May 22, 2001 Advice No. 3023 (U 904 G) Public Utilities Commission of the State of California Subject: Implement Public Purpose Program Tax Surcharge as Separate Line Item on Customers’ Bills Southern California Gas Company (SoCalGas) hereby submits for approval by the California Public Utilities Commission (Commission) revisions to SoCalGas' tariff schedules, applicable throughout its service territory, as shown on Attachment B, to be effective July 1, 2001. Purpose The purpose of this filing is to implement the gas public purpose program (PPP) tax surcharge as a separate line item on customers’ bills in compliance with Ordering Paragraph 3 of Commission Resolution G-3303 (Resolution), dated December 21, 2000. Background Assembly Bill (AB) 1002, dated September 30, 2000, directed the Commission to establish, effective January 1, 2001, a gas tax surcharge to fund public purpose programs such as low-income customer assistance, energy efficiency, and research and development. Commission Resolution G-3303 established public purpose program tax surcharge rates by major customer class effective January 1, 2001 and also requires the implementation of the PPP tax surcharge as a separate line item on customers’ bills by July 1, 2001. The tax surcharge rates, per the Resolution, are embedded in SoCalGas rates as of January 1, 2001. This advice letter removes the PPP tax surcharge rates, as authorized in Appendix 1 of the Resolution, from the applicable SoCalGas energy rates and implements the tax surcharge rates as line items on customers’ bills. SoCalGas requests Commission approval of the revised tariff sheets and reduced energy rates in Attachment B, resulting from the unbundling of the PPP tax surcharge.

The Resolution states “We emphasize that the surcharge rates established here are to be used by the utilities only for the purpose of quarterly payments on behalf of their customers to the Board [State Board of Equalization]. The surcharge rates do not change the rates of utility customers in California." Accordingly, SoCalGas customers will not see a change in their total monthly bills as a result of the PPP tax surcharge line item except for the case of exempt customers. AB 1002 exempts certain customers1 from the PPP surcharge. These customers will not see the PPP surcharge line item on their bills. SoCalGas has utilized SDG&E’s experience with constitutionally exempt customers in SDG&E’s billing the electric “State Surcharge Tax” for the California Energy Commission. This experience was utilized to identify the constitutionally exempt customers for SoCalGas. Information Schedule No. G-PPPS, included in Attachment B, is a new rate schedule that lists the PPP tax surcharge rates. The rates are listed for California Alternate Rates for Energy (CARE) and Non-CARE customers by major customer class. Schedule No. G-PPPS replaces the “PPP Surcharge Rates” table in Part I, General Service Information, of SoCalGas’ Preliminary Statement, requested in SoCalGas Advice No. 3013 of April 12, 2001. This new rate schedule is the basis for the rates on the new PPP tax surcharge line item on customers’ bills. The Non-CARE Customer rates in Schedule No. G-PPPS reflect necessary adjustments to the tax surcharge rates in Resolution G-3303, but the rates in Resolution G-3303 are used to calculate the surcharge payments to the BOE. The Non-CARE Customer rates are adjusted to incorporate the CARE balancing account amortization. This adjustment was made to the PPP tax surcharge line item since it replaces the CARE Fund Surcharge line item, which included the CARE balancing account amortization. The Natural Gas Vehicle (NGV) customer class has also been added to Schedule No. G-PPPS to be consistent with the rate allocation prior to July 1, 2001. The NGV customer class was not included in Appendix 1 of Resolution G-3303 due to an oversight in SoCalGas’ submittal to the Commission. These customers only pay for the CARE program.

Assembly Bill 1002 regarding consumers of natural gas who are exempt from the tax surcharge. Section 896 states “Consumption means the use or employment of natural gas. Consumption does not include the use or employment of natural gas to generate power for sale or use of gas for enhanced oil recovery, natural gas utilized in cogeneration technology projects to produce electricity, or natural gas that is produced in California and transported on a proprietary pipeline. Consumption does not include the consumption of natural gas which this state is prohibited from taxing under the United States Constitution or the California Constitution.” Section 897 states “Nothing in this article impairs the rights and obligations of parties to contracts approved by the Commission, as the rights and obligations were interpreted as of January 1, 1998.” Section 898 is in reference to a municipality, district, or public agency but also references Section 890. Subdivision (e) of Section 890 states in part “The Commission shall determine the total volume of retail natural gas transported within the service territory of a utility gas provider, that is not subject to exemption pursuant to Section 896, for the purpose of establishing the surcharge rate.”

