Eben Alexander, Jr. , M. D. , President of the Board of MedicalExaminers of the State of North Carolina, called this meetingto order at 8:30 p. m. , March 9, 1988, at the Hotel Europa,Chapel Hill, North Carolina.

The Board members present at this meeting included: JohnThomas Daniel, Jr. , M. D. , Secretary-Treasurer; Charles HowardDuckett, M. D. ; Harold L. Godwin, M. D. ; Hector Himel Henry, II,M. D. ; Nicholas Emanuel Stratas, M. D. ; and Mrs. Kathryn HowellWillis.

On March 10, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Henrythat the Board instruct its attorney to prepare an Order forDr. Rogers to show cause why the Board of Medical Examiners ofthe State of North Carolina should extend his licensure.

SHAIA, WILLIAM HARRY, M. D. , Charlotte, North Carolina

The Board of Medical Examiners reviewed information indicatingthat Dr. Shaia plans to retire from the practice of medicine byJanuary 1, 1989. On March 10, 1988, the Board unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel that the Board request written notification from Dr.Shaia when he has formalized these plans and has a definiteretirement date.

Dr. Daniel reviewed information indicating that this physicianhas experienced problems with a Board in another state.

On March 10, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Daniel and seconded by Dr. Duckett

that the Board offer Dr. Waltz the opportunity to surrender hisNorth Carolina medical license within a specified period oftime; and that, if Dr. Waltz does not surrender his licensewithin this time limit, the Board of Medical Examiners of theState of North Carolina prefer charges against Dr. Waltz on thebasis of the State of Alabama Medical Licensure Commission' sformal action.

ALESSI, JOSEPH FRANCIS, M. D. , Swansboro, North Carolina

On March 10, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Danielthat the Board offer Dr. Alessi the opportunity to enter into aConsent Order; and that, if Dr. Alessi does not sign theConsent Order within a specified period of time, the Board ofMedical Examiners of the State of North Carolina prefer chargesagainst Joseph Francis Alessi, M. D.

PROGRAM ON SUPERVISION OF PHYSICIAN EXTENDERS

Dr. Duckett advised the Board that he and the ExecutiveSecretary for the Board of Medical Examiners have prepared aone hour program on the supervision of physician extenders andthe responsibilities of the physicians who supervise themedical acts performed by these extenders. Dr. Stratassuggested that it might be appropriate to videotape thisprogram.

CRIMINAL HISTORY INFORMATION

On March 10, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Henrythat the President of the Board send the following letter toMr. Corley again requesting criminal history information andthat he also send the Attorney General a copy of this letter:

On March 10, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Henrythat the President of the Board write a letter concerning thismatter to Dr. Tolbert with copies to Dr. Imbus, Dr. Edwards,and Mr. Dux.

On March 10, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel that the Board respond to Mr. Bryan indicating that aphysician may set up a business corporation to provide experttestimony; but that, in acting on behalf of this businesscorporation, the physician may not provide medical services.

WENTZ, IRL JESSE, M. D. , Morehead City, North Carolina

On March 10, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Henrythat the Board request that this physician provide a writtenresponse indicating his intention to comply with the followingstipulations:

(1) Dr. Wentz wi 11 prescribe medications in DEA Schedules 2,2N, 3, 3N, 4, and 5 only in a hospital setting;

(2) Dr. Wentz will complete a minimum of fifty hours ofCategory One continuing medical education approved by theAmerican Academy of Family Practice or the Academy ofOrthopaedic Surgeons within one year;

(3) Dr. Wentz wi 11 take and pass the SPEX examination todemonstrate his competency to practice medicine;

(4) Dr. Wentz will appear informally before the Board as itmay request; and

(5) Dr. Wentz will submit his practice and office records tosuch monitoring as the Board may deem necessary.

On March 10, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Henrythat the Board offer Dr. Berrios the opportunity to enter intoa Consent Order with the Board of Medical Examiners and that,if within a reasonable time period Dr. Berrios does not signthis Consent Order, the Board prefer charges against OswaldBerrios, M. D.

