WATER OBSTRUCTION AND ENCROACHMENT PERMIT

The Department of Environmental Protection "Department", established by the Act ofDecember 3, 1970, P.L. 834 (71 P.S. §§510.1 et seq.) and empowered to exercise certain powers andperform certain duties under and by virtue of the Act of November 26, 1978, P.L. 1375, as amended bythe Act of October 23, 1979, P.L. 204 (32 P.S. §§693.1 et seq.) known as the "Dam Safety andEncroachments Act"; Act of October 4, 1978, P.L. 851, (32 P.S. §§679.101 et seq.) known as the"Flood Plain Management Act"; Act of June 22, 1937, P.L. 1987, (35 P.S. §§691.1 et seq.), known as"The Clean Streams Law"; and the Administrative Code, Act of April 9, 1929, P.L. 177, as amended,which empowers the Department to exercise certain powers and perform certain duties by law vestedin and imposed upon the Water Supply Commission of Pennsylvania and the Water and PowerResources Board, hereby issues this permit to:

authorize the following water obstructions and encroachments associated with the Bell BendNuclear Power Plant Project:

1. (Impact A) To remove the existing bridge and to construct and maintain a 60-foot wide, 5-span concrete vehicular bridge across the relocated Walker Run (CWF) and createdriparian wetlands. The bridge has a 400-foot span and an approximate 11-footunderclearance. (Latitude: 41105110"; Longitude: -76010'03")

2. (Impact B) To remove the existing vehicular bridge and to construct and maintain a 60-foot wide, 3-span concrete bridge across an UNT to Walker Run (CWF) and adjacentwetlands (EV). The bridge has a 408-foot span and an approximate 45-footunderclearance. (Latitude: 41o05'08"; Longitude: -76009'46")

3. (Impact C) To construct and maintain a 10-foot wide, 4-span pre-fabricated metal trussutility bridge across an UNT to Walker Run (CWF) and adjacent wetlands (EV). Thebridge has a 340-foot span and an approximate 20-foot underclearance and carries an 8-inch diameter DIP water line, a 10-inch diameter DIP sewer line, a 12-inch diametercement lined DIP water line (fire) and four 6-inch diameter steel electrical conduits.(Latitude: 41105'11"; Longitude: -7609'40',)

4. (Impact D) To construct and maintain a combined 87-foot wide, 4-span concretevehicular bridge and adjacent utility bridge across an UNT to Walker Run (CWF) andadjacent wetlands (EV). The bridges have a 410-foot span and an underclearance of 23feet and 15 feet, respectively. (Latitude: 41*05'09"; Longitude: -76°09'27"')

5. (Impact E) To construct and maintain a 28-foot wide, 6-span concrete railroad bridgeacross an UNT to Walker Run (CWF) and adjacent wetlands (EV). The bridge has a 535-foot span and an approximate 11-foot underclearance. (Latitude: 41°05'09"; Longitude: -76o09'25'')

6. (Impact F) To construct and maintain a 60-foot wide, 5-span concrete bridge acrossapproximately 390 feet of wetlands. The bridge has a 508-foot span and an approximate10-foot underclearance. (Latitude: 41004'55"; Longitude: -76009'21'')

7. (Impact G) To construct and maintain a stream enclosure of an UNT to Lake Took-a-While (CWF) consisting of a 125-foot long, 48-inch diameter reinforced concrete pipewith concrete endwalls for the purpose of constructing a railroad crossing. The invert willbe depressed 6-inches below streambed elevation. (Latitude: 41005'15"; Longitude: -76008'37")

8. (Impact H) To remove the existing stream enclosure and to construct and maintain astream enclosure of an UNT to Walker Run (CWF) consisting of a 428-foot long, 36-inchdiameter reinforced concrete pipe with the invert depressed 12-inches below streambedelevation. (Latitude: 41005'15"; Longitude: -76009'41")

9. (Impact I) To fill 0.12 acre of wetlands for the purpose of constructing the proposedpower block. (Latitude: 41*05'23"; Longitude: -76*10'05'')

10. (Impact J) To fill 0.06 acre of wetlands for the purpose of constructing the switchyardexpansion. (Latitude: 41005'18"; Longitude: -76008'55")

11. (Impact K) To fill 0.98 acre of wetlands and 617 feet of a tributary to the SusquehannaRiver known as the North Branch Canal Outfall Channel for the purpose of constructingthe intake structure and associated parking and access road. (Latitude: 41005'13";Longitude: -76*07'58")

