     AUTHORIZES THE SUPERVISOR TO EXECUTE PROFESSIONAL SERVICES

     AGREEMENT WITH EAST END ACCOUNTING SERVICES CORP.

    Councilman Hubbard offered the following resolution,

    which was seconded by Councilwoman Giglio

    WHEREAS, the Town Board of the Town of Riverhead requires the services ofan accounting service to assist the Town with internal audits; and

    WHEREAS, East End Accounting Services Corporation will provide on-goinginternal audit contract services on a per diem basis for the Town of Riverhead; and

    WHEREAS, budget and cost estimates will be provided by East End AccountingServices Corporation and approved by Town management prior to commencement ofengagement; and

    WHEREAS, East End Accounting Services Corporation has agreed to the terms

    and provisions in the Professional Services Agreement; and

    NOW THEREFORE BE IT RESOLVED, that the Town Board authorizes theSupervisor to execute the Professional Services Agreement with East End AccountingServices Corporation, in substantially the form annexed hereto, and be it further;

    RESOLVED, that all Town Hall Departments may review and obtain a copy ofthis resolution from the electronic storage device and, if needed, a certified copy ofsame may be obtained from the Office of the Town Clerk.

    CONSULTANT/PROFESSIONAL SERVICES AGREEMENT

    This Agreement made the of , 2016 between the TOWN OF RIVERHEAD, amunicipal corporation organized and existing under the laws of New York, with its office locatedat 200 Howell Avenue, Riverhead, New York 11901 (hereinafter referred to as the “Town”) and

    East End Accounting Services Corp., a corporation existing under the laws of the State of NewYork with a principal place of business at 320 Noyac Road, Southampton, NY 11968(hereinafter referred to as “Consultant“).

    In consideration of the mutual promises herein contained, Town of Riverhead and Consultantagree as follows:

    1. SCOPE OF SERVICESDuring the term of this Agreement, Consultant shall furnish the services related to internal audit(independent, objective assurance and consulting activity designed to add value and improve theTown’s operations and assist the Town accomplish its objectives by bringing a systematic,

    disciplined approach to evaluate and improve the effectiveness of risk management, control, andgovernance processes). All services shall be provided as an independent contractor and not as anemployee of Town. Consultant will provide on-going internal audit contract services on a perdiem basis for the Town of Riverhead. Internal audit assignments will be determined andassigned by Town management through the Town Supervisor and Audit Committee. Budget andcost estimates will be provided by East End Accounting Services Corporation and approved bytown management prior to commencement of engagement. It is agreed that all work will be performed by Charlene Kagel, CPA and utilize (billing for) team staff only if needed andapproved in advance by the Town Supervisor.

    2. TERM OF AGREEMENTAgreement shall commence upon the execution of same and terminate upon completion. It isagreed and understood that time is of the essence with respect to the internal audit of the Town’sfinances and such other policies and procedures related to such matters employment benefits, procurement, investment… Consultant and Town estimate that all services related to the internalaudit shall be completed on or before December 31, 2016.

    3. PAYMENTFor these services Town of Riverhead will pay Consultant based upon the fee schedule set forth below. The Town will pay Consultant the following fees for the services described in paragraphone above:

    Charlene Kagel, CPA, Company President $135 hourlySenior Accounting Consultant $85 hourlyAudit Manager $105 hourlyAccounting Associate $45 hourly

     Note, as set forth above all internal audit assignments will be determined and assigned by Townmanagement through the Town Supervisor and Audit Committee. Budget and cost estimates will be provided by East End Accounting Services Corporation and approved by Town management

    evidenced by letter of engagement identifying the services and executed by the Supervisor priorto commencement of said services. It is agreed additional staff will only utilized if needed, andsubject to approval, letter of engagement executed by the Supervisor, for additional staffing inadvance of commencement of such work. The Town shall require the submission ofdocumentation, including time records, identifying the services provided and individual

     performing the identified tasks. The Town shall not have any liability for any other expenses orcosts incurred by Consultant except for the services identified in paragraph one. It is agreed andunderstood that this agreement for payment of services does not include reimbursement for anyout of pocket expenses and the Town shall not have any liability related to same.

