elated over its passage j The bill was introduced by our Sen for Baker j Be It Enacted by the Legislature of the State of Florida Section I That the practice of j Optometry for the purpose of this i act is defined as follows viz The ire or employment of tests or < x aminations for the determination of I the natural and functional deficien- cies ¬ of the eye and the adoption of lenses for the aid thereof Sec l There is hereby createI n I board td be known and the Florida Hoard of Examiners in Ou I tometry to be composed of five reg I lIar opticians residents of the state i of Florida who have been engaged in practice of optometry in said estate fo Ttwo years Said board shall be appointed by the governor as soon as practicabe after the passage of this act one member for a term of one year one for two years one I for three years two for four years and each until his successor is ap j pointed and qualified and the term IOf members thereafter appointed I be for four years provided however that the appointment to I fill vacancies which the governor is hereby empowered to make shall be for the unevpired term Sec Said board of examiners shall elect at its regular meeting- and I annually thereafter one of its members as president and one as I secretary and treasurer and shall hold a regular meeting at least once I each year at such time and place as the said board may determine I special meetings may be called and i belt at such times and places as I may be designated by the president and se retary and such special meetings shall be held upon the ap- plication ¬ of the applicants for ap- plication ¬ At least thirty days no- tice ¬ of any regular meeting shall be I given by publication once a week in a nowejipper of general circulation throughout the state I Sec 4 Three members of said board shall constitute a quorum for the transaction of business and shoal a quorum not be present on the lay appointed for their meeting those present may adjourn from day to day or to some designated day until a quorum is present Sect Said board shall make such rules and regulations not iu consistent with law as it may con- sider ¬ necessary to the proper per- formance ¬ of its duties may take testimony concerning any matter within its jurisdiction and each member thereof may administer oaths It shall be the duty of said hoard to examine thoroughly every applicant desiring to practice opto- metry in this state and if a majority of said board shall be satisfied that said person is competent and posses the knowledge essential to such practice they shall grant him a cer ¬ tificate to that effect and enter his name on their records as a register- ed ¬ practitioner The secretary shall peep a full record of the proceedings- of the board which record shall at all reasonable times be open to pub ¬ lic inspection- Sec G Every person except ns hereinafter provided before begin- ning ¬ to practice optometry in this state after this act shall go into ef- fect shall pass an examination be- fore ¬ said board of examiners as pro ¬ for in section five of this act any person having signified his to be so examined shall ap ¬ ear before the board at such time and place as they may designate Before taking said examination the applicant shall pay for the use of said board in defraying the legiti ¬ mate expense as hereinafter provid ipl the sum of ten dollars and if he shall successfully pass said examina ¬ tion he shall pay for the use of the board as aforesaid the further sum of five dollars upon the issuance to him of the certificate of qualifica ¬ tion to be signed by the president and secretary Sec 7 The certificate provided for in the two preceding sections shall be recorded in the office of the clerk 01 the circuit court of the county in which such practitioner may reside or sojourn and in any county where he may practice in a book to be kept by the clerk for that purpose before the person to whom- it is granted shall be entitled to practice by virtue thereof and when so recorded the clerk shall certify thereon under his official seal the fact anti elate of such record and shall return such certificate to the person to whom the same was grant- ed ¬ and shall be entitled for such service to collect from the holder thereof the legal fee for recording- Sec I S All persons to whom mar have been granted a certificate of I graduation or diploma indicating competency of the holder to engage in the practice of optometry by any well recognized school college or institute wherein instruction in the essentials of optometry may have been taught and who may have been engaged in the practice of optometry in the state of Florida for a period of two years prior to the date of the passage of this act are exempt from the examination herein provided for and on presenting to said board such certificate of graduation or diploma or in the event of the loss of the same satisfactory evidence of iL is ¬ suance and on presenting satisfac- tory ¬ proof by affidavit or otherwise that the party applying for certifi ¬ cate is exempt from examination un ¬ der this section such person shall be entitled to receive from said board a certificate of qualification upon the payment of the sum of five dollars therefor provided the ap- plication ¬ for such certificate be made in writing within six months from the passage of this act and if not so be paid out of1 the state treasury or he a charge against the state nor shall the state be in any wise responsible for any indebtedness which may be created hy said board All moneys received by said board under the provisions of this act shall be held by the sec retary as a special fund out of which may be paid the per diem allowance and mileage of said members afore- said and the expenses incurred by the board in carrying out the visions of this act and the prod 1 board shall make an annual report of its proceedings to the soernor on the first Monday in January of each year which report shall contain an account of all meneys received an l1 disbursed by them in pursuance of the provisions hereof Sec 10 Any person who shall hold himself out to the public as a practitioner of optometry without first complying with the provisions- of this act or who shall iolate any of the provisions of said act shall be deemed guilty of a misdemeanor- and upon conviction shall be pun tshed by a tine of not less than twentyfive dollars nor more than two hundred dollars or by impris- onment ¬ not exceeding MX months Sec 11 Nothing in thib act shall be construed to apply to physicians and surgeons authorized to provide under the laws of Florida nor to dealers in optical goods who ref spectacles or eyeglasses without attempting to traffic upon skill in adapting them to the eye Sec l All the 10th of I May t J e have known the deceased for I many years but never knew him by I any other name than Campbell AVe worked with him seven years ago on the Democrat in Live Oak and at one time extended him a small favor which he seemed to greatly appre ¬ ciate and we nave since received I many letters from him while he was I I in Georgia Central America and I California Several weeks ago we he was not the Camp ¬ I bell of years ago In conversation he told us what we had previously learned from oth- er lips that he was a slave to Chamberlains medicines which had made him a wreck Monday
