Scotties take first game 15-2 The Scotty softball team made quick work of Shepherd this morning, shelling the Mustangs 15-2. Shyla Bergtoll pitched an inning and Abby Mehling came in and did a dandy job. The Scotties were to face the Stillwater/Cut Bank winner this afternoon at 3:00. If you can’t make it out to Sullivan Park for some awesome softball action, tune in to KLTZ/KLAN for updates. The final games today are at 5:00; the tournament continues on Saturday at 10:00 with the championship at 2:00 (and a second championship game possible in this true double-elimination format). The weather is warm and the grill is on for some great concessions at Sullivan Park. Get out and enjoy some softball.

BANKRUPTCY HEARING- Having attended the St Marie Development Corp bankruptcy hearing in Billings Federal Court last Tuesday I will provide a brief summary of the proceedings. Before I do so, let’s roll back the clock and look at previous history in order to gain a better understanding of the past, present , and future of St Marie.IN THE BEGINNING- Just up the road from Glasgow on Hwy 24 the Government planned, built, and paid for the Glasgow Air Patch(taxpayers). Out of the bowels of the earth this base, infrastructure, and housing rose up from being just an old cow pasture. At first came the Fighter Wing, later on came the mighty Boeing B-52’s or BUFF’s as they were affectionally called. The government or tax payers DEVELOPED St Marie !!LATER- Pat Kelly bought housing and commercial buildings for pennies on the dollar and sold them for large thousands. Then comes Parks (now in prison) who bought from Pat Kelly and made some money then went belly up. This led from VPI to VPLT (Valley Park Liquidating Trust), to SMDC (St Marie Development Corp or Kelly) and EMS and GTMS (Bethea corporations).....along with many individual owners that became SMCA (St Marie Condo Association) EARLY OTHER DEVELOPERS/INVESTORS- OCI (Olympic Coast Investments), BRH, EE (Equity Enterprizes), and Wright failed to “fix and sell” much of anything.NOW INVESTOR/DEVELOPERS- DTM and Mitchell who bought tax deeds, along

with Kelly and Bethea. Still waiting to see much fixing and selling happening. Their property recordings reflect North Valley County Condo Association (NVCCA) which by the governing documents should provide insurance and services and DO NOT.IN CONTRAST- SMCA condo owners pay their dues for the most part ($270K per year) and do provide repairs, gardening, and insurance. The market value of their 251 units is somewhere between $8-$9 million dollars and they are insured for replacement cost of $32 million with an average of $142,000 each. One can see the picture....a livable house finished off in most cases with new furnaces, water heaters, roofs, siding, painting, and windows and doors in workable order sell for between $30- $35,000. BUT the cost to replace with current labor and material prices is $125,000 to $180,000 depending on the square footage of the unit. Most all these SMCA owners pay their Association Fees, Water Bills, and Taxes and for the most part PAY to keep the infrastructure going.BANKRUPTCY PROCEEDINGS:Honorable Judge Ralph Kirscher held court with Fedeal Attorney Daniel McKay representing U.S. Trustee Gail Brehm. Kelly was represented by Gary Deschenes of Great Falls and Bethea/unsecured creditors committee were represented by James Patten of Billings. Jenny Reinhardt, Pat Kelly and Marv Bethea took the witness stand and testified. REINHARDT (Valley County Treasurer) was very impressive under heavy

Letter to the BuzzDave Gorton – Correction

A week or so ago I wrote a letter to the Buzz urging the voters of Valley County to support Dave Gorton for Justice of the Peace. After said letter was printed I was informed that it contained an error. In the letter I stated that Dave is presently serving as a member of the Montana Supreme Court Commissions on Courts of Limited Jurisdiction, which is the commission that helps develop the curriculum for the semi-annual training for City Courts, Municipal Courts, and Justice of the Peace. Unbeknown to me, Dave’s term had expired and he is no longer serving on the Commission but is a former member of the Montana Supreme Court Commissions on Courts of Limited Jurisdiction. Said error aside, I still believe that Dave Gorton is by far the most qualified person running for Justice of the Peace and urge the voters of Valley County to support Dave Gorton. Thank you. Vandals need to think twice before committing a crime on a public site managed by Montana Fish, Wildlife & Parks. Anyone convicted of vandalism on FWP managed sites, including fishing access sites and wildlife management areas, may lose their hunting, fishing and trapping privileges for two years. The vandalism law also carries a fine of up to $1,000, and six months in jail. FWP officials said that criminal trespass on FWP properties may also result in the loss of hunting, fishing and trapping privileges. Report crimes in Montana’s fishing access sites, WMAs or other FWP sites by calling 1-800-TIP-MONT (1-800-847-6668). TIP-MONT callers can remain anonymous and may be eligible for a reward of up to $1,000 upon conviction of those responsible for the crimes.

