51. WECOME AND NOTICES

The Chairman welcomed everyone to the meeting. 52. APOLOGIES Apologies were received from Councillors Clayden and Peters, Mr Squires and Mr Marchant. 54. DECLARATIONS OF INTEREST

Councillor Dr Walsh declared a personal interest in agenda item 14, report on the Local Government Pension Scheme (LGPS) Discretionary Pension Policy as a Trustee of the West Sussex LGPS.

55. MINUTES 55.1 Regarding Minute 38.2, (Leisure Trade), Members reported that a brief

discussion about mooring difficulties on the Town Quay and agreement to seek a meeting with Littlehampton Town Council had been omitted from the minutes. It was therefore proposed that the following be added to the Minutes,

“Following a discussion about the Town Quay and the funding thereof, it was agreed that a meeting be arranged with Littlehampton Town Council”.

55.2 It was therefore RESOLVED that subject to the addition of this amendment to

Minute 38.2, the Minutes of the meeting held on 11th July 2016 (previously circulated) be approved and signed by the Chairman.

56. HARBOUR OPERATIONAL REPORT

The Harbour Master presented a report (previously circulated) which detailed the operational activities undertaken in the harbour since the last meeting. In addition, the Harbour Master updated the Board on the following matters:

56.1 Commercial Trade

The Harbour Master reported that the MV Shetland Trader was due to visit the Harbour later in the month. It was observed that larger class vessels were now regularly using the harbour and that the workboat Erica was proving valuable in managing this type of commercial activity.

56.2 Leisure Trade The total number of visits for August was 128. 56.3 Workboat Activity It was noted that the workboat had been contracted to undertake further work

in connection with the construction of the Rampion Windfarm. Although arduous, the staff and workboat were handling the work well.

56.4 Local Notices to Mariners (LNM)

Further Notices had been issued as follows: 09 of 2016 – Jet Ski collision at the Marina 10 of 2016 – Collision with ship 11 of 2016 – Vehicle stranded on slipway 12 of 2016 – Motorboat capsized 13 of 2016 – Re-opening of the Marina Fuel berth 14 of 2016 – The Waterfront Festival – Sunday 21st August 15 of 2016 - Arundel Festival Dragon Boat Race – Sunday 28th August

56.5 Safety MarNIS Report The increase in reported incidents was a reflection of the rise in activity over the holiday period. Regarding the Jet Ski incident, the Harbour Master reported that the emergency services and Harbour duty crew had responded promptly and a major incident averted. However, the incident could have been a lot more serious in terms of environmental impact and injury. This had prompted the Harbour Master to undertake a review of how this type of

activity was managed in the Harbour, the outcome of which would be reported to the Board later in the meeting. Other incidents had highlighted the need for care when manoeuvring vessels at various points within the harbour and for mariners to be aware of commercial activity within the harbour and of sea conditions beyond the harbour limits. The Board noted with sadness the fatality at sea which had occurred on a dive boat. The Harbour Master stated that the fatality occurred outside the harbour and that he was in contact with HM Coast Guard who were responsible for managing the reporting regarding this incident. The value of the enhanced MarNIS reporting in terms of the oversight it gave the Board was acknowledged. 56.6 The Waterfront Festival

Councillors Buckland and Dr Walsh declared personal interests during the discussion of the following matter as Littlehampton Town Councillors. The Notes Secretary also declared a personal interest in the following matter as an employee of Littlehampton Town Council.

The Board praised the Harbour Master and his team on the success of the

event and thanked the staff for their hard work. The Chairman highlighted the lack of support from the Town Council and Councillors Dr Walsh and Buckland confirmed that if asked, Littlehampton Town Council might be happy to assist with the event in the future. It was also noted that the Harbour Master had contacted the Town Council to investigate the availability of grants. It was therefore RESOLVED that: The contents of the Harbour Operational Report be otherwise noted.

57. TREASURER’S REPORT 57.1 The Treasurer presented the income and expenditure statement and income

analysis for the period to 31 July 2016 (previously circulated). It was noted that income for the year to date was currently ahead of budget due to workboat income and the receipt of unbudgeted lease income from the new tenant at the former UMA wharf. Although operating expenses were also slightly below budget at this point, this was due to timing. Whilst there was no reason to expect that the Board would not meet its budget, it was too early in the financial year to make predictions. It was therefore RESOLVED that:

The Report be noted. 58. PERSONAL WATERCRAFT (PWCs) 58.1 The Harbour Master presented a report which contained a revised set of

controls regarding the management of PWCs within the harbour (previously circulated). He explained that the Board had relaxed the controls on this activity in the harbour in 2014. However, the recent incident at the Marina and the increased reports of anti-social behaviour in connection with the use of

PWCs had prompted him to reassess the need for more stringent controls to ensure the river remained navigable at all times. At this stage the reintroduction of an annual harbour due only policy and proof of insurance were proposed. The views of Members were therefore sought on this issue and whether the use of PWCs should be banned in certain parts of the river.

