One of the first things abuyer will ask an estate agentwhen offered a property is“How long has it been on the

market?”, and with good reason. Buyinga property is a huge transaction and ittakes courage to commit to undertakesuch an apparently huge decision –often with very little support other thanpure instinct.

One of the most persuasive andapparently reliable indications as to thesuitability of a property is to check outwhether other people have expressed an

interest. There is great comfort in knowing that you are not the only one who would liketo buy the property. Once people hear that others have expressed an interest, theneveryone seems to want the property as the power of this “social proof” kicks in. Thiscompetition can often stimulate a quick sale at a high price, and usually occurs when aproperty is attractively priced in relation to other properties available for sale.

Of course the opposite is also true. When the price of a property is overly ambitious,the excitement that should surround a property that is new on the market is reduced,and it can begin to go stale. The Private Rental Sectorcontinues to see strong demandwith a close correlation in mostareas of the country between

the increase in average rents and theincrease in the average incomes ofrenters. It is this relationship betweenrents and incomes that has seen theprivate rental sector exhibit a steady rateof rental value growth over the last year.

Nationally, the cost of renting a homein the UK has risen so quickly in parts ofthe UK that Greater London, the SouthWest and the South East of England are

pushing the bounds of affordability, according to new findings released from theJune 2014 HomeLet Rental Index.

The data also suggests that pockets of affordability are arising inthe North East of England, Scotland and Wales, where there isgreater parity between incomes and rental prices.

The HomeLet Rental Index, the largest monthly surveyof private tenants in the UK, shows that the average UKprivate home rent rose by 6.3 per cent over the year. Theaverage rent in the UK now stands at £862 a month,compared to £811 a year ago.

When Latest Homes first went out tomeet Nick, Managing Director ofSoundhouse, we thought they were a

Meeting Nick is always a pleasure, but over theyears we have also met with many of his happycustomers. Susan Corlett is one such person andwe went along to take a look at her new kitchen,extension, and the loft conversion that Nick hadpreviously done. Once again, it was a strikinglygood job maximising on space and, as ever,fitting seamlessly into the existing building.

We asked Susan how she heard aboutSoundhouse. “We found Nick and Soundhousethrough a recommendation from a friend, whohad had her loft done and was thrilled with it.That was back in 2010. We had planned to dothe kitchen at that point, but a change in ourcircumstances meant that a loft conversion wasa better plan at that time.

“Nick came and chatted about the kitchenbut we soon told him that we wanted to changeto the loft. He wasn’t at all phased, and he camealong with such great ideas. that work was completed. They were alsoconsiderate of our neighbours – Nick helped uswith the neighbourly consultation and theplanning process.

“Soundhouse are hard working, too, and youcan see that hard work and the progress thatthey make on a daily basis. Nick is also verygood at managing your expectations, thetimings, and the budget. Any delays were forgood reasons and nothing has cost more than hesaid it would cost. In truth, he maybe errs on thecautious side with timings and costs – which isvery nice, there were no nasty surprises!

“We consulted with him on everything atevery stage; he has a great eye for design andthat was a great advantage. Nick understoodour vision and made it real.”

A few hundred yards away, we visited anotherhome where Soundhouse had worked theirmagic. George told us about their experience.

“It took Jo and I over a year to plan whowould carry out our loft conversion. It’s been a fast-paced andexciting week in the Latest TVstudio. I have finally beenunited with my co-host,

Simone Thorogood, who will bethe on-screen Judy to my Richard.You’ll hear more from her in nextweek’s column.

Simone is now working with me,with gusto, on the remainingcontent for Latest Homes Liveepisode 1 (and 2, 3 & 4), and weactually did our first run-throughon set last Tuesday. This was thefirst time we had trodden theboards (or in this case, trodden the

green-screened shag-pile rug) of the Latest Homes Live set, and using thepower of TV we ran the first couple of segments of episode 1. Obviouslywe had to pretend that other people were our guests (Latest’s ring-master Bill Smith played the part of our token property expert) but wewere thilled to finally be turning the show into a reality. It’s often strangeto spend weeks in an office planning a show, and suddenly see it comingto fruition in front of your eyes.

Looking across Dubai towardsthe sea, from my 59th floorhotel room, I really do wonderhow it all went so wrong.

Back in the 1990s, prior to thecommencement of development,there was opportunity, vision andresources. Dubai was a blankcanvas and any of a number ofdifferent approaches could havebeen taken.

In many ways, Dubai’s problemscan be summed up by a quickglance at Al Yaquob Tower on thecity’s main drag, Sheikh ZayedRoad. The building is a 69-storey,

328m high replica of Westminster’s Elizabeth Tower (AKA Big Ben). Thisbuilding belongs in Las Vegas, and its developer belongs in the real BigBen's first floor prison room. Such structures are not constructed inserious places, nor are hotels called ‘Atlantis’ orothers claiming to be 7* (there is no such thing).