    4. RIGHTS TO DOCUMENTS OR DATAAll information and data, regardless of form, generated in the performance of, or delivered underthis Agreement, as well as any information provided to Consultant by Town, shall be and remainthe sole property of Town. Consultant shall keep all such information and data in confidenceand not disclose or use it for any purpose other than in performing this Agreement, except withTown’s prior written approval. In the event that the legal right in any data and information

    generated in the performance of this Agreement does not vest in Town by law, Consultant herebyagrees and assigns to Town such legal rights in all such data and information. Final paymentshall not be due hereunder until after receipt by Town of such complete document and data file,or a certification that there is no such information created by the services performed under thisAgreement, and receipt of all information and data which is the property of Town. Theseobligations shall survive the termination of this Agreement.

    5. PUBLICITYConsultant shall not; without the prior written consent of Town, in any manner advertise or publish the fact that Town has entered into this Agreement with Consultant. Consultant shallnot, without the prior written consent of the Town, provide, release or make available forinspection any documents, data, written material of any kind without the prior written consent ofat least three members of the Town board or by resolution of the Town Board.

    6. ASSIGNMENT AND SUBCONTRACTINGPerformance of any part of this Agreement may not be subcontracted nor assigned without, ineach case, the prior written consent of at least three members of the Town Board or by resolutionof the Town Board.

    7. TERMINATIONThis Agreement may be terminated at any time by either party upon 30 days written notice to theother party. In the event of such termination, Town shall have no further obligation toConsultant except to make any payments which may have become due under this Agreement.

    8. RECORDSConsultant shall keep accurate records of the time spent in the performance of serviceshereunder. The Town shall, until the expiration of seven years after final payment under thisAgreement, have access to and the right to examine any directly pertinent books, documents, papers and records of Consultant involving transactions related to this Agreement.

    9. CHANGESAs set forth in paragraphs #1 and #3 above, all internal audit assignments will be determined andassigned by Town management through the Town Supervisor and Audit Committee. The Town, by written request of the Supervisor may at any time, by written notice to Consultant, issueadditional instructions, require additional services or direct the omission of services covered by

    this Agreement and/or Letters of Engagement provided such services are within the generalscope of this Agreement (i.e. internal audit of Town financial statements/records). In such event,there will be made an equitable adjustment in price and time of performance, but any claim forsuch an adjustment must be made within 15 days of the receipt of such written notice. In theevent that the Consultant determines that a change order is required, Consultant shall obtainwritten approval of the Supervisor. It is agreed and understood that no oral agreement,conversation, or understanding between the Consultant and the Town, its departments, officers,agents and employees shall effect or modify any of the terms or obligations of this Agreement orschedules annexed hereto and made a part hereof.

    10. NOTICES

    Any notice shall be considered as having been given: (i) to Town of Riverhead if mailed bycertified mail, postage prepaid to Town of Riverhead, Attention: Bill Rothaar,200 Howell Avenue, Riverhead, New York 11901; or (ii) to Consultant if mailed by certifiedmail, postage prepaid to East End Accounting Services Corp., 320 Noyac Road, Southampton, NY 11968.

    11. COMPLIANCE WITH LAWSConsultant shall comply with all applicable federal, state and local laws and ordinances andregulations in the performance of its services under this Agreement. Consultant will notifyTown immediately if Consultant’s work for Town becomes the subject of a government audit orinvestigation. Consultant will promptly notify Town if Consultant is indicted, suspended ordebarred. Consultant represents that Consultant has not been convicted of fraud of any otherfelony arising out of a contract with any local, state or federal agency. In carrying out the workrequired hereunder, Consultant agrees not to make any communication to or appearance beforeany person in the executive or legislative branches of the local, state or federal government forthe purpose of influencing or attempting to influence any such persons in connection with theaward, extension, continuation, renewal, amendment or modification of any contract oragreement. Consultant may perform professional or technical services that are rendered directlyin the preparation, submission or negotiation activities preceding award of a Townagreement/contract or to meet requirements imposed by law as a condition for receiving theaward but only to the extent specifically detailed in the statement of work. Professional andtechnical services are limited to advice and analysis directly applying Consultant’s professionaland technical discipline.