BRIGGS, GERALD PAUL, M. D. , Lexington, North Carolina

On March 10, 1988, the Board of Medical Examiners unanimously

adopted a motion made by Dr. Duckett and seconded by Dr. Henrythat the Board request Dr. Briggs to provide a writtenstatement indicating that he will comply with the followingconditions:

( 1) Dr. Briggs wi 11 discontinue using HCG and all anorecticmedications in his medical practice;

(2) Dr. Briggs wi 11 refrain from prescribing medications inSchedules 2, 2N, 3, and 3N except in a hospital setting;

(3) Within one year, Dr. Briggs will furnish evidence ofcompletion of fifty hours of Category One continuingmedical education, applicable to his practice and approvedby the American Academy of Family Practice;

(4) Dr. Briggs will improve his record-keeping procedures bydocumenting in patient charts the medical indications forall medications prescribed; and

(5) Dr. Briggs will submit to such monitoring of his practiceand prescribing activities as the Board deems necessary.

On March 11, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Stratas and seconded by Dr. Danielthat, if the Board has not received a signed Consent Orderprior to the June, 1988, meeting, that the Board of MedicalExaminers hold a hearing in June on the matters contained inits proposed Consent Order.

On March 11, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Godwinthat the Board prefer charges against Selwyn Rose, M. D. , on thebasis of N. C.G.S. 90-14(a)(6), Unprofessional Conduct.

On March 12, 1988, the Board of Medical Examiners unanimously

adopted a motion made by Dr. Alexander and seconded by Dr.Godwin that the Board wi 11 approve Dr. Mauk's medical licensurein this state for a period of one year contingent upon Dr.Mauk's signing a letter: ( 1) which wi 11 be public information;(2) which will contain a reprimand for engaging in the practiceof medicine in North Carolina without a license; and (3) whichwi ll contain the following stipulations:

(a) Dr. Mauk will obey all federal and state laws;

(b) Dr. Mauk will be and remain of high moral character;

(c) Dr. Mauk will, within a period of one year, furnishevidence of completion of fifty hours of continuingmedical education; and

(d) Dr. Mauk, should he desire continued medical licensure inNorth Carolina, will appear before the Board for aninformal interview prior to the expiration of this datedlicense.

ASSAD-FALTAS, MARIE-THERESE, M. D. , Durham, North Carolina

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Godwinthat the Board deny approval of Dr. Assad-Faltas' applicationfor medical licensure in North Carolina on the basis of thefact that her postgraduate medical training does not meet NorthCarolina's statutory requirements.

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Stratasthat the Board deny approval of Dr. Habashi's licensureapplication on the basis of the fact that she has not completedclinical clerkships in hospitals with ACGME approved residencyprograms in the specialty areas of Dr. Habashi's clerkships.

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel, based on Dr. Fisher's compliance with statedconditions, the Board issue Dr. Fisher a dated license for aperiod of one year.

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr.Daniel that the Board offer Dr. Summerlin an opportunity toenter into a Consent Order with the Board of Medical Examinersof the State of North Carolina.

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a further motion made by Dr. Godwin and seconded by Dr.Daniel that, if Dr. Summerlin does not sign and return theConsent Order within a specified time period, the Board ofMedical Examiners of the State of North Carolina prefer chargesagainst this physician.

BICKLEY, SAMUEL TAYLOR, M. D. , High Point, North Carolina

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Henry that the Board offer Dr. Bickley the opportunity to signa Consent Order within a specified period of time from the datehe receives this document.

PHYSICIANS HEALTH AND EFFECTIVENESS PROGRAM

On March 13, 1988, the Board of Medical Examiners of the Stateof North Carolina discussed this program. The Board membersinstructed its representatives to participate in thedevelopment of a job description for the Medical Director ofthis Impaired Physicians Program which reflects therecommendations of the Board of Medical Examiners, particularlyregarding the Board's belief that the Medical Director of theProgram should be responsible for directing and monitoring theimpaired physicians and their recovery programs. The Boardmembers further stated that the Medical Director of theImpaired Physicians Program should follow-up on the status ofindividuals referred to this program and should provideprogress reports to the Board of Medical Examiners.

