INTRODUCTION:

The present Mayurbhanj District is the last princely state to merge with

Odisha consequent upon execution of an agreement between His Highness Maharaja

Purnachandra Bhanjdeo and Sardar Ballavbhai Patel on 01.01.1949. The name, Mayurbhanj

emerged out the close social and cultural relations between the two medieval ruling

families, i.e. Mayurs and Bhanjas which influenced and enriched the history.

ACCOMODATION

The Office of the Collector, Mayurbhanj is now functioning in an old building

constructed during Ex- Durbar Administration.

Sri Rajesh Pravakar Patil, I.A.S. is officiating as Collector and District

Magistrate, Mayurbhanj w.e.f. 01.08.2012. Prior to him, Sri Naba Kumar Nayak, I.A.S. was

the Collector & District Magistrate of Mayurbhanj.

Sri Suratha Chandra Mallick, O.A.S.-I (SB) is officiating as Addl. District

Magistrate, Mayurbhanj w.e.f. 24.09.2012. Prior to him, Sri Bishnu Charan Swain, O.A.S.-I

(SB) was the Addl. District Magistrate, Mayurbhanj. Sri Deben Kumar Pradhan, O.A.S.-I (SB)

CASE STUDY.

OLR RC- 1/15.

This Revision case was filed u/s 59(1) of the OLA Act by one Rama Chandra

Mohanty, S/o- Late Bhagirathy Mohanty of village- Salagan, PS- Baisinga, Dist. Mayurbhanj

on 25.06.2015 before the Collector, Mayurbhanj challenging the order dt. 26.05.2015 of the

Addl. District Magistrate, Mayurbhanj passed in OLR Appl. Case No. 3/13.

The ADM, Mayurbhanj, in his above order, has set aside the impugned order

dt.21.04.2013 passed by the Sub-Collector, Baripada in OLR case No.20/08 initiated suo

moto u/s 23 of the OLR Act.

The brief history of the case is that the Sub-Collector, Baripada had initiated

suo moto proceeding u/s 23 of the OLR Act on the basis of the enquiry report submitted by

the Welfare Extension Officer, Badasahi Block with a prayer to restore possession of

disputed land infavour of one Purna Chandra Dalapati, O.P. in the present R.C. by evicting

the present Appellant, Sri Ram Chandra Mohanty. In the enquiry report, it was alleged that

Sri Dalapati belongs to scheduled caste and the disputed plot No. 522, Khata No. 243, Area

Ac 0.04dec.in Mouza, Salgaon was possessed by the present petitioner, a member of non-SC

community on the strength of a Registered Exchange Deed from the father of the present

O.P. without obtaining permission from the competent Authority. The Sub-Collector,

Baripada in his order dt. 21.04.2013 held that the possession of the present petitioner over

the disputed land was legal as he had perfected the title through adverse possession.

The Revision case was admitted and L.C.R. called for vide order dt.

28.01.2016. Prior to admission of the case, the OP appeared suomoto through his advocate

on 10.09.2015. On perusal of the Case Record, it is revealed that the petitioner has taken as

many as 8 adjournments between 27.08.15 to 20.10.16 on various grounds. As a matter of

fact, the petitioner who is aggrieved by the order of the lower court should have keen

interest in the case for quick disposal of the same. Ironically, the petitioner is praying

adjournment of the case time and again as if he has no interest in the case or to linger the

case for a longer time for the reason best known to him.

The Collector is advised to dispose of the case as early as possible without

allowing further adjournments.

Enc (Rev) Case No. 4/16.

This case was filed under Sub-Section 2 of Section 12 of the OPLE Act, 1972

by Sri Jagannath Biswal and Sri Pratap Chandra Patra of Vill- Baghamara, P.S.- Kaptipada,

Mayurbhanj challenging the Order dt. 26.04.2016 of the Sub-Collector, Kaptipada passed in

the Enc. Appeal Case No. 18/15 arising out of Enc. Case no. 91/15 disposed by Tahasildar,

Kaptipada.

