I remember writing previously that the holidays were sneaking

up on us, and now here they are! Many people have been saying they just can’t believe how fast the year has gone. I tend to agree. But, I think that means that everyone has been so very busy and it made it feel like the time was flying. Busy is good, but too busy tends to cause us to forget about the little things and the most important people in our lives. There are a lot of things to be Thankful for, but we look at that one way. Here is a poem I found that takes being Thankful and puts a deeper perspective and maybe a more realistic view on being Thankful.

As I arrived back to Lake Bernadette in late September, I was again amazed at how much the community has matured.

Green, lush lawns and pleasing plant beds were easy on my traveling eyes. However, many of our trees are in need of trimming, especially those in the small easement between the sidewalk and the curb. As these trees mature and grow, they need to be raised (trimmed up) to a height of 8 to 10 feet from the ground. This is an owner/resident responsibility! At the last CDD meeting, residents complained about scratches on cars from low branches. Don’t be subject to a legal complaint for not trimming your trees and causing damage to someone’s vehicle.

While driving around LB, I noticed how many residents are heeding calls to park in driveways and not on the streets, and many are keeping sidewalks clear for our handicapped, walkers and children. So, here is a simple reminder for our new residents: No Parking on Any Street. Street parking adversely affects traffic flow, mail delivery, and restricts the flow of emergency vehicles. It’s the law! Residents may call the Pasco County Sheriff dispatcher at 813-929-1204 to report violations and request a Sheriff Patrol ticket the violator. I might as well remind all to keep that speed down to 20 MPH or below on our side streets. From following many vehicles around, I sense residents are reading the newsletter and paying attention to their speed. “Atta boy” to all!!!

We have received several complaints from residents in the Baldwin Park area about wooden ramps constructed at the back of the circle. Parents, please talk to your skateboarders and tell them that building ramps on the streets is illegal and punishable. Residents can take pictures of skateboarders and submit to the Sheriff for legal action.

By now, all residents have received notice of the annual meeting on December 5th. Please try to attend, but if you can’t, please submit your proxy card. As I wrote last issue, this is the one meeting of the year at which home owners can participate in the meeting. A quorum (approximately 30%) of home owners is needed to call the meeting to order.

We have a winner in the logo contest. Entries were received from Zephyrhills students of digital design as well as several residents. The entries were all very good. The Board of Directors mulled all entries and decided on one which could be used both as a logo and a letterhead for official correspondence. We went with simpler rather than complicated design. The winner was Ron Gantt of Braddock Pines. His artwork can be seen above as well as on the front page of this issue. Congratulations to Ron.

As this issue goes to press, many of us will be preparing for Thanksgiving. This is the time of year to reflect on our blessings of family and friends. Although some have been adversely affected by the steady economic downturn, we would do well to thank the Almighty for simply being alive and healthy. Patty and I will be celebrating with all of our northern grandchildren in Maryland.

December is also fast approaching and many will be preparing to celebrate Christmas and Chanukah. Since our next issue is not due out until January 2012, I would like to wish all of our residents a most joyous, safe and blessed holiday season. Until next year, best wishes.

The following resolution is an extract from the minutes of the Board of Directors Meeting of October 31, 2011.

RESOLVED: That the following Restatement of Art. IX, Section 6. Parking - is promulgated pursuant to the authority granted to the Board of Directors in Section 6 (c) “to promulgate additional rules and regulations pertaining to parking”. (Adopted unanimously, October 31, 2011)

Section 6. Parking.

(a) The parking and storage of automobiles shall be limited to carports, garages, driveways of Residences and other paved surfaces designated by the Association by members and their guests/tenants. No motor vehicle shall block a public sidewalk or park so as to block direct vehicular access to any mailbox by the postal carrier.

(b) No commercial vehicles of any variety belonging to a member, guest/tenant shall be parked or stored on a regular basis on the Dedicated Property (except in an enclosed garage with the garage door kept closed. No commercial vehicle or trailer may be parked at anytime on the streets of Lake Bernadette or on private driveways for any purpose other than pick-up and/or delivery

and for such purpose is limited to ½ hour. The only exceptions to the aforementioned restriction would be a construction vehicle or moving van in which case the vehicle’s stay would be limited to daylight active construction hours or loading/unloading of a moving van. This prohibition includes but is not limited to private vehicles with commercial advertising, and/or private vehicles containing commercial implements such as tools and/or ladders, any variety of truck with more than 4 tires and/or any variety of box truck. Upon the expiration of 24 hours notice posted on the windshield of any violating vehicle, the violating vehicle may be towed/impounded at the expense of the owner. Subsequent violations involving the same vehicle do not require another notice before towing.