58.2 The Board went on to discuss this issue and enhanced controls in terms of

current practice and what was practicable going forward. Members questioned whether PWCs could be used safely in the confined space of the harbour and how enhanced controls would be monitored and enforced. They also noted that PWCs were varied in design, had differing safety features and their use was unregulated. Observing that the majority of PWC users were responsible individuals, Members did not want to discourage this activity but accepted that the increase in casual use, ongoing reports of speeding and other antisocial behaviour made the need for more stringent controls necessary. The Harbour Master stated his review would look at practices in other harbours in respect of enforcement and zoning. It was also considered that the revised controls should include documentary evidence of insurance and training / experience. It was accepted that in all likelihood any changes would be self-policing and Members therefore considered it important that the Stakeholder User Group be involved in the review. A member could not recall authorising the relaxing of the previous rules and the Harbour Master agreed to take this forward as part of his review. It was RESOLVED that:

The review of the strategy to control the use of PWCs in the Harbour be

progressed as set out in Minute 58.2 above and the revised controls be brought back to the Board for approval prior to the start of the summer 2017 season.

59. PILOTAGE DIRECTIONS 59.1 The Harbour Master presented a report which sought the formal approval of

the Board to a change in the Pilotage Directions to enable the harbour to accommodate larger vessels (previously circulated). He explained that a trial visit by the MV Falcon had proved that vessels of up to 78m in length could be piloted safely in the harbour with the deployment of the workboat. Whilst the increase in the maximum length reduced the tolerances, it was noted that risk assessments would be completed for each new class of vessel. The Board therefore RESOLVED that:

The maximum length overall for vessels using the port be increased

from 75m to 78m and the Littlehampton Harbour Pilotage Directions be amended accordingly.

60. DREDGE BASELINE DOCUMENT 60.1 The Board had before it a draft baseline document which it was proposed

would form the basis of the Harbour Board’s dredge policy going forward (previously circulated). The Harbour Master explained that the policy aimed to provide information about the harbour environment, designations within it and

its uses to assist operators undertaking dredging activity in the harbour. The document had been drafted following consultation with stakeholders, the Marine Management Organisation and Natural England and would be shared with the Stakeholder Group at their next meeting. The Board went on to review the document in the context of conservation of the specially designated areas within the harbour, the extent to which the Board was empowered to dredge and its responsibilities within the harbour. It was observed that this was a working document which would evolve through reference and usage. Noting that the water quality information was out of date the Harbour Master confirmed that this would be corrected prior to publication. The Board therefore RESOLVED that:

Subject to the addition of up to date water quality information,

publication of the Littlehampton Dredge Protocol and Water Framework Directive Dredge Baseline Document be approved.

61. PUBLIC QUESTIONS

There were five members of the public present. 61.1 Noting that the Board had a number of Sub Committees, Mr Boyce stated that as a public body, the agenda’s and minutes of these sub committees should be subject to the same rules regarding publication of information as the main Board. He therefore asked that the Board consider amending its constitution to permit this. 61.2 In response, the Chairman asked Mr Boyce to submit his question in writing to the Board for consideration. 61.3 Mr Chapman accused the Chairman of the Board of defamation of character and sought his resignation. 61.4 The Chairman stated that it was inappropriate for the Board to comment as

the matter about which this accusation was made was subject to legal consideration.

61.5 Observing that the majority of the Board’s infrastructure assets were affixed to land that it did not own, Mr Boyce suggested that it would be a good idea if the Board had wayleave agreements with the respective landowners. 61.6 In response, the Chairman asked Mr Boyce to submit his suggestion in writing to the Board for consideration. 61.7 Mrs Boyce expressed her support for more stringent controls over the use of PWCs within the harbour and stated that Osborne of Arun would be happy to go one step further and add signage to support implementation. 61.8 Regarding the Littlehampton Ferry, Mrs Boyce observed that there was no information about the service on the Harbour Board’s website and asked that this be rectified. 61.9 In response, the Chairman stated that the Board would take this request forward. It was also reported that discussions were taking place with the Town Council regarding mooring provision in the harbour for the Littlehampton Ferry. 61.10 Regarding the Dredge Baseline Document, Mr Boyce asked that

consideration be given to sharing the whole port survey data with stakeholders and visitors. He also asked if the Board had considered adding the information contained in the Bathymetric Survey carried out by Shoreham Port in 2009.

61.11 In response, the Harbour Master stated that the Dredge Baseline Document was intended to outline a baseline for dredge activity rather than a base line for bathymetry itself. The latest whole port survey was conducted in 2016 and would be incorporated into the Admiralty chart in due course. The HM undertook to answer the question more fully if it were put in writing.

61.12 Regarding the use of PWCs in the harbour, Mr Warren asked the Board to consider introducing a byelaw in the harbour requiring that they be fitted with kill cords. 61.13 The Harbour Master stated that whilst in his view, controls included within the General Directions were more effective, he would investigate this as part of the work on drafting the revised controls. 61.14 Speaking from experience, Ms Finnamore stated that older makes of PWCs

were not fitted with kill cords. Observing that insurance did not guarantee reimbursement of losses incurred as a result of the misuse of PWCs, she stated that the Marina did take steps to ensure that users had insurance in place. She also expressed support for any changes that would advance the safer use of PWCs in the harbour.

