DISABILITYLAWSINPOSTSECONDARYEDUCATIONIndividualswithdisabilitiesareentitledbylawtoequalaccesstopostsecondaryprograms.Therearetwolawsthatprotectpersonswithdisabilitiesinpostsecondaryeducation:TheRehabilitationActof1973(Pub.L.No.93-112,asamended)andthe1990AmericanswithDisabilitiesAct(Pub.L.No.1001-336).AccordingtotheRehabilitationActof1973andtheAmericanswithDisabilitiesAct(ADA,1990),astudentwithadisabilityissomeonewhohasaphysicalormentalimpairment,hasahistoryofimpairment,orisbelievedtohaveadisabilitythatsubstantiallylimitsamajorlifeactivitysuchaslearning,speaking,seeing,hearing,breathing,walking,caringforoneself,orperformingmanualtasks.TheRehabilitationActTitleVofTheRehabilitationActof1973isgenerallyregardedasthefirstcivilrightslegislationonthenationallevelforpeoplewithdisabilities.Section504ofheRehabilitationActisaprogramaccessstatute.Itprohibitsdiscriminationonthebasisofdisabilityinanyprogramoractivityofferedbyanentityorinstitutionreceivingfederalfunds.Section504states(asamended):

NootherwisequalifiedpersonwithadisabilityintheUnitedStates…shall,solelyonthebasisofdisability,bedeniedaccessto,orthebenefitsof,orbesubjectedtodiscriminationunderanyprogramoractivityprovidedbyanyinstitutionreceivingfederalfinancialassistance.

UnderSection504,institutionswererequiredtoappointandmaintainatleastonepersontocoordinateitseffortstocomplywiththerequirementsofSection504.Individualsworkinginthisofficehavetheongoingresponsibilityofassuringthattheinstitution/agency/organizationpracticesnondiscriminationonthebasisofdisabilityandshouldbeincludedinanygrievanceproceduresdevelopedtoaddresspossibleinstancesofdiscriminationbroughtagainsttheinstitution.AtINSTITUTION,theestablishedofficeisOFFICE.TheAmericanswithDisabilityAct(ADA)TheAmericanswithDisabilitiesAct(ADA)isafederalcivilrightsstatutethatprohibitsdiscriminationagainstpeoplewithdisabilities.Therearefourmainsectionsofthelaw:employment,government,publicaccommodations,andtelecommunications.TheADAprovidesadditionalprotectionforpersonswithdisabilitiesinconjunctionwiththeRehabilitationActof1973.TheADAisdesignedtoremovebarrierswhichpreventqualifiedindividualswithdisabilitiesfromenjoyingthesameopportunitiesthatareavailabletopersonswithoutdisabilities.PostsecondaryinstitutionsarecoveredinmanywaysundertheADA.EmploymentisaddressedbyTitleI,andTitleIIaddressesaccessibilityprovidedbypublicentities.AccessibilityprovidedbyprivateentitiesisaddressedinTitleIII,andTitleIVaddressestelecommunications.MiscellaneousitemsareincludedinTitleV.AmendmentstotheADA,whichtookeffectJanuary1,2009,clarifywhoiscoveredbythelaw’sprotections.TheADAAArevisesthedefinitionof“disability”tomorebroadlyincludeimpairmentsthatsubstantiallylimitamajorlifeactivity.Theamendmentalsostatesthatmitigatingmeasures,including

assistivedevices,auxiliaryaids,accommodations,medicaltherapies,andsupplieshavenobearingindeterminingwhetheradisabilityqualifiesunderthelaw.TheADAinRelationtoSection504oftheRehabilitationActInstitutionsthatreceivefederalfunds(suchasINSTITUTION)arecoveredunderSection504.TheADAdoesnotsupplantSection504buttheADAstandardsapplyinthosesituationswheretheADAprovidesgreaterprotection.Therefore,postsecondaryinstitutionsmustadheretoboththeRehabilitationActandtheAmericanswithDisabilitiesAct.DocumentationofDisabilityINSTITUTIONrequeststhatstudentsnotifyOFFICEofanyspecialaccommodationneeds.Thisnotificationwillhelpensurethequalityandavailabilityofservicesneeded.StudentsareresponsibleforsupplyingtheappropriatedocumentationtoOFFICEpriortoarrangementsforspecialaccommodations.Aletter,writtenreport,ormedicalrecordfromaprofessional(suchasaphysicianoranaudiologist)statingthestudent’sdisabilityandrecommendedaccommodationsisacceptable.Thisinformationisconfidential.AllaccommodationsarediscussedwithOFFICEdisabilityspecialistandthestudent.Priortothestartoftheterm,facultymembersarenotifiedthataccessserviceswillbeprovidedinaspecificclasstoastudentwithadisability.

