    Pole Control Studios infamous Kitty Kat Cabaret dance troupes shows are a potent cocktail that mixed elements from

    traditional American Burlesque revues with a post-feminist punk attitude incorporating video vixen dance styles of music

    videos today. Their intricately choreographed and elaborately costumed extravaganzas had much more in common with the

    theatricality and humor of Vaudeville than with the strip club pole dancers of today. Pole Control studios ever changing

    crew of female performers range from, acrobats, dancers, comedians and musicians. Their savvy on-stage

    performancesgive you an intimate glimpse behind the curtain. Vivacious women of all shapes and sizes are encouraged to

    join us. We (the Pole Control Studios dancer troop welcomed organic individuality) radiated an authentic, raw energy in our

    routines that mesmerizes the audience large and small

    READ CAREFULLY

    THIS IS A WAIVER AND RELEASE OF LIABILITY

    Whereas, ______________________ (Participant) has a desire to participate in auditions and various

    dance routines for the Pole Control Studios Dance Team to be held at the Pole Control StudiosPractice Facility and at the Pole Control Studios dance Team(Audition);

    Whereas, Participant fully understands the risks involved in that it is possible to sustain seriousinjury during the course of said Audition; and

    NOW, THEREFORE, in consideration of the opportunity to participate in the aforementionedAudition, Participant agrees as follows:

    1. I hereby release, waive and discharge Pole Control Studios, Sam Cohen Realty 75 Pratt st, theNational Dance Association and its Member Teams and their respective affiliates, officers,directors, board members, agents and employees (collectively, Releasees), from all liability tome and to my conservators, guardians or other legal representatives, assigns, heirs and next ofkin for any and all claims, demands, losses or damages on account of any injury, death, ordamaged property, arising out of my Audition. I understand that Sam Cohen Realty does notendorse or support the Audition.

    2. I hereby release, waive and discharge the Releasees from all liability to me and myconservators, guardians or other legal representatives, assigns, heirs and next of kin for any andall claims, demands, losses or damages on account of any injury, death, or damaged property,arising out of any negligence relating in any way to the Audition.

    3. I also hereby agree to indemnify and hold harmless the Releasees from any claim or demand onaccount of injury or damage which I may suffer as a result of the Audition.

    4. I understand that this release, waiver and agreement to indemnify and hold harmless includes,but is not limited to, damages which are caused, or alleged to be caused, in whole or in part by thenegligence of the Releasees.

    5. I understand that my Audition is done on a purely voluntary basis. I understand that a danceaudition can, in some cases, cause injuries, including potentially severe injuries, and severe socialand economic losses. I am familiar with the potential risks involved in the Audition and I assume allsuch risk.

    6. I acknowledge that I have the opportunity to inspect the equipment, facilities, and either havedone so or will do so, and I hereby waive any claim I may have with respect to the use, design oroperation of the equipment or facilities that I may use.

    7. The numbered paragraphs of this Release and Waiver of Liability are severable.

    8. I have read the above agreement and release of waiver and liability and understand that by

    signing it I have given up substantial rights. I sign this agreement voluntarily.

    BASIC RULES AND REGULATIONS

    A. REQUIREMENTS

    Each Pole Control Studios Dance Team member (Member) must be at least 18 years of age bythe first day of the regular season.

    B. UNIFORMS

    Uniforms will be provided. Any article, including jewelry, to be worn in addition to the basicuniform must be approved by the Director. Each Member is responsible for the uniforms issued.

    The uniforms are the property of Pole Control Studios and all uniforms must be returned to theDirector upon leaving the squad or before the final tryouts for the next season begin. Uniforms arenot to be worn in any public establishment, except where directed by the Director pursuant to anapproved public appearance.

    C. REHEARSALS

    1. Two to five rehearsals will be scheduled each week for several weeks before the season begins.Each Member is expected to attend all preseason rehearsals.

    2. Once the season begins, a regular schedule of rehearsals will be established. Allrehearsals will be scheduled in the evening or on Sunday for the convenience ofthose who are working or attending school. Members must attend all rehearsalsunless they have obtained permission in advance from the Director to miss

    rehearsal. Any Member who has an unexcused absence from a rehearsal prior to aevent will not be allowed to perform at that event; nevertheless, attendance at thatevent is required.

    3. Rehearsals will generally last between three and five hours.

    4. Members should be ready to dance at the scheduled time and be able to stay for the entirerehearsal.

    5. It is very important that each Member attends, be on time, and stay for all scheduled practices.If a Member is absent from, leaves early, or is late to practice three times in any four-week period,the Member will receive a warning. If a Member is absent, leaves early or is late three times duringthe subsequent four week period, the Member will be suspended for a period of time to bedetermined by management on a case-by-case basis depending on the facts and circumstancessurrounding each case. During the suspension, the Member will not be allowed to practice, attendevents or participate in any other Pole Control Studios Dance Team functions.