61.15 Mr Boyce asked that enforcement methods form part of the review into the control of PWCs in the harbour. It was confirmed that this would be investigated as part of the review. 62. CONFIDENTIAL & EXEMPT BUSINESS

disorderly conduct and discussed the conduct of the public question session of Board meetings. The Board therefore RESOLVED that: 1) Comments of the nature levelled against at the Chairman during the

public question were not acceptable in a public meeting. 2) Proposals regarding the future conduct of the Public Question

Session of Board meetings be brought back to a future meeting. 3) The Confidential and Exempt Minutes of the meeting held on 11th July

2016 (previously circulated to Members of the Board only) be confirmed as a true record and signed by the Chair.

LITTLEHAMPTON HARBOUR BOARD Report to: Littlehampton Harbour Board Agenda item 8 Report on: Treasurer’s Report Report by: Treasurer to the Board For the 5th of December Board Meeting Income and Expense to the end of September 2016 Included in this report are the Income and Expenditure Statement and the Income analysis both to the end of September 2016. Summary The Income is currently ahead of budget by £58,000 primarily due to workboat income which is £38,000 ahead of budget at this point, £5,000 of unbudgeted lease rental income with respect to the new tenant on the former UMA Site, £8,000 up on services rendered and £6,600 for moorings. After discounting recoverable expense, operating expense was just £3,000 below budget. The outlook for 2016/17 is forecast at a reduced deficit of £31,000. Operational income- As stated above overall income at £284,517 is ahead of budget by £57,948; commercial shipping is marginally below budget with ship visits down but cargo tonnage up because of a greater mix of larger craft, reference to bad debt problems with the commercial shipping operation is dealt with later in this report. Commercial Rents are now £5,000 ahead due to the new lease on the remainder of the former UMA site, and this also has a knock on effect on our rates bill, (£5,000). Work Boat income is now £37,595 ahead of budget, the primary contributors coming from outside the harbour. With the advent of the new harbour management system, leisure harbour dues are only included when paid so it is good to see that dues are marginally ahead of budget expectations. Likewise Moorings and storage income now moves ahead of budget by £6,458. Fuel sales earlier in the year, (dispensed to the “Wessex Explorer” during its survey work), keeps sales well ahead of budget. Miscellaneous income is boosted by the recovery of the 2016/17 insurance premium on the Old Customs house, (£1,686). Operating expense i.e. before loan repayments and capital amounted to £220,622 and after discounting recoverable expense was marginally below budget by £3,363. Phasing of the budget into monthly slots is to say the least somewhat tricky and the majority of the variances both up and down are to date primarily due to phasing differences. Exceptions to this are: Boats and Vehicles inflated by the purchase of fuel to provide the requirement for the “Wessex Explorer”, Recoverable Costs include costs for carrying out the ADC Met Mast Contract, and Rent and Rates which reflect a rebate brought about by the leased occupation of the remainder of the former UMA site. Capital of £25,000 included in the budget was for the acquisition of the new harbour management system “Harbour Assist” which was in fact purchased towards the end of last financial year at a discounted price of £12,500 and the installation of a new pontoon at the workshop. . Comparison with last year The impact of the WSCC loan balance for “ERICA”, and the net proceeds from the sale of the former Pilot Boat “Jumna” have been removed from this presentation to better reflect true operational performance, income this year is ahead by £30,000. Shortfalls in

Overheads were £17,000 lower this time last year, increased costs relating to the additional workboat contracts, purchase of fuel for resale, the full year cost of the “Harbour Assist” support contract and the material for the ADC Met Mast contract being the main contributors to this year’s increase in spend. Introduction

The outcome for 2016-17 is based on the actual performance to the end of September projected for

the remaining 6 months either on original budget or on best current information available. The 2017-

18 budget is by contrast based where possible on a zero based budgeting approach rather than a

straight uplift on the current year. The harbour continues to lack sufficient income from its dues and

charges to cover costs and the generation of additional income in 2016-17 has come largely from the

successful promotion of the Board’s new multi-purpose vessel “ERICA” which has produced a gross

income to the end of September 2016 of £42,000, way beyond budget expectations. The successful

letting of the remaining vacant land at the former UMA Wharf has also contributed with an increase in

rental income and a reduction in the Board’s rating costs. Commercial shipping performance has

been disappointing so far this year with a failure to achieve the very conservative target of 2 ships a

month. That said the vessels tend to be of the larger variety thus generating more dues per ship visit.

The 2017/18 budget reflects a slight improvement in commercial shipping dues although the budget is

based on 16 ship visits not the historic base of 24. The 2016/17 Budget included £10,000 of capital

spend to install an additional pontoon at the workshop, unfortunately this has not proved to a practical

proposition and the project has been dropped. The net result is a reduction in the budgeted deficit for

2016/17 of £16K and an operational break even for 2017/18. The proposed 2017/18 precept at

£204,413 represents a reduction of 1% over 2016/17.

Key Assumptions for the 2017-18 budget

INCOME

All dues and charges have been uplifted by the annual CPI Inflation rate i.e.1%

Commercial shipping income based on 16 ship visits in the year with a mix of 12 large (78m)

and 4 small vessels (58m) vessels at an average cargo weight of 1382GT and 1175GT

respectively.

All Pilotage will be carried out by the Board’s own Pilots.

Workboat Income from 3rd parties in the budget year is almost impossible to accurately predict

at this stage and so the budget is based on repeat business and current expressions of

interest. However every effort will be made to achieve 2016/17 levels of income.