    12. INSURANCE, INDEMNITY AND LIABILITYConsultant shall carry Comprehensive General Liability Insurance and, if applicable, worker’scompensation insurance. Consultant hereby indemnifies and holds the Town, its departments,officers, agents and employees, harmless against any and all claims, actions or demands againstTown, its departments, officers, agents and employees and against any and all damages,

    liabilities or expenses, including counsel fees, arising out of the acts or omissions of Consultantunder this Agreement.

    13. CONFLICT OF INTERESTConsultant hereby represents and covenants that neither it nor any of its employees or

    representatives has or shall have, directly or indirectly, any agreement or arrangement with anyofficial, employee or representative of the Town of Riverhead which any such official,employee, representative shall receive either directly or indirectly anything of value whethermonetary or otherwise as the result of or in connection with any actual or contemplatedapplication before any department of the Town, contract with the Town for sale of any productor service. Consultant further represents and covenants that neither it nor any of its employees orrepresentatives has offered or shall offer any gratuity to the Town, its officers, employees, agentsor representatives with a view toward obtaining this Agreement or securing favorable treatmentwith respect thereto. Consultant further represents that it will not engage in any activity which presents a conflict of interest in light of its relationship with Town.

    14. DISCLOSUREThe Town shall have the right, in its discretion, to disclose the terms and conditions of thisAgreement (as it may be amended from time to time), including but not limited to amounts paid pursuant hereto, to agencies of the local, state and federal government.

    15. DISPUTESIf Consultant fails to perform any of its obligations hereunder in accordance with the termshereof, then after reasonable notice to Consultant not to exceed thirty (30) days, and anopportunity for Consultant to cure such failure (except in case of emergency), the Town may (butshall not be obligated to) cure such failure at the expense of the Consultant, and the amountincurred by the Town on demand. Notwithstanding the above, any dispute arising under thisAgreement which is not settled by Agreement of the parties may be settled by appropriate legal proceedings. Pending any decision, appeal or judgment in such proceedings or the settlement ofany dispute arising under this Agreement, Consultant shall proceed diligently with the performance of this Agreement in accordance with the decision of Town.

    IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the date firstabove written.

     AUTHORIZES THE FILING OF AN APPLICATION FOR NEW YORK STATE ASSISTANCE FROM THE HOUSEHOLD HAZARDOUS WASTE (HHW) STATE

     ASSISTANCE PROGRAM AND SIGNING OF THE ASSOCIATED STATE

    CONTRACT, UNDER THE APPROPRIATE LAWS OF NEW YORK STATE

    Councilwoman Giglio offered the following resolution,

    which was seconded by Councilman Wooten

    WHEREAS, the State of New York provides financial aid for hazardous wasteprograms; and

    WHEREAS, the Town of Riverhead herein called the MUNICIPALITY, hasexamined and duly considered the applicable laws of the State of New York and theMUNICIPALITY deems it to be in the public interest and benefit to file an applicationunder these laws; and

    WHEREAS, it is necessary that a Contract by and between THE PEOPLE OFTHE STATE OF NEW YORK, herein called the STATE, and the MUNICIPALITY beexecuted for such STATE Aid;

    THEREFORE, BE IT RESOLVED, by the Riverhead Town Board:

    1. That the filing of an application in the form required by the State of New York inconformity with the applicable laws of the State of New York including allunderstanding and assurances contained in said application is hereby authorized;

    2. That the Supervisor, or his designee is directed and authorized as the officialrepresentative of the MUNICIPALITY to act in connection with the application and toprovide such additional information as may be required and to sign the resultingcontract if said application is approved by the STATE;

    3. That the MUNICIPALITY agrees that it will fund the entire cost of said householdhazardous waste program and will be reimbursed by the STATE for the STATEshare of such costs;

    4. That five (5) Certified Copies of this Resolution be prepared and sent to theNYSDEC together with a complete application; and