Brief history of the case is that both the petitioners had unauthorizedly

occupied Govt. land vide Khata No. 546, Plot No. 1565, Ac.0.50dec. Kisam “Unnat Jojana

Jogya”. The Tahasildar, Kaptipada booked encroachment case no. 91/15 against both the

encroachers (petitioners). The petitioners in their showcause before the Tahasildar,

Kaptipada had taken stand that they had been in actual, continuous and undisputed

possession of the Govt. land for more than 30 years and the land is liable to be settled in

their favour without causing eviction. The Tahasildar, Kaptipada rejected their claim and

ordered for their eviction on 30.09.15 under the provisions of the OPLE Act. 1972.

The petitioners preferred Appeal U/S 8 A of the OPLE Act. 1972 before the

Sub-Collector, Kaptipada,vide Enc. Appeal No. 18/15 assailing the Order dt. 30.09.2015 of

the Tahasildar. The Sub-Collector, Kaptipada, after hearing the Appellants, dismissed the

Appeal on 26.04.2016. Hence, this Revision case was filed before the Collector, Mayurbhanj

U/S 12 (2) of the OPLE Act assailing the order dt. 26.04.2016 of the Sub-Collector, Kaptipada.

The Collector, Mayurbhanj, after hearing the counsel for the petitioners as

well as the Govt. pleader for the state, admitted the case on 28.07.16 and called for the LCR.

The case was heard at length on 22.09.2016 and posted to 20.10.16 for

order. It was again adjourned to 10.11.16 for order.

Reviewed the case and perused the papers/ documents available in the Case

Record. I find no unnecessary adjournment has been made and the case was ready for

orders within less then 3month time. The case was filed on 01.07.2016 and heard at length

on 22.09.16 on which date the case was reserved for orders.

The Collector is advised to pronounce the order on the date fixed therefor.

This Appeal was filled on12.01.2011 by one Goura Mohan Raj of village Bholaghati, PS-Morada, District-Mayurbhanj assailing the order dt01.12.2010 passed by the Sub-Collector,Baripada in OLR Case No-01/90. The Appeal was admitted on 20.01.2011 with order to issue notice and call for LCR. Notices were duly served on the Respondents as they appeared through their counsel on 26.05.2011. LCR was also received. Thus ,the case was ready for hearing on merit by that that date. Reviewed the case and perused the entire case record. I am surprised to see that as many as 56 adjournments have been made/ given on various grounds from 26.05.2011 , the date from which the case was ready for hearing, till 25.10.2016, the last date recorded in the case record. Even when the Appellant was absent, the case was not dismissed for default but adjourned suomoto. I find, on the dates i.e. 03.03.2011, 04.12.2012, 05.11.2013, 19.05.2015 and 16.02.2011, the Appellant was absent and the case adjourned without being dismissed for default. This type of practice is not desirable. Justice delayed is justice denied. The ADM is advised to dispose of the OLR Appeal case No 01/2011 without giving further adjournment.

Reg.2 Appeal No 05/2012 This Appeal was filed on 28.04.2012 by Sri Jagannath Behera and 4- others of village, Manada, PS. Bisoi, Dist-Mayurbhanj Challenging the order dt-31.03.2012 of the Sub-Collector, Rairangpur passed in Reg. II Case no-01/2012. The case was admitted on 05.05.2012 with order to issue notice to the Respondent and to call for LCR. The case was ready for hearing on 05.06.2012 as the Respondent caused appearance through his counsel on the said date. LCR was also received by that date. It is surprising to see that although the case is ready for hearing on merit ao 05.06.2012, the matter could not be heard by the ADM till the last date i.e. 25.10.2016 as recorded in the ordersheet. As many as 37 adjournments have been made/ given for various reasons. Reviewed the case and perused the entire case record. Virtually, the case was lingering from 05.06.2012, the date it was ready for hearing, under various plea with plethora of adjournments. This is not desirable. The ADM is advised to finally dispose of the case on the next date i.e. 15.11.2016 without allowing further adjournment.

DISTRIBUTION OF HOUSE SITES TO THE HOMESTEADLESS FAMILIES UNDER THE PROJECT “VASUNDHARA”

Govt. in Revenue Department launched a project namely “VASUNDHARA” in

From the above table, it is seen that the pace of disposal of certificate cases is extremely miserable. Against 911 cases pending for disposal, only 69 cases have been disposed off by different Certificate Courts of the District leaving a balance of 842 cases for disposal involving huge amount of Rs.6102.26lakh. The Collector is directed to impress upon the certificate courts to dispose of certificate cases in priority basis.