Due to lack of interest, the selling of advertising in the annual tide tables to offset printing costs

has been abandoned.

Rent reviews for both Railway Wharf and the Workshop are due during the budget year. It is

assumed for budgeting purposes that the present tenants will remain in occupation but at the

same current rent.

Precept at £204,413 reduces over 2016/17 by 1%

EXPENSE

Salaries and allowances have been uplifted by annual CPI inflationary movement of 1%.This

uplift has been included in the budget, there are no incremental increases proposed for the

budget year.

The success of the income generation of “ERICA” in particular has put a strain on staff

resource which in the past would have been covered by casual labour. However such labour is

now becoming more and more difficult to source and so in 2016/17 the Board decided to add

one more marine operative on a fixed term contract. This has of course increased

establishment costs but with some compensating offset in the casual budget. It is assumed

that this individual will remain in place throughout the budget year

With the exception of pension contributions, employment costs remain at the same level as

2016/17 The latest actuarial pension review has set the employers contribution % rate for the

next 3 years at the 2016/17 rate of 19.3%. However with the advent of Auto Enrolment it is

assumed that all staff will participate in the scheme raising the cost to the Board by £5,300.

Employment “on costs” now represent an average of 28% per employee.

Harbour Infrastructure spend during the year, both maintenance and planned works, is based

on the adopted engineering plan but with the addition of a £10,000 provision charged to

expense as a contribution towards the £50,000 repair fund estimated to be required by

2020/21

Forecast Outcome for the current financial year to 31 March 2017

Operational Income is projected at £400K, £55K above budget. A £32K gain from 3rd party work

boat contracts and the impact of securing a tenant to occupy the remainder of the former UMA Wharf,

(£12K for the balance of this year ) were the main contributors.

Operational expense at £441K is in excess of budget by £45K, £20K of which relates to employment

costs, (increases come from an additional marine operative on a fixed term contract, allowances,

pension and NI and other full year effects of recruitment), £12K relates to maintenance and repair

costs and £7K to materials purchased for the ADC Met Mast contract.

Capital spend falls by £5K. The orginal budget had £10K for a new pontoon at the workshop and

£15K to purchase new harbour management software. In the event the software was purchased last

year at a discounted price of £12,500 and the new pontoon proposal is not being pursued. The capital

sum now forecast for the the second half of the this year is for improvement to the visitor’s facilties

and the establishment of scrubbing piles.

2017/18 Budget

Operational Income at £367K is below the current year forecast by £33K principally driven by a

reduction in currently identified work boat income (£21K), moorings £5K and fuel dispensing £4K.

With regard to the apparent drop in work boat income year on year, the budgeted income is based on

current realistic expectations of new work and repeat contracts as it was last year. Thus there has

been reluctance on behalf of the operational management team to commit to numbers which at this

stage may turn out to be hopelessly optimistic. The importance of generating income from 3rd party

sources cannot be underestimated.

Operational expense at £405K is £35K below the forecast for this current year. Legal and

Professional costs reduce by £15K and maintenance and repairs by £17K. Allowance has been made

in this year’s budget to cover opportunities for board member training/ networking.

Loans and interest payments reduce by £11K reflecting the clearance of some loans in 2016/17.

Capital- no capital spend in 2017/18

The result is a break even budget.

Charges for 2017/18

As outlined in the budget commentary it is proposed that charges should increase in 2017 in line with

inflation, (CPI 1%).

RECOMMENDED

(a) That the Board note the forecast revisions to the 2016/17 Budget and authorise the

Treasurer to vire income and expense among the relevant budget categories

(b) The board approve the 2017/18 Budget and consequent precept of £204,413 to be

shared equally between West Sussex County Council and Arun District Council

(c) The Board approve the 2017/18 schedule of charges as presented.

- Payment terms, as stated on all account invoices are 30 days from the date of

issue. Payment of the charges may be required in advance of the service being taken up. Credit and debit cards facilities and online facilities are available either online, at the harbour office or over the phone.

- All annual payments connected with these conditions are made for the year

commencing as listed above.

- No refund is made for a part of a year whether the facility or service ceases to be used or enjoyed during the relevant year.

- The appropriate rate shown on the Littlehampton Harbour Board’s (LHB) schedule of charges will be applicable to all services rendered, whether or not made known specifically to the customer prior to rendering the service.

- Penalty for evading payment of charges – Section 43 (Harbour, Docks and Pier Clauses Act 1847), if the master of any vessel or the owner of any goods evades payment of the rates payable to the undertakers in respect of such vessel or goods, or any part thereof, he shall pay them three times the amount of rates of which he so have evaded the payment, and the same shall be recovered from such master or owner respectively in the same manner as penalties imposed by this Act are directed to be recovered, or by action in any court of competent jurisdiction.

- Failure to notify the harbour office of arrival or departing the harbour without paying harbour charges will be construed as an attempt to evade the payment of harbour charges.

- All lengths are referred to a length overall (LOA). This includes bowsprit, pushpit, stern davit and / or bumpkin etc as determined by the Harbour Master or authorised officers.

