The economic downturn of the last 12-18months has left many businesses andhomeowners struggling to stay afloat. Forthose with real estate holdings, homesales have largely slumped across theUnited States, where an abundance of un-sold properties continue to dot the land-scape.

In an effort to revitalize the housing indus-try, The Housing and Economic RecoveryAct of 2008 established a tax credit forfirst-time homebuyers that can be worthup to $7,500. The tax credit has sincebeen increased and extended through theThe Worker, Homeownership and Busi-ness Assistance Act of 2009, signed intolaw on November 6, 2009. It extended andexpands the first-time homebuyer creditallowed by previous acts.

According to the Internal Revenue Service(IRS), the new Act extends the deadlinefor qualifying home purchases from No-vember 30, 2009, to April 30, 2010. Addi-tionally, if a buyer enters into a bindingcontract by April 30, 2010, the buyer hasuntil June 30, 2010, to settle on the pur-chase. The maximum credit amount re-mains at $8,000 for a first-time homebuyer-- that is, a buyer who has not owned aprimary residence during the three yearsup to the date of purchase.

The Act also extends to homeowners whohave been in a primary residence for fiveyears or more and are looking to purchasea different primary residence. This is a"long-time resident" credit of up to $6,500.To qualify this way, a buyer must haveowned and used the same home as aprincipal or primary residence for at leastfive consecutive years of the eight-yearperiod ending on the date of purchase of anew home as a primary residence.

The new law also raises the income limitsfor people who purchase homes after No-vember 6. The full credit will be availableto taxpayers with modified adjusted grossincomes (MAGI) up to $125,000, or$225,000 for joint filers. Those with MAGIbetween $125,000 and $145,000, or$225,000 and $245,000 for joint filers, areeligible for a reduced credit. Those withhigher incomes do not qualify.

For those who have been on the fenceabout purchasing a home, these tax cred-its could be the incentive needed. Buyerswith qualifying purchases in 2010 have theoption of claiming the credit on either their2009 or 2010 tax returns.