The disposal figure shown above spell out the poor and misearable functioning of the certificate courts. The Collector is directed to impress upon the concerned courts to accelerate the pace of disposal during the remaining period of the current fiscal year. Land Revenue Administration Report

The annual land revenue administration report for year 2010-11 has already been sent to Board of Revenue, Odisha, Cuttack vide District Office letter No.487/Rev. dated 11.02.2013 under intimation to R.D.C.(C.D.), Cuttack and Govt. in Revenue & Disaster Management Department, Odisha in the prescribed existing formats of Board. The annual land revenue administration report for the year 2011-12 onwards has not been prepared due to non-receipt of the information from most of the reporting officers. The Collector is

It is seen from the above table, the Collection of Land Revenue for the year,

2014-15 and 2015-16 has crossed the target with recording of 129.32 and 100.52

achievement respectively. This is indeed a satisfactory achievement. However, the

collection of Water rate for the 2014-15 and 2015-16 has fall short of the target misearably

with recording of merely 59.81% and 41.12% achievement respectively. The Collector is

directed to devise his own stategy to gear up the field functionaries to achieve the target

fixed by Govt. during the current financial year.

It is revealed from the above table that the collection under different items is not at all satisfactory. The Collector is instructed to make all out

effort for collection of Arrear Revenue by devising his own strategy.

ANNUAL VERIFICATION OF TAHASIL ACCOUNT:

The annual verification of Tahasil Account for the year, 2015-16 has not been taken up though programme has been fixed. It is stated that due

to non-compilation of saltamami work at R.I., R.S. and Tahasildar level, checking by the Collector, ADM and Sub-Collectors have not been

started. The Collector is directed to give special attention on annual Verification of Tahasil Account and take disciplinary action against the

officer deliberately neglecting to comply the statutory provision in time.

This is being maintained in manuscript forms. The details of 4.25% deposit

against the S.B. Pass Book No.11043409104 has been entered into the cash book and

expenditure made time to time to meet the urgent nature of office expenditure and also

entered in the said cash book. On verification, it is seen that the closing balance as on

20.10.2016 is Rs.12,37,199.00

Odisha Rehabilitation and Resettlement Policy 2006

During the year, 2013, 2015 and 2016, total 114(32+35+47) families of

village, Upper Barakamuda and Bahaghar, Jamunagarh had been shifted from the core

area of Similipal Tiger Reserve and resettled in 3 Rehabilitation Colony, namely,

Asankudar Rehabilitation Colony under Thakurmunda Tahasil, Nabra Rehabilitation

Colony under Udala Tahasil and Manada Rehabilitation Colony under Jashipur Tahasil

respectively. As per NTCA guideline, they had been paid @Rs.10 lakh each under

Option-I. Besides, all 114 displaced families have been provided other facilities like

Ac0.10 dec. of Govt. land, Biju Pucca Ghara, Electrification in MGNREGA scheme and

BPL card to livelihood day to day life.

Forest Settlement

In Mayurbhanj District, 93 Forest Blocks have been notified U/S 4(1) of the

Odisha Forest Act, 1972. The total area of the above no. Of Forest Blocks comes to

AC.50574.52. Only one Forest Block with an area of AC.150.90 has been notified U/S21 of

the O.F. Act 1972. As many as 13no. Of proposals covering an area of AC.4995.27 are

pending with the District Forest Settlement Office for onward submission to Govt. for

issue of notification U/S 21 of the O.F. Act. 1972

In addition to that 13nos. Of proposals covering an area of AC.2030.28 are

pending with Govt. for issue of notification U/S 21 of the O.F. Act 1972.

The Collector is directed to give special attention on this and ensure that

notification in respect of the above proposals are issued as early as possible.

GENERAL

1. The Collector should perform adequate no. of tours and night halts so

that the common people can easily ventilate their grievances. Timely

2. Periodical inspection of the Sub-ordinate offices should be conducted

at regular intervals.

3. Prospective steps should be taken by the Collector for achieving 90%

Collection of Arrear Revenue.

4. Public Grievance Cell should be attended regularly.

5. The Annual Land Revenue Administration Report should be prepared

and submitted to the higher quarters. The Collector should ensure the

accomplishment of this statutory provision without any deviation.

6. Certificate courts should be impressed upon to dispose of 90% of the

pending cases on priority basis.