    5. That this resolution shall take effect immediately.

    RATIFIES CHANGE ORDER NO. 1 REDUCTION IN CONTRACT SCOPE OF WORK

     AND CONTRACT AMOUNT FOR 162 FOUNDERS PATH, BAITING HOLLOW

    DEMOLITION AND RECONSTRUCTION PROJECT

    Councilman Wooten offered the following resolution,

    which was seconded by Councilman Dunleavy

    WHEREAS, the Riverhead Town Board did adopt Town Board Resolution No.245 on April 7, 2015 entitled, “ORDERS THE TOWN ENGINEERING DEPARTMENTTO FACILITATE THE REMOVAL OF AN UNSAFE STRUCTURE LOCATED AT 162FOUNDERS PATH, BAITING HOLLOW. ALSO KNOWN AS SUFFOLK COUNTY TAXMAP NO. 0600-39-6-16 AND TO ASSESS REMOVAL COSTS AGAINST THESUBJECT PROPERTY”; and

    WHEREAS, the Riverhead Town Board subsequently adopt resolution No. 660on September 16, 2015 to publish and post a Notice to Bidders for the demolition of theunsafe structure at 162 Founders Path, Baiting Hollow. All bids were received and

    reviewed by the Engineering Department and the Riverhead Town Board; and

    WHEREAS, the Riverhead Town Board did adopt Town Board Resolution No.839 on December 15, 2015 entitled, “AWARDS BID FOR 162 FOUNDERS PATH,BAITING HOLLOW DEMOLITION AND RECONSTRUCTION PROJECT”; and

    WHEREAS, the bid was awarded to Carter Melence, Inc. in the amount of$32,144.00; and

    WHEREAS, Eugene Laferno, the owner of 162 Founders Path, Baiting Hollowdid personally remove the top section of the unsafe structure from the building; and

    WHEREAS, the Town Engineer has contacted Carter Melence, Inc. and spokewith Donald O’Hanlon to notify him of the removal of the top section by the home ownerand request a modification in the contract dollar amount to continue with the removal ofthe remaining unsafe structure and to secure the original home per the bidspecfications. Correspondence was received from Donald O’Hanlon of Carter Melence,Inc. on January 19, 2016 via email to the Town Engineer with the modified contractamount.

    NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town ofRiverhead be and does hereby authorize Change Order No. 1 to reduce the originalcontract amount by -$7,200.00 for a new contract amount of Twenty Four ThousandNine Hundred Forty Four & 00/100 ($24,944.00); and

    BE IT FURTHER RESOLVED, that the Engineering Department be and ishereby authorized to secure a Town of Riverhead purchase order from the PurchasingDepartment in the amount of $24,944.00; and

    BE IT FURTHER RESOLVED, that the Town Clerk be and is hereby authorizedto forward a copy of this resolution to Carter Melence, Inc., 104 New York Avenue,Sound Beach, NY 11789; and

    BE IT FURTHER RESOLVED, that the Town Clerk be and is hereby authorizedto forward a copy of this resolution to the Office of the Town Attorney, Engineering

    WHEREAS, on November 9, 2015, Peter Herman, on behalf of Nile RodgersProductions, Inc., submitted a Chapter 90 Application for the purpose of conducting aMusic & Art Festival entitled “The Freak Out!,Let’s Dance” with an expected total dailyattendance of 7,500 attendees, to be held at Martha Clara Vineyards located at 6025Sound Avenue, Riverhead, New York, on Friday, August 12, 2016, Saturday, August13, 2016 between the hours of 12:00 noon and 11:30 pm, and Sunday, August 14,2016, between the hours of 4:00 pm and 11:30 pm (act/performance hours); and

    WHEREAS, Nile Rodgers Productions, Inc. has completed and filed a LargeGathering Chapter 90 Application and a Full Environmental Assessment Form (FEAF),Parts 1 along with an Environmental Assessment Report Attachment and a TrafficReview Report, dated January 26, 2016, prepared by Nelson Pope & Voorhis inaccordance with 6 NYCRR 617; and

    WHEREAS, a certificate of insurance has been received naming the Town ofRiverhead as an additional insured; and

    WHEREAS, the applicable Chapter 90 Application fee has been paid; and

    WHEREAS, by Resolution # 79 adopted on February 2, 2016, the Chapter 90application is classified Type I action in accordance with NYCRR 617.4(b) (8) and (9),and as such required the referral of the application and FEAF to all involved agenciesfor coordinated review and to determine who will be lead agency; and

