Mr. Williams is the owner of a company that produces trailers. He is a stingy person who does

not like to spend too much money. For this reason, refuses to buy protective eye gear for his

employees who use angle grinders to smoothen off the welded areas on the trailers.

Mr. France is the Chief Executive Officer of the company. He is an excellent accountant and a

hard worker but not very mechanically minded, has absolutely no idea that protective eye

gear is required. Robert has been appointed as assistant and he knows that the protective

eye gear is necessary, but he does nothing to inform Mr. France.

Robert’s duties include monitoring health and safety at the factory. Jasonisa fitter and turner

and an employee of the company and he is not sure if he should use protective eye gear.

While Jason is using the angle grinder a piece of metal becomes lodged in his left eye and

does not tell anyone about it. Several days later an infection develops in Jason’s eye and

consequently the eye must be removed.

a) Clarify which duties Williams, as employer, failed to fulfil in terms of the Labour Act of

2007? Discuss only those duties, which are relevant to the facts given.

you would advise him to:
