Reserved Powers

The Constitution (10th Amendment) grants to the states all those powers“not delegated to the United States by the Constitution, nor prohibited by it to the states.”

This is a “check” on the “elastic clause.”

4-2Relations Among the

States

1) Full faith and credit – each state must recognize the laws and legal proceedings of another state.

2) Privileges and immunities – one state may not discriminate unreasonably against citizens of another state.

3) Extradition – fugitives must be returned to the state they have fled from.

4) Interstate compacts – states may enter into agreements with one another.

5) Lawsuits – states may sue one another.