POLICIESANDPROCEDURESHiringProcedureProvideinformationrelatedtohiringproceduresatyourinstitution.EvaluationThefollowinginformationregardingevaluationsisprovidedasanexampleonly.Severalevaluationswillbedisseminatedduringthesemester:studentevaluationoftheinterpreter,facultyevaluationoftheinterpreter,andinterpreterevaluationofthesemester.Studentandfacultyevaluationswillassisttheinterpreterinidentifyingstrengthsandareasforimprovement.Studentevaluationswillbeadministeredatmid-termandneartheendofeachsemester.Facultyevaluationswillbeadministeredneartheendofeachsemester.OFFICEwillattempttoprovideevaluationsummariesinatimelymanner.InterpreterevaluationsofthesemesterareanopportunityfortheinterpretertogiveOFFICEfeedbackaboutthesemester.Theseevaluationswillbeadministeredtointerpretersneartheendofeachsemester.QualificationCriteriaThefollowinglistoutlinesthecriteriatobehiredasaninterpreteratINSTITUTION:

1. CertificationfromRID,or2. QASTlevel(QualityAssuranceScreeningTest),or3. Graduationfromanaccreditedhighschoolorpossessionofacceptableequivalencydiploma

(G.E.D.).4. GraduateofanInterpreterEducationProgrampreferred.5. Twoyearsinterpretingexperience,preferablyinthepostsecondaryeducationalarena

OFFICEwillgenerallycontactinterpretersbasedoncertification,startingwiththosenationallycertified,continuingthroughstate-screenedinterpreters[whereapplicable].Studentpreferencesandseniorityarealsoconsidered.Increasesinpayrateduetotheinterpretersuccessfullyachievingahighercertificationlevelwillbeimplementedatthebeginningofthenextpaycycle.Theinterpretercoordinatormustfirstbeprovidedwithwrittenconfirmationfromthetestingorganization.SchedulingClassschedulesaremadeonacooperativebasisamongallstaffinterpretersbeforethesemesterbegins.Subsequently,theSUPERVISORwillcontactpart-timeinterpreterstoworkoutclassschedules.Duringtheschedulingprocess,everyeffortismadetomatchtheinterpreter’sskilllevelandpreferenceswiththeappropriatestudents,instructorsandclasses.AnyschedulingconflictsshouldbereportedimmediatelytotheSUPERVISOR.

TheSUPERVISORwillansweranyquestionsabouttheschedule.Theschedulewillindicatethetime,place,andtypeofclass.ThisschedulewillbeineffectfortheentiresemesterbutissubjecttochangebytheSUPERVISOR.Anyquestions,problems,orconcernsaboutthescheduleshouldbediscussedwiththeSUPERVISOR.InterpretersmustacceptthatOFFICEhasnocontroloverstudentsadding,dropping,orwithdrawingfromclasses.Scheduledhourscouldchangeatanytime.Ifastaffinterpreter’shoursdropbelowanacceptablenumberofhours,staffinterpreterswilloccasionallyberequiredtoreplacecontractinterpreters.Thesereplacementswillinnowayreflectnegativelyonthecontractinterpreters.AssignmentsthatarescheduledthroughOFFICEwillbepaid.Astudentmayaskaninterpreterifshe/heisavailable,buttheinterpretermustbegiventheassignmentthroughOFFICE.OFFICEmaintainstherighttomoveinterpreterswithintheirscheduledtime.Theinterpreterisscheduleduntiltheendofclass.Ifaninstructorgoespastthedesignatedtime,orifastudentneedstospeaktotheinstructorafterclass,theinterpretermaystayifher/hisscheduleallows.Iftheinterpreterhasanotherclassorassignmentshe/hemayleaveattheendofthescheduledtime.Iftheinterpreterhastoleave,andtheinstructorcontinuesteaching,theinterpretershouldinformtheinstructorthatshe/hehastoleaveandinformtheSUPERVISORofthesituation.Interpretersshouldnotacceptoutsideassignmentsthatwouldforcethemtoleaveearly,oracceptaINSTITUTIONassignmentiftheyknowtheymustleaveearly.Becauseofthedurationofeachsessionorotherfactors,someclassesmightseemtorequiretwointerpreters.Howeverafterthefirstfewclasses,itmaybeobviousthatoneinterpretercandothejob.ItistheresponsibilityoftheinterpreterstoinformtheSUPERVISORofthissituation.AtthispointtheSUPERVISORwilldetermineifitwouldbebesttoalternatethetwointerpretersortokeeponlyoneinterpreter.TimeSheetsProvideinformationforsubmittingdocumentationofhoursworkedatyourinstitution.PayrollProvideinformationregardingpayrollatyourinstitution.

EthicsandConfidentialityInterpretersareexpectedtoadheretotheRIDCodeofProfessionalConduct.Forreference,thefollowingistheRIDCodeofProfessionalConducttenets:

1. Interpretersadheretostandardsofconfidentialcommunication.2. Interpreterspossesstheprofessionalskillsandknowledgerequiredforthespecificinterpreting3. situation.4. Interpretersconductthemselvesinamannerappropriatetothespecificinterpretingsituation.5. Interpretersdemonstraterespectforconsumers.6. Interpretersdemonstraterespectforcolleagues,interns,andstudentsoftheprofession.7. Interpretersmaintainethicalbusinesspractices.8. Interpretersengageinprofessionaldevelopment.