Sample residential customer bills, depicting the changes to the computer-generated information contained on the front of the bills, are included herein as Attachment C. The sample residential bills reflect the PPP tax surcharge line item and the bill message. Also included in Attachment C are examples of the bill addition for noncore commercial/industrial customers. Revisions to both the residential bill (General Service Form 41-K) and the noncore bill (Commercial/Industrial Service Form 77-2B) have been made to the back of the bill to define the Public Purpose Surcharge as shown on Attachment B. The bill message that follows will appear on bills distributed in July for the applicable customers:
Effective July 1, 2001, the Public Purpose Program charges once included in your rate will now be shown separately on your bill. Please see enclosed bill insert for details.
Findings of Fact 28 of the Resolution states:
After January 1, 2001, and soon after the implementation of the surcharge for 2001, we will open a Rulemaking proceeding to address the broader aspects of the legislation, such as the unbundling of public purpose program costs from utility rates, the development and implementation of public purpose programs pursuant to Section 900, the identification of customers exempt from the bill, the true up of rates adopted here with the actual utility costs and revenues, the disposition of existing as well as any new balancing accounts established pursuant to this order, and other matters as applicable.
SoCalGas strongly recommends that the Commission open the above referenced Rulemaking proceeding at its earliest convenience to address, in particular, the following items:
• Procedures necessary for utilities to obtain needed state tax funds in order to continue implementing the PPP programs
• Unbundling of public purpose program costs from utility rates • Identification of customers exempt from the bill • True up of rates adopted in the Resolution with the actual utility costs and
revenues Included with this filing are a Summary of Revenue Changes and a Summary of Present and Proposed Rates (Attachment D). Protest Anyone may protest this advice letter to the California Public Utilities Commission. The protest must state the grounds upon which it is based, including such items as financial and service impact, and should be submitted expeditiously. The protest must be made in writing and received within 20 days of the date this advice letter was filed with the Commission. There is no restriction on who may file a protest. 2. Class Average Long Run Marginal Cost (LRMC) Floor Rates
a. D.98-01-040, Finding of Fact No. 5, allows SoCalGas the option to discount core transportation rates down to a LRMC floor rate; however, SoCalGas may not discount the cost of gas. For this program, the LRMC floor rate includes the following components: customer related, medium-pressure distribution, high-pressure distribution, transmission, seasonal storage, load balancing, company use transmission, unaccounted for gas, and interstate pipeline demand charges. In addition to these components, the full transportation rate includes the following components: non-marginal costs in base margin, ITCS, PITCO/POPCO transition costs, core averaging costs, and other exclusion costs.
b. The following table lists the full LRMC transportation rates authorized by D.97-04-082, and the class average LRMC floor rates authorized by D.98-01-040. LRMC Floor Rates were updated with new values established in D.00-04-060 and SoCalGas Advice No. 2982, effective January 1, 2001. Full Transportation Rates are updated with new values established in D.00-04-060, Resolution G-3303 and SoCalGas Advice No. 3023, effective July 1, 2001. The floor rates represent the lowest possible average annual rate by class under which SoCalGas can serve gas. These rates represent a starting point for the program and, pursuant to Commission order, may be modified in future rate proceedings.

Base volumes remain unchanged as long as the customer remains on this Schedule.
2. Baseline Rates: Baseline Rates are applicable only to specific volumes of residential usage.
3. Baseline Usage: The following quantities of gas used in individually metered residences not in a multi-family complex are to be billed at the Baseline rates. Usage in excess of applicable Baseline allowances will be billed at the Non-Baseline rates. Non-baseline usage in excess of base year non-baseline volumes will receive the SummerSaver credit for the months of May to October.