    WHEREAS, referral of the application and FEAF was made to the New YorkState Department of Labor (NYSDOL) and to the Suffolk County Department of HealthServices (SCHS), as involved agencies to determine who will be Lead Agency; and

    WHEREAS, by letter dated February 10, 2016, the NYSDOL consented to the

    Town Board of the Town of Riverhead to be Lead Agency; and

    WHEREAS, by letter dated February 11, 2016, the SCHS consented to the TownBoard of the Town of Riverhead to be Lead Agency; and

    WHEREAS, the Town Environmental Planner prepared a January 28, 2016report examining the SEQRA EAFs and information submitted in support of the Chapter90 application, recommending the Town Board of the Town of Riverhead, as Lead

     Agency, issue a negative declaration; and

    WHEREAS, the Town Planning Department and the Town Attorney of the Town

    of Riverhead have reviewed all documents regarding said application.

    NOW, THEREFORE BE IT RESOLVED, that that in the matter of the Chapter 90application of Nile Rogers Productions, Inc. as a Type I action, the Town of RiverheadTown Board hereby determines that it will not have a significant environmental impactand hereby issues a Negative Declaration pursuant to 6 NYCRR 617.7(a)(2); and be itfurther

    Councilwoman Giglio offered the following resolution,

    WHEREAS, the Town Board of the Town of Riverhead, by Resolution #299adopted on April 21, 2015, authorized the issuance of a Request for Proposals forQualified Municipal Advisor to Prepare Town of Riverhead Official Statement & AnnualStatement of Financial & Operation Information; and

    WHEREAS, pursuant to the terms of the Request for Proposals, each proposalmust comply with the instructions in the Notice to Bidders and required that allproposals be submitted on or before 11:00 am on June 4, 2015; and

    WHEREAS, three (3) responses to the Request for Proposals were received,opened, and read aloud on June 4, 2015 at 11:00 am in the office of the Town Clerk,200 Howell Avenue, Riverhead, New York; and 

    WHEREAS, the Town Board determined that it would be beneficial to meet withthe three firms that responded to the request for proposals; and

    WHEREAS, after meeting with each of the three firms and after seriousconsideration and evaluation, the Town Board recommends awarding the bid forQualified Municipal Advisor to Capital Markets Advisors, LLC.

    NOW THEREFORE BE IT RESOLVED, that the Town Board hereby awards thebid for Qualified Municipal Advisor to awarded to Capital Markets Advisors, LLC; and

    AGREEMENT BETWEEN TOWN OF RIVERHEAD ON BEHALF OF

    TOWN OF RIVERHEAD POLICE ATHLETIC LEAGUE AND

    RIVERHEAD YOUTH SPORTS, INC.

    THIS AGREEMENT made and entered into this day of , 2016, by and betweenthe Town of Riverhead, a municipal corporation duly existing under the laws of the State of NewYork, (hereinafter referred to as the "Town”), with its principal place of business located at 200Howell Avenue, Riverhead, NY and Riverhead Youth Sports, Inc., having an address at P.O. Box888, Riverhead, NY 11901.

    WHEREAS,  the Town of Riverhead Police Athletic League is a non-profit organization that provides organized sports programs, activities, and education for children ages 5-13 designedwith the intent of giving children healthy social and behavioral skills and the goal to reduce theirsusceptibility to gang involvement, alcohol and drug use and delinquency; and

    WHEREAS, the Riverhead Youth Sports, Inc. provides professional officials to referee games;and,

    WHEREAS, by Resolution #______ adopted on February 16, 2016, the Town Board authorizedthe Supervisor to enter into an agreement with Riverhead Youth Sports, Inc. for referee servicesfor 2016 Girls Lacrosse and 2016 Boys Lacrosse program as part of and affiliated with the Townof Riverhead Police Athletic League in an amount not to exceed $1920.00 and $560.00,respectively.

    NOW THEREFORE, in consideration of the mutual covenants and agreements herein, the parties agree as follows:

    SECTION 1. Purpose:

    The purpose of this Agreement is to contract with Riverhead Youth Sports, Inc. to provide andarrange for officiating services for the girls and boys lacrosse program as part of and affiliatedwith the Town of Riverhead Police Athletic League to increase the public health, safety, andquality of life for the youth of the Town of Riverhead. The extent of the Town's payment forservices hereunder to Riverhead Youth Sports, Inc. is intended to provide social and recreational programs and services that enable youth, especially from poor or otherwise disadvantaged family backgrounds, to participate in these healthy and productive programs to reduce crime andincrease youth opportunities for productive activities within the community.