Dubai doesn’t suffer from crassness alone.Many schoolboy infrastructure errors have beenmade as well. They built roads everywhere, butforgot about pavements. One particular four-lane highway springs up from nowhere andleaves pedestrians stranded on one side. Alongsimilar lines, there are hundreds of miles ofcoastline but few public beaches. Indeed, thetens of miles of brand new waterfront that werecreated as part of the famous man-made PalmIslands contain not a single public beach. And, totop it all off, there is so little greenery that onewonders how Dubai manages to use more waterper head than anywhere else in the world.

In Dubai’s favour, it is home to the tallest man-made structure on the planet, the Burj Khalifa,which offers a sparkling finger to the trash around it. It achieved this recordon 1st September 2008 when it surpassed Warsaw Radio Mast at 688mafter taking every other record (tallest proper building, highest top floor,etc) on the way. It topped out at 829.8m in 2009 and ended up beingnamed ‘Khalifa’ (‘burj’ means ‘tower’) after the ruler of neighbouring AbuDhabi, which bailed out Dubai earlier in its ongoing financial crisis. If thetacky Dubai Mall (biggest shopping centre in the world, of course) wasremoved from its base, the finished product would be close to perfection.

Like so many who played Sim City as a child, I would relish theopportunity to build a city from scratch. But with real buildings, usingreal money, I would think a lot more before clicking that mouse.www.buildingopinions.com [email protected]

Principal Private ResidenceRelief (PPR), which is set outin section 222 of the Taxationof Chargeable Gains Act 1992,

enables individuals to sell their mainresidence without incurring any CapitalGains Tax (CGT) on the capital gainmade upon the sale of that residence.

PPR applies to freehold property orleasehold property, and subject tocertain limitations includesoutbuildings and surrounding gardenor land falling within the limits definedas a ‘permitted area’.

If an individual resides in two ormore houses at the same time as themain residences, he or she must electone of them to be the main residenceat any one time for PPR. He or she cannominate which residence is to betreated as the main residence at anytime, or for any particular periods.

The nomination must be made

within two years of the date that theresidences in question are occupied. If there is a change in one or more ofthose residences, a new two-year periodbegins from the date of that change. If no nomination is made, it may be aquestion of facts and evidence as towhich property is the main residence.

Spouses married to each other andthose in a civil partnership livingtogether can have only one mainresidence between them. If each has aseparate residence, the couple mustjointly nominate which of the tworesidences shall be the principleprivate residence. The two yeardeadline for the election begins as at the date of marriage or registrationas civil partners.

If the spouses or partners separate,each will then have a separate electionto make on each property, within twoyears of separation.

PPR may also be claimed on aproperty which is outside the UK, if theproperty is the main residence and issubject to UK capital gains tax. Non-domiciled persons resident in the UKshould not make an election if he orshe is taxed on the remittance basis,and the foreign gains are not taxable inthe UK unless remitted.

In order to claim PPR, occupation of the principal residence must be withsome degree of permanence. The rulescontain certain periods of deemedresidence for temporary absences forwork, or during renovations. The finalperiod of ownership is deemed to be aperiod of residence regardless ofwhether it is occupied, or whetheranother property is the principalprivate residence at the same time. The final period used to be 36 months,but as from 6 April 2014, it has beenreduced to 18 months.

There are circumstances where PPRmay be claimed where the mainresidence is not owned by the claimant.In terms of section 225 of TCGA, if theproperty is owned by trustees and abeneficiary occupies the property as hisor her sole or main residence under theterms of the trust, the property will besubject to the same relief if the trusteesand the beneficiary make a joint electionunder s.222(5)(a) to that effect. Theelection must be made within two yearsof the beneficiary’s first occupation ofthe property. How can I protect my companyfrom employees who resign andwant to set up in competitionwith me?You need to ensure yourContracts of Employment containrestrictive covenants that areproperly drafted – they need to protect your business and be enforceable bearing in mindwhat is set out below.

A restrictive covenant limits theway an ex-employee can act afteremployment has ended, but thereis a general legal principle that anindividual should be free to followhis trade and use his skills withoutinterference such that anycontract term that tries to restrictan individual’s freedom to work isvoid, unless an employer candemonstrate that they have alegitimate business interest to

protect and that the covenant inquestion goes no further than isreasonably necessary to protectthat interest.

What types of things are‘legitimate business interests’?A desire to protect your customerconnections and/or to protectyour trade secrets andconfidential information arelegitimate business interests. It isalso legitimate for an employer towant to protect the stability oftheir workforce. For these reasons,restrictive covenants usually try toprevent ex-employees dealingwith your customers, fromsoliciting your customers andfrom poaching your employees.

These clauses have to bereasonable in terms of geographyand duration, and they also need

to be limited to the part of thebusiness that the employeeworks in.

The Court of Appeal confirmedrecently that they will not re-writeclauses that are badly drafted justto help an employer restrict anemployee, so it is important tomake sure any restrictivecovenants (and indeed yourContracts of Employmentgenerally) are properly drafted.

What legal action can I take forbreach of a restrictive covenant?If you convince a Court that acovenant is enforceable, you canask for an injunction preventing the employee from working incompetition with you. Do bear inmind that if you are deemed tohave already breached the Contractof Employment of a departingemployee, then the covenants willnot be enforceable against them.

This is a complex area of law soI would always recommendseeking advice from an expertemployment solicitor.
