. Ickes, Dr. Noble, Mr. Wham.

President Kinley was present. MINUTES APPROVED

The Secretary presented the minutes of the meeting of May 15, 1926. On motion of Mrs. Evans, the minutes were approved as printed on pages 587 to 603 above.

COMMITTEE ON STANDING COMMITTEES

The special committee on standing committees of the Board, Mr. Armstrong, Mrs. Ickes, and Mr. Barr, reported a recommendation that no change be made in the list of standing committees at this time.

On motion of Mr. Armstrong, this recommendation was adopted and the committee was discharged.

GREGORY MEMORIAL

Mrs. Ickes, for the special committee on a memorial to Regent J. M. Gregory, made a report of progress and asked for further instructions from the Board.

This matter was discumed and the committee was requested to confer with the interested alumni and report later.

OPTION ON PERCIVAL FARM

Mrs. Busey, for the Committee on Agriculture, reported a recom-mendation that the University do not avail itself of the option to pur-chase the Percival farm at the present time.

On motion of Dr. Noble, this recommendation was adopted. MATTERS PRESENTED BY PRESIDENT KINLEY

The Board considered the following matters presented by the Presi- dent of the University.

DEATH OF CAPTAIN JOHN R. TREVETT

( I ) Announcement of the death this day of Captain John R. Trevett, a member of the Board from 1913 to 1919.

On motion of Mr. Barr, the President of the Board was directed to appoint a committee to draft resolutions of regret. President Trees appointed Mrs. Busey, Mr. Wham, and Dr. Noble to act on this committee.

BAND OVERCOATS

(2) A letter fmm the Alumni Committce to secure overcoats for the band: June 9, 1926

Having straightened up the final details of our work as members of the Band Overcoat committee, appointed by the Alumni Association to solicit funds to pur-chase overcoats for the band men, we now take pleasure, on behalf df alumni and other friends of the University, in presenting to the University of Illinois z ~ qband overcoats. These were purchased with funds contributed by alumni and other citi- z.ens. The total amount received was $6,326.85. All of this money except $9.26 was spent for band ot-ercoats and for expenses connected with soliciting the money. The 89.26 remaining has been turned over to the band fund.

AMENDMENTS TO RETIRING ALLOWANCE SYSTEM

( I I ) The follodng communication: I . Paragraph 3 provides “as to all members of the faculty, and educational, ad-

ministrative, and mechanical staff who ‘nave been in the service of the University of Illinois for fifteen or more years”-and so forth. The question is raised whether the fifteen years’ minimum period of service required to make a person of sixty-five eligible for retiring allowance must be continuous. My opinion is that the interests of the Cniversity, for which this system was established, will be best promoted byinterpreting the phrase to .mean “fifteen or more years, a t least the last ten of which shall have been continuous,” and I so recommend. I recommend that this interpretation apply to individuals going on retirement September I next.

2. The question is asked whether in computing the retiring allowance any re- gard shall be had for the fact that a person retiring on a professorship held for five years or more previous to retiring, may have held, for example, a deanship or other office with a higher salary than he has been receiving during the five years preceding retirement.

3. Paragraph 4 provides that all rights and claims of the staff under the re- tiring allowance system cease with the terminaticm of service “whether such termi- nation is voluntary or otherwise.” Under this provision people on term appoint-ment might lose such claims as they had to a retiring allowance by the mere ex- piration of their term without action on their part or the part of the Board. I sugpt that there be added to paragraph 4 the following: “For purposes of this scheme of retiring allowances, members ci the faculty or staff employed in successive academic years or other term appointment shall be held to be in continuous employ- ment even though their cash compensation is paid in or for less than twelve months of any academic year.”

4. Paragraph 3- (b ) .provides that “upon retirement there shall be paid to the member retiring, during his life, an amount equal to 25% of the average cash por-tion of compensation which has been paid to him during the last five years prior to retirement”-and so forth, I recommend that the following Sentences be added to this paragraph a t the end: “In case a member of the staff retired under these rules has been on leave of absence on half pay under the University regulations in any one of the five years preceding his retirement or part of any one of said five years the full salary rate for the year of absence shall be taken in computing the average of the cash compensation of the five years on the basis of which the allowance is determined. In the casc of a member who has been absent in any one of the five years preceding retirement, or part of any one of said five years, without salary, absence having been with the approval of the Board of Trustees, the salary received for the year preceding the year of absence shall be the amount used for the cash compensation in the year of absence for the purpose of computing the average cash compensation for five years.”

On motion of DF. Noble, these matters were referred to the Finance Committee for consideration and report on Monday.

NEEDS OF THE COLLEGE OF MEDICINE

( 1 2 ) A request that Dean Davis be heard on the budgetary needs of the College of Medicine for the next biennium.

