This is the response to the Agency's request of29106/2010 for information under Article17(1) of the EPA (Licensing) Regulations 1994 to 2008. ] have been asked by theApplicant Mr. Paul Tully of Moate Pig Unit, Ballinakill, Portlaoise, Co. Laois to assist indrafting this response which is submitted on his behalf.

In April 2004 PJ Cahill Farm Limited applied to the EPA for an IPC licence (applicationreceived by the Agency 28/4/2004). This application was accompanied by an EIS (15hard copies) received by the Agency on 22/07/2004 (see cover page attached asdownloaded from the EPA web-site). The Licence Register Number for this applicationwas 710-0 I. An electronic copy of the EIS is available on the EPA website. Given thatthis EIS is available on the website it is not considered necessary to re-submit it. If theAgency disagrees with this they may request a copy to be re-submitted.

The EIS was submitted to Laois County Council in support of a planning application forthe pig unit operated by PJ Cahill Farms Limited (Planning reference 04/886). Themanagement of animal manure has been regulated subsequent to this EIS being submittedand accordingly sections of it would need to be amended to give proper regard to theprovisions in S.1. 252 of2008 and S.1. 253 of2008 that classify manure as Category 2 by­product, authorise sale or supply and transfer of manure from producers for use asorganic fertiliser or soil improver and the provisions in S.l. 101 of2009 that assignresponsibility for all aspects of the use of the manurelfertiliser to the occupier of theholding on which it is deposited on land.

On 16/6/2006 a planning application was submitted to Laois County Council in supportof a planning application "to replace the existing service house with a new finishinghouse and two meal bin silos such that the capacity of the unit shall accommodate allprogeny of the existing 620 sow herd to slaughter". The planning reference number forthis application was 061918. A copy of this grant of planning permission and associatedconditions was included in the IPPC licence application.