12. (Impact M) To construct and maintain a water intake and blowdown pipeline crossing ofa tributary to the Susquehanna River known as the North Branch Canal Outfall Channeland approximately 950 feet of wetlands. (Latitude: 4105'18"; Longitude: -76°08'00'')

13. (Impact N) To construct and maintain an intake structure in and adjacent to the westbank of the Susquehanna River (WWF, MF). To excavate and maintain a 120-foot by220-foot area along the west bank of the Susquehanna River to an approximate depth of1-foot below the riverbed for the purpose of constructing the intake structure. (Latitude:41005'14"; Longitude: -76007'52")

14. (Impact 0) To construct and maintain a 24-inch diameter blowdown diffuser pipeanchored to a 116.5-foot long by 7-foot wide concrete pad set on the river bed coveredwith riprap. The pipe extends approximately 325 feet into the Susquehanna River (WWF,MF) from the shoreline. (Latitude: 41005'06"; Longitude: -76007'51")

15. (Impact P, Q & R) To construct and maintain various aerial transmission line crossings ofwetlands throughout the project area. (Impact P - Latitude: 41*05'21"; Longitude: -76009'42"; Impact Q - Latitude: 41O05'21"; Longitude: -76°09'21"; Impact R - Latitude:41005'03"; Longitude: -76o08'59")

16. (Impact U) To construct and maintain various stormwater outfalls to the Walker Run,Susquehanna River and tributaries thereto.

17. (Impact V) To relocate approximately 2,799 feet of Walker Run with the construction andmaintenance of approximately 4,159 feet of new stream channel using natural streamdesign techniques.

The project includes 2.90 acres of permanent wetland impacts and 997 feet (0.21 acre) ofpermanent stream impacts. The project also includes 1.77 acres of temporary wetlandimpacts and 5,079 feet of temporary stream impacts. The permittee is required to provide1.72 acres of replacement wetlands.

The project is located approximately 4.5 miles northeast of the intersection of U.S. Route 11and U.S. Route 93, directly south of Beach Grove Road and to the west and to the south of theexisting PPL Nuclear Power Plant Facility. The project is bisected by Confers Lane(Berwick, PA Quadrangle Latitude: 410 5' 17.57"; Longitude: -760 9' 42.08") in SalemTownship, Luzerne County.

The issuance of this permit also constitutes approval of a Water Quality Certificationunder Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341 (a)].

If this work authorized by this permit is not completed on or before the 31st day ofDecember A.D. 2016, this permit, if not previously revoked or specifically extended by theDepartment in writing, shall become void without further notification.

This permit is issued in response to an application filed with the Department ofEnvironmental Protection on the 1st day of July A.D. 2011, and with the understanding that the workshall be performed in accordance with the maps, plans, profiles and specifications filed with and madea part of the application on November 15, 2011, November 23, 2011 and January 25, 2013, subject,however, to the provisions of the Dam Safety and Encroachments Act, the Flood Plain ManagementAct, the Clean Streams Law, the Administrative Code, the rules and regulations promulgatedthereunder and the following conditions and restrictions:

The permittee shall sign the Acknowledgement of Appraisal of Permit Conditions therebyexpressly certifying the permittee's acceptance of, and agreement to comply with, the termsand conditions of this permit. The permittee shall return a signed copy of theAcknowledgement of Appraisal of Permit Conditions to the Department. Unless theAcknowledgement of Appraisal of Permit Conditions for is completed and filed with theDepartment, this permit is void.

2. The Department, in issuing this permit, has relied on the information and data which thepermittee has provided in connection with his permit application. If, subsequent to theissuance of this permit, such information and data prove to be false, incomplete orinaccurate, this permit may be modified, suspended, or revoked, in whole or in part, and theDepartment may, in addition, institute appropriate legal proceedings.

3. This permit does not give any property rights, either in real estate or material, nor anyexclusive privileges, nor shall it be construed to grant or confer any right, title, easement, orinterest in, to, or over any land belonging to the Commonwealth of Pennsylvania; neitherdoes it authorize any injury to private property or invasion of private rights, nor anyinfringement of Federal, State, or Local laws or regulations; nor does it obviate thenecessity of obtaining Federal assent when necessary.

4. The work shall at all times be subject to supervision and inspection by representatives ofthe Department, and no changes in the maps, plans, profiles, and specifications as approvedshall be made except with the written consent of the Department. The Department,however, reserves the right to require such changes or modifications in the maps, plans,profiles, and specifications as may be considered necessary. The Department furtherreserves the right to suspend or revoke this permit if in its opinion the best interest of theCommonwealth will be subserved thereby.

