Sub: Seeking humble intervention against the apathetic
attitude of the department in the matter framing of
Recruitment Rules and cadre review consequent
upon recommendations of the 6

CPCand
DOP TGuidelines
Sir,
This is to invite your kind and humble attention
again towards the DoP T's, New Delhi O.M.
No.AB.14017/61/2008-Estt.(RR) dated 17/03/2016 wherein it
is been categorically laid down that DoP T guidelines on
framing/amendment/relaxation of Recruitment Rules vide para
3.1.5 dated 31th December,2010 provide that the
Recruitment
Rules should be reviewed once in 5 years with a view to
effecting such change as are necessary
to
bring them in
conformity with the changed position, incZuding additions
to
or reductions in the strength of the lower and higher
leve l posts.
Furthermore, the DOP T, New Delhi vide OM dated 24.03.2009
had issued instructions to all the Ministries/Departments to
initiate action to amend the existing Service Rules/Recruitment
Rules in view of the revised pay structure/merger of pre-revised
pay scales/up-gradation etc. These instructions were
subsequently reiterated vide this Department's OM
No.AB.14017 /61/2008-Estt (RR) dated 25th March, 2014 .
Notwithstanding the aforesaid categorical
guidelines, the condition of the Administrative Staff working in
All India Radio Doordarshan are so horrible that the
Financial Promotional status of LDC, UDC and Assistants are
lower than the Motor Driver/Helper/Carpenter / Painter /
Tailor due to non-implementation of the cadre restructuring of
Administrative Staffs /RRs and inapt action for decades by the
Ministry of Information Broadcasting. Resultantly,

the stagnation of the above categories of the administrative staff
is perpetuating since long and they are forced to suffer
humiliation vis-a-vis the officials of other streams in the same
organization. What is most pertinent to bring to your humble
notice is that on account of the non-implementation of the
instructions of the DOP T, the deputationists of other
department are growing fat by frustrating and grabbing the
fundamental, genuine, justifiable and lawful rights of the
departmental administrative staff.
This is also to draw you humble attention towards the
under mentioned guidelines in connection with the deemed
deputation :-

The Commission had received many demands from
Central Government employees on deemed deputation
to
Prasar
Bharati for restricting of posts/cadres in Prasar Bharati The
Commission has not made any recommendation on the posts in
Prasar Bharati since it is an autonomous body and therefore
outside the Terms of Reference of the Commission In any case
Central Government employees on deemed deputation
to
Prasar
Bharati will be governed by the extant rules in this regard
(b) GOI, Ministry of Law Justice Amendment In Prasar
Bharati Act 1990 dated 08.01.2012 GOI, Ministry of Law
Justice
Section 11 3 -The officers and employees referred
to
in sub-section 1 and sub-section 2 shall be entitled
t

pay and all other benefits as admissible

(c) AB.14017/37/2009-Estt. (RR) dated 08.10.2010 issued
by DOP T, New Delhi regarding time-limit for framing of Rules
and Regulations on conversion of Govt. Department into
PSU / Statutory body.
It has been decided that in such cases where there is a
conversion of a Government Department into PSUs/
autonomous/ statutory body there must be a time frame within
which a new body shall frame its rules and regulations t the
end of this period all employees on deemed deputation should
have opted either
to
get permanently absorbed in the new
organization or revert
to
the Government A Maximum period of
5 years for framing of rules and another 2 years for phasing out
repatriation
to
those opting
to
come back
to
Government has
been prescribed

Notwithstanding the aforesaid express
guidelines/provision, the status of Prasar Bharti employees has
not yet been conclusively decided leading to the perpetuation of
the suffering of the employees.
Under the aforesaid factual matrix, I am reasonably
compelled to seek your humble intervention by approaching you
for issuing suitable direction for the efficacious/immediate
framing of Recruitment Rules and finalization of Cadre Review
of the administrative staff of All India Radio and Doordarshan in
the light of the existential instructions/guidelines already
issued by the DOP T, Ministry of Finance, Department of
Expenditure DoP T together with the directions of the Hon'ble
Tribunals.
Your humble intervention would go a long way in
boosting the morale of the administrative staff since the
promotional avenues pave the way of building and
strengthening work efficiency in its true perspective which has
been the true objective behind recommendation of the same by
the 6
th
CPC.