    SECTION 2. Scope of Work:

    Riverhead Youth Sports, Inc. shall provide and arrange for officiating services for the 2016 Girlsand Boys Lacrosse program offered to the youth of Riverhead as part of and affiliated with theTown of Riverhead Police Athletic League.

    SECTION 3. Duration of Contract:

    The term of this agreement shall commence on , 2016 and expire at the end of theMarch 20, 2016 Town of Riverhead Police Athletic League Lacrosse season.

    SECTION 4. Consideration:

    As consideration for the services provided, as specified in Paragraph 2, the Town will reimburseor provide *payment to the Riverhead Youth Sports, Inc. for a sum of money not to exceed$1920.00 for 2016 Girls Lacrosse and $560.00 for the 2016 Boys Lacrosse for 2016 LacrosseProgram to provide and arrange for officiating services for said program(s) that are part of andaffiliated with the Town of Riverhead Police Athletic League during the contract period.Riverhead Youth Sports, Inc. may submit vouchers seeking payment or reimbursement formonies spent on officiating services on a biweekly or monthly basis during the contract period.*To the extent that Riverhead Youth Sports, Inc. seeks payment prior to completion ofofficiating services, Riverhead Youth Sports, Inc. shall be required to provide the Town withdocumentation to substantiate costs related to such services within 60 days. It is agree andunderstood that consideration is limited to payment or reimbursement of monies/costs related toofficiating services and no additional costs, charges, or fees are permitted under this agreement.

    SECTION 5. Relationship:

    The Town and Riverhead Youth Sports, Inc. intend that an independent contractual relationship be created by this contract. The Riverhead Youth Sports, Inc. is not considered to be anemployee of the Town for any purpose and neither the Riverhead Youth Sports, Inc. nor anyemployee of the Riverhead Youth Sports, Inc. shall be entitled to any of the benefits the Town provides for the Town’s employees, including, but no limited to, health insurance, sick or annualleave, or workers compensation. The Riverhead Youth Sports, Inc. specifically represents andstipulates that the Riverhead Youth Sports, Inc. is engaged in the business of providing theservices set forth in this contract, whether or not for profit, and that the Riverhead Youth Sports,Inc. is fully registered and legally authorized to conduct such business, and pays all necessarytaxes and assessments levied against such business. The terms of this agreement are not intendedto create any duties, obligations or liabilities to any third parties. Neither party intends thisagreement to create any third-party beneficiaries to this agreement.

    SECTION 6. Suspension, Termination, and Close Out:

    If the Riverhead Youth Sports, Inc. fails to comply with the terms and conditions of this contract,the Town may pursue such remedies as are legally available, including, but not limited to, thesuspension or termination of this contract.

    SECTION 7. Changes, Amendment, Modifications:

    The Town and Riverhead Youth Sports, Inc. may, agree from time to time, to change or modifythe Scope of Work to be performed hereunder. Any such change, amendment or modificationshall be in writing and signed by all parties.

    SECTION 8. Assignability:

    The Riverhead Youth Sports, Inc. shall not assign any interest on this contract and shall nottransfer any interest on the contract without prior written consent of the Town.

    SECTION 9. Reports and Information:

    The Riverhead Youth Sports, Inc., at such times as and in such form as the Town may require,shall furnish the Town such periodic reports, including an accounting for the expenditures ofTown funds, as it may request pertaining to the work of services undertaken pursuant to thecontract, the costs and obligations incurred or to be incurred in connection therewith, and anyother matters covered by this contract.

    SECTION 10. Liability and Indemnification:

    The Riverhead Youth Sports, Inc. agrees to hold the Town harmless and shall indemnify anddefend all claims, demands, or suits of law or equity arising from the negligent or intentionallywrongful actions or omissions of the Riverhead Youth Sports, Inc. or the Riverhead YouthSports, Inc. officials or agents in providing the services called for under this agreement.