5. This permit authorizes the construction, operation, maintenance and normal repair of thepermitted structures conducted within the original specifications for the water obstructionor encroachment, and in accordance with the regulations of the Department and terms andconditions of this permit. Any repairs or maintenance involving modifications of the waterobstruction or encroachment from its original specifications, and any repairs orreconstruction involving a substantial portion of the structure as defined by regulations ofthe Department shall require the prior written approval and permit of the Department.

6. All construction debris, excavated material, brush, rocks, and refuse incidental to this workshall be removed entirely from the stream channel and placed either on shore above theinfluence of flood waters, or at such dumping ground as may be approved by theDepartment.

7. There shall be no unreasonable interference with the free discharge of the river or stream ornavigation during construction.

8. If future operations by the Commonwealth of Pennsylvania require modification of thestructure or work, or if, in the opinion of the Department of Environmental Protection, thestructure or work shall cause unreasonable obstruction to the free passage of floodwaters or

navigation, the permittee shall, upon due notice remove or alter the structures, work orobstructions caused thereby, without expense to the Commonwealth of Pennsylvania, so asto increase the flood carrying capacity of the channel or render navigation reasonably free,easy, and unobstructed, in such manner as the Department may require. No claim shall bemade against the Commonwealth of Pennsylvania on account of any such removal oralteration.

9. The permittee shall notify the Department, in writing, of the proposed time forcommencement of work at least 15 days prior to the commencement of construction.

10. If construction work has not been completed within the time specified in this permit and thetime limit specified in this permit has not been extended in writing by the Department or ifthis permit has been revoked for any reason, the permittee shall, at his own expense and in amanner that the Department may prescribe, remove all or any portion of the work as theDepartment requires and restore the watercourse and floodplain to their former condition.

11. The permittee shall fully inform the engineer or contractor, responsible for the supervisionand conduct of the work, of the terms, conditions, restrictions and covenants of this permit.Prior to the commencement of construction, the permittee shall file with the Department inwriting, on a form provided by the Department, a statement signed by the permittee and anindividual responsible for the supervision or conduct of the work acknowledging andaccepting the general and special conditions contained in this permit. Unless theacknowledgment and acceptance have been filed, this permit is void. A copy of this permitand the acknowledgment shall be available at the work site for inspection upon request by anofficer or agent of the Department or another Federal, State, County or Municipal Agency.

12. The permittee shall operate and maintain the structure or work authorized herein in a safecondition in accordance with the permit terms and conditions and the approved maps, plans,profiles and specifications.

13. This permit may not be transferred without prior written approval from the Department, suchapproval being considered upon receipt of the properly executed "Application for Transferof Permit" form.

14. If and when the permittee desires to discontinue use or abandon the activity authorizedherein, he must remove all or part of the structure or work authorized and take other actionsas are necessary to protect safety and the environment in accordance with a permit issued bythe Department.

15. If the use of explosives in any waterways is required, the permittee shall secure the priorwritten permit from the Pennsylvania Fish and Boat Commission, pursuant to thePennsylvania Fish and Boat Code, Act 1980-175 Title 30 Pennsylvania ConsolidatedStatutes, Section 2906. Requests should be directed to the Pennsylvania Fish and BoatCommission, Division of Environmental Services, 450 Robinson Lane, Bellefonte, PA16823-9620, telephone 814-359-5140.

16. Permittee shall implement and monitor an Erosion and Sedimentation Control Plan preparedin accordance with Chapter 102 so as to minimize erosion and prevent excessivesedimentation into the receiving watercourse or body of water.

17. The project site shall at all times be available for inspection by authorized officers andemployees of the Pennsylvania Fish and Boat Commission. Prior to commencement andupon completion of the work authorized by this permit, the permittee shall notify thePennsylvania Fish and Boat Commission's Northeast Regional Office, 5566 Main Road,Sweet Valley, PA 18656, Telephone 570-477-5717.

18. The project site shall at all times be available for inspection by authorized officers andemployees of the County Conservation District. Prior to commencement and uponcompletion of the work authorized by this permit, the permittee shall notify the LuzemeConservation District, 485 Smith Pond Road, Shavertown, PA 18708, Telephone 570-674-7991.

19. Work may not commence until a signed copy of the Acknowledgement of Appraisal ofPermit Conditions is received by the Department. Any work authorized by this permitconducted prior to the Department's receipt of a signed copy of the Acknowledgement ofAppraisal of Permit Conditions is a violation of the Dam Safety and Encroachments Act andthe Clean Streams Law, and you may be subject to fines and penalties pursuant to thoseActs.