No recreational vehicle belonging to a member, guest/tenant including but not limited to: boats, campers, trailers, built up truck bed enclosures, and vans other than small passenger vans shall be parked or stored on a regular basis on the Dedicated Property (except in an enclosed garage with the garage door kept closed). Boats and campers (RVs) may be parked occasionally for provisioning and unloading not in excess of 12 hours. Any variety of truck and/or automobile the body of which has been raised or elevated from the chassis is a recreational

vehicle within the meaning of this prohibition. Upon the expiration of 24 hours notice posted on the windshield of any violating vehicle, the violating vehicle may be towed/impounded at the expense of the owner. Subsequent violations involving the same vehicle do not require another notice before towing. An inoperative vehicle includes a vehicle that is in a state of disrepair and incapable of immediate movement under its own power, or a vehicle that is incapable of being lawfully operated on the streets of the State of Florida. A vehicle shall be deemed inoperative if one or more parts which are required for the safe operation of the vehicle are missing, are dismantled, are inoperative or are not attached to the vehicle as designed. A vehicle shall be presumed incapable of being lawfully operated on the streets of the State of Florida if a current registration tag, also known as a license plate of a category required under state law as a condition of operation upon the public streets or highways, is not affixed to the assigned vehicle.

No inoperative vehicle belonging to a member, guest/tenant shall be parked or stored on any lot or driveway in public view that does not bear visible current registration and a current visible (attached to the vehicle) license tag from the State of Florida or other applicable licensing

governmental agency. No inoperable vehicle shall be supported by blocks or any means of support other than its traditionally affixed wheels/tires for maintenance or storage for any period of time unless completely enclosed within a garage with the doors of the garage closed. No inoperable motorized vehicle shall be stored on any lot or driveway in public view for a period of time exceeding twenty-four (24) hours. No motorized or wheeled vehicle including automobiles, motorcycles, trailers (by way of illustration and not by way of limitation) shall at any time be parked or stored on any lot or driveway in public view covered by plastic, vinyl, burlap, cloth or other covering sheet material. No motorized vehicle shall be parked or stored on any lot or driveway in public view that is leaking oil, gasoline or any other liquid. No motorized vehicle shall be parked or stored on any lot or driveway unless its engine is started and the vehicle is moved every fourteen (14) days.

Storage, service and repair of an inoperative or disabled motor vehicle is permitted only when such storage, service and repair is conducted entirely within the confines of a completely enclosed garage (garage door/s closed), not to include open carports and also provided that the motor vehicle is the property of the owner or occupier of the lot and that such use is not a commercial use of the property.

the Board of Directors received many quality and beautiful entries for the

logo contest. The lady golfer was submitted by resident Monica Castro. Ten others were submitted by resident Lisa Dawson’s Zephyrhills High School Business Technology class. She used the contest as part of a digital design school project. Two others were submitted by resident “John” of Whispering Pines. The quality and thought which went into each entry is a testament to the talent and imagination of all entrants.

The winning entry will double as both a logo and letterhead. However, don’t be surprised if some of these logos appear in later issues to help emphasize our great community.

Congratulations are in order for the hard work all designers put forth for the contest. A special thanks to Ms Dawson for displaying local talent from our high school. Her students have a bright future in business and digital design.

Florida Law on stopping for school buses(Statute and Plain language)

Section 316.172, Florida Statutes, states: “(1)(a) Any person using, operating, or driving a vehicle on or over the roads or highways of this state shall,

upon approaching any school bus which displays a stop signal, bring such vehicle to a full stop while the bus is stopped, and the vehicle shall not pass the school bus until the signal has been withdrawn. A person who violates this section commits a moving violation, punishable as provided in chapter 318.

(b) Any person using, operating, or driving a vehicle that passes a school bus on the side that children enter and exit when the school bus displays a stop signal commits a moving violation, punishable as provided in chapter 318, and is subject to a mandatory hearing under the provisions of s. 318.19.

(2) The driver of a vehicle upon a divided highway with an unpaved space of at least 5 feet, a raised median, or a physical barrier is not required to stop when traveling in the opposite direction of a school bus which is stopped in accordance with the provisions of this

section.

(3) Every school bus shall stop as far to the right of the street as possible and shall display warning lights and stop signals as required by rules of the State Board of Education before discharging or loading passengers. When possible, a school bus shall not stop where the visibility is

obscured for a distance of 200 feet either way from the bus.”