The Board further discussed the concept that the North CarolinaMedical Society should assume the responsibility for fundingthe Physicians Health and Effectiveness Program and indicatedthat the Board of Medical Examiners was not prepared to beeither the sole, or major, source of financial support.

On March 13, 1988, the Board of Medical Examiners unanimously

adopted a motion made by Dr. Stratas and seconded by Dr. Henrythat the Board advertise an administrative hearing to adoptregulations for the Physicians Health and Effectiveness Programand that the Board also approve two additional ex-officiomembers of the Physicians Health and Effectiveness CommitteeTask Force to 'perform Search Committee functions only.

On March 13, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Stratas and seconded by Dr. Henrythat the Board is prepared to authorize an expenditure of$40, 000 for 1988 and $80, 000 for 1989, contingent upon thefollowing conditions:

(1) Board approval of the Medical Director's job description;

(2) Board approval of a narrative description of the Program'sfunction;

(3) Board approval of a budget analysis specifying how theProgram will utilize the Board of Medical Examiners'financial contributions;

(4) The North Carolina Medical Society's obtaining funds tomatch the Board of Medical Examiners' contributions during1989; and

(5) Board approval of a Memorandum of Understanding containingthe conditions specified by the Board of Medical Examinersprior to a commitment of funds by the Board of MedicalExaminers of the State of North Carolina.

The Board members recommended that they review a proposedMemorandum of Understanding containing their recommendationsfor enabling language at the May, 1988, meeting and clearlystated that they would not approve funding prior to theeffective date of this Memorandum of Understanding containingconditions acceptable to the Board of Medical Examiners of theState of North Carolina.

KELLER, TED STEVEN, M. D. , Dayton, Ohio

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel that the Board advise Ted S. Keller, M. D. , the Board ofMedical Examiners expects a response to its offer of January23, 1988, within two weeks or the Board of Medical Examiners ofthe State of North Carolina will initiate formal actionprocedures.

TAYLOR, STANLEY DOUGLAS, M. D. , San Bernardino, California

On March 11, 1988, at 1:15 p. m. , the Board of Medical Examinersof the State of North Carolina held a hearing on chargespreferred against Stanley Douglas Taylor, M. D. Althoughneither Dr. Taylor nor his counsel attended this hearing, inaccordance with N. C. G.S. 90-14.7, the Board of MedicalExaminers continued with the hearing procedures.

On March 11, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Duckett and seconded by Dr. Godwinthat the Board finds the charges preferred against Dr. Taylorto be true and that the Board of Medical Examiners revokes thelicense to practice medicine in the state of North Carolinapreviously issued to Dr. Taylor.

KROGER FOOD STORES HEALTHY LIFE SERVICES

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Danielthat the Board write Kroger Food Store, 1116 Eastchester Drive,High Point, North Carolina, a letter regarding "Healthy LifeServices" and that it send a copy of this letter to Kroger FoodStore Headquarters.

RESIDENT TRAINING LICENSES PROCEDURES

The Board discussed obtaining a letter from Eastern VirginiaSchool of Medicine which wi 11 indicate the type of supervisionresidents engaged in this medical school's training programhave received and which will specifically answer the question:Have clinical faculty members provided supervision to residents?

The Board of Medical Examiners also directed its staff toestablish a system whereby the Board is aware of:

( 1) physicians who are participating in training programs,

(2) the time length of these programs, and

(3) instances involving extensions of physicians' trainingprograms.

The Board further advised the staff to place temporal limits onresidents training licenses.