This request was granted, and Dean Davis was heard. AMENDMENT TO SCHOLARSHIP REGULATIONS

( 1 3 ) I recommend that the President of the University be author‘md to extend the period of any undergraduate scholarship established by the Board so that it may run for a maximum of six years when extension is requested on the ground either of absence to earn money to meet the expenses of schooling, as now; or of serious ill-ness necessitating the absence of the scholarship h d d e r 4 h e term “serious illness” being interpreted to mean such illness as incapacitates the individual concerned for

a period long enough to make it impossible for him to finish the work of a t least the semester in which he becomes ill, provided that the individual concerned shall return to his work at the Univerkty as soon as health permits.

On motion of Mrs. Ickes, this amendment was adopted. REPORT OF PROGRESS ON THE NUTRITION INVESTIGATION

(14) Following action taken by the Board at the February meeting, two meetings of the Nutrition Commission have been held-March 13 and April ID-to consider the publication of Volume I1 and the Summary giving the conclusions of the Commission.

The Commission strongly recommends that Volume IT of the Report be pub-lished in full as edited by Dr. MacNeal in order to mmplete satisfactorily the pub- lication of the records of the investigation as originally planned. The Commission has not yet decided whether to recommend the publication of a Volume VI, a pam- phlet giving the Conclusions of the Commission.

Of the above, Professors Barton, Goebel, Noyes, Talbot, Hollister, Mr. W. A. McIntire and Mr. C. A. Dunseth have intimated a desire to continue a t least an- other year in their present work. After the best consideration I can give the matter, I am of the opinion that the best interests of the University require the retirement of all in the list who have reached the age of Sixtyeight whose princi- pal work, or a large part of it, is teaching. Therefore, I am not able to acquiesce in the requests by those in such positions.

I recommend that Professor H. A. Hdlister be continued one year more as High S b l Visitor. My reason for recommending his request to you is that I feel the need of his srvices for one year more to carry through to compktion the ex-periment of cooperative high school inspection which we have been making for the past two or three years with the Superintendent of Public Instruction. I feel the need of at least one more year’s trial of this experiment before concluding what to recommend to your Board as our policy in the matter. To turn the work over to a new man before the experiment is conduded would vitiate the experiment.

The continuance of Mr. C. A. Dunseth is recommended by Professor White. He states that Mr. Dunseth is in good physical health and rendering full and loyal service to the University in the Physical Plant division, Mr. Dunseth being a car- penter.

I concur in Professor White’s recommendation. Mr. W. A. McIntire is a clerk in Agronomy whose duty is to keep the records

of the weather service. He is entirely competent to continue this work for another year and I recommend his continuance.

With reference to Professor Goebel and Professor Barton certain questions have been raised which go to the policy which your Board wishes to follow in the inter- pretation of the provisions of the retiring allowance scheme. In the case of Pro-fessor &be!, moreover, the question is raised whether in the past few years he has been treated fairly in the matter of salary and whether his retiring allowance, therefore, is as large as it should be. I recommend that your Board appoint a com-mittee to inquire into the vc-hole matter, to determine whether there is any ground for thinking that a mistake has been made in this case, and if so,what means your Board will adopt to repair it. 1 would recommend also that this committee con- sider the question raised in Professor Barton’s case.

I would call your attention especially also to the case of Andrew Tornquist. Mr. Tornquist has been in the service of the University a total of eighteen years, eight and two-thirds months. The longest period of continuous service, however, is from September I, 1908, t o October I, 1917, a period of nine years, one month. Mr. Tornquist then left the University service for a period of seven months, re-entering it May I , 1918, and continuing until now. It should be added that from May I, 1918,to February I, 1919,he was employed in the School of Military Aero- nautics. I include this work as University service.

On motion of Mr. Armstrong, Professor Hollister was continued for one year from September I, 1926, as High School Visitor.

On motion of Mrs. Ickes, Mr. C. A. Dunseth was continued for one year from September I, 1926,as carpenter.

On motion of Mr. Wham, Mr. W. A. McIntire was continued for one year from September I , 1926,as clerk in agronomy.

On motion of Dr. Noble, the President of the Board was directed to appoint a special committee to inquire into the amounts of the re- tiring allowances for Professor H. J. DEATH BENEFIT FOR ERIC FROBERG (18) Mr. Eric Froberg, Head Janitor a t the College of Medicine, died May 16. I recommend that an ap- propriation of $750 be made from the Reserve and Contingent fund and that the Comptroller be authorized to pay this amount to Mrs. Englejohn.

I. The University purchase a seven-passenger Nash sedan to take the place of the Nash touring car for use in Agricultural Extension, the new car to be used for extension and general University purposes.

2. Instead of turning in the old car, for which an allowance of $3~0would be made, it be transferred to the Physical Plant operating department,

I recommend that $1400be appropriated from agricultural funds and $950 from the Reserve and Contingent fund for this purchase, and that the old car be turned over to the Physical Plant department.