SPECIAL CONDITIONS

2. Customer may receive service under this schedule (a) separately, or (b) in combination with another rate schedule(s) through a single meter installation. Where service is rendered under (b), a separate monthly customer charge shall be applicable for service under each schedule unless otherwise stated.
3. In the event of curtailment, customers under this schedule will be curtailed in accordance with Rule No. 23, Continuity of Service and Interruption of Delivery.
4. Customers served hereunder may elect to be reclassified as noncore. Eligibility requirements are defined in Rule No. 1. Customers electing noncore service status must sign the required natural gas service agreement and have electronic meter reading equipment installed at the customers expense as a condition of noncore service.
5. Customer receiving service under this rate schedule may elect to aggregate their gas quantities to receive service under Schedule No. GT-10.
6. The rate savings afforded customers under Schedule No. GN-10V shall only apply to those customers served under this schedule and located within the City of Vernon consistent with the SoCalGas-Vernon Stipulation and Settlement Agreement approved by D. 96-09-104. In addition, the Utility may negotiate rates other than those set forth herein for those customers located in the City of Vernon and served under this rate schedule, pursuant to the Agreement and D.96-09-104.

For customers with less than twelve months of historical usage, the customer charge shall be determined on a pro rata basis using the months for which usage is available.
The term "space heating only" applies to customers who are using gas primarily for space heating for human comfort as determined by survey or under the presumption that customers who use less than 11 therms per month during each of the regular billing periods ending in August and September are using gas primarily for space heating for human comfort. Except for closing bills or at the time of a rate increase, usage will be accumulated to at least 20 therms before billing.

General

2. Customers must receive service under this schedule separately from their other non-qualifying usage requirements. Any additional service and measurement related facilities deemed necessary by the Utility to separately measure service hereunder shall be installed, owned, and operated by the Utility and the installation of such facilities shall be at the customer's expense.
3. In the event of curtailment, customers under this schedule will be curtailed in accordance with Rule No. 23, Continuity of Service and Interruption of Delivery .
4. In the event customers make any material change, either in the amount or character of their gas equipment, written notice to the Utility must be made in accordance with Rule No. 29, Change of Customer's Apparatus or Equipment .

Applicable to the transportation of customer-owned natural gas for qualifying gas engine water pumping uses, as defined in Rule No. 1, at each Facility classified in Rule No. 23 as Priority 1 and 2A who (1) elect to purchase natural gas from ESPs in accordance with Rule No. 32; or (2) meet a minimum transportation requirement of 250,000 therms at the Facility and elect transportation-only service hereunder. Service under this schedule is optional for all Priority 1 qualifying usage. For facilities classified as Priority 2A, service under this schedule is optional subject to the contract terms set forth herein. Current noncore customers with usage that would otherwise qualify for service under this schedule may elect by written notice to SoCalGas to be served hereunder for such usage. In such an event the customer shall become a core customer for such usage and any grandfathered noncore status the customer may have shall terminate. In the event a Priority 2A or noncore customer elects service under this schedule, such election shall apply to all of the customers qualifying usage at the facility.
Pursuant to Resolution No. G-3304, effective December 21, 2000, this rate schedule is suspended to transfers of customer facilities taking Noncore Service, as defined in Rule 1, that are not eligible for Priority 1 classification as set forth in Rule 23, except for those customer facilities where their Gas Service Provider Is No Longer Offering Gas Service In California as defined in Rule 1.

SPECIAL CONDITIONS
1. Definitions of the principal terms used in this schedule are contained in Rule No. 1.
2. As a condition precedent to service under this schedule, an executed Master Services Contract, Schedule A, Intrastate Transmission Service (Form Nos. 6597 and 6597-1) is required. All contracts, rates and conditions are subject to revision and modification as a result of Commission order.
3. In the event of curtailment, the Utility shall provide service to Customer in accordance with the provisions of Rule No. 23.
4. The transportation imbalance will be calculated by aggregating the confirmed transportation deliveries for the customer with the confirmed transportation deliveries for customers taking service under Schedule No. GT-SD less the actual usage recorded by the Utility at the SDG&E system receipt points. All other terms and conditions of Rule No. 30 and Schedule No. G-IMB shall apply to the transportation of customer-owned gas under this schedule.