- Application for and acceptance of a mooring, berth, compound space or other facility, is at the discretion of the Harbour Master and implies the acceptance of the rate of charge currently in force and of the conditions of issues including that the Board and its staff indemnified against any claims arising from or in connection with such berth or facility, save only as the authority may be liable under the Unfair Contracts Terms Act 1977.

- The lawful orders or Directions of the Harbour Master and any other authorised officers of the Littlehampton Harbour Board must always be obeyed promptly.

- No facility granted may be shared, assigned or sub-let without the prior consent of the Harbour Master in writing and further charges may apply.

- The LHB has the right to exercise a general lien upon any vessel, and/or her gear and equipment, whilst in or upon the harbour premises, or afloat, until such time as the monies due to the Board from the applicant in respect of such vessel whether on account of storage or mooring charges or otherwise, shall be paid.

- No person shall use a mooring to place a vessel of a different size than that applied for without the applicant obtaining the approval of the Harbour Master in writing.

- In the event of the applicant selling or otherwise disposing of the vessel authorised to use the mooring, the Harbour Master must be notified in writing.

- The Harbour Master may vary these charges and / or levy additional charges in respect of anything done or provided by, or on behalf of, the harbour authority in accordance with the Harbour Act 1964 and all powers delegated to the Harbour Master by the Littlehampton Harbour Board.

Part 2: Definitions

- Limits of the Harbour. The area of jurisdiction for the Littlehampton Harbour Board as the statutory harbour authority extends from the old road bridge in Arundel to approximately one hundred feet due south of the western pier at the harbour entrance and extending five hundred yards east and west of the breakwaters, as defined in the Littlehampton Harbour Revision Order of 2015.

- Pilotage. Pilotage is compulsory within the area of jurisdiction defined in the

Littlehampton (Pilotage) Harbour Revision Order 1988 for vessels 60 gross tonnes and over, vessels of 20 metres or more in overall length carrying more than 12 passengers, any vessel engaged in towing or pushing where the combined tonnage exceeds 60GT and any vessel greater or equal than 20m suffering from a defect or deficiency that effects it’s ability to navigate or comply with the requirements of the COLREGGS or STCW requirements.

- Pilotage exemption certificates (PEC). Under section 8 of the Pilotage Act 1987 the Harbour Master has delegated powers to issue pilotage exemption certificates.

- Work within the Harbour. The loading, discharging, transport, carriage, storing

or accommodation of goods, cargo, dry, liquid or gaseous commodities, livestock or passengers. The carrying out of any project for any purpose including but not limited to photographic, film or other artistic work on or by any vessel. Dredging, bed levelling, diving, pile driving or removal, laying or recovering an underwater cable or pipeline. Laying, maintenance, survey or

recovery of mooring anchors, ground tackle, risers or buoys. Surveying, scientific research, water sampling or core sampling and drilling in to the river bed for any purpose. Any other project resulting in the construction or removal of any structure or the alteration of the harbour bed or infrastructure. Operations carried out by HM Customs, Immigration, UKBA, Police and fisheries patrols but excluding fire fighting and search and rescue operations.

- Passenger. Any person carried that is not essential to the running of the

vessel or any person who has paid to be transported, accommodated or trained on the vessel on which he/she is embarked.

- Commercial vessels. Recreational vessels of 50m LOA and over. Vessels used for the carriage of cargo and all other vessels, including Navy vessels, dredgers, workboats, tugboats, barges, and pilot boats used for any purpose other than recreation except motor fishing vessels as defined below.

- Recreational vessels. Any vessel <50m LOA used solely for the purpose of recreation and leisure use.

- Motor fishing vessels. A registered motor fishing vessel licensed by the Government department responsible for fisheries and displaying a bona fide fishing number, the owner/master/operator of which is engaged in commercial fishing for his sole or main income.

- Boats in club compounds. Vessels associated with a recognised club, association or other organisation in the Littlehampton Harbour limits which are permanently stored in compound storage ashore at the premises of that club and do not have a permanent mooring in the harbour.

Part 3: Harbour Dues

- Harbour Dues are payable on all vessels entering, within or leaving the

Harbour including pontoons used to provide berths. Harbour Dues relate to a

particular vessel and are not transferable. It is not Board policy to give refunds

or partial refunds for Harbour Dues. An adhesive valid plaque and/or receipt

is supplied as evidence that Harbour Dues have been paid. This valid plaque

must be prominently displayed on the vessel for which it is issued (except

pontoons). Vessels not displaying an appropriate plaque will be deemed not

to have paid Harbour Dues.

- Harbour Due plaques that are lost, mislaid or stolen must be reported to the

Harbour Office as soon as practical. Replacement plaques will be charged at

the full rate applicable to vessels up to 5m.

- Bona-fide tenders up to 3m in length are covered by the payment of Harbour Dues on the parent vessel. Such tenders must be clearly and uniquely identifiable. Only one tender per vessel is covered in this way. Tenders may only be used for transport to and from the parent vessel and/or mooring. Craft of 3.0m and under which are not bona fide tenders will attract Harbour Dues

at the rate appropriate to their length, as specified in the Board’s scale of charges.

- Small vessels of 5m LOA or under for which the only means of propulsion is

either oars or paddles and which are not normally berthed within the limits of the Harbour are exempt from the payment of Harbour Dues.