    SECTION 11. Severability:

    If any portion of this Agreement is held to be invalid or unenforceable for any reason, suchholding shall not affect the validity or enforceability of any of the remaining portion.

    Councilman Dunleavy offered the following resolution,

    which was seconded by Councilman Hubbard

    WHEREAS, Chapter 14-§14-40 of the Riverhead Town Code entitled “Open

    Space/Park Preserve Committee” causes the establishment of an advisory body to theTown Board known as the Open Space/Park Preserve Committee (commonly referredto as the “Open Space Committee”) consisting of five representatives from thecommunity at large appointed by the Town Board for staggered two-year terms; and

    WHEREAS, the Open Space Committee is charged with the advisoryresponsibility related to, but not limited to, identification, review and recommendation oflands that should be acquired by the Town and preserved as open space orincorporated into the Town of Riverhead park system or preserve; and

    WHEREAS, Marjorie Acevedo was reappointed to the Open Space Committee

    by Resolution #224 adopted on April 1, 2014 for a term expiring January 15, 2016 andhas been held over since expiration of said term; and

    WHEREAS, the Town Board wishes to ratify the reappointment of Marjorie Acevedo for a two year term such that the term will be deemed to have commenced onJanuary 15, 2016 and will expire on January 15, 2018.

    NOW, THEREFORE, BE IT RESOLVED, the Town Board hereby reappointsMarjorie Acevedo to the Open Space Committee for a two year term such that the termwill be deemed to have commenced on January 15, 2016 and will expire on January 15,2018; and

    CHAPTER 33TERM LIMITS

    § 33-1. Legislative intent.

    It is the intent of the Town Board of the Town of Riverhead to increase theaccountability of and expand participation in the governance of the Town of Riverheadby limiting the number of terms of office for the Supervisor and Town Council.

    § 33-2. Term Limitation for Supervisor

     A person who is elected or appointed to the position of Supervisor shall not serve morethan a total of twelve consecutive years, be it six two year terms of office, three fouryear terms, or any such combination thereof, as the case may be.

    § 33-3. Term Limi tation for Town Council

     A person who is elected or appointed to the position of Councilman or Councilwomanshall not serve more than a total of twelve consecutive years, be it six two year terms of

    office, three four year terms, or any such combination thereof, as the case may be.

    § 33-4. Other Elective Office 

    Nothing contained in this chapter shall prohibit the Supervisor or a member of the TownCouncil from seeking, being elected to, or holding another and different elective publicoffice in the Town of Riverhead at the conclusion of a term of public office as requiredby this Chapter. 

    § 33-5. Supersession of state law.

    This chapter is enacted pursuant to the authority contained in Municipal Home Rule Law

    § 10(1)(ii)(a)(1) and, to the extent that the provisions of this chapter are inconsistent, isintended to supersede the provisions of Town Law § 24 and limit the number of terms ofoffice held by a Town Board member.

    Section 1. TITLE: This local law shall be known as the “Local Law to Change the Termof Office of Town Supervisor from Two (2) Years to Four (4) Years” in the Town ofRiverhead, Suffolk County, New York.

    Section 2. PURPOSE: The purpose of this local law is to extend the term of the officefor the Town Supervisor from two (2) years to four (4) years. The Town Board believesan extended term would bring greater continuity to the office and believes the extendedterm is in the public’s best interest.

    Section 3. STATUTORY AUTHORITY: This local law is adopted pursuant to Section10(1)(ii)(a) and Section 23(2)(e) of the Municipal Home Rule Law of the State of NewYork.

    Section 4. APPLICATION OF FOUR YEAR TERM OF OFFICE: This local law shallextend the term of office of the elected Town Supervisor from two years to four years.Such four-year term shall commence as of the first day of January following the firstbiennial town election after the effective date of this local law and shall apply to theperson elected to such office at the biennial town election held on November 7, 2017and those elected thereafter.

    Section 3. MANDATORY REFERENDUM: This local law is adopted subject to amandatory referendum and shall be submitted for approval of the qualified electors ofthe Town of Riverhead at the general election to be held November 8, 2016. Aproposition in the following form shall be included on the ballot at such general election,and the increased term of office shall not take effect unless such proposition is