20. SPECIAL CONDITIONS:

A. The permittee shall obtain the following approvals and any other necessary permits orauthorizations from the Department prior to commencing this earth disturbance activity inaccordance with Section 102.4(d):

1. If regulated above ground or underground storage tanks are to be installed orremoved, contact the Storage Tank Program in the northeast regional office, at 570-826-2511, to ensure that the requirements of 25 Pa. Code Chapter 245 are met.Most tank installations will not require a permit prior to construction (i.e. the SiteSpecific Installation Permit), but by contacting the northeast regional office thepermittee can make sure that the new tanks are properly installed by certifiedcontractors and registered prior to use.

All new large aboveground storage tanks (AST), defined as tanks over 21,000gallons, and all new large AST facilities with an aggregate capacity over 21,000gallons require a Site-Specific Installation Permit prior to installation. Additionally,any new regulated field-constructed underground storage tank, and any new highlyhazardous storage tank also require a Site-Specific Installation Permit prior toinstallation.

All regulated storage tanks require installation by DEP-certified installers, andregistration with DEP. Regarding requirements for tank registration please contactthe Division of Storage Tanks at 717.772.5599.

2. A National Pollutant Discharge Elimination System (NPDES) Industrial WastewaterPermit from the PADEP authorizing regulated activities associated with the project.The PADEP uses the process described in Title 25 Pa. Code Chapter 92a to issue theNPDES permit to meet the requirements of the federal Clean Water Act (33U.S.C.A. §§ 1251-1387) and Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1 -691.1001).

3. A Water Quality Management Permit for construction and operation of industrialwastewater treatment facilities associated with the project from PADEP inaccordance with the requirements of Section 308 of Pennsylvania's Clean StreamsLaw, 35 P.S. § 691.308.

B. Project construction shall take place when the stream is at low flow.

C. Since Walker Run is a wild trout stream, no work shall be done in the stream channelbetween October 1 and December 31 without the prior written approval of the PennsylvaniaFish and Boat Commission.

D. The permittee shall provide for 1.72 acres of replacement wetlands. The construction ofreplacement wetlands shall be started at the commencement of or prior to initiating theencroachment activity authorized by this permit.

E. Within 30 days of completing construction of the replacement wetlands, the permittee shallsubmit "as-built" plans of the replacement wetlands to the Department.

F. Permittee shall monitor the wetland replacement site for at least five years. Reports shall besubmitted to the Department every six months for the first two years after construction andannually for three years thereafter. The monitoring reports shall contain informationdescribing the success of the site at the time of inspection, an inventory of the survivingplant species and percent areal coverage, photographs of the replacement sites with plansshowing the location and orientation of each of the photographs, and a written plan tocorrect any deficiencies identified during the monitoring phase.

G. If wetlands constructed on the approved sites have not achieved design objectives withinthe monitoring period, remedial work will be required to assure establishment of 1.72 acresof functional wetlands. Replacement wetlands shall be considered successful when theymeet the design objectives as stated in the approved wetland replacement plan.

H. This permit also authorizes the installation of pumps, filter bags, rock filter berms,cofferdams, and flume pipes, which upon completion of the project shall be completelyremoved and the area restored and stabilized.

I. The permittee shall be responsible for any damages resulting from increased backwatercaused by the temporary pumps, filter bags, rock filter berms, cofferdams, and flume pipes.The permittee shall remove these temporary erosion controls in the event of high water toprevent the increased backwater.

which authorizes the permittee to:

authorize the following water obstructions and encroachments associated with the Bell BendNuclear Power Plant Project:

1. (Impact A) To remove the existing bridge and to construct and maintain a 60-foot wide, 5-span concrete vehicular bridge across the relocated Walker Run (CWF) and createdriparian wetlands. The bridge has a 400-foot span and an approximate 11-footunderclearance. (Latitude: 41105'10"; Longitude: -76*10'03")

2. (Impact B) To remove the existing vehicular bridge and to construct and maintain a 60-foot wide, 3-span concrete bridge across an UNT to Walker Run (CWF) and adjacentwetlands (EV). The bridge has a 408-foot span and an approximate 45-footunderclearance. (Latitude: 41*05'08"; Longitude: -76*09'46")

3. (Impact C) To construct and maintain a 10-foot wide, 4-span pre-fabricated metal trussutility bridge across an UNT to Walker Run (CWF) and adjacent wetlands (EV). Thebridge has a 340-foot span and an approximate 20-foot underclearance and carries an 8-inch diameter DIP water line, a 10-inch diameter DIP sewer line, a 12-inch diametercement lined DIP water line (fire) and four 6-inch diameter steel electrical conduits.(Latitude: 41005'11"; Longitude: -76009'40")