- Safety and or rescue vessels may be exempted from Harbour Dues by agreement with the Harbour Master. Except that all RNLI vessels will be exempt from the payment of Harbour Dues and mooring fees. HM Ships, Customs, UKBF and Excise vessels and craft in the service of Trinity House may be exempt from the payment of harbour charges.

- At the discretion of the Harbour Master, harbour charges may be offered at concessionary rates for the vessels taking part in organized events within the harbour limits if permission is sought and granted in advance of the event and the names and lengths of the vessels involved are made available to the Harbour Master.

- All rates of Harbour Dues are made payable in advance, no refunds will be

given. To qualify for daily rates, payment must be made at the time of launch. Failure to pay daily or monthly Dues in advance will automatically result in owners being charged at the annual rate.

- All harbour plaques assigned to a vessel are non transferable are to be affixed to the port side aft of the vessel.

- Time spent chasing harbour dues costs the Harbour Board time, effort and money. The Littlehampton harbour board reserves the right to make a charge for debt recovery administration.

Part 4: Non commercial vessels

- Charges are levied according to length per annum thereof expiring 31st March the following. Prices are inclusive of VAT unless otherwise stated.

- Payment of Annual Harbour Dues must be signified by the display of the

Harbour Board ‘Plaque’ for the appropriate term which will be issued when

payment is made. Failure to display a valid plaque or displaying a plaque

issued in respect of another vessel will be taken as an attempt to evade the

payment of Harbour Dues.

- Boats in club compounds will be liable for the full annual rate if moored in the

Harbour without the prior consent of the Harbour Master.

- Boats moored north of the Old Town Bridge in Arundel are not liable for

Part 6: Personal water craft (PWC) and flyboards

- All PWC must be registered with the Littlehampton Harbour Board

- PWC are only permitted to use the harbour with the consent of the Harbour Master or authorised officers of the board.

- The Board’s PWC policy states each craft must have valid annual Harbour

Dues, provide evidence of insurance, the owner / user must show evidence of

a RYA training course or equivalent, have a valid data tag registration number

and attend a safety briefing from the Harbour Master of authorised officer

regarding Harbour Byelaws, Directions and the International Regulations for

Preventing Collisions at Sea.

- Flyboards are permitted in the harbour and on application to the Harbour Master.

- The allocation of moorings and facilities is entirely at the discretion of the Harbour Master.

- Permanent moorings and berthing facilities are allocated on an annual basis, 1st April to 31st March the following.

- No refund of mooring fees will be given.

- The hirer must obtain insurance against third party claims for at least the minimum sum recommended by leading marine insurers.

- Owners must ensure that the vessel is provided with a sufficient number of fenders and warps adequate for the size of vessel, so as to prevent damage to other vessels, quays or other property.

Part 8: Services and miscellaneous charges

- There is no charge for water taken by small vessels.

- There are vessel length, breadth and weight restrictions for services carried

out by the Littlehampton Harbour Board. Customers must ensure their vessel

is fit for the work to be carried out. Works are carried out at the discretion of

the Harbour Master.

- Use of a mobile crane / commercial crane on harbour property / estate is at

the discretion of the Harbour Master. A charge may be made for permitting

this equipment to be used on the premises.

- Enhanced rates will be charged, out of ordinary working hours, where

overtime is required to be worked. If staff called out, a minimum of 2 hours

overtime will be charged per person.

- Littlehampton Harbour Board personnel and equipment (subject to availability) are charged out at the following rates, all including VAT. Use of these facilities is at the Harbour Master’s discretion.

- Towing services are provided at the discretion of the Harbour Master

During the periodic annual review process it has been highlighted that the charges for houseboats and for non LI-registered fishing vessels have not been levied despite their inclusion in this and al previous schedules. It is the Board’s intention to review and enforce a revised set of charges from April 2017 onwards.

Part 9: Commercial Vessels

- This section applies only to commercial vessels; prices are exclusive of the current VAT rate.

- Commercial vessels remaining in the Harbour for longer than seven days on

any one visit will be charged at the ‘per visit rate’ for every week or part

thereof exceeding the first seven days in the Harbour.

- Commercial vessels laid up and not working within the Harbour will be

charged the per visit GRT rate and a compulsory pilotage fee. Arrangements

to lay up in Littlehampton Harbour must be agreed by the Harbour Master in

Part 10: Pilotage

- Services of a Pilot and/or Pilot Boat are exempt from vat.

- The Littlehampton Harbour Board is the Competent Harbour Authority for

Littlehampton Harbour and under the Pilotage Act 1987 undertakes all

functions relating to Piloting within the Harbour. Pilot Boarding place 50°

46.60’ N, 000° 32.60’ W.

- Pilotage is compulsory within Littlehampton Harbour area of jurisdiction for

vessels over 60 gross tones and over and vessels of 20 metres or more in

overall length carrying more than 12 passengers.

1.1 A meeting of the Littlehampton Harbour Stakeholder Group was held at the Look and Sea Centre

on 4th October 2016 and was chaired by the Recreational Users Rep Mr P Bush. Minutes can be found at the Annex.

