Suit to Compel Harry Garrison to Surrender Funds A question of importance to organiza- tion having subordinate bodies by Chief Justice Clabaugh yester- day in the case of the Army and Navy Union of the United States against the Regular Army and Navy Union of the United He decided that bylaws of organisations must always give way to the laws of the land and that bylaws are of binding force between the mem bers until they are called in question in which case the courts determine the va- lidity of these bylaws The complaint was that the Regular Army and Navy Union was incorporated- by act ef Congress and that it had subor- dinate branches called garrisons who received their charters from the national body and were subject to its constitu- tion and bylaws It is declared that the William F Barry Garrison was one of the subordinate garrisons and that on September 27 1909 at a special meeting K motion was adopted to secede from the Army and Navy Union and Join the Reg ular Army and Navy Union At this meet ing it Is claimed the Barry Garrison mem bers were into the new organi- zation thereby ceasing to be members- of the other garrison The complainant contends it was the duty of these members to turn over nil the money of their garrison to the Army and Navy Union which they however declined to de The Army anti Navy Union In consequence asked the court that the Regular Army and Navy Union bar restrained and that the Barry Garri- son be required to turn over its funds to the Army and Navy Union Chief Justice Clabaugh stated that a higher body cannot confiscate the prop erty of one A question of importance to organiza-tion having subordinate bodies

by Chief Justice Clabaugh yester-day in the case of the Army and NavyUnion of the United States against theRegular Army and Navy Union of theUnited He decided that bylawsof organisations must always give wayto the laws of the land and that bylawsare of binding force between the members until they are called in question inwhich case the courts determine the va-lidity of these bylaws

The complaint was that the RegularArmy and Navy Union was incorporated-by act ef Congress and that it had subor-dinate branches called garrisons whoreceived their charters from the nationalbody and were subject to its constitu-tion and bylaws It is declared that theWilliam F Barry Garrison was one ofthe subordinate garrisons and that onSeptember 27 1909 at a special meeting Kmotion was adopted to secede from theArmy and Navy Union and Join the Regular Army and Navy Union At this meeting it Is claimed the Barry Garrison members were into the new organi-zation thereby ceasing to be members-of the other garrison

The complainant contends it was theduty of these members to turn over nilthe money of their garrison to the Armyand Navy Union which they howeverdeclined to de The Army anti NavyUnion In consequence asked the courtthat the Regular Army and Navy Unionbar restrained and that the Barry Garri-son be required to turn over its fundsto the Army and Navy Union
