If this is a heruing to consider an appeal from an automatic fine, the Filing Officer has imposed a fine on you for your failure to file a campaign treasurer's report on the designated due date and, by filing an appeal, you have asked the Commission to consider either (1) that the report was in fact timely filed; or (2) that there were unusual circumstances that excused the failure to file the report timely. You are required to prove your case.. If the Commission finds that the report was filed timely or that there were unusual circumstances that excused the failure, it may waive the fine, in whole or in part The Commission may reduce a fine after considering the factors in Section 106.265, Florida Statutes If the Commission finds that the report was not timely filed and there we1e no unusual circumstances, the fine will be upheld

Derek Hankerson is appealing the fine claiming that he had several incidents occur that were outside of his control According to Mr. Hankerson, he withdrew from his campaign due to his 83 year old mother being diagnosed with cancer and having various treatments and surgery He also notes that he was in an accident in early October Mr Hankerson states that he moved to care for his mother and was not able to acquire his mail. I am writing to appeal to the fine of $1,250 00 for my late filing of a campaign treasurer report that was due on October 10, 2014, and was submitted on October 26
If you check my Department of State records you will find this is consistent with the letter I sent to the elections office in November resigning from the state senate races due to an aging mother
I am writing to appeal, because prior to the filing date of October 10, I learned my 83 year old mother had cancer, had to have a portion of her colon removed as a result of a cancerous tumor, and has had to go through chemotherapy
During the course of my filing and potential run in the Special Election for District 6 and while thinking about my mother I accidently type in that I'd lend myself $5,000 when it should have been $500.00 I changed the figure before the end of that same day of the filing and was charged $1,250.00 for that filing.
Granted, I too pick up and move from my home to my mother's home to become a care giver for my mother as a result of her operation and care which put me behind on everything and to include acquiring my mail!
Additionally, I too was in an accident in early October that caused me to have cramps in my neck and it prevented me from writing, working on a computer let alone filing a campaign report!
I have since closed all campaign account and trying to get my many issues resolved now that I am temporarily (back) at home in St Augustine, Florida for a few weeks before heading back to my mother home as a caregiver
Therefore, I am asking to have this fine dropped or dismissed due to incidents outside of my control and care for an aging mother, which is consistent with my previous comments, letters, and withdrawal from the electoral process!

Vehicle 1, a Silver Volkswagen Jetta bearing Florida tag 471-IUW driven by Derek Hankerson was traveling east on County Road 207 A. Hankerson turned Northbound on State Road 207 which is currently being paved. Hankerson failed to navigate to the correct Jane of travel due to the lack of traffic signs and barriers ..
Hankerson continued to travel in the construction lane causing his vehicle to.strike the uneven pavement resulting in all 4 of the tires to blow out and his windshield to crack .. Hankerson was able to pull the vehicle into the correct lane of travel and pull off to the shoulder.. ·
Hankerson called AAA prior to my arrival to arrange for a tow. Johnson's towing arrived on scene and towed the vehicle to St. Augustine Volkswagen per Hankerson's request.
Photog1 aphs of the vehicle were taken and will be uploaded to the Putnam County Sheriff's Server
Contact was made with the Foreman of the construction company who was advised of the situation in this area and was asked to put the proper barriers or signage up to warn drivers and prevent further incidents