1.2 Minutes have been forwarded to the Group by email.

2. Key Points a. Discussions took place on the better management of PWCs within the river in response to two

potentially serious incidents that were recorded over the summer season. The HM undertook to bear these discussions in mind when introducing improved controls on the use of PWCs in the harbour over the off season.

b. Members of the group requested that the Chairman consider moving public questions at Board meetings to the start of the meeting rather than the end as was current practice.

The Minutes of the previous meeting held on 12 Jul 16 were agreed. The Chairman

asked those present that if they have any comments or observations about the

content of the Minutes could they notify the Harbour Master as soon as possible.

ITEM 3 – UDATE FROM OUTSIDE ORGANISATIONS

RNLI Lifeboat Station. Ivan Warren summarised the incidents where Lifeboats had

been involved in the last period as follows:

Police - Special Branch Ports Unit. Sgt John Begley gave an overview of activity

within the county and requested that any unusual activity be reported. The HM

undertook to act as a local point of contact if needed.

No further updates were received.

In the discussion, Gerry McGeehan asked if harbour users could be provided with a

list of crimes that have occurred in and around the river – a question he had posed at

a previous meeting. Cllr Ian Buckland advised that he had contacted the police and

due to a reduction in police manning it would be difficult for them to send a

representative. Cllr Ian Buckland further stated that following his discussions with

the police it was not possible for them to provide a list of crimes. It was noted that

some thefts of fuel tanks from the Arun YC had been reported recently.

Gerry McGeehan noted that during the preceding weeks a number of boats had

been interfered with on two separate occasions along the pontoon frontage at

Mariners Quay. Further to this he reported that at least one boat had been removed

from the harbour as a direct result of the "crime issues" and pointed to the possibility

that others could follow and the subsequent impact the removal of boats might have

on the harbour.

Cllr Buckland advised that if members of the public wished to engage with the local

policing team regarding specific issues the JEAC meeting to be held at the

Woodlands Centre in Nov 16 would be the best forum to do so.

ITEM 4 –ACCIDENT AND INCIDENT REPORTS REVIEW

The HM summarised the following accidents or incidents since the last meeting from

09 of 2016 to 014 of 2016, and gave wider consideration to the 12 ‘2016 summer

season’ incidents recorded. (Under the Group ToRs the October meeting should

include a general safety evaluation.)

The HM further categorised the 12 ‘summer season’ incidents:

1 x Capsize;

2 x PWC incidents;

2 x Diving;

1 x CQS;

1 x speeding;

4 x Berthing (small craft);

1 x Slipway incident.

The most serious incidents identified were the death of a diver, motorboat capsize

(resulting in a number of people in the water by the entrance to the harbour) and the

PWC incidents. The HM noted that there was little that could be done to further

control diving or leisure boat activity within the harbour but that regulation of PWCs

would be covered at a separate agenda item.

In the discussion, Nigel Draffan asked if there were any common denominators in

the accidents. The Harbour Master advised that there were no common threads.

ITEM 5 – CONSERVANCY ACTIVITY

The HM provided an update on conservancy activity issues.

Dredging

Dredge Baseline Document now approved by the Board. (Separate agenda item)

Aids to Navigation/Charting

Trinity House inspection took place 3 Aug 16. No LHB pick-ups to report. Southern

water buoy remains unlit, but Southern water contractor notified. Cllr Ian Buckland

asked if the LHB could assist with the reinstatement of the unlit buoy. He was

informed that assistance had been offered but not taken up. He was further

informed that the buoy was located outside of the LHB area of responsibility.

Environmental Protection.

Oil spill equipment and staff deployed at incident 09/16 at the Marina and POLREP

submitted to HMCG. The HM also advised that OSRL were interested in exercising

river booms in the Wick Quay reach and undertook to pass on details now that Mr

Boyce had taken on the freehold for the area.

Maintenance Activity.

The HM outlined the various maintenance activity that had taken place during the

period, including: unscheduled crane lift arranged for Marina, tide gauge replaced at

entrance (East Bcn), repairs to east Pier were ongoing, removal of walkway railing

panel for EA access to Harbour Office tide gauge. HM also reported that Mackley

Construction Ltd were due to mobilise at the West Works to conduct repairs to

horizontal waling timbers later in mid Nov 16.

ITEM 6 – PLANT AND EQUIPMENT EXPECTED.

The HM advised that the only LHB plans to mobilise plant and equipment in the

period Oct 16 - Jan 17 would be the Mackley repairs to the West Works. Two mini-

cranes were likely to be used and stakeholders were advised to contact Mackley

direct if they wished to discuss projects that might utilise these. No other

organisations were planning to mobilise equipment but the HM advised that the EA

would be conducting shingle recycling on the West Beach during October.

The HM further advised that the shingle bank had not grown sufficiently to engage

EA to clear but would monitor the situation over the winter. Nigel Draffan asked if

APE could be kept informed as and when this might occur.

With regard to LNtM 6 of 16, the HM asked when the AYC would recover the race

marks. Brian Flook agreed to investigate and advise the HM.

ITEM 8 – LITTLEHAMPTON USERS GROUP

Following an item raised at the last meeting, the Chairman asked the group if further

consideration had been given to the formation of a Harbour Users Group. A wide

ranging discussion ensued taking in the pros and cons of a forming User Group with

a wider attendance (and perhaps frequency), not chaired by the LHB and using this

group to feed into a smaller Stakeholder Group chaired by the LHB and attended by

outside organisations with representation from the User Group.

