MOTION FOR LEAVE TO SUBSTITUTE AND REPLACE

EXHIBIT "U"

EP Energy E&P Company, L.P. ("EPE"), acting by and through its attorneys,

MacDonald & Miller Mineral Legal Services, PLLC, and pursuant to Utah Admin. Code

Rule R641-l 05-300, hereby requests the Board of Oil, Gas and Mining (the "Board") for

leave to substitute and replace Exhibit "U" filed as part of EPE's Exhibits on September

26, 2016, with the Replacement Exhibit "U" attached hereto and by this reference

incorporated herein. In connection with preparation for the hearing scheduled this

Wednesday, October 26, 2016, counsel for EPE discovered he had filed an old version of

Exhibit "U" with the Board rather than the most current version supplied to him by EPE.

Page 1 of Exhibit "U" is unchanged but the version on tile with the Board omits

information concerning the Lake Fork Ranch 4-13B4 Well (referred to on Page 1)

necessary for a full and complete analysis of costs. Upon discovery of this omission

today, counsel for EPE contacted counsel for the Division by telephone for permission to

substitute, which counsel for the Division provisionally granted subject to the Division's

engineer having sufficient time to review and analyze the replacement exhibit's content.

Exhibits filed later than 30 days before the scheduled hearing date may be allowed

by the Board upon good cause shown (see Utah Admin. Code. Rule R64 1-105-500). As

indicated above, and subj ect to the proviso, the Division should not be unduly prejudiced

by granting the requested leave to substitute.

As a consequence, and for the reasons outlined above, EPE respectfully request

this Motion for Leave be granted and the attached Replacement Exhibit "U" be

substituted for and reply the original of said Exhibit currently on file in this Cause. A

proposed Order Granting Leave is submitted herewith.
