will be held responsible for loss of a potential opportunity to tender due to possible incorrect categorising of requirements.

2. Requests are categorised separately for tenders with estimated values of less than R75 000 and more than R75 000.

4.Tender documents are generally available in English only.5. The addresses at which tender documents may be obtained and to which tenders should be posted, appear in

Annexure 1.5.1 The address where a document is available from and where it must be submitted to may differ.5.2 Tenderers should read the Conditions of Tender issued by the different tender boards. Mostly tenders that are

submitted after the closing time will not be allowed for consideration.6. The financial category for construction related supplies and services are the following:

A: To R300 000B: R300 000 to R2 000 000C: R2 000 000 to R6 000 000D: Above R6 000 000

6.1 Where security is required particulars thereof are indicated in the tender documents. However, security is mostlynot required for services with an estimated value of less than R100 000.

7. Please note that all documents issued by the Department of Public Works will be sold as follows:

• R50,00 per set for all services with a pre-estimated value from above R100 000 to R300 000.

• R100,00 per set for all services with a pre-estimated value above R300 000 to R2 000 000.

• R200,00 per set for all services with a pre-estimated value above R2 000 000.These amounts will not be refunded. Only cash or postal orders will be accepted.

7.1 No documents will be exchanged.8. Tenders must be on the official tender forms which must be filled in and completed in all respects.9. Tenders must be submitted in sealed envelopes.10. Separate envelopes must be used for each tender invitation.11. The address, tender number and closing date must appear on the front of the envelope.12. The name and address of the tenderer must appear on the back of the envelope only.

Drilling and Testing of Boreholes to Supply Water to the following four locations at the De Hoop Nature Reserve.

—Sandhoogte Service Hub.

—Bloukrans Overnight Facility.

—Mosselbank Overnight Facility.

—Hamerkop Overnight Facility.

Introduction:

CapeNature requires potable water at the above-named stations on the Whale Trial. A borehole capable of yielding at least9 000 e /d is required. Under a separate project drilling positions were selected. However it remains the responsibility of theappointed consultant to approve and/or verify the selected positions. Tenders are hereby invited for the work specified below.

Project Specifications:

The following tasks need to be undertaken on behalf of CapeNature:

—Obtain tenders from suitable contractors: Tender documents need to be prepared submitted and adjudicated for thedrilling and testing of boreholes at the Nature Reserve.

—Resistively survey: A geophysical survey may be required. Provision must be made for undertaking two geophysical traverses to identify the best drilling position.

—Drilling of borehole(s): At least one borehole is to be drilled at each location. If the first borehole is unsuccessful then asecond borehole will be drilled. The boreholes are to be fitted with sufficient PVC casing and screens to ensure that the boreholes remain open. For budgeting purposes assumed the exploration boreholes will have to be drilled to a depth of 150 m.Water samples are to be collected at the end of drilling to assess the portability of the water.

—Borehole testing: Step draw down tests are to be undertaken on all successful boreholes. Testing will be aimed at ensuring the borehole can yield the required amount of water and checking that the borehole is not at risk of inducing saline intrusion. The portability of the water must be verified on conclusion of the test.

On completion of the proposed work the findings of the exploratory work are to be documented in a short report and presented to CapeNature.

Scheduling:

The proposed work is to be completed within 2 months of the project being awarded to the successful tender.

NATIONAL EMPOWERMENT FUND

REQUESTS FOR PROPOSALS: LEGAL COUNSEL

The National Empowerment Fund Act No. 105 of 1998, established the National Empowerment Fund Trust, for the purposes of promoting and facilitating economic equality and transformation. The NEF is a Development Finance Institution(DFI) that operates under the umbrella of the Department of Trade and Industry (the dti).

The NEF is a catalyst of Broad-Based Black Economic Empowerment in South Africa. We enable, develop, promote andimplement innovative investment and transformation solutions to advance sustainable Black Economic participation.

The NEF would hereby like to call for proposals from equalified attorneys to provide general and fund management legalcounsel services in support of the organisation’s function.

Delivery of these services will be divided into two categories whereby appointment will be assigned to either one of the twopanels of attorneys, one providing general legal counsel and the other, fund management legal counsel. The general legal counsel panel will be constituted by attorneys providing services in all considered areas of law while the fund management legalcounsel panel will comprise attorneys providing specialist services in the areas of contract, commercial and insolvency law.

The appointments will be subject to a contract period of two years with an option for a one-year contract extension at theNEF’s discretion. It should be further noted that it is at the sole discretion of the NEF to review any contract of appointment onan annual basis, if deemed necessary. The contract is expected to commence with effect from 1 September 2006.