    D. COMPENSATION

    Members will be paid an hourly wage (not less than minimum wage) and any applicable overtimerequired by law, for all hours worked. A record of hours worked will be maintained by the Directorand each Member will be asked to review and initial the time record prior to its submission to

    accounting. Members will be paid on the 15th of each month (or the previous business day if the 15th falls on a Saturday, Sunday or holiday) and on the last businessday of each month. Members will receive one free pass for a guest, plus free parking (subject to availability at the sole discretion of Pole Control Studios) for each event in which they are eligible to perform. No other benefits are

    provided. However, hair care, studio membership, athletic shoes and other clothing may be provided subject to sponsorship agreements.

    E. PERSONAL APPEARANCE AND ACTIVITIES

    The Pole Control Studios Dance Team are members of the professional dancers and entertainment industries and that fact must be reflected in the appearance and performance of each Member. Personal appearance and

    dancing skills were major factors in the selection of Pole Control Studios Dance Team. Members must maintain the personal appearance and level of dancing skill upon which their selection to the organization was based and

    must learn and practice Pole Control Studios Dance Team dance routines. As a Member, you automatically come under the scrutiny of the public eye. Actions as a Member of Pole Control Studios Dance Team not only reflect on

    the Member and her family, but on Pole Control Studios as well. The Director shall have the authority to set policies regarding gum chewing, smoking, eating, drinking, and proper attire. Certain activities such as fraternization

    between Members and the Pole Control Studios employees, staff, management or affiliates, may be misunderstood by the public. Consequently, such fraternization, posing in the nude or in a manner deemed in poor taste and

    other activities which are detrimental to Pole Control Studios image are not permitted, and will result in immediate dismissal from the squad.

    F. PUBLIC APPEARANCES

    Members may be asked to participate in various public appearances for Pole Control Studios. The Pole Control Studios Director must approve all such public appearances in advance in writing. The Pole Control Studios Dance

    Team in its sole discretion may develop a budget for paid team appearances. Certain of these appearances will be set by Pole Control Studios, such as dance camp, nursing home visits, holiday hospital visits and the like. Other

    appearances will be considered, subject to budget constraints, if submitted at least three weeks in advance of the appearance and only if a sufficient number of Members, as determined by Pole Control Studios in its sole

    discretion, are committed to appearing. Travel time outside the Greater Hartford area will be paid.

    Members may also participate in other public appearances for entities other than Pole Control Studios on a voluntary basis. However, Member understands and agrees that Pole Control Studios must approve all appearances,Pole Control Studios may condition appearances as determined by the Studio in its sole discretion and Member may not make any appearance (including, without limitation, media interviews, televisions appearances, photo

    sessions and public commercial appearances) without the prior written consent of Pole Control Studios.

    G. Studio performances

    Members must be at home Studio three hours before scheduled Event. All Members must be available to participate in all scheduled events. Membership is not required or expected. Attending or not attending classes will have

    no impact on your status as a Member of the Pole Control Studios Dance Team.

    H. TRADEMARK AND COPYRIGHTS

    The trademark for the Pole Control Studios Dance Team and the uniform design are registered service marks of and are owned by Erotikink Inc. All rights in and to the trademark are reserved. Any Member using the trademarks

    without prior, written authorization by the Pole Control Studios is subject to suspension or termination and to a lawsuit for damages.

    The undersigned acknowledges that all choreography used by the Pole Control Studios Dancers and any derivations thereof, whether developed by Pole Control Studios. Violation of this policy can result in suspension or

    termination and a lawsuit for damages.

    I. AGREEMENT NOT TO COMPETE

    Each Member agrees that within five years of termination, they will not do anything in competition with the Pole Control Studios Dance Team, including but not limited to the following: Engagements or appearances, public or

    private, with any reference to or identification of Pole Control Studios; Any engagement or appearance wearing the old uniform or a facsimile thereof; and/or Any act which might compete with the rights of the Pole Control

    Studios, or the Pole Control Studios Dancers.

    J. PUBLICITY

    Member grants full permission to the Pole Control Studios Dance team, the National Dance Association and its Member Teams, NDA Properties, Inc. and their respective parents, subsidiaries, affiliates, directors, officers,

    governors, employees and agents to use Members name, nickname, voice, biographical information, photograph, and/or other likeness, however captured, for any purpose (including, without limitation, for advertising, sales,

    promotional and/or other commercial purposes) in any media or format now or hereafter known, worldwide and in perpetuity, without further compensation, authorization or notification to Member or anyone on Members

    behalf.

    K. REMEDIES AND INDEMNIFICATION

    The Pole Control Studios reserve the right in its sole discretion to suspend or terminate any Member who violates these rules and regulations. Member expressly agrees to indemnify the Pole Control Studios Dance Team for any

    damages, claims, liabilities, costs or expenses of any kind, which may arise from Members negligent acts or omissions or willful misconduct or from any breach of this Agreement by Member.

    L. NDA RULES AND REGULATIONS

    Member agrees to be bound and governed by the Constitution, By-Laws, rules, regulations, resolutions and agreements of the NDA, as they may be modified or amended from time to time.

    M. TERMINATION

    The Coach and any authorized officer of Pole Control Studios may dismiss any and all Members from the team with or without cause, at any time, the employment hereunder being at will. Employment will automatically

    terminate at the time of the auditions for the Pole Control Studios Dance Team for the 2009-2010 season.