The general consensus was that while the existing Stakeholder Group (which took in

both stakeholders and wider users) functioned well (and was not overwhelmed by

attendees) there would be little need for a further layer of bureaucracy. It was noted

by the HM though that already the Stakeholder Group accepted a wider attendance

than its ToRs (through a policy of accepting any attendee interested), and that both

the current system and a revised system had merits.

During the discussion the topic of Public Questions at Board Meetings was raised

with a clear indication from the Stakeholders that the agenda item should be moved

to the start of the meeting. The Chairman advised that this would be consistent with

the wording contained in the LHB Constitution and would give the proposal some

consideration.

ITEM 9 – MANAGEMENT OF JETSKIS

The HM discussed an appropriate response to incidents over the summer involving

PWCs with jammed throttles that could well have resulted in much more serious

pollution, injury and even fatalities.

He proposed to return to a system where PWCs using the harbour would be required

to obtain annual HDs, provide details of insurance and training as well as receive a

safety brief prior to going afloat. He also gave consideration to preventing PWCs

transiting up river (beyond the A259) without prior permission from the HM.

Brian Flook highlighted that the incidents involving jammed throttles were both

involving a particular older model of craft. He did not wish to see all PWCs

characterised as dangerous or reckless due to a very small minority and the HM

agreed with this.

He also highlighted that new craft are fitted with a ‘No wake’ mode, and that while

craft were obviously designed for high speeds in open water, that this mode could

easily be used for transiting in the confines of the river.

Re training he advised the group that most new PWCs were sold as a package that

included training. The HM encouraged any harbour user to seek appropriate

training.

The discussion also raised the matter of launching PWCs from the public slipway

and whether or not someone should be employed to monitor the launching and

recovery of these vessels. Those present were advised that this had been tried

previously but was not cost-effective.

Robert Boyce highlighted that the Yacht Clubs and Marina in the harbour all took

details of insurance prior to entering into mooring agreements and that this

documentation could potentially be shared.

In connection with the Powers of General Direction, Robert Boyce asked if there was

an associated enforcement policy so that offenders could be prosecuted.

Mr Chapman wished to see a total ban for PWCs in the river.

A consensus that a revised policy requiring annual HDs, proof of insurance ad

training and a ‘with permission only’ policy for transiting up river would be a

reasonable measure to control a minority of users who had the potential to put others

at risk.

Brian Flook noted that it was not just a small minority of PWCs that were involved in

reckless behaviour, but that an equivalent number of small speedboats could be

witnessed behaving in a similar way. The HM agreed but noted the practical aspect

of making General Directions to cover this sort of behaviour would be likely to entail

a specific ruling for PWCs while relying on general speeding or seamanship

regulations for other small craft.

ITEM 10 – PUBLICATION OF DREDGE BASELINE DOCUMENT

The HM distributed copies of the Dredge Baseline Document now approved by the

Board and advised of its availability on the LHB website.

Nigel Draffan (APE) asked for clarification on the definitions of capital and

maintenance dredging. The HM advised that further detail was contained within the

document, but broadly navigational dredging could not return an area to a depth

lower than it had been in the last 10 years.

ITEM 10a – AOB

(Additional agenda item inserted by the Chairman)

Cllr Cates asked why in his opinion little had been done about the situation involving

a commercial fisherman parking on pavement in Pier Road. He was advised by the

HM, Chair and Cllr Buckland that considerable time had been spent, by the HM and

Cllr Buckland variously, with ADC (as a parking matter rather than one for

consideration by the LHB). Cllr Buckland outlined that while he did not condone

blocking the pavement by the pedestrian walkway, the fisherman was not in fact

breaking any laws and as such all steps that could be taken to resolve the matter

had been taken by the LHB and ADC respectively. Cllr Cates added that a complaint

he had submitted to the Harbour Board but this had not been responded to. He was

advised to forward a copy to the Chairman or Cllr Buckland for consideration.

Helen Bryett (Ford Marina) reiterated the regularity of speeding incidents involving

PWCs experienced up river.

ITEM 11 – ARRANGEMENTS FOR NEXT MEETING

Provisional date for the next meeting was set as Tuesday 10 Jan 17 and would take

place at the normal venue of the AYC.

LITTLEHAMPTON HARBOUR BOARD Report to: Littlehampton Harbour Board Agenda item 12 Report on: Corporate Complaints Policy Report by: Clerk to the Board For the 5th of December Board Meeting Currently, the LHB does not have an adopted procedure for dealing with complaints from members of the public. In order that we may provide a good standard of service and deal with any complaints in a fair and consistent way it is proposed to compile and introduce a Corporate Complaints Policy (CCP). Members are requested to delegate the formation of the policy to officers, in consultation with the Deputy Chairman, with a view that those relating to complaints against members of staff should become operative immediately and these together with the procedure for dealing with complaints against members of the Board are subject to formal adoption at the next LHB meeting. RECOMMENDATION: That the Board delegate authority to its Officers, in consultation with the Deputy Chairman, to compile a CCP and that the CCP relating to complaints against staff becomes immediately operative but, that these and the procedure for dealing with complaints against members, is thereafter, submitted to the next meeting of the LHB for formal adoption.