The JUDGE brought up the issue of Kelly not having insurance on the bankrupt properties in question- Kelly responded that he had an E-mail quote from an Insurance Agent (the day before) at which the Judge asked the cost and if he had a policy in hand. Kelly did not. The JUDGE asked about a “Business Plan.” Kelly stated that the properties could sell for about $70,000 each with “National Marketing.” and made mention of a golf course. What golf course? On his bankruptcy filing Kelly stated that the properties were valued at 1, 2, 3, and 5 thousand dollars each? BETHEA took the stand as a creditor stating that his claim was for “management fees.” He also expressed his desire for a Chapter 11 with conditions....that he along with Robert Dunseth and Jay Kasso be on a created Creditors Committee. Some ask: “Did he act as “Paid Manager” of Valley Park Liquidating Trust, St Marie Development Corp, and North Valley County Condo Association?” Did they all go bankrupt?JUDGE’S ORDER- The day following the hearing Judge Kirscher ORDERED that the Debtor (Kelly) would have through May 30 to provide the Court with proof of appropriate insurance on all its properties and if the Debtor does not do so by May 30, the case will be DISMISSED.OPINION- Having sat through and listened to all the testimony under oath (re direct, narrow the world to a few, need to show cause, rights of remedies, file another motion, bifurcated plan, creditor/debtor obligations, determination of the court, etc.) and reading all the correspondence, it appears that the TRUSTEE has made their case for Ch 7 or dismissal. By Bruce AuchlyFWP Region 4 Information Officer The other morning I spied a yellow-rumped warbler outside the office window. Just a brief moment that turned into a highlight of the day. Bird watching anyone? It’s easy, doesn’t take much equipment and is cheaper than a lot of other hobbies – ask any boat owner. And it can brighten an early spring day when the weather wants to shackle us to winter. One day it’s drab outside, the next day there is a colorful bit of fluff and feathers in the front yard that has just accomplished an amazing feat of migration. Some of those birds, weighing just a few ounces, fly thousands of miles from the tropics to the northern boreal forests. Although other parts of the country south of Montana are already seeing lots of songbirds passing through or setting up house, the beginning of May is a bit early for the peak here. Many migratory birds, such as orioles and yellow warblers, don’t reach their peak arrival here until mid- to late May. The early birds, like that tiny yellow-rumped warbler, that are here by late April or the beginning of May have found a niche in nature that allows them to arrive ahead of the feathered mob, find a spot for a nest, attract a mate and get on with the survival of their species. Several years ago, May 1 blizzards hit the state and, no doubt, killed a few of the early migrant species. The early bird gets the worm, of course. But also, the early bird can muscle in on some prime real estate for nesting, which means a better chance to hatch and raise young, have the young learn to fly, then everyone head south by late summer. Birds arriving too late are pushed into marginal habitat and are less likely

to successfully nest for a variety of reasons: less food, more predators, exposure to the elements. So there’s the gamble: Arrive early and with warm weather, or even average temperatures, thrive and prosper. Arrive late, or get hit with a cold wet spring, and lose. By the way, there are several fascinating websites on spring migrants. Try the Cornell Lab of Ornithology and National Audubon Society: http://ebird.org/content/ebird. It lists weekly updates by regions, then species. Start at the Explore Data link. For a Montana flavor, specifically which bird is seen where, find the American Birding Association website: http://birding.aba.org Then, click on Montana under Western US. At that point, bookmark it. What is perhaps more amazing than when birds arrive is how they do it. How do birds navigate over thousands of miles to find just the right spot for raising young and ensuring the survival of their species? Migrating birds navigate by using the sun and stars, the earth’s magnetic field, and probably mental maps. Although that means a warbler that successfully hatched and flew south last summer has to remember the route and fly it in reverse. It’s not easy. And sometimes birds don’t make it. That yellow-rumped warbler outside the window the other day, may still not be done. The species nests into Northern Canada and Alaska. So my friend may have just made a pit stop to pick up an insect or two and head north. It’s a bird’s life.

A French guest who was staying in a hotel in Edmonton phoned into room service for some pepper. “Would you like black pepper, or white pepper?” asked the concierge. The Frenchman said, “Toilette pepper!”