©CopyrighttheRegistryofInterpretersfortheDeaf,Inc.Allrightsreserved.SeeAddendumAforsuggestedphrasestomaintainconfidentialityAttendanceandPunctualityTheinterpreterwillarriveontimeforallassignments.InterpretersshouldnotifyOFFICEassoonaspossibleintheeventshe/hewillbeabsentfromanassignment.AppearanceAlthoughthereisnoformaldresscode,interpretersshouldfollowtheRIDCodeofProfessionalConductregardingappropriateandprofessionalattire.Someclassesmayrequirespecialconsideration,andinterpretersshoulddressaccordingly(e.g.scubadiving,marinebiology,ceramics).Aninterpretershouldwearclothesthatcontrastskincolorandarenotdistractingtothestudent.TeamInterpretingDuetodurationorintensity,someclassesrequiretwointerpreters.Insuchsituations,bothinterpretersaretoactasateam,rotatingresponsibilitiesatpre-arrangedintervals,andprovidingsupportandfeedbacktoeachother.Interpreterswillserveatalltimesaseitherprimaryorsupportinterpreter,andshouldnottakecareofpersonalbusinessatthistime.Continuityisassuredwhenallteammembersremainpresentandactivelyinvolved,therebymaintainingawarenessofthecontextandcontentoftheinformationbeingtransmitted.Onlyoneinterpreterneedstobepresentontestdays.Interpretersshoulddecidewhichonewillinterpretonagiventestday(e.g.,alternatingdaysoroneinterpretertakingalltestdays).Whenastaffinterpreterisintheclass,thestaffinterpreterwillinterpretontestdaysunlessotherwisearranged.Bothteaminterpretersareexpectedtostayuntiltheendofthedesignatedtime.AnyarrangementstothecontraryshouldbediscussedinadvancewithSUPERVISOR.Interpretersshouldonlybillfortimeworked.

Ifaclassislongerthananhourand15minutes,andthereisnoteaminterpreter,theinterpretermaythenrequesttotakeabreak.SUPERVISORwillclarifythiswiththeinstructorandtheinterpreter.ExchangeofInformationProvideinformationasitappliesatyourinstitution.Thefollowingisprovidedasanexampleonly.EmailistheofficialformofcommunicationdesignatedbyINSTITUTION.AnyinformationfromOFFICEwillbeprovidedviaemail.Thisincludesmemos,schedulechanges,andanynon-emergencyphonemessages.PleasekeepyourcontactinformationcurrentwithOFFICE.Incaseofanemergencyphonecall,everypossibleeffortwillbemadetocontactyouwhereveryouareoncampus.Therefore,itisimportantthattheofficeknowifyourscheduledclasshasbeencancelledorchangedlocation.FirstDayofClassInterpretersshouldmeettheinstructorswithwhomtheywillbeworkingbyarrivingearlyandintroducingthemselvesonthefirstdayofclass.Theinstructorshouldalreadybeawaretheywillhaveaninterpreterintheirclassthrough[inserthowyouestablishthatinitialintroduction:email,memosphonecalls,etc.].Theinterpretermaywanttoaskiftheinstructorhashadpreviousexperiencewithdeafstudentsandinterpreting.Iftheinstructorhasnot,thestaffmembermaychoosetoexplaintheirrole.Askingifitispossibletogetanextracopyofthetextandallofthehandoutsassociatedwiththeclassshouldbedoneonthefirstdayaswell.Thesecanassistwithpreparatoryworktomakethejobeasier.Also,thestaffmembershouldrequestthattheinstructorgiveadvancenoticeifheorsheplansafieldtriporplansonshowingvideos,films,orslidessothatthestaffmembercanarrangeforappropriateaccommodationsifnecessary.StudentResponsibilities(AttendanceandPunctuality)Studentsareresponsibleforgettingtotheirclassesontime.Studentsshouldbeawarethatinterpretersarerequiredtowait15minutesforclassesupto90minuteslong,and30minutesforclasseslongerthan90minutes.StudentsareresponsiblefornotifyingOFFICEatleastonedaypriortomissingclass(exceptinthecaseofanemergency).FailuretoattendclasswithoutnotifyingOFFICEmayresultinthediscontinuationofservicesafterthethirdoccurrence,makingitnecessaryforthestudenttomakeanappointmentwithSUPERVISORtodiscussreinstatement.Forinterpreterrequestsoutsideofregularlyscheduledclasstimes,studentsaretocompletetheInterpreter/Speech-to-TextInterpreterRequestFormassoonastheyareawareoftheneed.EarlynotificationwillhelpOFFICEmakethenecessaryarrangements.[Note:youmaychoosetoindicatehowmuchadvancenoticeispreferred.]Ifarequestismadewithlessthan______notice,allattemptswillbemadetofindaserviceprovider.However,itmaynotbepossibletoaccommodatetherequest.