QUESTIONS ON APPLICATIONS FOR LICENSURE

Dr. Stratas discussed the need for revising the questions on

the Board's application for licensure form to reflect theconcerns expressed in the current oral questions; the ExecutiveSecretary offered to consult with Dr. Stratas in revising thesequestions; and Dr. Stratas and Mr. Paris stated they wi 11present proposed revisions to written application questions forthe Board's review.

MOORE, ANTHONY JOSEPH, M. D. , Durham, North Carolina

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Duckettthat the Board extend Dr. Moore's dated license for a period oftwo years.

ROBERTS, JANIFER C. , M. D. , Whitevilie, North Carolina

On March 11, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Henry and seconded by Dr. Danielthat the Board extend Dr. Roberts' dated license for a periodof one year.

COFFMAN, DONALD RALPH, M. D. , Greensboro, North Carolina

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr.Alexander:

(1) that the Board reaffirm its previous action;

(2) that the Board offer Donald Ralph Coffman, M. D. , theopportunity to enter into the Consent Order originallyproposed by the Board of Medical Examiners; and

(3) that, should Dr. Coffman not sign and return the ConsentOrder within a specified time period, the Board of MedicalExaminers of the State of North Carolina advise him itwi 11 proceed with such other actions as the Board deemsappropriate.

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel:

(1) that the Board reaffirm its previous action concerning Dr.

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Stratas and seconded by Dr. Danielthat the Board offer Dr. Smith the opportunity to enter into anagreement specifying:

In response to an invitation from the Board of MedicalExaminers, Mr. Don Brown, Diversion Group Supervisor, DrugEnforcement Administration, Greensboro, North Carolina,discussed his activities with the Board which relate to thepractice of medicine.

Don Brown advised the Board members that the classification forthe controlled substances: Doriden and Talwin, will soon changeto Schedule 2. Brown for providing the Board with this report and stated, "Ibelieve it will be to the Board of Medical Examiners' benefitto meet with you again. " Mr. Brown indicated his willingnessto meet with the Board members for future discussions.

At the conclusion of the interview, the President of the Boardstated that he believed the Journal should publish some of theinformation presented by this representative of the DrugEnforcement Administration and further stated that, asPresident, he will write a letter on behalf of the Boardexpressing its appreciation for Mr. Brown's informativepresentation.

The Board's Attorney reported that Dr. Bressler has indicated,after completion of litigation on one final case, he willsurrender his license to practice medicine in North Carolina.

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Stratasthat, if Dr. Bressler has not surrendered his license prior tothe June, 1988, meeting, the Board of Medical Examiners hold ahearing on charges preferred against Bernard Bressler, M. D. , atits June, 1988, Board meeting.

MALPRACTICE REPORTS FROM INSURANCE COMPANIES

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Stratas that, as there is no indication for further action, theBoard instruct its staff to file appropriately the malpracticereports reviewed during the March, 1988, meeting.

The Board of Medical Examiners issued the followinginstructions regarding these malpractice reports:

(1) Request detailed information on, and present for fullBoard review, both individual and collective suitsinvolving $100,000 or more.

(2) Present to full Board for review malpractice reports onphysicians who have five or more suits;

(3) Include the following information in summaries ofmalpractice reports:

REGISTRATION PROCEDURES

The Executive Secretary presented a report to the Boardregarding the administrative work involved in the new

registration procedures.

On March 12, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Daniel and seconded by Dr. Duckettthat the Board request Mr. Paris to make a presentation to theFederation on this subject; that the Board commend Nr. Parisand Mrs. Green for their efforts in implementing the Board ofMedical Examiners' action on registration procedures; and thatthe Board consider as an Agenda Item for Discussion at eitherthe May or June, 1988, meeting:

(1) In the future, will the Board of Medical Examiners askphysicians registering their North Carolina medicallicenses similar questions to those asked during thisregistration period?

(2) If the Board decides to do so, what questions will it ask?

On March 13, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Daniel that the Board accept as information a report indicatingthat this physician has withdrawn her application for a licenseto practice medicine in the state of North Carolina.