O. K., now you know what the law says, but what does this mean in non-statute language? It is really very simple.

(1) If you are going the same way as a school bus that is flashing red lights and has the stop arm extended, you must stop behind the bus and cannot move until the bus retracts the stop arm and turns off the flashing red lights.

(2) If you are going the opposite way as a school bus that is flashing red lights and has the stop arm extended, you must stop in front of the bus and cannot move until the bus retracts the stop arm and turns off the flashing red lights -- UNLESS:

(A) you are on a divided highway and the one-way roadways are separated by an unpaved space at least five feet in width, or

(B) you are on a divided highway and the one-way roadways are separated by a physical barrier.

In short, you must stop for a school bus that is flashing red lights and has the stop arm extended -- unless (1) you are going the opposite direction, (2) you are on a divided highway, and (3) the divided highway has either a five-foot unpaved space or a physical barrier separating the roadways. If all three of the above are present, you should continue driving at a legal speed, but with an increased awareness that school-aged children are in the vicinity.

An unpaved space is a grass, dirt, gravel, water, etc. division between one- or multi-lane roadways going in opposite directions. This space may either be a swale lower than the roadways or a median raised above the roadways. While “paved” sometimes refers only to concrete surfaces, in this context “paved” refers to any hard surfaced permanent ground cover.

The one- or two-way left hand turn lanes common between many single- and multi-lane roadways are never to be considered a barrier or “unpaved” space. If you are traveling on one of these roads, you must stop for a school bus that is flashing red lights and has the stop arm extended -- regardless of the direction you are traveling or the number of lanes in either direction.

School buses are equipped with yellow flashing lights in addition to red flashing lights. Flashing yellow lights are for warning purposes, primarily to let you know the driver is nearing a loading or unloading zone and will soon be stopping and displaying flashing red lights and extending the stop arm. You should not stop for flashing yellow lights; however, you should slow and be prepared to come to a complete stop.

Over the past few years, we have published several articles about tree trimming and responsibilities. Branches, mainly oak, are starting to spread into the streets and over sidewalks. Trees need to be raised (pruned) up the main trunk to a height of eight to 10 feet. This will allow cars to navigate the streets and people to walk without being scratched by overhang. The owner/resident is responsible for keeping all trees trimmed on home sites, even those planted in the easement between the sidewalk and street.

Residents are reminded that the HOA and CDD have no control over parking on non-community areas. An example of such an area is the lot just off of SR54 on the right side of Golf Links Blvd. That area is privately owned and the HOA and CDD have no jurisdiction over parked vehicles. Complaints can be filed with the Pasco Sheriff.

The Zephyrhills Woman’s Club is dedicated to community service, civic participation and educational

programs. Members work together in a spirit of friendship for the betterment of the community, and support local national and international relief efforts. The Woman’s Club was organized on November 11, 1915. The Club was federated with the national General Federation of Woman that same year.

Monthly meetings are held the first Friday of each month from October through May at 1 pm at the Clubhouse at 38549 Fifth Avenue in Zephyrhills. Each meeting is hosted by one of the departments.

Membership is open to all women who reside in the area. Dues are $20 annually. All are welcome to join. Each member is encouraged to participate in at least one activity and department.

Along with the fall and winter holiday season, Medicare open enrollment is a certainty for many seniors. As a Medicare recipient, you have a chance each year to make changes to your Medicare Advantage plan or Medicare prescription drug coverage for the following year.

Traditionally, the Medicare annual open enrollment period started

on November 15 and ended on December 31. However, Medicare has made some changes for 2011, including:

join a Medicare health plan or prescription drug plan. The new enrollment period will start on October 15, 2011 and end on December 7, 2011. Any changes you make during this period will be effective on January 1, 2012.

Making Changes to Your Medicare Advantage Plan Coverage after December 31

Between January 1, 2012 and February 14, 2012, if you are in a Medicare Advantage plan you can leave your plan and switch to Original Medicare. If you decide to switch to Original Medicare during this period, you will have until February 14 to also join a Medicare Prescription Drug Plan to add drug coverage. Your coverage will begin the first day of the month after the plan gets your enrollment form.

During this period, you can only switch from your Medicare Advantage plan to Original

Medicare; you cannot do any of the following:

• Switch from Original Medicare to a Medicare Advantage Plan.

• Switch from one Medicare Advantage Plan to another.

• Switch from one Medicare Prescription Drug Plan to another.

Since plan costs and coverage change each year, you should check to make sure that your plan still meets your needs and budget. Your Medicare Advantage plan may no longer be available where you live or there may be a health or drug plan available with better coverage or a lower cost in 2012.
