FAIRNESS: Present a child with the toy or book. Tell them to pretend it is their own. Ask to see it and then tell them they cannot have it back. Is that fair? PROTECTION FROM OTHERS: What about playing at recess and a bully pushes you or takes your toy or book? What should you do? (Encourage them to raise their hands or call upon a teacher or teacher’s assistant for help to spur answers). PROTECTION FROM SELVES: What should you do to cross a street? The rules protect us from bullies / others or hurting ourselves. PROTECTION FROM ENVIRONMENT / THINGS THAT CANNOT SPEAK: What about the times when no one can talk about what has happened? Suppose someone is mean to a dog or cuts down a whole forest of trees or pours garbage into our rivers so we cannot have clean water to drink? Anyone ever had muddy or dirty water to drink? Like clean water better? Rules protect even things that cannot talk.

resources DISPUTE RESOLUTION: Ask the class to raise their hand if they like Milky Way, Snickers, Hershey Bar, Smarties, or Sour Worms. Select two volunteers and give the favorite of each child to the other. Explain they have to use words to work out an exchange. Ask what each would do if the other said no. CONSEQUENCES: Does anyone have to help out at home, like taking out the trash or cleaning their room? What happens when you help out? Has anyone been punished and / or received time out for not following a rule?

Rules, order, fairness, solving disagreements, and being responsible for decisions are all part of our court system. It is the role of lawyers and judges to help out.

z In the last few minutes, tell them that you need their help with something. Ask them to think about something very important, and when they have the answer, ask them to stand up next to their desk. Remain very quiet and do not move. Then ask, if they could make up a new law, what would be the new law? Have them stand next to their desk quietly when they have their answer. Ask each child their rule. After each one answers, have them or anyone else that had that same idea to take a seat.

Explain, sometimes that is how our laws are created. People in government sometimes have and share the same idea. They decide it is good enough for everyone else.

See how easy it was to listen and understand one another about ideas for a new law? Now, ask them to just start saying what their favorites are in these categories – food, television show, music, place, vacation, sports, or hobby. Have them (softly) say the names of their brothers, sisters, parents.

Ask them to stop. No one can figure out what anyone else was thinking. How much harder is it when we do not have rules? There is no way to work together. There is no way to share ideas or know who has a good idea like yours.

Explain that you hope they can see how rules help us share, learn to get along with one another, protect us, and keep us organized. Many times adults need help when they have disagreements or need protection. Laws are the rules that exist to help adults and children. Some adults need lawyers to help solve problems or disagreements. When they cannot solve a problem with the help of a lawyer, a judge is there to follow the rules and make a fair decision.

{ PERSONAL CLOSING: Share why your job or this process is so important and how grateful you are to spend this time with them at their school. Elementary school students are quick to grasp that our laws embody the same principles of fairness, order, protection, and consequences for one’s actions as they have also experienced at home, school, and play.