AMENDMENT OF RULES ON RETIRlNG ALLOWANCES

Mr. Armstrong, for the Finance Committee, recommended that the rules on retiring allowances and death benefits be amended to be ef- fective at once, as recommended by the President of the University (see page 634) with the exception that the amendment to Paragraph 3 shall read “at least the last seven years of which shall have been con-tinuous.” The amended paragraphs read as follows:

3. As to all members of the faculty, and educational, administrative, and mechanical staff who have been in the service of the University of lllinois for fifteen or more years, a t least the last seven years of which shall have been Umtinuou8, and

who shall be in the employment of, and active service for the University at the time for retirement as hereinafter provided, a part of the compensation for their services shall be paid in the value of retiring allowances to be provided or secured for, or paid to, them by the Board of Trustees, in the following amounts and under the following conditions, to-wit: . . . . . . .

(b) Upon retirement there shall be paid to the member retiring, during hi life, an amount equal to twenty-five per cent of the average cash portion of compensationwhich has been paid to him during the last five years prior to retirement, together with one per cent of such average amount additional for each year of his service a t the University of Illinois; the maximum payment, however, not to exceed one- half of such average amount. Provided, however, that no retiring allowance shall be paid in excess of $6,000 per year to a President of the University, 54,000 to a dean, and 53,000 to other members. In case a member of the staff retired under these rules has been on leave of absence on half pay under the University regula- tions in any one of the five years preceding h i retirement, or for part of any one of the five years, the full salary rate for the year of absence shall be taken in com- puting the average of the cash compensation of the five years on the basis of which the allowance is determined. In the case of a member who has been absent in any one of the five years, or part of any one of said five years, without salary, absence having been with the approval of the Board of Trustees, the salary received for the year preceding the year of absence shall be the amount used for the cash compensa- tion in the year of absence for the purpose of computing the average cash compen- sation for the five years.. . . . . . . .

4. As the additional compensation in death benefits and retiring allowances herein provided is to be paid to =cure the stability and permanency of said faculty and staff; therefore, all rights and claims of any member of said faculty and staff in or to death and disability benefits and retiring allowances, are forfeited, and shall cease, with the termination of service of such member for the University, whether such termination is voluntary or otherwise. For the purposes of this scheme of retiring allowances, members of the faculty or staff employed in successive academic years or on other term appointment shall be held to be in continuous employment even though their cash compensation i s paid in or for less than twelve months of any academic year.

On motion of Dr. Noble, these amendments were approved and adopted.

Mr. Wham, for the committee to consider the amount of allow-ance for Professors Barton, Goebel, and Harker, announced that a report would be made a t the July meeting.

On motion of Mr. Barr, the recommendation of the President of the University that certain persons be retired on allowance as of Sep- tember I, 1926 (see page 635),was adopted.

REGULATION OF TUTORING Mrs. Grigsby, for the Committee on Instruction, announced that the Committee expected to make a report on the proposed regulation on tutoring a t the July meeting.

( 2 ) A statement concerning the bids on the electric wiring for the Armory Addi- tion and the Library Stack room (pages 640, 641):

On Saturday 1 submitted recommendations from the Supervising Architect concerning the award of contracts for the electrical work in the additions to the Armory and the Library. These contracts were awarded to the Marrs-Tanner Elec-tric Company. The Supervising Architect has sent me a letter today in which he states that by some oversight one of the bids, that of the Hatfield Electric Company of Indianapolis, duly submitted in accordance with the specifications for the sub- mission of bids on this work, was overlooked when the bids were opened in his office on the afternoon of the 12th. This bid is $6718 for the Library wiring and $7580 for the Armory, with deduction of 2% percent if both bids are accepted. Professor White further states that the bid of the Hatfield Company was mailed, According to the post mark, at 8:00 p. m, June 9. He further states that the Hatfield bid was received and recorded in his office on June 10. Tbe certified check for $430 enclosed in the letter was certified by the Merchants’ National Bank of Indian-apolis on June 9. He then states, “The bid was mislaid in my office and not opened with the other bids a t two o’clock on the afternoon of the 12th. The bids in both cases are over $1000 lower than the low bid as listed when the other bids were opened.” Professor White further says, “I called Mr. Tanner of the Marrs-Tanner Electric Company, on long distance on Saturday evening, as he was present when the bids were opened, and explained the situation to him.’’

Professor White recommends that the vote of the Board on Saturday awarding the contracts for the electrical work for the additions to the Armory and Library be reconsidered and rescinded and that the award be made to the Hatfield Electric Company as being the lowest bidder. Professor White says that he will inform all the bidders of this incident, so that all may understand it.

The error is regrettable, but the procedure recommended by Professor White seems to me proper and I concur in his recommendation with the proviso that the facts be set forth in the Minutes as I have given them above and that all interested be duly informed.

On motion of Mrs. Evans, the action of June 12 (page 640, para-graph 29) was rescinded.

On motion of Mrs. Ickes, and in view of the fact that the rec- ords in the Supervising Architect’s office show the receipt of this bid regularly and in due time, the contract for the electrical wiring for the addition to the Armory was awarded to the Hatfield Electric Company, the low bidders.

ELECTRIC WIRING FOR LIBRARY On motion of Mrs. Evans, the action of June 12 (page 641,paragraph 32) was rescinded.
