    Certainty on Land Acquisition

    Better policies on land acquisition reduce risks toinvestors

    Land acquisition is undertaken by land procurement

    committee appointed by the Government. Appointment of independent appraiser to determine

    reasonable price.

    Land capping policy the maximum cost overrun in landacquisition borne by investors is 10% of land acquisition costor 2% of investment cost, whichever is higher (Regulation of

    the Minister of Public Works No. 12/PRT/M/2008). Government provides a revolving fund to acquire land in

    advance and the fund will be reimbursed by investors oncethe land for one toll road section is acquired (Decree of theMinister of Finance No. 44/KMK.05/2007).

    Risks Are under Investors Control

    1. Construction Cost

    Construction cost is lower than estimate since tenderis carried out at competitive price.

    In the case of cost overrun out of investors control, asstated in PPJT, investors may request the Governmentto review investment cost.

    2. Operation & Maintenance Cost

    Deliver cost efficiency initiatives, among others:

    ETC system.

    Performance Based Maintenance Contract - extendthe maintenance guarantee period.