GENERAL
The public purpose program (PPP) surcharge is a tax shown on a customer's bill as a separate line item. The surcharge is authorized to recover the cost of public purpose programs such as low-income assistance, energy efficiency, and public interest research and development. The Utility remits surcharge payments quarterly to the State Board of Equalization (BOE) by the last day of the month following a calendar quarter. The BOE deposits the payments in the Gas Consumption Surcharge Fund (Fund) with the State Treasurer. Utility public purpose programs are financed through monies appropriated to the Utility from the Fund by the Commission.
The Commission will establish tax surcharge rates annually.

** AB 1002 of September 30, 2000 authorized the Commission to establish a gas tax surcharge. Resolution G-3303 established public purpose program tax surcharge rates effective January 1, 2001. The tax surcharge rates were removed from utility energy rates and added as line items to applicable billings effective July 1, 2001.
The Non-CARE Customer rates reflect necessary adjustments to the tax surcharge rates in Resolution G-3303, but the rates in Resolution G-3303 (1.810 versus 1.405, 2.400 versus 1.998, 0.660 versus 0.258, 1.020 versus 0.613, and 0.600 versus 0.194) are used to calculate the surcharge payments to the BOE. The Non-CARE Customer rates are adjusted to incorporate the CARE balancing account amortization. This adjustment was made to the PPP tax surcharge line item since it replaces the CARE Fund Surcharge line item, which included the CARE balancing account amortization.
The Natural Gas Vehicle (NGV) customer class has been added to Schedule No. G-PPPS to be consistent with the rate allocation prior to July 1, 2001. The NGV customer class was not included in Appendix 1 of Resolution G-3303 due to an oversight in SoCalGas' submittal to the Commission. These customers only pay for the CARE program.

PUBLIC UTILITIES COMMISSION NOTICE "Should you question the amount of this bill, please request an explanation from the Company by calling the telephone number on the front of this bill. If you thereafter believe you have been billed incorrectly, the amount of the bill should be deposited with the California Public Utilities Commission, 505 Van Ness Avenue, Room 2003 San Francisco, California, 94102, e-mail: [email protected] to avoid discontinuance of service. Make remittance payable to California Public Utilities Commission and attach the bill and a statement supporting your belief that the bill is not correct. The Commission will review the basis of the billed amount and make disbursement in accordance with its finding. However, the Commission will not accept deposits when it appears that the dispute is over matters such as quality of service, level of rates, pending applications for rate increases, etc., which do not relate directly to the question of the accuracy of the bill:
If you do not deposit the disputed bill amount with the Commission within 15 days after we notify you of your right to do so, we may discontinue your service for non-payment.
INFORMATION RELATED TO DEPOSITS Amount of Deposit The amount of the deposit required to establish or re-establish credit is twice the estimated average periodic bill.
Return of Deposit/Interest on Deposit This deposit, together with any interest due, less the amount of any unpaid bills, will normally be refunded either on discontinuance of service or after the deposit has been held for twelve (12) consecutive months, during which time continuous gas service has been received and all bills for such service have been paid in accordance with the rules in effect and filed with the Public Utilities Commission of the State of California. No interest will be paid if service is temporarily or permanently discontinued for non-payment of bills.
EXPLANATION OF BILLING TERMS Public Purpose Programs Surcharge A charge to fund Public Purpose Programs such as California Alternate Rates for Energy (CARE), Direct Assistance Program (DAP), energy efficiency and research and development. Each customer’s surcharge is determined by the number of gas therms used. State Regulatory Fee A fee used to fund the California Public Utilities Commission. Each customer's fee is determined by the number of gas therms used. Service Establishment Charge Applicable to all classes of customers except Utility Electric Generation and Wholesale customers, a charge to establish or re-establish gas service each time an account is opened. Municipal Surcharge A mandated state fee which compensates local governments for the private use of public lands during the transportation of gas. Charges are based on the value of the gas and current franchise agreements. Excluded from this fee is transported gas subject to existing franchise agreements. WACOG The monthly WACOG is the Weighted Average Cost of Gas purchased by SoCalGas on behalf of its gas procurement customers in the current month. Due Date The past due date indicated on this bill is for new charges, it does not stop collection activity on an unpaid previous balance. Utility Users" Tax A user tax charged by some cities and counties, based on the amount of the current monthly bill. The Gas Company is required to collect this tax for the cities and counties.