4. (Impact D) To construct and maintain a combined 87-foot wide, 4-span concretevehicular bridge and adjacent utility bridge across an UNT to Walker Run (CWF) andadjacent wetlands (EV). The bridges have a 410-foot span and an underclearance of 23feet and 15 feet, respectively. (Latitude: 41005'09"; Longitude: -76009'2711)

5. (Impact E) To construct and maintain a 28-foot wide, 6-span concrete railroad bridgeacross an UNT to Walker Run (CWF) and adjacent wetlands (EV). The bridge has a 535-foot span and an approximate 11-foot underclearance. (Latitude: 41005'09"; Longitude: -76o09'25")

6. (Impact F) To construct and maintain a 60-foot wide, 5-span concrete bridge acrossapproximately 390 feet of wetlands. The bridge has a 508-foot span and an approximate10-foot underclearance. (Latitude: 41*04'55"; Longitude: -76009'21")

7. (Impact G) To construct and maintain a stream enclosure of an UNT to Lake Took-a-While (CWF) consisting of a 125-foot long, 48-inch diameter reinforced concrete pipewith concrete endwalls for the purpose of constructing a railroad crossing. The invert willbe depressed 6-inches below streambed elevation. (Latitude: 41005'15"; Longitude: -76o08'37"')

8. (Impact H) To remove the existing stream enclosure and to construct and maintain astream enclosure of an UNT to Walker Run (CWF) consisting of a 428-foot long, 36-inchdiameter reinforced concrete pipe with the invert depressed 12-inches below streambedelevation. (Latitude: 41°05'15"; Longitude: -76009'41")

9. (Impact I) To fill 0.12 acre of wetlands for the purpose of constructing the proposedpower block. (Latitude: 41°05'23"; Longitude: -761109059')

10. (Impact J) To fill 0.06 acre of wetlands for the purpose of constructing the switchyardexpansion. (Latitude: 41005918"; Longitude: -76o08'55")

11. (Impact K) To fill 0.98 acre of wetlands and 617 feet of a tributary to the SusquehannaRiver known as the North Branch Canal Outfall Channel for the purpose of constructingthe intake structure and associated parking and access road. (Latitude: 41005'13";Longitude: -76°07'58"')

12. (Impact M) To construct and maintain a water intake and blowdown pipeline crossing ofa tributary to the Susquehanna River known as the North Branch Canal Outfall Channeland approximately 950 feet of wetlands. (Latitude: 41005'18"; Longitude: -76008'00'')

13. (Impact N) To construct and maintain an intake structure in and adjacent to the westbank of the Susquehanna River (WWF, MF). To excavate and maintain a 120-foot by220-foot area along the west bank of the Susquehanna River to an approximate depth of1-foot below the riverbed for the purpose of constructing the intake structure. 14. (Impact 0) To construct and maintain a 24-inch diameter blowdown diffuser pipeanchored to a 116.5-foot long by 7-foot wide concrete pad set on the river bed coveredwith riprap. The pipe extends approximately 325 feet into the Susquehanna River (WWF,MF) from the shoreline. (Latitude: 41'05'06"; Longitude: -76107'51"1)

15. (Impact P, Q & R) To construct and maintain various aerial transmission line crossings ofwetlands throughout the project area. (Impact P - Latitude: 41005'21"; Longitude: -76009'42"; Impact Q - Latitude: 41*05'21"; Longitude: -76009'21"; Impact R - Latitude:41005'03"; Longitude: -76008'59'')

16. (Impact U) To construct and maintain various stormwater outfalls to the Walker Run,Susquehanna River and tributaries thereto.

17. (Impact V) To relocate approximately 2,799 feet of Walker Run with the construction andmaintenance of approximately 4,159 feet of new stream channel using natural streamdesign techniques.

The project includes 2.90 acres of permanent wetland impacts and 997 feet (0.21 acre) ofpermanent stream impacts. The project also includes 1.77 acres of temporary wetlandimpacts and 5,079 feet of temporary stream impacts. The permittee is required to provide1.72 acres of replacement wetlands.

The project is located approximately 4.5 miles northeast of the intersection of U.S. Route 11and U.S. Route 93, directly south of Beach Grove Road and to the west and to the south of theexisting PPL Nuclear Power Plant Facility. The project is bisected by Confers Lane(Berwick, PA Quadrangle Latitude: 410 5' 17.57"; Longitude: -76° 9' 42.08") in SalemTownship, Luzerne County.
