Sh. Ashwani Kumar, Science Master, GHS Sotha (Kaithal) was charge sheeted under

Rule, 7 of Haryana Civil Services (P&A) Rule 1987 vide order no. 14/51-11 dated 23.11.2011.

He submitted his reply to the said charge sheet. After due consideration, it was not found

satisfactory therefore the competent authority appointed Sh. I.M. Khungar, I.A.S. Retd. as

inquiry officer vide order no. 14/51/2011- HRM-I (2) dated 23.12.2011 to inquire into the

charges leveled against him. After completion of process, the inquiry officer submitted his

inquiry report on 14.03.2012.After going through the record and inquiry report submitted by Inquiry Officer, it was

found that the charges leveled against Sh. Ashwani Kumar, Science Master, stand proved. The

undersigned is provisionally of the view that his services are no longer required in the

department and he should be dismissed from service. However, before taking such action, he

would like to offer an opportunity of show cause notice as to why the proposed action should

not be taken against him. Any representation, which he would like to make in this connection,

will be duly considered by the undersigned. Such a representation, if any, should be submitted

to the undersigned in writing within 15 days. He submitted his reply and requested to grant

him personal hearing. Accordingly, opportunity of hearing was granted to him and he was

heard on 12.06.2011, he stated that on that day, he was suffering from fever and was advised

to take rest. But in view of election duty assigned to him, he did not request to exempt his duty

at the belated stage. He also stated that he had not earlier performed election duty therefore

some mistake was committed at the time of preparation of final result. He admitted that some

lapses took on his part but pleaded it was not intentional and all this happened due to first

time performing election duty as well as he was suffering from high fever.

I have considered the charge sheet, reply submitted by the delinquent, the report of

Inquiry officer and submissions made by delinquent during hearing. Keeping in view all the

facts brought on record, a penalty of stoppage of three increments with cumulative effect is

inflicted upon delinquent.
