California GATE History• 1961-Mentally Gifted Minor: 98th percentile on standardized
intellectual test• 1980-GATE was established (AB 1040):Districts can set own
criteria, but criteria should include giftedness in the following areas: academic, visual and performing arts, leadership, and creativity

Office of Civil Rights (OCR) Background
2011 OCR Review
• Initiated to determine whether EGUSD provided African American students equal educational opportunities to participate in:
*College and Career Ready Programs*GATE*AP/Honors Courses
2014 OCR FindingsEGUSD policies/procedures for identifying GATE students and for enrolling students into middle and high school Honors/AP courses have an unlawful, disparate impact on African American students.
*OCR did state it was not intentional and was not done so on the basis of race
Agreement with OCR• “Implement and monitor processes and practices to increase
the diversity of students identified as GATE and/or enrolled in middle school honors classes and in high school honors and AP classes.”