SHEARIN, WILLIAM ARTHUR, M. D. , Raleigh, North Carolina

At his request Dr. Shearin appeared before the Board. He

stated, "I am the President of the Ophthalmologists Society forthis year. The Advisory Board wanted me to come to you andasked that I discuss with you some of its concerns.Post-operative care is the main concern; and mostOphthalmologists believe that the operating surgeon or anotherOphthalmologist should provide this post-operative care. "

Dr. Shearin then asked the Board of Medical Examiners to definewhat it believes to be an appropriate period of post-operativecare for a cataract patient. Dr. Alexander told Dr. Shearin,"The Board of Medical Examiners represents medical practicethroughout the state of North Carolina. Although the Boardagrees with your position regarding Ophthalmologists' providing

post-operative care to their patients, it cannot specify toOphthalmologists how long they should fo1 low patientspost-operati ve1y. "

Dr. Stratas suggested, "Ophthalmologi sts could formal ly acceptcertain practices as representing the standards of care inNorth Carolina. The Board would then have this information asreference. "

The President of the Board of Medical Examiners told Dr.Shearin, "The Board appreciates your bringing these matters toits attention and expressing your concerns. Moreover, itrequests that you notify the Board of Medical Examiners of anyspecific practice which you believe a representative of thisBoard should investigate. "

HOSPITAL MANDATORY REPORTING REQUIREMENTS

On March 13, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Duckett:

(1) that the Board indicate, although the Board of MedicalExaminers does not wish to review hospital disciplinaryaction based on charts not being up to date, it does wishto receive information regarding any disciplinary actionconfirmed by:

a hospital's Board of Governors, Chief of Staff, orDisciplinary Committee;

(2) that the Board further indicate it wishes to receiveinformation on all suspensions acted upon by the GoverningBoard of a hospital as well as any situations that mayrepresent violations of the medical practice act in thisstate;

(3) and that the Board communicate this information to theNorth Carolina Hospital Association.

AUDIT REPORT

On March 13, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr. Danielthat the Board commend the Executive Secretary, the Board'sstaff, and the Auditor on this report.

HOSPITALITY SUITE AT FEDERATION MEETING

On March 13, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Godwin and seconded by Dr . Stratasthat the Board authorize an expenditure of $2, 500 to cover thecost of supporting the campaigns of Drs. Citron and Duckett atthe Federation meeting.

QUESTION FROM THE BOARD OF DENTAL EXAMINERS

On March 13, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Stratas and seconded by Dr.Duckett that the Executive Secretary advise Christine H.Lockwood it is the opinion of the Board the proceduresdescribed in Dr. Homoly's letter are outside the scope of thepractice of dentistry and may encroach on the practice ofmedicine.

EMERGENCY MEDICAL SERVICES REPORT

On March 13, 1988, the Board of Medical Examiners unanimouslyadopted a motion made by Dr. Alexander and seconded by Dr.Godwin that the Board endorse the following recommendations ofJohn Thomas Daniel, M. D. , Liaison Representative from the Boardof Medical Examiners to the Office of Emergency MedicalServices:

(1) that the Board approve all Advanced Life SupportApplications and Bee Sting Certifications presented by theOffice of Emergency Medical Services;

(2) that the Board hold action on the application submitted byMarty Edwards in abeyance pending receipt of additionalinformation.

(3) that the Board approve the Documents submitted by theOffice of Emergency Medical Services as required by theAdvanced Life Support Regulations which will becomeeffective May 1, 1988;

(4) that the Board advise C. J. Schmidt, M. D. , there arestatutory requirements and regulations with which he mustcomply and that the Board of Medical Examiners recommendsyou coordinate your efforts concerning this matter withMr. Ed Browning, Assistant Chief-Education, Office ofEmergency Medical Services.

(2) that the Board advise Dr. Magee it will pay all theexpenses required to take this examination;

(3) and that the Board also advise this physician, afterreceiving his scores, the Board of Medical Examiners willagain consider his licensure request.
